Ms. Martin advised that two bids had been received on the lease/purchase, one froa Orix Credit Alliance, Inc., and one frOII Municipal Services Group, Inc. The bid froa Municipal Services Group, Inc., was the low bid in the total aaount of $400,533.32 including interest with a yearly payment of S133,Sll.16. Ms. llartin explained that the 1991 budget allocates S104, 107 for this lease purchase, therefore, an addi - tional allocation of SZ9,404, as set forth tn the second resolution, ts neces - sary. Council Members Koltay, Hathaway, Wiggins, Bullock , Clayton, Habenicht, Van Dyke None (c) A resolution establishing annual salaries for the Municipal Court Judge and Associate Judges for the calendar year 1991 was considered. City Attorney DeWitt advised Council that an annual salary of $62,830 would rep- resent a 3~ increase for the Municipal Judge. Further, that a per diem salary of $280 ts proposed for the Associate Municipal Judges' salary, representing the first increase in five years for Associate Judges' pay schedule. Council Nellber Bullock questioned whether the salary ts adequate. Mr . DeWitt tnfonaed Mr. Bullock that tt is his understanding the Associate Judges are strongly coattted to the coauntty and consider their appointaent a service to the coaunity. Mr. DeWitt advised that Judge Parkinson feels the proposed per dt• is satisfactory. It was strongly suggested by Council Mellber Bullock that the salary for Associate Judges be reviewed in an atteapt to bring that salary up to market prior to next year's budget. The report follows: The caucus held at Scanttcon, Denver, was well attended with approximate- ly 150 participants from the Metro Denver region. The focus was on metropolitan cooperation; sharing ideas and develop;ng relationships. It was sponsored by Colorado C01111Unity Initiatives which ts the aetropol itan civic leadership foundation. There were eight corporate sponsors with additional underwriting frOII Greater Denver Chlllber of COII- Mrce, State of Colorado -Departaent of Local Affairs, and Denver Regional Council of Governaents. Purpose for the caucus was to consider the viability of developing a regional governaent 111de up of officials frOII within the Denver Metro Region, in order to address regional issues which cross jurisdictional boundaries. It was felt by 111ny that a regional group would pr0110te regional consensus on aulti-jur1sd1ct1onal issues. The purpose ts not to replace local governaents, but rather to facilitate regional solutions to regional issues shared by all, i.e., The environment -air pollution, water pollution, solid waste 111nag ... nt Transportation Econ011ic developaent Strategic planning on land use Revenue sharing -it was pointed out that SOiie regional revenue sharing ts currently on-going -cultural tax, baseball tax, RTD tax. Although a rather small city , measured by residential population, Englewood is currently perceived as a aajor player in the future development of regional cooperation. We need to continue to build and pr0110te our needs, in this position of strength if further discussions on regional ism are to be developed with Engle- wood's interest in hand. Regional governance may become a reality if tax limitation initiatives becOllle law. Regional delivery of services may be the only alternative left with the future passage of an Amendment 1. (b) Council Mellber's Choice (1) Council Metlber Hathaway advised Council that the Denver Regional Council of Governments Policy and Procedures Review C01111tttee, of which she ts a llellber, wtll be .. eting Wednesday, January 9th. (b) She also provided copies of page Zand 3 of the January 7th Issue of Bond Bu1er concerning the pre -sale of the Bi -City bonds as It relates to the Colora o Water Resources and Power Development Authority and the rat Ing placed upon those bonds . (c) With regard to the bond sale, she lnforaed Council that the pre - sale occurred Friday , January 4, and it appears that all bond s will be sold on the actual issuance date, January 18 . The 011 landfill is among the most notorious Superfund sites in the country and is widely known as a case study of the environmental problems so-called "municipal" landfills can cause. Cases like this one could spread rapidly throughout the country and shift billions of dollars in costs from corporate generators of hazardous waste to general taxpayers through their local governments. ,. - In fact, there has recently been a dramatic increase in these kinds of cases. In Connecticut. 22 cities and towns have been sued for approximately SO percent of cleanup costs at two landfills where preliminary studies estimate costs of $70 million. At another site, the city of Woodstock. Illinois. which has an annual budaet of under $13 million. could be liable for over $12 million for site investiaation and study costs alone. In October 1990. a number of larae companies in Utica, New York. sued 500 local businesses and several municipalities to contribute to the cleanup costs at the Ludlow landfill. Even if your local aovemment is not faced with Superfund liability today, the odds are that you will have to face it tomorrow. Corporate plaintiffs in these contribution actions include some of the nation's most powerful and politically sophisticated corporations. Meanwhile, most local 1ovemments involved with such sites are unaware of the potential threat and relatively uninterested in the operation of the Superfund proaram. Superfund's funding and liability provisions apply to all "releases or threatened releases· of a "hazardous substance· from a "facility" into the "environment." The law is aenerous, even extravagant, in its definitions of those terms. A "release" is any method of introducing a hazardous substance into the environment A "hazardous substance" is any one of some 700 toxic substances that are ubiquitous in products manufactured and used by consumen and industry. A "facility" is anywhere that the hazardous substance ends up .m .'5llld .md Jm u a result of a releue .m .1 threatened releue. And the law's vision of the ·environment· it will protect is all of the ambient air, the land (surface and subsurface), and the water found within the borden of the United States. In summary, Superfund coven virtually any contamination of the natural environment unless it results from activities subject to and explicitly countenanced under a federal permit. Superfund "sites" can include anythina from a traditional landfill to an abandoned mine shaft, and even an entire aquifer under a small Minnaota town and under the San Gabriel Valley in CalifomiL This aspect or the statute aiv• enormous authority and discretion to the state and federal agencies that implement it and is one reuon why prospective defendants at potential sites find it so intimidatina. The oriainal Superfund law explicitly included local governments in its definition or ·persons· potentially subject to its stringent liability scheme.
