AN ORDINANCE APPROVING AND AUTHORIZING THE EXECUTION OF AN
INTERGOVERNMENTAL COOPERATION AGREEMENT WITH ARAPAHOE COUNTY ON
BEHALF OF THE ARAPAHOE COUNTY TRANSPOKl'ATION SERVICES AND THE CITY
OF ENGLEWOOD, COLORADO FOR SPECIALIZED TRANSPORTATION SERVICES FOR
ENGLEWOOD HANDICAPPED AND ELDERLY RESIDENTS FROM JANUARY 1, 1993
THROUGH DECEMBER 31, 1193.
WHEREAS, the City Council don henby determine that it i1 in the public intenst and
welfare of the residents of the City of Enclewood. Colorado that the City enpp in a
cooperative Aereement with Arapahoe County Tramponation Servicn for transportation
services for Enslewood handicapped and elderly residents; and
WHEREAS, the City shall pay Arapahoe County on behalf of Arapahoe County
Transportation Services 112,000.00 for transportation provided lo En,iewood handicapped
and senior residents ; and
WHEREAS, Arapahoe County Transportation Servicn shall be rnpon1ible for noeivinc
telephone call, from Enslewood handicapped and Nnior ftlidenll in need of transportation

ARAPAHOE COUNTY TRANSPORTATION SERVICES
THIS AGREEMENT made this __ day of , 199_, by and between the

COLORADO c•COUNTY"), on behalf of the ARAPAHOE COUNTY TRANSPORTATION
SERVICES c·ACTS"), and the CITY OF ENGLEWOOD, COLORADO c•CJTY"); and ahall
con1titute arrant for tran1portation aervice1 for En1lewoocl rnidentl for the con1ideration
hereinafter aet forth; and
WHEREAS, there i1 a need to provide apecialiud tran1portation aemcea to
handicapped and elderly re1ident1 of the CITY; and
WHEREAS , ACTS i1 a transportation apncy which can preaently provide
tran1port.ation aervicea to the elderly and handicapped reaidenta of the CITY.
NOW, THEREFORE, in conlideration of the mutual promi-and covenants
contained herein, the partiea .,.... u follow1 :
1. The term ofthi1 A,reement 1hall be from January 1, 1993 to December 31, 1993
inclusive .
2. The CITY ,hall pay the COUNTY, on behalf of ACTS, for tran1portation provided to
En&:lewoocl residents. Said payment ahall be made on February 18, May 15, Auaust
17, and November 13, 1913 and within thirty (30) day• of receipt of any final bilfinc
1ubmitted at the conclusion or termination of the Acreement. In the event the CITY',
budcet or the budpt of the rnpon1ible department ia nduad, theae funda will be
reduced . The CITY realizea that the COUNTY and ACTS cannot aerva all
tran1port.ation nqueatl with the available f\anda and that ACTS may requelt the
CITY to help determine trip prioritiea. The CITY ahall have the final cleciaion u t.o
which residents 1hall be tranaported within the conftnea of the allou.d budpt.

(b) ACTS shall not, as a rule, deny service to a person who has already been
scheduled for a lower priority trip in order to accommodate a hi1h priority trip.
6 . ACTS shall provide transportation within the followin1 boundaries:
(a) Grocery transportation will pnerally be provided only to ,rocery stores within
a client's pneral vicinity.
(b) Non-,rocery store transportation will be provided only to atorea within the
En1lewood city limits.
(c) Meal site transportation will be to the VOA Title Ill maJ lite in En,lewood.
(d) ACTS shall provide lower priority transportation only within a 5-mile radius
of a client's home. These restrictions ahall not apply if a lo-r priority trip
request can be provided within the route ol an ellilline top priority trip.
(e) Transportation coat, for persona under IO 1•n of• or for 1-priority
trips shall be limited to S20 .00 per month per person.
CO ACTS shall make every effort to link handicapped individuals under the ap
of 60 yeara to other available transportation procramL
7. ACTS shall provide its services pnerally between the houn of 8:00 Lm. and 4:30
p .m . Penona requeatin1 transportation NrYicel must have appointment/deltination
arrival times between 9:00 a .m . and 2:00 p.m. and retum tima by 3:00 p.m. ACl'S
shall provide ita service Monday throqh Friday, unleu requested for apeciftc medical
treatment. Requeata must be made before 2:00 p.m. one work day in advance 1111lna

