Mr. Fonda explained passage of the ordinance st111ply acknowledges the agreement South Arapahoe Sanitation has for trans•ission of wastewater through their own lines for treatment at the Bi-City Wastewater Treat•nt Plant. Mr. Fonda assured Council that the City will not incur ltabtltty through thts action. The Ctty Clerk was asked to read Council Bill No. 38, entitled: COUNCIL BILL NO. 38, INTROOUCED BY COUNCIL MEMBER HABENICHT A BILL FOR AN ORDINANCE AMENDING THE WASTE WATER TRANSMISSION AGREEMENT BETWEEN SOUTH ARAPAHOE SANITATION DISTRICT, THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF ARAPAHOE, THE CITY OF ENGLEWOOD AND WASTE MANAGEMENT OF COLORADO, INC. Nr. Fonda stated that the Ctty ts interested in ob- tainint 600 acre feet of storage in Bear Creek Reservoir. The cost for the storate space wtll be based on the construction costs of the reservoir and the costs needed to •itigate recreational uses tf the extsttng ,.,.....t storage pool ts increased for auntcipal supply. Mayor Van Dyke asked about additional benefits of having the extra storage space in Bear Creek. Mr. Fonda explained that this would increase our water storage capacity and could provide protection against drought; additionally, releases could be •ade in the winter time to the treatment plant which •ight help the quality of water during the winter 110nths. Mr. Fonda explained the line has been surveyed by television and is cracked and broken along its entire length with intrusion of tree roots, etc., con- strict int the s ... r flow and causint s ... r backups. Due to its location, this section of s ... r line would be taposstble to replace or repair by .. ans other than the Insttufora process which fonas a solid, water tight replacta1t1t for the s ... r pipe within the current sewer line. General Discussion (a) Mayor's Choice Mayor Van Dyke did not have any aatters to bring before Council. (b) Council Mellber's Choice (i) Council Mellber Habenicht expressed appreciation to those in- volved in the Tuileries Festival, especially for the participation of Council Mellber Hathaway, City Manager Fraser, and Sentinel Editor Munds. She also encouraged attendance at the su1111er recreation program -Fiddler on the Roof, CO!laenting upon the fine perforaances offered by both casts. 13. City llanager's Report (a) City Manager Fraser offered the following as an interi• budget report: •ouring the past several weeks, City staff has been working on the preparation of 1991 budget recoaendations for ay consideration. Because of the 95S guidelines they have been utilizing for their work, considerable speculation and concern has been expressed by IINbers of the coaunity and the City eaployees. I would like, therefore, to coaent, briefly, on the process of preparing the 1991 budget. •we have discussed with the Council on several occasions all our forecasts for City revenues and the fact that City revenues have not been growing. During the aost recent of those discussions, this spring, it was again clear that Council was not in favor of tax increases. Therefore, in late Nay when we issued the gutde- lines for next year's budget preparations, there was no cause to project increasing revenues. On the expenditure side, increases in overall costs were expected in the vicinity of four to six percent. The general dileaa was, thus, fairly clear: without a revenue increase, the cost to do the s-things in 1991 that we are doing today would probably exceed our budget by four to six percent. To accoap 1 hh the Charter requ i reaent of a balanced budget without a revenue increase we would need a siailar four to six percent de- crease in spending. Consequently, we asked each City departant to tell us, in their budQet subaittals, what expenditures would have to go away to have a 1991 budget which was only tss of the current, 1990 budget. I will certainly try to ainiaize the negative iapacts of changes in service that have been outlined in soae budget reco...ndations. There have also been aany sugges- tions for new and better ways of providing city services which hap- pen to cost less 110My. We will surely iapl .. nt those where we can. There have been soae proposals to do away with progrus which s ... no lo114Jer to be cost Justified, which aay be out of date, or which serve only a few people. Soae of those rec0111endations will probably also be contained in IIY budget, although I cannot say, tonight, which those aay be. Where appropriate, suggestions will be included in the budget for revenue alternatives which Council aight consider to fund prograas which would otherwise be discontinued. ·The budget process 1s the aeans we use to set our direction for the future. Those citizens who are interested in particular pro- grus and services will naturally want to ainiaize the negative effects of that change which reduced budgets can brilMJ. None- theless, the pressure to contain expenditures has not yet been relieved. Non-scheduled Visitors (a) Ken Haraldsen, 3018 South Washington Street, expressed concern regarding the proposed stadium tax issue. He connented that Denver is being discriminatory by per11ttting only citizens of Denver to work at the new