discussed the problems as50Ciated with marketing or leasing property with two sepanUc owners . She
advised that stair nx:ommcnds the City DOC pu,dwc the EURA property at this lime. but that the City take
a lead role in the dc\lclopmclll al thcac propcnics 111d obtain an appraisal al both properties lo gain a
clearer understanding of the value al the USCIS . Ms. Wedding-Scott IIOlcd that the EURA docs ROI have
the funds 10 contribute 10 the COIi al appraisals.
Council Member Bullock proposed a motion 111d questioned the Cllimllcd COil al an evaluation. City
Allorncy De Will es1ima1ed a $3,000 10 S5.000 per pan::el appraisal fee for commercial property. Length)'
discussion ensued and as a pan of the discussion the motion was withdrawn .

THIS WATER TOWER LEASE AGREEMENT (this "Leaae") is entered into thi1 _

("Landlord") and Denver Cellular Telephone Company d/b/a/ Cellular One ("Tenant").

Tenant certain apace on the water tower (the "Tower") and certain apace to construct
an equipment wit.er (the "Equipment Shelter") 1-t.ed on the rNI preperty dncribed
in attached Exhibit A (the "Property"). The location and orientation of'Tenant'1
apace on the Tower and within the Equipmfflt Shelter (the "Premiaee") is deleribed
and depicted in the attached Exhibit B.

There are no current appraisals for either property and therefore this analysy; relies on the
City's 1990 purchase of its Broadway property. At that time, the City paid $43,000 or $6.88
per square foot for the property. In establishing a value for the EURA property, an
assumption is made that the EURA property is worth less per square foot than the City's
property simply due to its size and configuration. That is, 3,562.5 square feet configured as
a very narrow parcel while able to be developed. presents several practical constraints to
profitable development. Assuming that the 1990 value still holds and that the EURA
property's per square foot cost is approximately half of that of the City's, or $3.00 per
square foot, the EURA property hu a total value of $10,687.50. The total value of both
properties would then be approximately 554.(XX).
The development potential of the City's property is dearly greater if the EURA property is
included . Owning both properties rmtoves the potential of the development of the EURA
property not being complimentary to the development of the City's property. It is poaible
also, that a higher per square foot price may be obtainable if both properties are included
for development. Therefore. it is in the City's best interest to insure that both properties are
marbled together and developed u one . This does not mean that the City should own
both properties.
There is some truth to the contention that more than one owner may somewhat complicate
a development, however, became the two owners, in this cue, are public entities and both
committed to achieving the same end, any complications encountered would not be
signific.ant and could be ovft'C.'OIM . Alao, there • no queation that both the Oty and the
EURA desire to have this comer developed . However, the Oty'• pun:hue of the EURA
property will e<»t the City in the lhort-tenn and not improve the overall developnient
potential of the properties. The Oty lholaJd however, take the lead role in the marketing ol
thete properties and continue to work cooperatively with the EURA to inlure a 8Uitable
development for thete propertia.

On October 4, 1993, Council held a Public Hearing on this matter. It was also discussed
during the October 11 Study Session .
BACKGROUND
The proposed Regional Park is located on the former South Drive-In site and Arapahoe
County Fairgrounds site . The two sites comprise approximately 665 acres and are currently
unde\'eloped . These properties were annexed to the City in 1984 at which time they were
zoned B-2 , Business and R-3, High Density Residence . SSP&R District purchased the two
sites in 1991.
The need for thi proposed facility was based upon the documented demand for recreation
services and faciliti in the south metro area as compiled by the District . The District
utilized a publi in\'olvement process to determine the specific facility needs for the regional
park and ha,·e inc rporated the results of that process into the design .
STAFF ANALYSIS
During the taff review of this propoeed Planned ~·elopment, several UIMK'I were raised
with the Oiitrict concerning the physical development ol the regional park . Spedfially, the
· u were the adequacy of the Traffic Impact Analysis in llfflna ol the design for stnet

the installahon f the water mains to be placed in South Windermere Street and West

B. West Prentice Avenue shall be constructed in 1996, unless otherwise agreed by the
Englewood City Council and South Suburban Park and Recreation District .
C. The number of softball fields on the former South Drive-In site shall be limited to
no more than three, and the area designated as "temporary parking" shall become
"permanent parking". If additional property is acquired an amended planned
development may be submitted for additional field(s) within the approved plat.
D. The underpass to Belleview Park shall be completed in the first phase of the
Park's development.
E. A pedestrian barrier shall be constructed as part of the first phase development
on the north side of Belleview . If City staff and South Suburban caMot agree on
the nature of the barrier, then a six foot fence shall be installed.
F. Install pedestrian flashing lights on West Belleview Avenue to warn motorists of
the Park area and pedestrian cr055ing.
G . A "Right Tum Only" sign with physical barrier preventing left turns from the
main Park entrance onto westbound Belleview shall be installed.
H . Adequate lighting for the walking trails throughout the Park shall be installed. In
addition all area lighting shall be shielded so as to prevent the direct beam from
lea\'ing the de,·elopment.
I . Easements for the City of Englewood Utilities shall be as shown on the Plat.

A RESOLUTION CONCERNING UNFUNDED MANDATES ON STATE
AND LOCAL GOVERNMENTS.
WHEREAS, federal mandates require cities and towns to perform
duties without consideration of local circumatances, costs, or capacity, and
subject municipalities to civil or criminal penalties for noncompliance; and
WHEREAS, federal mandates require compliance regardless of other
pressing local needs and priorities affecting the health, welfare, and safety
of municipal citizens; and
WHEREAS, excessive federal burdena on local ,overnments force
some combination of higher local taxes and fees and/or reduced local
services on citizens and local taxpayers; and
WHEREAS, federal mandates are too often inflexible, one-size-fits-all
requirements that impose unrealistic time frames and specify procedures
or facilities where less costly alternatives milbt be juat u effective; and
WHEREAS, existing mandates impc>M hanb preuures on local
budpta and the federal ,ovemment has imposed a freeze upon funding to
h Ip compensate for any new mandates; and
WHEREAS, the cumulative impact of these lepalative and reculatory

relocation to that comer wc started doing some racarch and working with the EURA on ownerships . In
