March I , 1993 Council appro\'cd a resolution of'intent to form Special Improvement District No. 36 . He
provided proof of notice of public hearing which ,ns published in the Englewood Herald on Man:h 4,
March 11, and March 18, 1993 . Swl'bas estimated that Sll,100 will be needed for the improvements.
$40,000 remains available from previous appropriations in the PIF. An additional appropriation of'
$48,000 \\ill be required from the PIF balance to ftdJy fund the project. The uxamcnt tOlal for the
developer's portion of'the improvcmeau ii estimated to be $36,100. Mr . Esterly pointed out Illa& tbcrc is
only one property owner involved in this pn,jecl

Council approved Relolution NP, 34 March 15, 1993 addrelling their inllent to form this
Paving District.
BACKGROUND
Since 1956, the City hat been improviftg its *-' to nat minimum City Standards
through Paving Impn,wment Di,tricts. During this period, 29 diltricta have been
completed, improving appro,wnately 99 mila al __.. and Q alleys.

owners, requests from Council, review of past districts, review of maintenance problems
and costs, and physical inspections. Prior to inclusion in the list, streets showing signs of
distress were tested for thickness of asphaltic concrete and basecourse to determine the
appropriate action required . Streets not meeting minimum City Standards were proposed
for reconstruction and assessment. Streets that were found to meet City Standards were not
proposed for paving district inclusion, but rather, were included in a City overlay-sealcoat
program where no assessments are levied.
The street propoaed for inclusion in Special Improvement District No. 37 is a street that has
not previously been constructed to minimum City Standards, and, from testing results,
requires total reconsbuction. This street wu allo petitioned for paving in 1992 for
construction in 1993.
STAFF ANALYSIS
Originally scheduled for Year 6 in the 10 Year Paving Plan introduced in 198.1, this street
(~2300 W . Yale Avenue) would have been constructed in 1990. Due to delays, the 10
Year Plan wu revi9ed in 1991; this street remained in Year 6 ol the revi9ed plan. then
re-Kheduled for 1993. The 5 Year Capital ConstNction Plan. prepared in 1992 few yean
1993 through 1997, did not include a paving district in 1993. It propoeed construction of
Yale Avenue would be delayed until at leaat 199'.
FINANOAL IMPACT
The City allocated, by Raolution No. 35, 1993, the funds nee ery for the CONtnaction ol
Paving District No. 37 in the amount ol si,7,000 &am the City'• GeNral Fund balance. The
City'• emu for said improvements are estimated to be $229,000 . lmp.owment CIDlb
adjacent to privatie ownenhip, and subject to 11111 He Nimbunmlent, are eatimMed at
S128,000 .

STAFF ANALYSIS
Staff continues to monitor slurry seals and micn:Hurfacing constructed in the metro area
during the previous six construction seasons . The workmanship of others, particularly with
micro-surfacing, appears to be of significantly lower quality than that continually provided
by BASS, Inc ., and far below a performance level acceptable to the City of Englewood . For
unexplained reasons, there remains much inconsistency in the typical mix designs utilized
within the metro area . The 1992 products of other user agencies appear again significantly
different than those specified in previous seasons. This leads us to continue to believe that
contractors and/ or user agencies are still experimenting and are not totally satisfied with
earlier products. Most micro surfacing products placed by others during the 1992 season
generally appear at this time to be achieving only marginally satisfactory results; many
areas of localized failure have been noted . Reports by U9er agencies still suggest that 1992
slurries continue to have slow traffic ready times, in the,& to 5 hour range . It is too early to
fairly evaluate the 1992 mic:ro-surfacing test sections by others .
Throughout our six year experience with "Englewood" slurry, mic:ro-surfacing, and BASS,
Inc ., citizen feedback continues to question our not including more streets in our annual
micro-surfacing programs . Minimal inconvenience during construction (our traffic ready
times have remained under 2 hours) and product quality appear to meet the expectations of
our citizenry . Staff continues to be pleased with our product's perfonnancr. TIie extalded
pavement longevity from slurry and micro-surfacing applications continues to look
promising .
As you will recall , in 1991 Englewood took the product development initiative to move
forward and address the main~ needs of many of our more heavily utilimd artmal,
collector, and industrial streets. "Englewood " mic:ro-surfacing wu introduced , a product
designed to address the main~ need of roadways sut,;ected to exc:ellive traffic
volumes resulting in pavement rutting and lanes requiring leveling treatments in addition to
wearing counes and surfacr al .

