Ordinances, Resolutions and Motions • • t• • (a) City Manager Fraser presented a recommendation from the Department of Connunity Development to adopt a bill for an ordinance extending the Sales/ Use Tax Rebate on machinery and equipment for three years. He stated that during the past year the response to the rebate has not been overwhelming; however, he noted it is a good marketing tool, an incentive to re-invest in our cOIIIIUnity, and does not have a major financial impact on the City's budget considerations. The Deputy City Clerk was asked to read Council Bill No. 30, entitled: COUNCIL BILL NO. 30, INTRODUCED BY COUNCIL MEMBER HABENICHT A BILL FOR AN ORDINANCE EXTENDING THE REBATE OF SALES ANO USE TAX ON THE PUR- CHASES OF MACHINERY ANO MACHINE TOOLS FOR BUSINESSES IN THE CITY OF ENGLEWOOD, COLORADO. General Discussion <. • • I• • (a) Mayor Wiggins congratulated EDDA and others involved in the Charlie Pride Concert and the Best of the West Fest presentation on Saturday. It was agreed to send EDDA a letter commending them for a job well done and offering continued support for future festivals. Also, a letter of thanks to Charlie Pride. (b) Council Member's Choice (i) Council Mellber Bullock advised Council they would be recetv- tng a request from radto station KQXI, which ts currently co-transmttttng wtth a Chrtsttan radio station on the sewer plant site tn Englewood. KQXI ts in- terested tn obtatntng their own grant or franchise frOII the Ctty of Englewood to establish their own tower. Dtscusston ensued. (tt) Council Metlber Yan Dyke: I. She noted several Council Mellbers had received a letter frOII Ron Densaer regarding the proposed traffic stgn at Charles Hay Eleaentary School. She requested an update on the placeaent of the stgn. Council Mellber Gulley explained Mr. Densaer feels that the warning stgns are not appropriate to the actual pattern used by the children. Council Mellber Habenicht noted that when the legtslatton regarding the stgns was passed Council had been assured the School/City Coatttee had been con- sulted. She felt ... should go back to the school accountability coaittees to see if they concur with the plac ... nt of the stgns. City Manager Fraser ad- vised that each school was represented tn the discussion and had the oppor- tunity to review the plans for the stgns. Ms. Habenicht explatntd that in the past the schools tend to put staff lllllbers tn positions of speaking on behalf of the parent groups and soaeti•s that infonution does not get through to the parent groups. Discussion ensued. 2. Ns. Yan Dyke requested that letters and certificates of thanks to the individual participants of the Revenue COllll1ttee be sent of behalf of Council. (tii) Council Nellber Hathaway encouraged participants to send sug-r.stions as ... 11 as congratulations to EDDA regarding the Best of the West est. (tv) Council Nellber Habenicht: I. She coaented on the article in the July 30, 1992 issue of the Englewood Herald about pol tee officers walking the beat. She was iapressed wtth the favorable citizen response to the progr•. She thanked the Englewod Herald for so 1 t c 1 t t ng ct ti zen coaents on issues of cOftCern to Counc 11 . Ms . Habenicht stated she ftnds the opinion poll very helpful. 2. She reminded Council of the upcoming City of Englewood Recreation Depart- ment production of Oklah011a, August 6, 7, 8, and 9, 1992. 4. She advised that Howard McGregor, of Engineering Dynamics, has agreed to a free consultation regarding the court room sound system. 5. She passed out a rough first draft of a reso 1 ut ion regarding Co 1 or ado Children's First Act. Council was asked to review the proposal and be pre- pared to discuss the issue at the next study session. Discussion ensued. (v) Council Member Gulley shared several negative cownents she had received regarding the proposed conde1111ation of Cinderella City. She felt the public relations on this issue was not handled well and Englewood's i•age has suffered for it. City Manager Fraser responded concerning the various facets of the City's in- volv8118nt in trying to revitalize Cinderella City. Further discussion ensued about how the City and its representatives could hopefully turn the negative perceptions into positive ones. It was strongly suggested that citizen input be solicited in this project. 13 . Ct ty llana .. r' s Report (a) Mr. Fraser ret1inded Council of the Budget Workshop scheduled for Septetlber 25 and 26, 1992. (b) He stated the position of Deputy City Manager has been restruc- tured. He announced that llanapant Analyst Reid has been proaoted, effective August 3, 1992, to Assistant Ctty llan19er. (c) He announced that Lee Merkel has been hired as Director of C01111Uni- ty Developaent. Mr. Merkel has worked for various towns throughout Colorado as a unager, planner, and mst recently for the northwst ar·ea Council of Ciovernaent on water issues. (d) He noted Council had received copies of a draft ordinance regarding cable consortium. He noted staff has been working with a nllllber of other cit- ies on the possibility of a collaborative effort to negotiate a cable franchise that would serve the .. tro area, rather than have a series of in - dependent negotiations. (e) At Mr. Fraser's request Assistant City Manager Reid provided an update on the General Iron Works site. Mr. Reid noted the owner of the site, Atlas Metal Iron, has agreed to reaove all uterial in the northwst section of the property by SeptNber 30, 1992. Efforts to remve cont•i nated uterials are still being discussed. He also provided an update on the shingle recycling business now Nied by Allerican Excelsior. " (f) Mr. Fraser transaitted copies of the final report on the study of U.S . 285. He noted the report has been sent out to the citizens who partici- pated tn the public aeetings. The report covers the area between Santa Fe and Broadway on U.S. 285. 14. City Attol"My's Report Assistant Ctty Attorney Brotzaan stated the barking dog problem at Orchard Place has not been resolved, but ts set for trial on Septeaber 1, 1992. 