(a) Kathleen Duncan, 616 Simon Center, felt the proposed contract with
Arapahoe County Transportation Services, to provide transportation for Engle-
wood's handicapped and elderly residents, would not meet their needs. She
voiced her concerns with the ACTS program and pointed out the advantages to
participants in the taxi coupon program. Ms. Duncan submitted a list of sig-
natures of persons that opposed the ACTS program.
Council Mellber Bullock asked how quickly the taxi program could be re-
inipleaented.
Nalley Center Recreation Service Manager Mickelson stated the program could be
re-iaple11ented upon Council's request.
Council Mellber Gulley questioned the feasibility of offering both programs.
Ms. Mickelson stated the prograa could be iaple11ented at Council's discretion.
She pointed out one consideration aight be budget constraints.
Council Mellber Hathaway noted that the taxi coupon program has income limita -
tions, and a atxed use between the taxi coupon program and ACTS would allow
other seniors access to transportation assistance.
Council Mellber Van Dyke asked about financial cOlll)arisons between the two
prograas.
City Manager Fraser stated they anticipated the taxi coupon progra• to cost
$25,000 this year and the ACTS prograa $12,000.

ed staff solicit input from citizens involved ;n the programs.

(a) Bill Young, Fire Division, Safety Services Department, was recog-
nized and honored as Englewood's E111ployee of the Month for January.
(b) J1111es Beckwith, attorney for Bob's Auto Service, reiterated his
protest of awarding the towing contract to Hinson Towing. He encouraged Coun-
cil to i111pleaent a rotation syste11 COlll)rised of Bob's Auto Service and Bob
Hinson Towing Specialists. Mr. Beckwith provided copies of memorandums out-
lining a contract rotation proposal and advising of statutory penalties for
carriers acting without authority.

Neighborhood Services Adllinistrator Stitt, duly sworn, entered into the record
Proof of Publication of Notice of Public Hearing, which was published tn the
En lewood Herald on January 2, 1992 and Certifications of Posting. Mr. Stitt
presen e e rec01111end1tton froa the Planning and Zoning C011111tssion. He not ·
ed that staff, tn an effort to address Issues brought to their attention
regarding appropriate uses, began looking at the nature of the downtown area
at the ttae of the original zoning. At that tl11e, there was a natural break
between the uses. However, as tt .. has passed, there have been SO!lle chang s
in the nature and uses of the downtown area. Staff, In conjunction with th
Planning and Zoning COlllllsslon, .. t with the Challl>er of COIMltrce and EDDA to
talk about the proposed change In zoning. They also 111tt wtth restd nts to
address tssues of concern. Tht c0111tnts froa the two entities and residents
were Incorporated into the staff report. Staff's overall concern ts to pro ·
vlde for adequate zoning and opportunities, while protecting the resid nthl

modification of the proposed rezoning, which would still provide for those
"110re intense auto related uses• in the 3200 block along Broadway, but would
provide protection for the residential uses on the Lincoln and Acoma side.
Council Member Hathaway asked if the boundary lines could be cut back to the
a 11 ey 11 ne on the south half on South Acoma, and to the a 11 ey line on the
north half on Lincoln in order to keep the residential area from being rezoned
8-2. Mr. Stitt agreed that was an option.
Council Mellber Waggoner asked for clarification of the legal description and
pointed out a discrepancy.
Discussion ensued regarding the original proposed rezoning reconnendation and
the possibility of reducing the boundaries of the affected area.
Council Mellber Habenicht asked about the definition of adult entertainment
under condtttonal uses. City Attorney DeWitt responded to her concerns. He
noted the deftnitton of 8-2 zoning ts not being changed; staff ts only propos-
ing a change tn the area to which tt applies.
Dtscusston ensued regarding the procedure to follow if Council approved an
aaended legal descrtptton.
Earl Ladewig, 3235 South Lincoln, duly sworn, stated he objected to the pro -
posed rezoning. He felt however, that if Council were to approve the rezon-
ing, they should rezone the entire area to B-2 "not just a piece of tt.• He
responded to questions froa Council.
Frank R ... s, 3201 South Lincoln, duly s.orn, expressed hts confusion over the
exact area be1f111 considered for rezoni1111. Council NNber Hathaway identified
the area under consideration. Mr. R ... s confiraed he would like his property
included in the B-Z zoni1111.

