I . • , 2 - • • Englewood City Council Minutes July 13, 1992 -Page 2 • • • Director Esterly presented evidence of the required Publication of Notice of Public Hearing which appeared in the Englewood Herald on June 18, 1992, June 25, 1992 and July 2, 1992. Mr. Esterly stated that a notice of intent to form the district was published in the Englewood Herald February 21, 1991, February 28, 1991, and March 7, 1991. On March 25, 1991 a Public Hearing was held prior to the foraation of these districts. On April 8, 1991 Public Works re- contacted everyone involved in the process, at Council's request, to confirm that the City had decided to proceed with the foraation of these districts. On April 9, 1991 staff solicitated volunteers with doorhangers and in addition there were previous contacts that had requested inclusion in the concrete por- tion of the district. On June 29, 1992 Public Works aailed out notification of the proposed assessments. Mr. Esterly reviewed information included tn a prepared handout. The handout includes a brief description of areas covered by the paving district and the aandatory concrete district. He noted volun- tary concrete replaceaent exists throughout the entire city. Final assessment data was reviewed. He reviewed the proposed schedule for COlll)letton of Paving District No. 34/Concrete Replaceaent District 1991. He discussed two concerns raised by property owners: inequitable assessatnts and cost of tree reaoval. He noted varying credits were allOlftd, in SOIi& instances, for replacing exist- ing concrete that was tn good condition and that tree reaoval work is patd for by the City. Mayor Pro Tea Hathaway tnvtted public c01111tnt an d explained that c0111&nts will be taken on a street-by-street basts. ZONE 1 (PAVING DISTRICT NO. 34) 3800 South Delaware Street Ken Love, 4501 South Logan, appeared on behalf of hts aother Eleanor Gates who owns the property at 3121 South Del.,.re. He thanked Council and the City govenaent for coaing in under the original estiaates. He noted SOIi& of hts concerns have been addressed by Mr. Esterly. HcMever, he coaplatned of the poor worlcaanship on the sidewalk at 31Zl South Delaware. Mr. Esterly noted the work at that location has been accepted by the City. He stated there has been soae problem associated with cracks along joints of tndtvtdual stones -"ich have been addressed on an individual lot -by -lot basts and discussed with the lloaewrs. The Ctty fNls they are not a hazard to the future 1 tfe of the concrete. He stated he was unaware of other worlcaan - shi p issues . In response to Mayor Pro T• Hathaway 's request Mr . Esterly ex - plained the City 's two -year bond on concrete contractors. Replaceaent of de - fective work will be deaanded of the contractor up to two years after coaple - tion of the work. Council Metlber Habenicht asked for an explanation of the recourse for hoae - owners if the concrete should prove to be defective. Discussion ensued. Mr. Esterly stated the contractor has agreed, upon request of the lloaewr, to replace the concrete that has s'"-n hairline cracks that are not on control joint locations.
