Ch'clinances, Resolutions and Motions (a) Director Winkle presented a rec011111endatton from the Parks and Recreation C011111ssion to adopt a b111 for an ordinance revising the Youth Mem- ber's teras of office. She explained the 110tivatton behind the recommendation ts to support recruit111ent of a wider range of applicants who might be inter- ested in serving as Youth Mellbers on the C01111ission. Discussion ensued con- cerning recruttaent and appointaent of Youth Mellbers. It was explained that rec:ruttaent and appointaent would take place prior to June 1st. The Youth lllllbers appointed would be uking a coaitaent for one year coaencing with the appointaent. Mayor Van Dyke explained that all entities in- volved in fon11tion of the Plan are seeking 1ffin11tion and support from their governing boards relative to the Plan as presented. Mr. Fonda responded to questions con- cerning the prospects of obtaining loan 110nies frOII the Water Pollution Con- trol Revolving Fund. The possible proble11s the City aay experience with arbi- trage were discussed. Mr. Fonda will be seeking an opinion frOII the City At- torney on this ••tter. This revision would accommodate construction and operation of a go-kart facility on the site previously designated for expansion of the miniature golf course. Recommendation from the Bi-City Supervisory Committee to adopt a t resolution terminating the lease of the radio station located at Bi-City .. n L The proposed expansion of the Plant necessitates that the space {f,.J currently occupied by the radio station be vacated in order to begin construction. Recommendation from the Bi-City Supervisory Committee to approve a motion awarding the contract for construction management to Brown & Caldwell Consultants and authorizing Stewart Fonda to sign the contract. Bi-City's Long Range Master Plan identifies the need for rehabilitation and expansion at ttw facility, and this propoeed contract would satisfy the requirements of the first phase of construction. Mr. Wag- goner stated the .. jority of the work in the Project relates to deteriorated work done by Colorado Seal and Stripe, Inc., during the 1986 paving district and that Colorado Seal and Stripe had refused to •ake the necessary repairs. The low bid was offered by EI J Concrete, Inc., in the aaount of $38,051.16. It is understood and ac~n o~ledged that the O?erator ~as obtained financing from National Bank of Arapahoe/?arker in t h e form of an SBA guaranteed loan in an ~~cunt not to exceed $150,000. It is agreed that this agreement, together with equipment and improvements being constructed by the O?erator, is assignable to a National Bank as collateral for a loan or line of credit. Such assignment to the Bank/SBA is conditioned upon the City having a right of first refusal to approve successor Operator appointed by the 3ank/S3A. If the City refuses a pro?osed successor operator other than for cause, City will cash out the loan. 16. ~aterial.Breacb. The parties agree that the hap?ening of any of tr.e foll owin g events shall constitute a material breach of this agreement and City may, at its election, terminate the agreement upon the happening of any of the following e ve r.ts: a. Operator shall fail to maintain a nd o~er at e th e concession according to the terms of this agr ee~en t. b. 0-?erator shall fail to pay the City th e fees provided in paragraphs 4 or 5, whichever is applicable, wit h in thirty (30) days of date when they are due. c. Upon termination of this agreement by the city upon a material breach, the City shall have the option for thirty (30) days :oll owing such termination to ~urchase Operator's leasehold improvements, fixtures, signs, equipment and other property for a su:n equal to the fair market value less all monies due to the City under this Agreement. Fair market value shall be determined by t~o appraisers, one appraiser selected by the City and one appraiser selected by the Operator. If these two appraisers fail to agree on fair market value, then the two appraisers shall select a third appraiser who shall determine fair market value of the property. If the City refuses to purchase the improvements then the Operator shall have thirty (30) days to remove the fixtures and equipment. The City may withhold sufficient fixtures and ?roperty in order to pay all monies due to the City under this Agreement. Any su~ to be paid shall be offset by any paymer.t to third ?arties. l9. Trade . Same. The trade name o! RIVERSIDE MI~IATURE GOLF CLU3 shall remain at all times the property of Operator unless purchased by City. 20. Termi~atioc .by.O~erator. This Agreement may be terminated by Operator upon sixty (60) days' written notice to the City. The recoimiendations have, in 111ny cases, begun to be realized as the Plan was developed. The broad base of support, combined with the coordination a110ng groups having a stake in the outcoae has assured successful results and a sense of shared purpose. BACKGROUND The Englewood Econoaic Developaent Coalition was fol"lltd in the Fall of 1989. Prior to this, the Englewood Dolffltown Task Force had been the group which had focused on i111proving c01111Unication aaong the various groups