(1) City Manager Fraser presented a reconnendation to award the con-
tract for vehicle wrecker and towing services to Bob Hinson Towing
Specialists. He advised that staff had reviewed the material and estimates,
at Council's direction. He stated Bob Hinson Towing Specialists was low bid-
der and the City has been satisfied wtth their current level of service.
Council Heaber Waggoner stated he was disappointed that the tabulations had not been subllitted with the first presentation.

Mayor Wiggins requested a motion to strike the section declaring this council bill as an emergency.
The Deputy City Clerk was asked to read Council Bill No. 5, entitled:
COUNCIL BILL NO. 5, INTRODUCED BY COUNCIL MEMBER HABENICHT
A BILL FOR AN ORDINANCE ADDING A NEW SECTION 13, TO THE INTERGOVERNMENTAL
COOPERATION AGREEMENT WITH ARAPAHOE COUNTY RELATING TO THE CONDUCT OF C~NI-
TY DEVELOPMENT BLOCK GRANT PROGRAMS FOR FEDERAL FISCAL YEARS 1992 THROUGH 1994 AND DECLARING AN EMERGENCY.
City Manager Fraser advised 1t was not necessary to declare an emergency in
this instance. He noted they have been tn touch with Arapahoe County and feel
they can work this out without asking Council to COIie tn for another meeting
tn the aorntng to pass this as an eaergency bill. He stated staff would like
to reserve the use of an -rgency ordinance for S0111tthing a little more serious than they believe this to be.
City Attorney DeWitt countered that there are aistaken views on emergency or-
dinances and he clarified Council would not have to aeet in the morning. He
advised they could handle it at the next council aeeting. Mr. DeWitt noted
emergency ordinances prohibit certain types of legal proceedings against the ordinance.
Council Mlaber Gulley asked if the funding was in Jeopardy if this were not
declared an ... rgency. City Manager Fraser assured her it was not.
Council Mlaber Habenicht asked tf this aight cause problet1s in our dealings with Arapahoe County.
City Manager Fraser advised her staff had discussed the situation with Arapa-
hoe County and they wre tn agreeant.

contract with the Englewood Schools.

1. She advised that the Superfund strategy connittee had asked that Council
conftra a representative. Ms. Van Dyke stated that she would like to continue
in that role with Council's support.

(a) Kathleen Duncan, 616 S1110n Center, felt the proposed contract with
Arapahoe County Transportation Services, to provide transportation for Engle -
wood's handicapped and elderly residents, would not meet their needs. She
voiced her concerns with the ACTS progra• and pointed out the advantages to
participan\j in the taxi coupon prograa:.:J4s. Duncan submitted a list of signa-
tures1~pposed the ACTS prograa.

Councfl "'-ber Bullock asked how quickly the taxi program could be re-
i111pleaented.
Malley Center Recreation Service Manager Mickelson stated the program could be
re-iapleaented upon Council's request.
Council Mellber Gulley questioned the feasibility of offering both programs.
Ms. Mickelson stated the progra• could be impleaented at Council's discretion.
She pointed out one consideration •ight be budget constraints.
Council Mellber Hathaway noted that the taxi coupon progra• has incOffle limita-
tions, and a mixed use between the taxi coupon progra• and ACTS would allow
other seniors access to transportation assistance.
Council Mellber Van Dyke asked about financial comparisons between the two
prograas.
City Manager Fraser stated they anticipated the taxi coupon program to cost
S25,000 this year and the ACTS progr .. $12,000.

Proof of Publication of Notice of Public Hearing, which was published in the
Englewood Herald on January 2, 1992 and Certifications of Posting. Mr. Stitt
presented the recoaendation froa the Planning and Zoning Coaission. He not-
ed that staff, in an effort to address issues brought to their attention
regard1119 appropriate uses, began looking at the nature of the downtown arH
at the ti .. of the original zoning. At that ti111, there was a natural break
between the uses. Hol!Mver, as ti .. has passed, there have been soae changes
in the nature and uses of the downtown area. Staff, in conjunction with the

(a) Jaaes A. Beckwith, attorney for Bob's Auto Service, protested
awarding the towing contract to Hinson Towing. He provided copies of a memo-
randua addressing purported discrepancies for Council 's review. Mr. Beckwith
contended that Hinson Towing does not have the necessary range of towing
equipment; that the City has not agreed to allow subcontracting for that ser-
vice; and that Hinson does not identify the subcontractor, and rate, for heavy
equipment 110veaents. He asked that Council reevaluate the Hinson Towing con-
tract and award the contract to Bob's Auto Service as •it is the only bidding
party who aeets all of the bid specifications.• He reviewed bidding price
coapartsons for standard and optional services. He requested, if City Council
should decide to re-bid the contract, that the traditional rotational towing
systea be used until the contract is awarded.