The State'• ,hare shall be comprised entirely of federal funda made available to
the State. The State ,hare amount of the Contract ,hall not be a-«led
without the benefit of a written 1upplemental contract executed prior to the
performance of additional activities or the incurrin1 of additional costa . If the
actual total proeram coats are le11 than the estimated total proeram coats u a
result of the City of En,lewood'1 failure to expend the estimated City's share, the
1tate'1 share shall be reduced proportionately unleaa a prior written
supplemental contract hu been aecuted which reduced the required City's
share. The City may increase the City's share without further ate approval .
Thia increase shall have no impact on the state share. Proportional shall be
defined u the ratio of actual upendituna for both State and the City of
En,lewood.
6. The State shall reimbune the City of Enaiewood Safety ServicH Department for the
accomplishment of the Contract eadutively from funds made available for the
Contract under the Hipway Safety Act., Title 23, U.S.C. Section 402. Such
reimbursement shall be only u provided In the Contract Manual. Such
reimbursement shall be continpnt upon the contributicm by the City of Eqlewoocl
Safety Services Department of ita pan.icipatin, share u provided henin, and shall
be continpnt upon the continuin, availability of federal funds under the Hipway
Safety Act, Title 23, U.S.C. Section ,02, for the purpoan hereof.
7 . The term of the Contract shall becin on the eft'ective date and shall t.mninate on
September 30, 1993. The eft'ective date of the Contract shall be the date the
required 1ipatun approval of the State Controller ii obtained on the Contract, u
evidenced by the date flnt appearin, above. The City of En,lewoocl ..,._ that any
contract work performed or eoatl incurred prior t.o the eft'ective date shall not be
eompenuted under the term1 oft.he Contract.
8 . The City ofEn,lewood Safety Services Deparunent ..,._ that any eubmntract

THIS CONTRACT, made this _ day of , 1992, by
and between the State of Colorado, for the use and benefit of the
Department of Transportation, Office of Transportation Safety, 4201
East Arkansas Avenue, Denver. Colorado 80222, hereinafter referred to
as the State. and Englewood Department of Safety Services, 3615 South
Elati Street, Englewood, Colorado 80110. hereinafter referred to as
the Contractor,
WHEREAS, authority exists in the Law and Funds have been budgeted,
appropriated and otherwise made available and a sufficient
unencumbered balance thereof remains available for payment in Fund
Number 400, Appropriation Code 303, Contract Encumbrance Number 99314;
and
WHEREAS, required approval, clearance and coordination has been
accomplished from and with appropriate agencies; and
WHEREAS, the State is authorized under Sections 43-5-401 and 24-
42-103, C.R.S., as amended, to coordinate with th• federal government
and other entities to develop and i111>lmnent plans and programs
involving all aspects and cOlll)Onenta of traffic safety in Colorado;
and
WHEREAS, the State has received approval and funding for
implementation of its Fi scal Year 1993 Highway Safety Plan (HSP) from
the U.S. Department of Transportation, National Highway Traffic Safet y
Adm i nistration and Federal Highway Adlni.niatration; and
WHEREAS, the HSP contains programs and activities designed to
reduc e the frequency and severity of traffic crashes or i111>rove the
opera ti onal eff i c iency of existing traffic safety programs in
Col o rado ; and
WHEREAS, the St a t e determine• which agencies or entities would be
mo st appropr i ate in cOlll)leting the objectives, conducting the
activ itie s and prov i d i ng the services required by th• HSP; and

