The 1991 estimated replacement value of these i11provements exceeds $20 million. In 1983 Council requested staff to develop an organized progr111 to COlll)lete construction or reconstruction of all l'etllining streets in our systea. A ten-year plan was presented and approved at that tiae. This year's prograa is year five of the ten-year plan. New to this year's program is the inclusion of proposed Concrete Replaceaent District 1991. Ordinance No. 31 of 1962, encOllpassed legislation that aade the aaintenance of curb, gutter and sidewalk on city right-of-way the responsibility of adjacent property owners. Mr. Kahm stated that the general condition of concrete within the connunity has been on a steady decline for aany years; of approxiaately 10,000 properties within the City, over 4,000 deaonstrate at least soae adjacent concrete in a serious state of disrepair. Since aandatory concrete repairs under existing ordinances can create liens, generally payable within one year, inclusion of needed repairs in an improvement district, such as this proposed sidewalk district, with an optional ten-year payment period should aake COlll)liance aore palatable. Provisions have been aade for citizens to volunteer for the inclusion of their deficient concrete which will reduce the need for the City to include thea in future aandatory replacement prograas. He explained the District is divided into three zones, Zone 1 is Paving District No. 34 wh~ch consists of the street and alley reconstruction; Zone 2 is the Concrete Replaceaent portion of the District, both aandatory and voluntary; and Zone 3 is the developer portion of the project. He discussed the cost breakdown for each zone. Mr. Kaha discussed cost and assessment information, timetable and .. thod of payment. The Special Assessaent Deferral Prograa was explained. Mr. Kah• explained that because of the funding available on this project, returns which are in good condition would not be replaced just for the sake of installing a handicapped facility. Council Mellber Clayton mentioned he had noticed a nulllber of deteriorated gutters and suggested as an alternative to replacing the entire curb and gutter soae type of •asphaltic sealant• or soae other way of paving over the gutters. Mr. Kaha noted that over the years there has been a reluctance to put asphalt in gutters, as the two products do not go together. He stated it is hard to keep asphalt down on concrete, particularly llfhere it would be continuously exposed to water. Council Mellber Clayton asked Mr. Kaha to describe tn detail the real probl• with deteriorated gutters. Mr. Kaha stated the concern ts as it deteriorates it drops below the asphalt level and in aost residential streets there are only two inches of asphalt. The seal llfhich keeps aoisture out froa under the base and sub-grade of the street 1s under the two inches of asphalt. Mr. Kaha addressed the probl•s encountered with concrete deteriorating. He stated the City has done everything possible froa a quality control standpoint; further that contractors are required to give a two-year guarantee. Council Nlllber IUggins asked if hoaeowners would be held responsible, if in the course of taking a cut to replace a vertical curb, they damage the sidewalk adjacent to the vertical cut. Mr. Kala CGllfiraed they would be held responsible for their negl tgence. Ray Creighton, Engineering Construction Inspector, responded to his question. Mary Trouth, 3868 South Delaware, asked if the crown would be taken out of the street and the utilities lowered. Mr. Kahm stated the intent would be to put in a standard crown, which is considerably lower than what they have now. He advised her that current information indicates the utilities should not be a problem. Ms. Trouth questioned whether her neighbor would be required to remove his trees at the corner of 3800 South Delaware and Lehigh. Mr. Kahm cited the City's policy on trees, which is every attempt is aade to save the trees. However, there is a tree replaceaent prograa in the paving district. If the owner desires to have the trees reaoved, the City will pay for reaoval and replace thea withal 1/2" to 2" tree. Nr. Kahll stated it is generally the owner's choice. She asked if hOlltOlfflers would bt required to obtain a perait to reaove the concrete. Mr. Kahll answered that if they do their Olffl work or hire a licensed bonded contractor a perait 1s needed froa the Engineering Division. Nr. Kah• confiraed that curbs have to bt replaced with new concrete. Council Mellber Hathaway clarified for the citizens that the cost of relocating utilities is borne by the City. Mr. Kahm advised that the Utilities Depart111ent is extending an eight-inch water main from Dartmouth, almost the length of Platte River Drive, to connect with an existing eight-inch Main the Roy's put in several years ago. Council Member Habenicht asked if deferrals were available to the owners of industrial or c011111ercial property. Mr. Kahll explained that there are incoae and asset guidelines. Council Mellber Clayton wondered, given the probleas with Platte River Drive, i.e., state i111prove11ents, additional utilities, if it is prudent to include this area in the paving district. Nr. Kahll stated efforts have been coordinated with Utilities and the State Highway Department for aany aonths, and starting in aid-August would give adequate tiae. Tie in existing driveways as necessary. Tom Sarton, resident aanarer of Villa Parada Ap1rt111ents, 3655 South Delaware, stated they have paid paring in the back. He wanted to know if the City will cut or tie into their parking lot when the alley is paved. Nr. Kaha recalled the entire length was paved, and a perfect aatch is not always possible, but they will do what they can to match the design. Deputy City Clerk Ellis noted a letter of protest had been received froa Jack Karford, owner of property at 450 West Jefferson. The letter was entered"""Tnto the record. ZONE 2 (CONCRETE REPLACEMENT DISTRICT NO. 1991, AND VOLUNTEER CONCRETE) Deputy Ctty Clerk Ellis stated a petttton had been ftled wtth the Ctty Clerk containing 109 signatures, representing 83 properties in various sections of Zone 2, protesting the Concrete Replaceaent Dtstrtct No. 