Although our efforts in 1993 will be concentrating on local service and minor collector
streets, we believe that our micro-surfacing product is superior to previous years standard
slurry seal applications, allowing much moJ'.'! flexibility in use . 1be individual components
of our "Englewood" micro-surfacing design are very similar to those in our earlier slurry
seal products. However, micro-surfacing utiliz.es a polymer modified Ergon emulsion, more
chemically complex than our earlier slurry applications. Slurry seal is a single thickness
application product. Miao-surfacing has the capability of being applied in whatever
thickness is necessary to address our maintenance requirements. ft can be utilized for rut
filling and leveling as well as for overall roadway sealli,g. In past years, chemical makeup
allowed for 17 second break times. Applications on collector and arterial streets could be
opened to through traffic in 20 to 30 mmutes, if neciessary. Our design will continue to
specify the quality gray granite aggregate from Asphalt Paving Company, Golden,
Colorado. However, staff has recently worbd with the ERGON materials laboratory in
Jackson, Mississippi, to "fine tune" our miao-surfacing emulsion formula . Hopefullt, we
will be able to slaghtly retard the products breaktime and provide extra lealNis for hand
work" around street intenections.
FINANCIAL IMPACT
$406,000 is available in the Public Improvement Fund, Road and Bridge account for 1993 .
Preliminary conversations with BASS, Inc . ~ a willingnelll to return to Ena)ewood in
1993 and construct micro-surfacing at a unit pnce similar to that in our 1991 ..ta 1992
contracts ($152 .18 per ton). The 1991 contract was for-$280,<XX> (approximately 160,000
square yards or 60 blocks). Funding for 1992 was limited to $2i60,(XX) for miao-surfacing
(approximately 185,<XX> square yards or 70 bloc:b). In 1992, with minor rut filling, surfacing
leveling and normal residential application rates, we had a product yield that generated per
square yard costs of approximately Sl.37. This COit remains in the magnitude of 40% of the
cost of asphaltic concrete overlay while ltil1 allowing us to correct many of the iffegularities
within a structurally IOUnd roadway surface.
For 1993, we are recommending a contnd with BASS, Inc . for, ~tely 20&,000 square
yards of miao-surfacing (80 blocb -approximalely 10 miles ol Englewood streets). At a
unit price similar to that negotialled in tioth 1991 and 1992, this would rault in a cmntract in
the S310,<XX> to $315,<XX> ranp. The balance ol funding in the 1993 Road and Bridp PIF
account will be utilized for iisphaltic concrftt overlays and aaociated maintienance program
administration. testing, and inlpection.

Apprise Sheridan of Englewood's arguments based on state
statutes. Mab clear that the board believes Englewood
has a strong cue against transferring any money to them
and against -.ting their volunteer pension fund in any
way.

ests of the volunteers who have aerved both municipalities.

nns AGREEMENT is made this day of , 1993,
between the Trustees of the City of Sheridan Volunteer Fire Pension Board ("SVFPB") and
the City of Englewood ("Englewood").
RECITALS
A The City of Sheridan ("Sheridan•) is a statutory city and exists pursuant to
Colorado laws and is located within Arapahoe County. 1be City of Englewood
("Englewood·) is a municipal corporation orpnized and existina pursuant to Artide XX of
the Colorado Constitution and is located within Arapahoe County.
8. Both cities established volunteer fire departments. Sheridan presently
maintains a volunteer fire depanment ("Sheridan Volunteers·), and SVFPB is the trustee
for the Sheridan Volunteen' pension fund. However, Englewood bas discontinued its
volunteer fire depanment ("Englewood Volunteen·).
C. On Aupst 20, 1985, Sheridan and Enalewood entered into a Mutual and
Automatic A.id Agreement ("Mutual Aid AIRCJnent"). Pursuant to the Mutual Aid
Agreement members of the Eftllewood Volunteer Fire Department who also serve as
volunteers on the Sheridan Fire Department may transfer their pension benefits to
Sheridan. Such transferred pension hencfilS sball be adrninistefCd in aa:ordaoc:e with the
ordinance of Sheridan, the laws ol the SWe ol Colorado. and any policies now in effect or
hereafter adopted.