WHEREAS, the Contractor has submitted an Application to conduct
certain activities approved in the HSP which has been approved by the
State and which is incorporated herein to the extent consistent with
the terms of this contract; and
WHEREAS, the Contractor, a political subdivision of the State, has
the technical ability to properly complete the objectives and
activities described in Attachment A of this Contract; and
WHEREAS, it has been determined no State agency can reasonably
conduct the activities and provide the services required of the
Contractor; and
WHEREAS, this contract is executed by the State under authority of
Sections 43-5-401 and 24-42-101, C.R.S .• as amended, and is executed
by the Contractor under authority of Section 29-1-203, C.R.S., as
amended, and as authorized by the formal resolution attached hereto as
Attachment A; and
WHEREAS, the Contractor warrants it has taken all necessary steps
to ensure the individual Contractor signatory below has the authority
to sign this Contract.
WHEREAS, all State personal services contracts are subject to
immediate termination as a result of court orders in the cases of
Colorado Association of Public Employees (CAPE) v. Department of
Personnel, CAPE v. Department of Highways. and CAPE v. Regents of the
University of Colorado;
NOW THEREFORE, it is hereby agreed a• follows:
1. The Contractor shall carry out the program. conduct all the
activities and provide the services described in the Scope of Work
attached hereto as Attachment A and detailed in Attachment A. These
Attachments are attached hereto and are incorporated herein by thi s
reference.
2. In the performance of the work. the Contractor shall COlll)ly
with all applicable adllliniatrative procedure• and contract
requirements contained in the October 1, 1990 Colorado Highway Safety
Contract Management Hanu.l, hereinafter referred to aa the Contract
Manual, which is incorporated herein and .. de part hereof by
reference. Such procedure• and requir ... nts are conditions cf this
contract.
3. The Contractor shall submit periodic and final reports to th
State according to the requirements of the Contract Manual and the
reporting criteria set forth in page 2 of Attachment A.
4. The Contractor shall COlll)ly with the budget for this contra c
as set forth in page 3 of Attachment A. 'ft\e Contractor shall be
solely responsible for all coats incurred in excess of this bud9et
amount.

5. The total estimated program costs shall be $288,265. Subject
to the conditions of this contract, the State and Contractor shall
participate in providing this amount as follows:

The State share shall be comprised entirely of federal funds made
available to the State. The State share amount of this Contract shall
not be exceeded without the benefit of a written supplemental contract
executed prior to the performance of additional activities or the
incurring of additional costs. If the actual total program costs are
less than the estimated total program costs as a result of the
contractor's failure to expend the estimated contractor share, the
state's share shall be reduced proportionately unless a prior written
supplemental contract has been executed which reduced the required
contractor share. The contractor may increase the contractor share
without further state approval. This increase shall have no impact on
the state share. Proportional shall be defined as the ratio of actual
expenditures for both State and contractor shares.
6. The State shall reimburse the Contractor for the
acco~lishment of this Contract exclusively from funds made available
for this contract under the Highway Safety Act, Title 23, U.S.C.
Section 402. Such reimbursement shall be only as provided in the
Contract Manual. Such reimbursement shall be contingent upon the
contribution by the Contractor of its participating share as provided
herein, and shall be contingent upon the continuing availability of
federal funds under the Highway Safety Act, Title 23, u.s.c. Section
402, fo~ the purposes hereof.
7. The term of this Contract shall begin on the effective date
and shall ter111inate on September 30, 1993. The effective date of this
Contract shall be the date the required signature approval of the
State Controller is obtained on this Contract, as evidenced by the
date first appearing above. Contractor agrees that any contract work
performed or costs incurred prior to the effective date shall not be
c()lll)ensated under the tenna of this Contract •
8. 11\e Contractor agrees that any subcontract entered into under
this Contract shall ineet all applicable state and federal requirements
and must be approved by the Director, Office of Transportation Safety,
prior to execution. Contractor shall not assign this Contract without
prior written approval of the State.

