Director Merkel, Co.unity Developaent, explained that interest in rezoning the subject property located at 2280 West Evans caae about as a result of a Board of Adjustllent and Appeals action; and additionally that the property is split between the two zone districts B-2, Business on the north and R-2-C, Medium Density Residential on the south side. In 1183, the Board granted a variance to allow Robert Kurtz the right to operate a truck repair facility at 2280 West Evans. In 1989 the board ter11in1ted the use because Mr. Kurtz was in non-coap11ance with the conditions iaposed in the 1183 variance. Subse- quently, the property was taken back by the lender, Ollnibank. In October 1990, Ollnibank subaitted an application for rezoning of the southern portion of this property froa R-2-C to B-2. This application was withdrawn by the applicant in Decellber 1990 and no further action was taken until the present owner of the property, Willi• Forington, approached the City concerning pos- sible rezoning. At that ti .. , staff developed the proposal for the 1-3 Busi- ness district to ... t the proposed needs. ,,. - Planning Adllinistrator Stitt provided proof of notice of public hearing "'9ich was published in the Englewood Herald on S.,ttllber 17, 1912. He aaintained that the B-3 zoning would for11 aore of a transition into the ldjacent in- dustrial areas froa SOiie of the existing uses that occur in the Evans corri- dor. Mr. Stitt explained that that does not .. an the proposed zone district would proaote industrial uses. He stated the nature of the area ts signifi- cantly different froa other B-2 areas in the City. Staff felt it was iapor- tant to address historically how the area has developed on a ret1onal basts, not just the Englewood portion. The proposed zone includes protections that provide extra landscaping, fencing, and set-back requ1,.....ts "'9ich the exist · Ing 8·2 zoning does not have. The aajor difference bet....i the 1·2 and 1 ·3 11 that the auto related conditional uses, now in the 1·2, becoae peraitted uses in the B-3 . In addition, contractor and trades have been tncluded and re · stricted so as not to allow heavy contractors to have stor1g1 yards . This inclusion would penait soae types of developaent that aay not need the type of facilities that you find in an Industrial area, but "'9ich ...,ld befttfit froa the exposure on the Evans Corridor. Mr. Stitt noted tllat, even though the 1·3 allows auto related uses as per11itted uses, staff has included the •- restrictions that apply under the conditional use provision in the 1·2 zone . As a result, staff contends that the new zone classification 1 ·3 will address the needs of the business coaunity and also protect the ldjacent residential developaent tn that area . Mr. Stitt stated staff 1 ooked at it in terms of the types of uses that are there currently. Staff determined that 1-1 uses were not appropriate on Evans Avenue which ser- ves as a c011111ercial corridor; which is significantly different frOII the COll- aercial corridor on Federal Boulevard, Hampden Avenue or the northern and southern parts of Broadway. In response to Ms. Gulley's inquiry, Mr. Stitt confirmed that Denver's 8-4 zoning allows for aore uses than are being pro- posed in the 8-3 zone and it would provide I aeans of coapeting with the adja- cent areas. Mr. Stitt advised that several property owners have contacted the City over the last couple of years expressing interest in using property along the south side of Evans for auto related uses. They chose to look elsewhere when they discovered it was either not peraitted or a conditional use. He noted the 8-3 zone would perait those uses by right and still provide for the saae protection as the B-2 zone. With regard to Mr. Stitt's coaents about the B-3 zone providing protections and at the saae tiae bringing the area into s-sort of conforaity with the Denver zoning that 1s already there, Council Nelllber Habenicht asked tf the Denver coaerctal zontng extends as far south along that corridor as the area proposed by thts change. She stated it is clean and fenced and they do not bother the neighbors. Dis- cussion ensued regarding the fact that their business is not a penaitted use under the R-2-C and it would still be a non-confonaing use under the proposed 8-3 zone. He noted this ts a public hearing to consider the rezoning of property located along the west Evans corridor tn Englwood. He passed out aaps to Council and the audience to assist with the discussion. Nr. Stitt stated this rezoning c-about, tn put, fro11 actions taken by the Board of Adjustatnt and Appeal. Stitt advised that when Mr. Fortngton purchased the property staff aade tt clear to ht• that ht could use the front