Safety Services to approve by 110t1on I contract for vehicle wrecker and towing
services to Bob Hinson Towing Spec1a11sts, 4343 South Santi Fe Drive. Nr.
Olson noted they have served 1n thh capacity for the last two years, staff
has been satisfied with their level of service, and they subllttted the lowest
btd . He noted actual costs are substantially less than the .orst case scenar-
io proposed 1n the bid specifications.
Council Metlber Habenicht quest toned whether the request for bid precluded any
contr1ctl119 out on the part of the bidder. Nr. Olson stated that during the
bid process Nr. Clothier, owner of Bob's Auto Service, stated hts concern with
that Issue. As a result, an addendua was aalled to 111 bidders that had re -
quested bid packages speclfylllCJ that heavy duty towing could be sub-
con tracted . He felt this was not I aajor Issue as it Is rare for the City to
use thfs type of specialized heavy duty towf119 .

Council Mellber Habenicht questioned the accuracy of bidding price coniparisons
as set forth in the 1111111r1nd1111 frOII Mr. Beckwith dated January 6, 1992. Dis-
cussion ensued.
Bob Hinson spoke on behalf of Bob Hinson Towing Specialists. He stated there
have been four requests for tractor and trailer s .. i's in the last two and a
half years, which they handled. He aaintained he would stand on his past
record with Englewood, Cherry Hills Village, and Greenwood Village. He noted
he has letters on file froa two of the largest towing cOlll)anies in town stat-
ing they would back hi• on any police request for heavy duty equipaent.
Council Mellber Hathaway expressed her concern over the discrepancies in the
inforaation presented on this issue. She requested additional inforaatton on
the rotational syst•, heavy duty tows and cost differential. Although, an
tnteri• agreement was discussed, Mr. DeWitt rec011aended they issue a notice to
continue the current contract, with alternative eaergency .. asures to be con-
sidered if disagreements arise.

Council Nellber Hathaway encouraged c01111Unity involvement in his effort, as she
was aware he ts training for the Olyapics. She suggested he contact the South
Metro Challber of C0111erce and the Greater Englewood Challlber of C011111erce.
Council Nellber Habenicht offered her congratulations to Mr. Clayton and re-
quested that he and his representative be given a City T-shirt. It was agreed
to provide a book bag, pins, etc.
Council Mellber Gulley confinaed that the Greater Englewood Challlber of Con11erce
had approved a contribution of $1,000.
7. Non-scheduled Visitors
Ken Haraldsen, 3018 South Washington, invited Council to attend the upc011ing
Colorado Cowboy Poetry gathering at the Arvada Arts Center, as he will be a
participant. He noted on January 21, 1992, SOiie of the participants will be
perfonaing at the Englewood Public Library.
Mr. Haraldsen suggested Council record various convention meetings in order to
share infonaation at the study sessions. It was noted that occasionally tapes
can be purchased. City Attorney DeWitt stated that in SOllle instances taping
is specifically prohibited, as soae prograas are copyrighted or otherwise pro-
tected. Discussion ensued.

(d) Director Esterly presented a recOIIIIN!ndation from the Departinent of
Public Works to approve a resolution declaring the intent of City Council to
create Special Japroveaent District No. 1992. He noted, that during the for-
111tion of Paving District No. 1991. it was detennined the Santa Fe Circle
project should be reaoved because it was a developer project; and that this
particular project would have a negative iapact on bond ntes, resulting in
higher costs for other district llellbers. He advised that this district in -
cludes water, sewer, engineering, and paving. Council Mellber Waggoner ques-
tioned the financial arrangeaent. Mr. Esterly explained it would be financed
with the City 's reserve funds. Discussion ensued. Counc 11 Mellber Waggoner
wondered if the City anticipated another paving district. Mr. Esterly advised