passage of Ordinance No. 21, Series of 1992; and
WHEREAS, numerous property ownen volunteered to be included in the
District, so additional coats of $20,000 were incurred; and
Whereu, the fundinc for the District wu 6nanc:ed throueh the General
Fund; and
WHEREAS, the City Attorney's Office inc:urred increued expenses for
prosecutions; and ·
WHEREAS, the Safety Services Department received ,rants for Victim's
Assistance, Law Enforcement and Traffic Safety, and incurred additional

A RESOLlITION AMENDING THE APPROVED 1993 BUDGET AND
APP~OPRIATING MONIES FOR THE CITY OF ENGLEWOOD.
WHEREAS, the City Council of the City of Eollewoocl, Colorado, desires to
make certain changes to the 1993 Annual Budget; and
WHEREAS, durin& the 1993 budget proceu, the City Council budpted
monies for salary improvements for all General Fund employees in the
General Government department; and
WHEREAS, the approved aalary inc:reuea for 1993 wen eatablilhed by
City Council; and
WHEREAS, the City Charter allows transfer of appropriated monies
between departments' budgets with the approval of the City Council; and
WHEREAS, the Community Development Department intends to add a
half-time intern in order to aui1t with Environmental Service project.a; and
WHEREAS, the Golf Fund is considering a major upanaion project;
NOW, TIIEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
TIIE CITY OF ENGLEWOOD, COLORADO, THAT:

of the State of Delaware and is authorized to conduct bu1ine11 in the State and has presented to
the Issuer a proposal whereby the I11uer will, pursuant to the Act, i11ue the industrial
development revenue refunding bonds hereinafter delCribed and loan the proceeds
therefrom to Safeway in order to effectuate a current refundin1 of the Prior Bondi on Au,uat
1, 1993 l'nd pay a portion of the coats ofi11uance uaoeiated therewith; and
WHEREAS, Safeway has civen its u1urance to the City that Safeway will pay, or
reimburse the City for payment of, and all lepl f-and espenNI and administrative costs
and expen1e1 theretofore incurred or hereafter to be incurncl by the City related to the Project
and its refinancin1, and that 1uch a,reement to pay or reimbune the City i1 not continpnt
upon the refinancinr of the Project; and
WHEREAS, The City of Enslewood, Colorado lnduatrial Development Revenue
Ref'undin1 Bondi (Safeway Inc. Project) Series 1913 in the ..,..ta principal amount not to
exceed 13,850,000 (the "Bondi") will be iuued, eold and delivered by the I11uer to Doueherty,
Dawkins, Strand & Biplow Incorporated, Denver, Colorado (the "On,inal Purchaser"), in
order to provide fund, to effectuate the current refundinr of the Prior Bondi on Auplt 1, 1993,

Industrial Development Revenue Refundinc Bondi (Safeway Inc. Project) Series 1993" in

bond, within the meanin1 of Section 103(b) of the Internal Revenue Code of 1954, as

of'Section 103(b)(6) of the Internal Revenue Code of' 1954, u amended, with reapect to

Please find enclosed a copy of the above mentioned claim for damqes in
the amount of$6,534.76. This claim alleps damaps u a result of water
leakifli from the City Ditch into Donald Denhem·s property, bis insurance
Company (Fire Insurance) paid bia claim and are now askina
reimbursement from UI. This claim WU oncmally turned into CIBSA
who denied the City's liability due to the Governmental Immunity Act. We
