The special meeting of the Englewood City Council was called to order by Ma yor
Van Dyke at 7:27 p.m. The invocation was given by Council Member Wiggins.
The Pledge of Allegiance was led by Mayor Van Dyke. Roll was called .

Ms. Ragland stated that 308 property owners were advised of this Public
Hearing by registered mail; 299 were received; seven letters were unclaimed ;
and two were undeliverable. In addition the Englewood Sentinel published
notice of this Public Hearing three consecutive weeks as required; proof of
publication was entered into the record. Ms. Ragland stated the final reading
of the ordinance assessing costs will be considered on Monday, July 2, 1990,
and if approved the ordinance will go into effect Friday, August 3, 1990. The
5% discount for payment of assessments prior to August 3, 1990 was explained .
She noted there is a Deferral Assessment Program which is available to qualified citizens.
Office Engineer Kahm, also the Project Engineer for Paving District No . 33,
advised Council there will be an amendment to the Council Bill to be
considered on Monday, June 18, 1990 . Mr. Kahm stated property owned by the
Englewood Housing Authority had been assessed, and they had just been advi sed
that according to State Statute the Housing Authority property is exempt from
assessments for paving districts . Mr . Kahm discussed the discovery of
hazardous material on West Wesley ; the City is working with the State Health
Department on the clean-up. He explained in detail the computation of
assessments for the various work done within the District and prov i ded the
breakdown of unit prices in the project . Mr . Kahm explained the various
methods of payment . He Introduced Royce S.ith, a local Real Estate Broker and
Appraiser , and noted Mr. Royce would be addressing the specific benefits of
the completed paving district for the property owners .
Royce Smith stated he has been In real estate 22 years and involved in seven
of the City of Englewood paving districts . He has inspected the propertie s
prior to the paving district and after to deten.fne if there has been a
significant i~rov ... nt In property valu . He noted he Is considered an
expert appraiser In every County Court In the State and has served as an Urban
Renewal Authority Co..issioner . Mr . S.fth stated that real estate appraisal s
are increased 3S to 71 If the street, sidewalks, and alleys are fn good condf lion.

obtain an application, and Janet Grimmett, Housing Authority, would assist her
in filling out the form. Ms. Ragland noted the deadline to submit the application is September 4, 1990.
Robert L. Mestas, 3371 South Clay Street, stated he owned the property at West
Hillside and Zuni (the corner lot). There is no address as it is a vacant
lot. Hr. Mestas questioned the amount of the assessment as there is no house
on the lot. City Engineer Ragland explained that the assessment was based on
lot size. The Mayor offered to have the Department of Public Works do a
recalculation of the assessment. Mr. Mestas was agreeable to that. Discussion ensued.
Lawrence A. Blazer, Blazer Auto, 3718 South Broadway, questioned why he was
paying for paving on East Kenyon. Office Engineer Kahm advised Mr . Blazer
that he had 100 foot of frontage . Discussion ensued. Mr . Blazer requested a
recalculation of his assess~nt. Mr . Kah~ agreed to verify the figures.
Council MeMber Habenicht asked that the Department of Public Works follow -up
on the concern expressed at a previous City Council Meeting fro. Gary Koza cek on behalf of Mr . Binetti.
The following letters were identified as having been received in protest to the assessments:
1. Letter fro. D. Will ia~s. 3766 South Bannock (street i~rove.ents
In the 3700 block of South Bannock Street).
2. Letter fro. Patricia Rich, 2561 East Floyd Avenue (street ~~~ove.ents In the 1800 block of West Wesley).
The letters were ~eceived into the official record of the Public Hearing.
Mayor Van Dyke asked if there were any other persons present who wished to
address Council regarding the assess .. nts under Paving District No. 33. No one c ... fo~ard .
Council "'-btr Habenicht asked when the original estt .. tes were aade and wh n
the property owners re apprised of the cost. Office Engineer Ka stated
the original construction estt .. tlng was done in the late s r of 1988 and
th property ers re notified In th early fall of 1988 .

I would like to protest the assessment against property owned
by me located at 2401 South Raritan , Englewood, Colorado and
whose legal description is : That part of N ! of SW t of NE t
of SW t of SEC 28-4-68 Fly known as Lots 25-28 Blk 67 Breenlow
Park Now Vac x ~s 28-4-68 , for the following reasons :

In January 1990 my husband suffered a heart attack and
subseq uently had a fi v e artery bypass operation at Veterans
Hospital . He is unable to work and this has placed a severe
financial burden on us . We ar unable to pay the additional
assessment . To verify this information you may contact Dr .
Fullerton or Dr. Kreiger at 393-2826 .
Because of financial problems I attempted to get a loan on the
property in January 1990 from Bank Western . The Bank informed
~ that even though I presently owe nothing against the property ,
it was not possible to loan money on it b cause the rough cinder
block building was not consid red to be a property improv m nt.

th building is exceasiv • I was also informed that all
ca.mercial property in Colorado has lost 20' oC it's valu sine
th time I purchased the property .
In addition I would like to at t that the te•porary building
on th property is the only building fronting on th 1800 block

AI 2 . The property owner who occupies the eligible residence property is a low
income person with assets and inc ome less than the eligibility limits established
for those persons and establ ished period ically by the City Council.
The asset and year ly inc ome eligibil ity amounts shall be set periodically
(preferably yearly ) by the City Coun cil upon the recommenoation of the
Director of Finance, who shall consider as adv1sory the inc ome level and asset
level of fifty percent (50 °o) of the med ian inc:>m e leve l of persons in the
metropolitan area .
B. Property Elig ib le for Assessment Deferment . Property elig 1ble for assessment
deferment is that which the owner occupies as his residence at the t 1me of
application . If the owner ceases to occupy the property as h1s res 1d ence , he
shall notify the City and the assessment shall become due and ONmg and be
collectible as other assessments .

If a property owner has previously received an assessment deferment under
this Chapter , he may re:eive an assessment deferment upon pr operty
subsequently occupied as h1s res idence onl upon show1ng that the prev1ous
deferment has been fully pa id or has become due and owing to the C1t and 1s
being collected in the manner for collection of assessments .

Finance shall pay to the assessment district from a special fund of the City the amount
of the deferred assessment. He shall then note on the assessment roll that such
assessment has been deferred . and the assessment shall not be payable until the
deferment expires as provided in thrs Chap er rQrd 41 Series 19811