9. a> Termination pue to Loss of Funding. The parties hereto
expressly recognize the Contractor is to be paid, reimbursed, or
otherwise compensated solely with federal funds provided to the State
for the purpose of contracting for the services provided for herein.
Therefore, the Contractor expressly understands and agrees all its
rights, demands and claims to coffl)ensation arising under this Contract
are contingent upon receipt of such funds by the State. In the event
such funds or any part thereof are not received by the State, the
State may immediately terminate or amend this Contract.
b) Termination for Cays•. If. for any cause. the Contractor
shall fail to fulfill in a timely and proper manner its obligations
under this Contract, or if the Contractor shall violate any of the
covenants, agreements or stipulations of this Contract, the State
shall thereupon have the right to terminate this Contract for cause by
giving written notice to the Contractor of such termination and
specifying the effective date thereof, at least 30 days before the
effective date of such termination. In that event, all finished or
unfinished documents. data. studies, survays, drawings, maps, models,
photographs and reports or other material prepared by the Contractor
under this Contract shall. at the option of the State, become its
property, and the Contractor shall be entitled to receive just and
equitable co111>ensation for any satisfactory work COffl)leted on such
documents and other materials. Any provision of this contract to the
contrary notwithstanding, in the event termination of this becomes
necessary. in the state's sole discretion, to COlll)ly with any court
order concerning state personal services contracts generally or this
contract, specifically, this contract may be terminated by the state
innediately upon the giving of notice to contractor without further
obligation of the state.
Not withstanding the above, the Contractor shall not be relieved of
liability to the State for any damages sustained by the State by
virtue of a breach of the Contract by the Contractor. and the State
may withhold any payments to the Contractor for the purpose of setoff
until such time as the exact amount of damages due the State frOIII the
Contractor is determined.

The City Counctl considered the Swedish Medical center Planned Development on January
16, 1989 and February 21, 1989 upon the recommendatton of the Planning Comrnwston.
At that ume the Counctl remanded the Planned Development to the ~ Cornrnlsslon
at the request of Swedish Medtcal Center. The Commiaalon reconsidered the remanded
Planned development OD March 21. 1989 and voted to refer It to City Counctl wtth a
favorable recommendatton. City Council reconsidered the Planned development at a Public
Heartna on May 15. 1989 and approved the Planned Development by Reaolutton Number
30, Sedea of 1989.
In July 1989. Swedish Med1cal Center requested an amendment to tbe Planned
Development to ~ the footprint of the Cr1Ucal Care Unit (CCU) from what WM
approved In the Planned DeYelopment. The Plal\DJD,I Comrnteetnn held a Public H~ on the propoeed amendment on July 18, 1989 and~ to refer It to City Council with a
favorable recornrnendaUon. City Council conaidered the propoeed ammdment on Auguat
21. 1989 and approved the amendment by Raolutton Numtier 47, Serlea of 1989.
In May 1990. Swedish Med1cal Center again requested an amendment to tbe Planned

The Applicant is requesting approval of an amendment to the existing Swedish Medical Center
Planned Development. The amendment would allow the construction of 107,370 square feet
of additional hospital space and an expansion of the existing Logan Street parkin1 structure.
DQCRIP[ION OF lJIE SUBJECT SITE;
The Swedish Medical Center campus is located on the east edp of the Central Business
District and is part of the East Hampden Avenue Commercial Corridor. The main campus,
bounded by East Girard Street, South Clarkson Street, East Hampden Avenue and South
Lo1an Street, contains the 328 bed Medical Center, the 80 bed Cni& Rehabilitation Hospital,
as well as four Medical Office Buildin1s. The adjacent area is a mix of commercial, office
and sin1le-family and multi-family residential uses.

The subject property is identified as pan of the hi&h density residence area and the East
Hampden Avenue Commercial Corridor in the 1919 Comprehensive Plan.