(f) City Attorney DeWitt presented a recoaendation frOII the City At-
torney's Office to approve republishing I bill for an ordinance concerning
water rights. He advised that thts ordinance does not repeal the 1985 or-
dinance, it elaborates specifically on certain aspects of that ordinance and
p.-ovides for an unusual publishing sequence to bring it into COllpliance with a
specific State Statute.
Council Neaber Waggoner questioned the status of property that c111e into the
City after January 1, 1985. Discussion ensued.

however, she understood that Waste Manageaent would be contacting citizens to
offer recycling services. She noted the transition frOIII the City's pilot
recycling prograa to Waste Manage11ent's recycling prograa would take a little
tiae. Discussion ensued. Council Meaber Van Dyke agreed to meet with Waste
Manageaent and discuss Council's concerns.
3. He inquired as to the status of the sale or lease of the Federal Fire
Station. Ms. Martin advised the property was posted, advertise11ents were
placed in the Daily Journal and Englewood Herald, and a bid opening ts
scheduled for February 4, 1992.
(vi) Council Mellber Habenicht coaented on the significance of
the first resolutions of the new year.
(vit) Council Mellber Hathaway noted coordinators of the 10,000
Trees Project would be approaching Council with their presentation . She in-
quired as to whether the City would like to put together a tea• again for
planting a site, as she would like to coordinate the effort with Outdoor
Colorado. Deputy City Manager Martin 19reed to .. ntion it to staff and advise
Council. Ms. Hathaway requested staff prepare a chronological history of
funding and reilllburse11e11ts.
(viit) Council Mlllber Bullock asked if the City has insurance to
cover those people sentenced to coaunity service by the Municipal Court. He
stated he understood that technically they .. ,.. not eligible for Workers' Coa-
pensation. City Attorney Dellitt provided an update on the issue.

(a) Deputy City Manager Martin transattted a draft of the current pro-
posal for the ctttzen survef llllllich 1s conducted everf other year. She re-
quested coaaents froa Counci by January 13th, to enab e staff to process the
survey in a ti .. ly •nner. The responses will be tabulated prior to Counctl
establishing goals for 1993. Council Mlllber Habenicht asked if the questions
were consistent with the last survey . Ms. Martin noted that 111 questions
providing substantive inforaation, that can be used for tracking, have been
retained. Council Melll)er Van Dyke stated she would like to SN an addend ua to
the survey regarding recycling . Management Analyst Reid advised that they
would be surveying all the people who participated in the recyclt119 progr•,
as well as an equal number of people In the pilot area who chose not to
participate.
(b) She noted that as of Deceaber 31, 1991 Phil Dewt119 ts no longer
eaployed by the City . He was charged with the delivery of coun c il pa cke ts .

City Manager's Office. Mayor Wiggins noted Council Mellbers Habenicht and Gul-
ley had also prepared reports to share with Council.
14. Cfty Attorney's Report
(1) Mr. Dellitt praised Phil Dewing for his assistance during the tran-
sition to private process service.
Council Mellber Habenicht thanked staff for ti .. ly and coaplete council
packets.
(b) He provided copies of correspondence fl'OII the Career Service Board
regarding the policy decision •king process.
(c) He noted the EPA ts uncertain as to how they would like to handle a
municipal settl .. nt policy, however he would keep Council apprised of the
situation.
(d) He stated Council would be receiving a confidential opinion on the
Fiber Optic Cables.
Council Nellber Van Dyke requested an update on the D1ftse1 R19land case. Mr.
DeWitt stated Career Service has not supported her position and she has filed
a notice of claia.

Hall upon the request of the City of Englewood to conaider the

wa• received. The Conuaiaaion received the Notice of Public Hearing
and the Staff Report, which were incorporated into and made a part of
the record of the Public Hearing. After considerinci the atate .. nts of
the witne••e• and reviewing the necessary docuaents, the .. abers of
the City Planning and Zoning co .. iasion .. de the following findings
and conclusions.

1. THAT the Public Hearing waa initiated by the City of Englewood to

terline of South Acoma street a distance of 452.43 feet, more or
less; then east to the centerline of south Broadway; then south
along the centerline of South Broadway to the centerline of Floyd
Avenue; the east along the centerline of East Floyd Avenue to the
centerline of the South Broadway -south Lincoln Street Alley;
then north alo119 the centerline of the south Broadway -South
Lincoln street Alley to the centerline of East Eastaan Avenue;
then west along the centerline of East Eastllan Avenue to the cen-
terline of South Broadway.
6. THAT Michael CUllifer, 3225-29 south Lincoln street, stated that
he supported the proposed rezoni119 as originally presented.
7. THAT Earl Ladewig, 3235 South Lincoln Street, stated that he did
not feel that there have been sufficient changes in the subject
area to warrant the rezoning.