1991. The petition circulator, Jeanne NcWtlltaas, caae forward and stated she was appearing on behalf of her aothir, lliho owns property at 3795 South Grant Street. Ns. NcWilltaas and her aother circulated the petttton. She stated that no one she talked to objected to replacing truly daaagect concrete, but they are concerned wtth the way tt ts urked. She ctted several inconsistencies in the urked concrete. Ns. Nc:Wtlliaas eaphasized they are very concerned that the hOll90lllller ts held entirely responsible for the cost. She discussed a survey she had conducted among other ctties regarding payaent procedures and she noted Englewood ts the only Ctty, as far as she could tell, that assesses the hoalowner lOOI. She had provided Council wtth coptes of her survey. She stated that with the help of Ctty of Englewood staff tt had been deterained, based on the assessed net value of property tu revenue, in order for Englewood to ratse SZ00,000 the tu levy would have to be increased by .8 •ills. Ms. NcWilltaas understood the concrete was recyclable, but questioned the iapact on the enviroment. Discussion ensued. Council Member Hathaway reminded the citizens of the S~ discount that will be offered for prepa,Y1118nt. Council Mellber Koltay thanked Ms. McWilliaas for her efforts. Council Member Wiggins stated he appreciated Ms. McWilliaas efforts. He coanented that he had walked the district and noticed that several houses, where people had signed the petition, had no aarkings. Ns. McWilli .. s responded to Council Metlber Wiggins. Mayor Van Dyke assured Ms. McWilli .. s that her concerns would be addressed. She noted it was clear there is soae concrete that needs to be done and there is concern with equity and consistency. Mr. Kahal's staff is willing to work with each citizen individually. Discussion ensued between Council Metlber Hathaway and Mr. Kahal retarcllng the history of concrete replac ... nt in Englewood. James Naron, Pastor of En~lewood First Assellbly of God, 4101 South Lincoln, expressed concern about t equality of work, and he specifically requested thicker concrete be installed because of the parking lots on both sides of the building. He confiraed he realized there would be increased costs. He inquired about having another entrance into the church parking lot on the Oxford side. Mr. Kah• agreed to aeet with Mr. Naron in the field to ascertain exactly what the church wanted. Mr. Naron inquired if owners of trucks which daaage concrete are ever held responsible for the damage; Mr. Kata advised that when the incident is reported and can be verified, soae success in collecting daaages has been experienced. Kenneth Koel, 4001 South Pennsylvania, with property at 3903 South Grant Street, stated he is disturbe«rby the •gross •isaanagement• of the project. Re'""winted Council to know that he did not intend to pay the over-inflated prices. He inquired about where the extra 110ney goes, cOlllenting that the bids he has seen are 15 to 30 percent lower than the City's estiaated cost. He asked why he was not inforaed of the District earlier, and he wondered why he had to find out for hi•self that there was an approved list of licensed contractors. In his opinion that list should have been included in the original .. iling. He feels that the citizens should not have to pay for these repairs, since other citizens in other cities (i.e, Denver, Littleton and others) do not. He spoke about the inconsistencies tn .. rktng the concrete, stating he has seen concrete wiich deftnttely needs to be replaced unaarked. We asked wiat the standard is, and coaented that the project seas out of control. He does not want to see concrete replaced every ten years and expressed concem about the quality of concrete installed by a •1ow bidder.• He does not object to replacing bad concrete, but does object to the unner in wiich he was advised, stating he should have been given •fair waming. • In suaary, he proposed leaving the concrete .. ruc1 as it is, giving the people more ti• to do the work on their own; the June 7th deadline is too short, and the only option s ... s to be to let the City do it at thetr inflated rates. Council Nellber Hathaway clartfted, and Nr. Kallll concurred, that tt would be possible to vet an extension on the June 7th peratt dNdltN and the June 21st coapletton deadline. Additionally, that the costs quoted by Nr. However, he offered that a mini11Um of 12-IIOnths notice should be given for a project of this nature. He also stated that Mr. Kaha could coae out and see for himself that there is nothing wrong with the concrete at his hoae. Deputy City Clerk Ellis advised that no protest letters had been received from this area; however, 11 people froa this area signed the petition circulated by Ms. McWi 11 iaas. 8. 3700-4200 South Washington Street Bill Broast, 3908 South Washi:yton, stated he is very concerned about the cost of replacing the 90 1 of concre e along Mansfield and Washington. He explained that in 1985 Mansfield had been resurfaced; tn 1987 Washington was included in Paving District No. 33, and both of these projects have added to his taxes. With the concrete replac ... nt, his taxes possibly could go up another $400. He does not feel the entire 90' needs replac ... nt. He stated he understands that if the curb and gutter are deteriorated, the road aay be destroyed. Mr. Kahll atteapted to respond; however, Mr. Broast continued by stating how bad York and Eastaan is and that the residents along Eastaan want repairs done. Tlle curb is smooth, not cracked and poses no hazard to pedestrians. ~'hile SOiie of the autter surface is rouahened, ~ater from rain and ~•ltina snow does not collect in these areas. In addition, due to the new parkina restrictions requirina a spec1a~ parkina .permit, further ~ear on the ,utter should be minimal. -Second It 18 ti• the City of Enalevood became more enviroru:ientally a~are. The lara• amount of broken cement resultina from this project will add an unnecessary burden to an already overflovina land fill. Also the exhaust from the ciachinery will contribute to the city's air pollution problem. -11iird I am a ~idov livina on a fixed income. An expen .. of this sort is a severe strain on my budaet.