1n revicwin& a Planned Development the followin& standards arc to be applied:
1. Uses permitted. The use of the property which is the subject of the Planned
Development, shall be a Permitted Principal Use in the Zone District in which the De-
vcl~mcnt is located, or a use permined pursuant to other provisions of the Zanin&
Ordinance.
The proposed expansion is consistent with the existina development within the campus. These
uses arc permitted in both the R-3 and B-2 zone disuids.
2. The Planned Development shall be consistent with the intent of the Comprehensive
Plan and the policies therein.
This proposed Planned Dcvclopnent _ amendment is consistent with the aoaJs of the

The proposed Planned Development amendment represents the final phase of development
within the main campus. Future development on the campus would be the redevelopment of
existing structures. The scope of this final phase is si&nificant primarily because of the shift
from semi-private rooms to private rooms. While the number of beds will not increase, the
floor space devoted to the beds will. Future development within the campus is thus not
impaired by this final phase.
4. Minimum requirements for usable open space shall be set through the overall design
and amenities proposed for development.
Since the majority of the site is in the R-3 Zone District, the R-3 landscapin& requirements of
25" of the total site to be landscaped has been applied to the entire development. With the
proposed additions the pcrcentqe of landsc:ape CO\'Ulle is chan&ed from 28.4 " to 28.8" of
the total site. This increase is due to the ~ development takin& place in areas that are
for the most pan "hardscaped", such u parldn& lots. Also landscapin& 1s bein& added to area
that are currently noc landscaped •
5. The number of off-street parlcin& spaces in the proposed development shall not be less
than the requirement of Comprehensive Zonin& Ord1nance.
In conjunction with this proposed amendment, Swedish Medical Center retained Felsburg,
Holt and Ullevi&, transponation consultants to review existin& and future parldn& needs and to
recommend improvements in these areas.
In analyzin& the parkin1 needs, the consultant compared the existin& number of spaces
provided, coupled with the anticipated future development, lpinst standards from Englewood,
Denver and the Institute of Transponalion EnplCIUS (ITE). This comparison, attached to the
Planned Development, shows that the Enslewood standards require more parking spaces than
either Denver or ITE. While this comparison and analysis could be used to Justi a reduction
in the required parkin1, the consultant has recommended that Swedish Medical enter adhere
to Enalewood's standards. The recommendation of die consultant, provides for a surplus of 37
parkin& spaces.
6 . Site Plan. The approvin& qencies shall be lllisfied dial the site plan for the Planned
Development meets all the followin& requirements:
a. If the proposed ~t includes multi-family or nonresidential buildin&s or
structures and is adJacent to a sift&le family residential use district, the
development shall conlain a buffer .
The propo sed Planned Development amendment includes hospital and parlcin& suueture
add mons that are adjacent to the R·l-C Sin&le -family Diluict nonh of East Oirud Avenut
between Sou th Losan Street and Soulh Pearl Street. The park.in& suueture addition will be
bufftred by a fifteen foot landape strip becween the mucture iuelf and East Oirud Avenue
con sistent wilh the landsc:apin& adjacent to die existina parkina mucture.. The proposed
Women 's Center, located II die IOUtheut comer of East Oirud Avenue and South

and a pleasant environment.
The proposed additions to the Medical Center have been desi1ned to take advanta,e of the
exisun1 toJ>Olraphy and blend with the existin& desi&n of the Medical Center and the character
of the nei&bborhood.
c. If the area of the development is such that an internal cin:ulation system is
necessary, such a system shall be desiped for the type of traffic that will be
&enerated, and all curbs at entrances and other access poinu shall have ramps to
facilitate access for the handicapped and bicycles.
The internal circulation system will be modified so that access from East Hampden Avenue is
improved. This will involve the elimination of one curb cut and the relocation of one curb
cut. The emeriency entrance will also be redesiped to provide covered access and will be
relocated to the west with one way traffic flow.
d. Bicycle and pedestrian traih are to be provided where the City bicycle and/or
trail plan or the Rqional Bicycle Transportation Plan shows such trail or trail
corridor.
Bicycle or pedestrian trails are not proposed for the subject site.
e. The site plan shall provide for the maximum preservation of natural drainqe
areas, vqetation and other desirable features.
Since this is essentially a redevelopment of a J)C?fflon of the Swedish Medical Center campus,
the drainqe plan developed u a pan of the on&inal Planned Development, will be modified to
account for the addition development.
In terms of the overall development plan this amendment is consistent with the intent of the
Comprehensive Plan and the Planned Development requiremenu.
