The revised plan shows a grou floor area of 80,350 aquare feet in four floon and a net floor area of 70,000 square feet In accomplishing this modification. the footprint was enlarged and would necessarily enaoac:h into the east leg of the alley hammerhead. The modified plan was accepted by the Staff, since the ovenll impact of the structure would be less and a revised alley hammerhead would be dedicated in place of the portion enaoached upon. The normal procedure in cases like this is to proceed with the vacation request through the Planning Commission and then to Oty Council for final approval. However, became of time constraints placed on the project by both the construction financier and the permanent financier, the developer is in the position of having to halt the project until the vacation has been approved. Since this process may take as long • sixty to ninety days, the developer has requested that the Oty consider an enaoadunent agnement for the affected portion of the alley to satisfy the construction financier, while simultaneously proceeding with the vacation of this same portion of hammerhead to satisfy the permanent financler. Coupled with this would be the dedication of a new hammerhead. 1hia approach would allow the project to resume as soon • pollible and ultimately satisfy both the finanden, while providing public access to adjacent structures.
