Federally mandated costs have risen rapidly since 1986, growing at a pace faster than overall federal aid. Judjcial Probftrna In addition, problems exist at the faderal level not only with the Executive and Legislative Branches, but with the Judicial Branch of government as well. Several recent U.S. Supreme Court rulings have significantly eroded the powers of state and local government through broad Interpretations of the Commerce Clause and its relationship to the powars of state and local government. These opinions have expanded the ability of the f9deral government to prNmpt atate and local government powers and decisions. Some cities use their budget meetings as an opportunity to identify new state and federal mandates and the impact on the budget. they are able to communicate with the public in real dollars and sense. the costs that are beyond the control of city officials. Others use their utility bills to communicate the portion of costs attributable to state or federal mandates. Types pf Costs Costs can usually be grouped into four categ0rie1 when analyzing mandates; ( 1 I marginal, 121 opportunity, 131 total and (41 cumulative costs. I 1 I Marginal Costs are incremental costs and require no formula . For example, a c ity can look at an average day for city personnel and estimate what portion of their time will change to comply with the mandate and assign a cost to that change . &ample: John Jones work.s ,n the public works department and works an eight hour day. A new regulation will require him to devote an estimated time of one hour per day or 12.5'6. of his time to carry out the new regulations. so 12.5'6. of his time could be auigl'8d to the mandate. This can be part of the normal budget proceu although you can never prove a marginal cost. 121 Opportunity Costs represents actions or laws that restrict or diminish the revenue raising capacity of the city, such as additional tax exemptions or the state restnct,ng the amount of business lic:eflN fNs a city can levy . (3 1 Total Costs are d irKted to new prog, ama or ac:dvtty . For instance. in catculaung the costs auociated wilh opening a new budding. one would need to consider the total c:osts m open the building after construclion . How much fOf 8'ec:1rlCl!Yl How much to, ineurancel How much for overtime 1f rt Is open after hourll eu:. (4) Cumulative Costs are presented In numencal vlluel wtth examptes given . It 's not the one mandate that breaks die back of ttwo cttv but the cumulative et ect of the other twenty, plus the new one . It the Cum&MtNe empact not tne 1ndrvadual one whetl conaidering cwg...y. The dilemma facing those calculating unfunded costs are several, including: I 1 l Not all local governments agree on what constitutes a mandate; (21 Some local governments believe that ·se1act1ve• enforcement of mandates exists; (31 Mandates affect local governments differently. In one city a particular mandate may be simply a nuisance; in another it may present a true hardship; 141 The ability to uwa adequately the costs uaociatec:t with mandates varies. due to staffing reaourcea available to a local government; (5) Some mandates are request9d by local governments; (61 Some local government officials b9lleva that responsible local gowrnments would Nit-impose standards or requn, nema 1D mure public ufety and welfare of the citizens anyway; (71 Many mandates are •pus through• mandates from the federal levet to the state government level, making it dlfflcult and often judgmental a to where to uaign the mandate.