air- port. Regarding the Quincy Fire Station, Mr. Haraldsen said it should be pre- served as a part of Englewood's heritage and not sold or destroyed for a park. Discussion ensued. (b) Sharon Fritz, 4861 South Cherokee Street, expressed strong support for installation of warning sirens [Agenda Item 12(b)(i)J. (c) Allan Fritz, 4861 South Cherokee Street, concurred with his wife's coaents. INTERGOVERNMENTAL AGREEMENT CONCERNING INTERCITY CLAIMS FOR RECOVERY THIS AGREE~ENT is entered into by and between the Colorado municipalities listed on Exhibit "A". All parties will be referred to together as "Cities." WHEREAS, Article XX of the Colorado Constitution grants plenary power to home rule cities to levy and collect taxes within their respective City limits: and WHEREAS, each City administers and collects these taxes pursuant to provisions independently established by their governing bodies: and WHEREAS, because of discrepancies between post of!ice addresses and actual City boundaries and the delivery o! goods from one City into another, there are instances where aales and use tax is erroneously remitted to the wrong taxing jurisdiction. In most of these situations, the purchaser has, in good faith, paid tax to the vendor and the vendor has, in good faith, re~itted such tax to a taxing authorit:: and WHEREAS, tha Cities are in agreement that, in order to prevent the undue burdening of businesses, re~edies should=• available to allow for "corrective payments" to be made between Cities so that each jurisdiction may recover tr.e t ax rightfully due to them: and WIIL:lll!/\S, the Cit.ics .ira ouc ho ri:ccl to make t:hc most efficient and e f!ect ive use of their powers and reaponsibilit ies by cooperating and contracting with each other to provide a lawfully authorized function or service pursuant to Article XIV, section 18, of the Colorado Constitution and Part 2 of Article 1 of Title 29, C.R.S. When it is determined by the Director of Finance or other proper authority of one of the Cities that sales and use tax has been reported and paid to the wrong City, the following provisions shall apply: A. The Assessing City shall notify the vendor that taxes are being improperly collected and remitted, and that as of the date of the notice the vendor must cease impro?er tax collections and remittances. The Assessing City shall determine that the tax and/or penalty and interest ~as, in fact, remitted to the wrong City, and may make a written Claim for Recovery directly to that City, or, in the alternative, may institute procedures for collection of the tax from the taxpayer or vendor. The decision to ma~e a Claim for a Recovery lies in the sole discretion of the Assess i ng City, and this Agreement shall not affect the authority of the tax?ayer or vendor to make a Claim for Recovery. lf the Claimant is the Assessing City, the Claim for Recovery shall include a properly executed release of claim from the taxpayer and/or vendor releasing its claim to the taxes paid to the wrong City, and evidence to substantiate the Claia. Within ninety (90) days after receipt of a Clai• for Recovery, the City receiving the Clai• shell verify to its satisfaction whether or not ell or• portion of the tax claimed was iaproperly received, and shell notify the Clai .. nt in writing that the Claim is either approved or denied in whole or in pert, incl u d ing the reasons for the decision. If the Cle i • is approved in whole or in part, t h e City rec eiving the Clai• shall reait the undisputed aaount to the Clai11ant within thirty (30 ) days of approval. The period subject to a Claim for Refund shall be limited to the thirty-six (36) month period prior to the data the City that was wrongly paid the tax receives the Claim for Recovery: F. The City receiving a Claim for Recovery may request an extension of time to investigate the Claim for good cause, and approval of the extension by the Assessing City shall not be unreasonably withheld. 3. Intent. The intent of this Agreement is to streamline and standardize procedures related to situations where tax has beJn remitted to the incorrect City. !tis not intended to reduce or eliminate the responsibil~~~es of the taxpayer or vendor to correctly pay, collect. and remit taxes in accordance with the provisions of the applica~le City. This Agreement is intended to describe rights and respons ibilities only as bat~••n the named parties hereto. It is not intended to and shall not be deemed to confer rights to any persons or entities not named as parties hereto. 4. Term. This Agreement shall remain in effect as to each respective City until euch City decides to no longer be e party to this Agree .. nt and tenainatee its obligations hereunder by giving ninety (90) days advance written notice to each of the other parties. 5. Remedies for Default. This may be accomplished by the addition of the City to the list on Exhibit "A" and by the execution of a signature page. The amended Exhibit "A" and copies of the signature page shall be sent to all parties. The addition of an additional party shall not be considered a modification of the Agreement so long as no other terms or conditions have been changed.