half of the property for any use penattted tn the 1-2, but the rear half would have to be used strictly for R-2-C purposes. Mr . Stitt eaph1Stzed there are two taportant parts to the rezoning effort. One ts to address the long tena goals of the Ctty tn term of redevelopaent, and staff fNh rezoning the area to 1-3 would be a step in that direction. The second hsue ts to address the tapact rezoning would have on the restden- t tal coauntty south of the R-2-C zoned district. It ts staff's contntton that with the protections and regulations included tn the 1-3 Zone Dtstrtct the property to the south of Adrtattc extended would be adequately protected. Mr. Stitt felt at this point it would be very difficult to vtsualtze the R-2-C area being developed as residential. He explained that aost of the properties are landlocked and can not be developed until llest Adriatic goes through. The only properties that technically can be developed are those that have access to either Vallejo or Zuni. He stated staff feels that this particular rezon- ing will accoapltsh the goals of furthering develo.-nt mile protecting the interests of both the business and residential coaaunities. Council Mellber Waggoner questioned street right-of-~• in the area. Nr. Stitt stated that six properties have not dedicated ri t-of-.,.y. Discussion ensued regarding the City's efforts to obtain rigllt-o -.,.ys and tt was noted that even tf the area ts rezoned the properties could not be developed until the street goes through. Responding to questions froa Council Nlllber &ulley, Nr. Stitt advised that an alley does not exist on Warren between Zuni and Vallejo. He noted the area is coaprised of single-f .. tly residences or duplexes, with the exception of two lots on the Vallejo side. If Adriatic goes through that would open up the possibility of developing approxtaately ten lots with single-faaily residences or duplexes. He advised he and his neighbors have always been wtl ling to work wtth anyone interested tn starting a business in thetr area. Mr. Apodaca stated there are a lot of in- dustrial sections in the area whtch allow body shops away froa restdenttal. with plenty of access. He advised the residents had consulted wtth a couple of realtors and they had been advised that anyttae light industry hits, there wtll be a 20I decrease tn property values. He noted the Planning and Zontng C01111tsston had told ht• they would like to keep at least an alley or s011tthing between business and restdenttal. Mr. Apodaca contended that tf the B-3 zone were approved and tf Adrtattc would go through, there would not be a buffer. He expressed concern regarding sufftctent parking. He advised Council that several of hts neighbors were unable to attend the public hearing to express their opposttton to the proposed B-3 zone . He subllitted a letter tnto the record frOII a neighbor opposing the new zone. In closing, he stated he thought tt was a lot of work to rezone for one business. He contended tt effects a lot of people tn a very negative way, when a staple adjustaent for the person or persons would suffice. Council Meaber Hathaway asked tf tt was true he had no quarrel wtth putting Adrtattc through provided it stays restdenttal on both sides. Mr. Apodaca stated that was true, but he would have serious reservations tf tt ended up betng business on the northern stde. Dtscusston ensued. Mr. Apodaca could not understand why they have to rezone since there are vi- able, new, active businesses tn the area. He stated tt would be different tf the area was tn a downgrade, but there are two new gas stations, a shopette whtch ts full, two car lots, and two other businesses. Mayor Wtggtns asked Mr. Kelley tf he would be receptive to dedicating the ts feet to cut a street through on West Adriatic should Council not approve this rezoning. Mr. Kelley satd yes, if they can get the rest of tt; all he wanted was SOiie assurance of the type of development that would be in there. Council Mtllber Hathaway stated that she understood that Mr. Kelley did not currently have any structures or residences on that particular strip along Zunt. " Housing Authority that they contact the owners of property in question for consideration as a •Project Rebuild.