15. He advised that when the Zuni Water Tank was taken off line for its every-other-year inspec- tion in April, a high degree of corrosion was noted on the exterior of the stand pipe section. This corrosion, if left unchecked, could lead to pipe failure. This storage tank is an integral part of the water distribution sys- tem in the Scenic View area. Discussion ensued. It was agreed to send EDDA a letter coaending thea for a job well done and of- fering continued support for future festivals. Also, a letter to Charlie Pride, thanking hi• for his efforts on behalf of the MS COllllll.lnity Resources. (b) Council Mellber's Choice (1) Council Mellber Bullock advised Council they would be receiv- 1119 a request froa radio station KQXI, which is currently co-transaitting with the Christian radio station on the sewer plant site in Englewood. They are interested in obtaining their own grant or franchise froa the City of Engle- wood to establish their own tower. Discussion ensued. (ii) Council Mellber Van Dyke: 1. She noted several Council Mellbers had received a letter froa Ron Densaer regarding the proposed traffic light at Charles Hay Elementary School. She requested an update on the plac ... nt of the light. Council Mellber Gulley explained Nr. Densar feels that the warning sips are not appropriate to the actual pattern the kids use. Council Mellber Habenicht noted that when the ordinance was passed Council had been assured the School/City Coaittee had been consulted. She felt • should once aore go back to the school accountability coaittees to see if they con- cur with the placeaent of the sips. City llanager Fraser advised that each school was represented in the discussion and had the opportunity to revi• the plans for the signs. lls. Habenicht explained tut in the past the schools tend to put staff _..rs in positions of speaking on behalf of the pare11t groups and s-ti•s tut inforaatton does not get through to the pare11t groups. Discussion ensued. 2. She requested Council send letters and certificates of thanks to the in- dividual participants of the Revenue Coaittee. (ttt) Council lllaber Hathaway asked that suggestions as •11 as kudos be sent to EDDA regarding the •1est of the Mest. • She noted that it 1s an integral part of the process to hear both sides of the story fra the par - ticipants . She noted that several 110nths back Public Works had COIie out to look at a property that is on Lipan Court facing the industrial section to the west. There was an indication that there would be sOllething done in teras of putting up SOiie sort of barrier thats in the agreeaent that we have with those proper- ties when that planned developaent was put in and also there was soae graffiti on the wall and we were going to have the police investigate that graffiti before it was reaoved. Well the graffiti is still there to •Y knowledge, it was pointed out to ae this weekend and I thought perhaps it got lost in the paperwork or soaething, but she thinks it should be addressed. 3. She reminded Council of the upcoming City of Englewood Recreation Depart- ment production of Oklahoma, August 6, 7, 8, and 9, 1992. 4. She advised that Howard McGregor, an owner of Engineering Dyn•ics, they work as accoustacle engineers. She had casually mentioned that we have prob - leas with this system of ours in the City. He indicated he was willing to consult with us at no cost to take a look at what the acoustacle dynaaics are and wtth the sound system. I thought that was a very generous offer and I want to share it wtth you. 5. She passed out a rough first draft of a resolution regarding Colorado Children's First Act. Council was asked to review the proposal and be pre- pared to discuss the issue at the next study session. Discussion ensued. (v) Council Neaber Gulley shared several negative c~nts she had received regarding the proposed condemnation of Cinderella City. She felt the public relations on thts issue was not handled well and our iaage has suf- fered for tt. City Manager Fraser stated that Council had talked about the concept of con- deaation of Cinderella City during a public aettng as a tool that could be used tn trying to revitalize Cinderella City. He felt the article in the En - glewood Herald was reasonable and tt was picked up by the Rocky Nountatn News. He spoke to the reporter froa the News and discussed the concept of condemna- tion and what that •ans to the public and our concern about people vtewtng the aall as potentially closing as a consequence of that. That thts was one tool of aany that we atght use to try to facilitate a change of a.nership and the redevelo.-nt of that stte. Siatlarly, when Channel 9 and 4 were out he talked to the reporters about the notion of a condeanation as opposed to clos - ing down the aall and the fact that the aall ts going to continue on be vital . It's unfortunate that people have different reactions to the word condemna - tion . He noted that Richard Dolson of Equitable had contacted hts office on Friday about their willingness to hire a public relations fira to work on thts project and to deal with just thh ktnd of issue. He stated he was excited about the offer as i t ts the first response we have had froa any of the owners in the two year s the City has been working on this deal . She felt there is an opportuni- ty that we can change it around and aake it positive whenever possible. City Manager Fraser pointed out that the notion of a condeanation that this Council accepted to work with was I reaarkable stroke froa the City's perspec- tive and also one which stia1lated the ownership to aake a aove. He felt it was legittaately I prtae interest story for the aedia. He stated that people now understand that the Ctty ts going to be active tn this and he suggested the next step be to get the c01111Untty involved wtth the Ctty in developing a plan that works for Cinderella City and that we talk about I highly public process that ts one in which the c01111Unity says •here's what we'd like to see•, •here's what aakes sense• as a result of soae retail studies, etc. that has c01111Untty support so at the ttae when soae action ts taken by the City it wtll be one that enjoys the kind of support you are talking about. Council Mellber Hathaway stated she had also been involved tn •daaage control•, however the c~nts she received •re of a aore positive nature. She tried to explain the concept of condealation and encouraged the citizens to be part of the process. She cited lack of ctttzen input during the redevelopaent of Trolley Square. 13. City llana ....
