circumstances beyond the City of Englewood's control and that the project will
proceed within a reasonable length of time. The timetable's implementation
shall begin when the County provides writ.ten notification to the City of Englewood
to proceed.
12. Beirohuocrncot for E1ecow1 : The City of Englewood a,ree1 that before the
County can distribute any CDBG funds to it, the City ofEnplwood must submit to
the County's Housing and Community Development Services Division
documentation in the form required by that Division which properly and fully
identifies the amount which the City of Enplwood is requntin1 at that time. The
County shall have ten workin1 days to review the request. Upon approval of the
request, the County will distribute the requested funds to the City of Englewood or
directly to the appropriate subcontractor or vendor as soon as posaible. Such
requests shall not be submitted more frequently than once per month.
13. Pragram lnramc· All pro,ram income derived from the Arapahoe County
Community Development Block Grant Protram received by the City of
Enele.vood will be retained by the City of Englewood and will be di1pened for its
approved CDBG project activities before additional CDBG funds are requested
from the County. Followin1 completion of the City of £nslewood'1 Arapahoe
County CDBG Project, all Pl'Oll'&m income directly pnerated from the uae of
CDBG funds will be remitted to the County.

County's "Urban County" designation, the Agreement shall terminate as of the
termination date of the County's CDBG crant acreement with HUD.

WHEREAS, punuant to the provi1ion1 al Part I of Article X al the Charter al the City of
Englewood, Colorado, adopted by the voten on July 8, 1958, a budget for the fi-1 year 1993
waa duly aubmitted by the City Manqer to the City Council on August 31, 1992; and
WHEREAS, a public hearinc on the aaid budpt wu held by the City Council within three

A RESOLUTION APPROVING AN ENCROACHMENT INTO PUBLIC RIGHT-OF-WAY
FOR THE PURPOSE OF CONTROLLING UNAUTHORIZED ACCESS TO PRIVATE

WHEREAS, Title 11, Chapter 3, Section 4, of the Enclewood Municipal Code 1986
providea that an encroachment into public riahwf-way may be sranted upon comp~

PREVIOUS COUNCIL ACTION
Qty Council, through Resolution Number 20, Series of 1989, approved the vacation of the

Amendment showed a gross floor area of 83,380 square feet in five floors, with 69,rn
square feet of net floor area. The revised plan shows a grou floor area of 80,350 aquare feet
in four floon and a net floor area of 70,000 square feet In accomplishing this modification.
the footprint was enlarged and would necessarily enaoac:h into the east leg of the alley
hammerhead. The modified plan was accepted by the Staff, since the ovenll impact of the
structure would be less and a revised alley hammerhead would be dedicated in place of the
portion enaoached upon.
The normal procedure in cases like this is to proceed with the vacation request through the
Planning Commission and then to Oty Council for final approval. However, became of
time constraints placed on the project by both the construction financier and the permanent
financier, the developer is in the position of having to halt the project until the vacation has
been approved. Since this process may take as long • sixty to ninety days, the developer
has requested that the Oty consider an enaoadunent agnement for the affected portion of
the alley to satisfy the construction financier, while simultaneously proceeding with the
vacation of this same portion of hammerhead to satisfy the permanent financler. Coupled
with this would be the dedication of a new hammerhead. 1hia approach would allow the
project to resume as soon • pollible and ultimately satisfy both the finanden, while
providing public access to adjacent structures.

Attached is Council Bill 42.1, which would replace Council Bill 42 estabUlhlng the mill levy
for property taxes to be collected in 1993. The revision ls nec:aaary becallle the ordinance
contained in Council Bill 42 included an increase in the mill levy establithed fw the EDDA.
Punuant to the pauage ol Amendment 1 an November 3rd. tax leYia cannot be niled
without approval by the voten. Therefore, staff rtql*b that Cound1 Bill 42 be tabled an
second reading, and that Council Bill 42.1 be adopted an ftnt rudlng.

County Assessor on October 10, 1992 is:

forecast In the 1993 budget. The Debt Service Fund'• mill levy is auffident to raise the
revenues needed to make the 1993 principal and Interest payments on the Recreation
Center's bonds.
FINANCIAL IMPACT
The General Fund mill levy will raise $1,333,000 In revenues. Thia aeprwnb 6.3" ol
General Fund revenues. The Debt Service Fund mill levy will raise $560,000 in revenues.
An Englewood homeowner with a home valued at $70,000 would pay $87.68 In property
taxes to the Oty ol Englewood calculated • follows:

in public placet which wu repealed approximately one year ago and lira that
time we have had numerom occuions to die for open containers.
One major problem area ii the Gothic Theatre -during the swnmer montlw we
found numerom violations ol open container and we wen ~ to enfora the
violations. Another problem area is the neighborhood adjacent to Belleview Park
-the partidpating teams know they can not drink In the park eo they drink In
the street next to the park.