• She stated she has talked to the resi- dents several times over the years and they have a problea, regardless of ded- icating. No aatter what they do, if they dedicate 25 feet, they do not have enough lot size on either side of the house. Mr. Stitt concurred. Sherrel Price, 2157 South Zuni, Denver, expressed concern that by adding busi- nesses in the area, they would experience an increase in traffic and the crime rate. The letter that was subllitted by Mr. Apodaca could not be read into the record as Mr. DeWitt opined it was hearsay; however, he stated it could be attached as part of the public record, and Council was given an opportunity to peruse the letter. Mr. Stitt stated that to his knowledge there are no non- conforming uses. One auto repair business is considered a legal non- conforming use and tt would be a perattted use under the B-3 zone. Council Mellber Habenicht stated she understands the City, through the efforts of the Planning and Zoning C0111ission, plans to update the COlll)rehenstve Plan wtthtn a year. He stated the Professional Coapliance Progra• is c011posed of over 100 standards dealing with police ad- ministration and police procedure. He presented a plaque and State Accredita- tion Certificate to Safety Services Director Stanley. Director Stanley thanked Mr. Stefanie and noted that the award was the result of dedication and hard work on the part of staff. (b) Ellployee Services Specialist Caudill announced that the City of Englewood has once again won a Loss Prevention Award. She introduced Chris Krall, CIRSA Loss Control Manager, and Mark Jaeger, CIRSA Deputy Executive Officer. Mr. Jaeger coaended the City of Englewood for c011pl11nce with the CIRSA loss control standards. He noted the City of Englewood has been very responsive to the loss control progru and is the first city in the pool to achieve a perfect score. He coaended the City Council, unag-nt, and all eaployees for their efforts. Mr. Jaeger stated Englewood's credit 1s $32,000, which is by far the largest credit of any city tn the progra. He noted the City's good loss history has brought the contribution down tn the Worker's C011pens1tton pool and kept tt stable tn the Property Casualty pool. He stated CIRSA is thankful to have the City of Englewood as a lllllber of CIRSA. City Manager Fraser recognized the contribution of the 111ployees throughout the organization which have resulted tn the awards. He noted the general fund has increased by 14S since 1988. Mr. Clayton stated that during this time homes have been devalued, property and sales taxes have increased, and businesses have failed. He contended "we cannot tax ourselves into prosperity." He feels the City of Englewood spends 110re money per citizen than any city in the 111etro area. Mr. Clayton encouraged Council to look harder at the budget and eliminate current unnecessary programs, to not start any new unnecessary programs, and continue to insist on innovation and efficiency. Fred Hawley, 3024 South Corona Str .. t, noted he had perused the Proposed 1993 Budget, The Citizen, and articles in the Englewood Herald regarding the pro- posed budget. He felt the proposed increase in property tax was unjustified. He felt some of the items listed in the Public laproveaent Fund were optional. Mr. Hawley stated he has had to cut budgets in the past and he thought nothing about a S% or less cut. Council Member Bullock asked if Mr. Hawley is in favor of putting the proposed tax increase to a vote of the people. She explained that each year the City receives revenue frOII the State Highway Users Trust Fund. Thts revenue comes from the fees that are assessed froa the registration of drivers and vehicles, passenger aile taxes on coaon carriers, and principally froa the excise tax on gas. The State and County receive a portion of the revenue and 9% is rem i tted to the cities based on the nllllber of auto r19istrattons and miles of streets in those cities . (b) Environmental Services Adllinistrator Glazier presented a reconnen- dation from the Departaent of C01111Unity DeveloP119nt to approve a bill for an ordinance restricting conventional wood burning devices in Englewood in order to enhance local air quality and assist in aeeting acceptable levels of pol- lutants. He noted the Denver •tro area faces three serious air pollution problems : carbon monoxide, particulate aatter and the brown cloud. Because of these air quality problems the Enviro1111ental Protection Agency has required that the State submit plans that obtain and aa1nta1n acceptable levels for these pollutants. If the State does not obtain or aainta1n these required levels, the EPA can impose stringent penalties until coapliance is aet. Mr. Glazier advised that recent studies have shown that eaission frOII conventional or non-certified fireplaces or stoves account for 251 of the brown cloud, up to 30% of particulate •atter, and 51 to IOI of the region's carbon aonox1de emissions. There are an esti•ated 250,000 conventional wood burning devices in the metro area. He stated the Regional Air Quality Council estiaates that without restrictions an additional 30,000 devices could be added over the next several years. Mr. Glazier also pointed