CONCERN #2 -EQUIPMENT REQUIREMENT FOR HEAVY DUTY TOWING
Hr Beckwith indicates that while Bob's Auto has the equipment to
perform heavy duty towing for tractor-trailers and similar
equipment, Bob Hinson•s does not, and therefore does not meet the
minimum bid requirements. Please be aware that during the bid
process, the owner of Bob's Auto, Mr. Sam Clothier, complained to
Batty Goosman and ma about this situation. As a result, and after
Batty checked with the State PUC, an addendum was mailed to all
bidders, specifying that heavy duty towing could be sub-contracted
by the winning bidder, but only if the sub-contractor hald the
relevant letters of authorization froa the PUC allowing for such
service to be provided.
Bob Hinson•a baa aet thia provision of the bid, and baa sub-
contracted with a valid operator for thia aervice.
It must alao be stated that it is rare for the City to use thia
type of specialized heavy duty towing, and that in the paat, Bob
Hinson•• has bean able to provide this service without utilizing
heavy duty wreckers.

in the bid, and that if it waa, Hinaon•a bid would be even higher.

sub-contracted aervice, and thia eatiaate figured into the overall
proposal fro• Hinaon•a which waa atill lower than llob'a Auto.
CONCLUSIONS
The currant towing serv ices contract with Bob Hin ao n•s was signed
by the City Manager on March I, 1919 •

Third, the bidding party is not barred fro• sub-contracting
for transports of self-propelled construction equlpaent. However,
rates for such services, performed by a co11J11on carrier holding a
proper Certificate of Public Convenience and Necessity, are
regulated by the Colorado Public Utilities co-isslon. Th••• rates
must be on file with, and approved by, the Colorado P.u.c.
Bob's Auto holds co11110n carrier authority (PUC Certificate No.
26621) , and has th• equlpaent to perfora such aove-nts. Its
tariff rate la included in its bid on this contract.
Conversely, Hinson Transport Specialists does not hold
authority to transport self-propelled construction equipaent. Its
bid does not reference the charges to be laposed by a co11110n
carrier for such service. If those charges were added to the bid,
then the price differences between Bob's Auto and Hinson would be
even greater.
Bob's Auto has held the City Contract for several years.
During this period, it has dedicated its entire fleet of light,
aedlua and heavy duty wreckers, indoor storage, and Landoll
trailers to Englewood's service.
The bid of Bob'• Auto is not only the lowest, but also the
aost responsible and rHponsive, bid for this City Towing Contract.
Accordingly, an award of the contract to Hinson Transport
Specialists violates the Bid Specifications, and should not be
granted.

relating to the conduct of
COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAMS
for FEDERAL FISCAL YEARS 1992 THROUGH 1994
This Addendua modifies the Intergovernmental Cooperation
Agreement (the "Agreement"), entered into and effective as of
June 1. 1991, by and between Arapahoe County, Colorado (the
"County"), a body corporate and politic of the State of Colorado,
and the city of Enqlawogd (th• "City"), a municipal corporation
of the State of Colorado located in Arapahoe County.
WHEREAS, the County and the City are desirous of receiving
funding from the Community Development Block Grant ("CDBG"),
proqram adainistered by the U.S. Departaent of Housing and Urban
Development ("HUD"); and
WHEREAS, pursuant to the provision• of section 906 of PL
l0l -6 2S (incorporated at 42 USC 5l04(l)J, it is necessary that

A. By the addition of the following as Section 13:
13. The County and the City each agree to adopt and
enforce the following policies:
a. "prohibiting the use of excessive force
by law enforcement agencies within its
jurisdiction against any individuals engaged
in nonviolent civil rights demonstrations":
and
b. "enforcing applicable State and local laws against
physically barring entrance to or exit from a facility
or location which is the subject of such nonviolent
civil rights demonstration within its jurisdiction."
e. The County and the city shall provide copies of said
policies to HUD and to each other, as requested.
c . All other provi sions of the Agreement not inconsistent
with this Addendum are reaffirmed.