out that Senate 1111 No. 92-137, re- cently passed, requires all auntc1pa11ttes or counties within the Denver aetro area to adopt si•ilar provisions by January I, 1993. However, currently conversion rates to cleaner burning units are only about 5%. He noted that a local bank is offering loans that are easier for consumers to use and less expensive than typical retail spon- sored loans. To encourage participation to convert, a cooperative effort has been undertaken by manufacturers and retailers to offer special discounts in pricing on natural gas logs, fireplace, pellet stoves, new technology wood stoves, and inserts. He pointed out that a disposal and recycling progra• for old wood stoves has been arranged. Mr. Glazier noted the cost of peraits average between $15.00 and $35.00. The anticipated loss to the City of issu- ing these permits without a fee ts between $1000.00 and $1500.00 for the next year. Discussion ensued. ' I . • I - • • • • • Englewood City Council Minutes September 21, 1992 -Page 8 City Manager Fraser stated that this concern is part of the reason this amend- ment was drafted, as it has been recognized that these issues can have an im- pact on the cornnunity and it is important to •go through a 1110re public process than what has been required in the past.• Council Member Waggoner questioned if there is a way to incorporate a perfor- mance bond requirement into the ordinance to address areas where recyclable materials are stored outside. City Attorney DeWitt concurred that this atght be a requirement that they would need to look at tn the future. He discussed soae possible problems. Discussion ensued regarding requiring a bond. The Board will report to the establishing organizations quarterly. The City Council will appoint one Board member to the Englewood Small Business Development Corporation Board. The intent is to have the loan organization in operation by November. Therefore, the Board appoinbnent 1hould be made as soon u pouible. The Englewood Downtown Development Authority (EDDA) has named Gary Oxman to serve on the Board, and the Chamber NII named Teri Holland. The other two Board members will be appointed according to the ESBDC bylaws. STAFF ANALYSIS There is a great need for ,mall buainess financing in Englewood. In 1983 the Board granted a variance to allow Robert Kurtz the right to operate a truck repair facility at 2280 West Evans. In 1989 the board terminated the use because Mr. Kurtz was in non-coapliance with the conditions iaposed in the 1983 variance. Subsequently, the property was taken back by the lender, Ollnibank. In October 1990 Ollnibank subllitted an application for rezoning of the southern portion of this property froa R-2-C to 8-2. This application was withdra.n by the appli- cant in Deceaber 1990 and no further action was taken until the present owner of the property, W1111• For/ington, approached the City concerning possible rezoning. At that tiae staff developed the proposal for the 8-3 Business dis- trict to aeet the proposed needs. Planning Adllinistrator Stitt provided proof of notice of public hearing wllich was pub l 1shed in the Eng 1 ewood Hera 1 d on Sept811ber 17, 1992. Mr. Stitt advised that several property owners have contacted the City over the last couple of years expressing interest in using property along the south side of Evans for auto related uses. They chose to look else- where when they discovered it was either not peraitted or a conditional use. He noted the B-3 zone would penait those uses by right and still provide for the saae protection as the B-2 zone. With regard to Mr. Stitt's coaents about the B-3 zone froviding protections and at the sue tiae bringing the area into so. sort o confonaity with the Denver zoning that 1s already there, Council Nellber Habenicht asked if the Denver c011111ercial zoning extends as far south along that corridor as the area proposed by this change. Mr. Stitt stated he believes it does, but with the except ion of one area between Vallejo and Zuni, aost of Denver's zoning 1s half a block deep on either side of Evans. Ns. Habenicht asked if the B-3 zoning would be aore than half a block deep in this particular instance. Nr. Stitt stated that in the area between Vallejo and Zuni staff is proposing that the area be rezoned froa Evans to Adriatic extended and includes a portion of what is now zoned R-2-C. In response to questioning froa Ns. Habenicht, Nr. Stitt confinaed that the area is probably not coaparable to the Denver corri- dor. Ms. Habenicht expressed concem that if the B-3 zone wre approved it would set a precedent for other areas of the City. She asud if the Planning and Zoning c-ission had considered how it aight affect other zoning issues. Nr.