active in the down town Englewood area. The Coalition was given an expanded aission and member- ship to include all of Englewood, both retail and aanufacturing, and increased citizen participation. A list of aeabers of the Coalition ts contained in Appendix A. The Coalition began meeting in September, and by Novtllber an Econoaic Develop- mtnt Coordinator was hired by the City. Part of the Coordinator's Job was to staff the Coalition and assist In facilitating the writing of a Strategic Plan for Economic Dtvelopaent. The process of strategic planning includes specific steps. Those steps which the Coalition adopted included: 1) Identify objectives or issues. The fountain area hosts c011111Unity events including concerts and is a focal point for connunity pride. In the aid-1980's, an area south of Haapden was added when developers showed an interest in redevelopaent of a greenhouse area for a retail area which 1s now anchored by HOiie Club and Buyer's Club. The final results are impressive, and the City has received several recogni- tion awards for the design excellence of the Little Dry Creek Flood Control project and c01111unity plaza. The revitalized retail areas have varying degrees of success in teras of vacancy rates, however the sales taxes generated in the urban renewal area have tripled. These vacancies t.re not appreciably higher than the Metro Area as a whole, which has experienced a cOllbination of over-building and recession in the last four years. The entire effort was critical to the ccauntty tn retaining and regaining its urket share as new aarltet areas have developed further south. A taxing district for joint urketing and business networking, the Englewood Downtown Developaent Authority, was foraed in 1979 and has cOllbined the ef- forts of the Broadway businesses and the Cinderella City Nall. With an annual budget of just over $200,000, the Authority ts tn aany ways serving the saae purposes as the business iaproveMnt district recently created by the state legislature. South Broadway would benefit froa an effort to induce contt- nutty tn an area of sign pollution and a crowded appearance. National retail trends indicate aore entertatraent-related business, specialty stores doing better than departaent stores and aore sophhttcated shoppers. Dellographtcs suggest aore aarkettng directed to senior buyers as baby booaers age. Englewood's diverse econoatc base should continue; however, there ts a trend toward tndustrtes aovint to the south as they expand where land ts cheaper, and other incentives aay be available. The Economic Development Coalition dealt with two 11ajor areas in discussing the future implementation of econOt11ic develop111ent measures in Englewood: 1) The future role of the City, its businesses and existing organizations; 2) The future role of the Englewood Econ011ic Developaent Coalition. The City of Englewood has a role in econ011ic developaent which crosses departaental boundaries --that of creating an environment in which businesses can prosper. The aajor respons i b11 i ty of the govenaent, as seen by the Coalition, was to ensure that penait processes and the red tape of dealing with the City were not burdensOlle or unreasonable. The need for a service ortentatton on the part of City eeiployees was frequently brought up. A second responsibility of the City was that of providing infrastructure --businesses need the public sector to aaintain and upgrade the transportation and utility infrastructure in order to have the c01111Unity reaain COIIPttitive in a business sense. The City has adopted a aore proactive role by establishing an Econoaic Developaent coordinator position. The four uin short-tena objectives included: 1) Maintaining an inventory of sites for business locations and responding to inquiries. The Coalition should continue to aeet quarterly to address the i•- pleaentation and reporting step of the strategic plan process. Additionally, the Coalition found several areas where the action role was not currently clear in tel"lls of responsibility. In each area, a subc01111ittee or task force could easily respond to and iinpleaent the next step or phase, be it further evaluation and recoaendations, or i11pl .. ntation. These areas also provide the opportunity of drawing upon existing cOIIIIUnity resources. Other players include the banks, Englewood Public Schools, Arapahoe C01111Unity College, and local clubs and or,ianizations. Each has an opportunity as a par- ticipant in boostering the c01111Unity. Two partnership roles identified by the Econoaic Developaent Coalition were financing and training. Financing of loans for local businesses was defined as an econoaic developaent strategy, of particular i11port1nce to the s .. 11 and 118di1111 sized business with less access to capital and less ability to qualify. Prepare a draft Plan of Operation in accordance with Colorado Department of I lcalth (CDH) requirements. The Owner shall develop. in consultation with Engineer, key information required to maintain critical operations and meet dis charge permit requirements during construction and startup of ne w fa c ilities . The Owner will review and suhmit the draft Plan of Operation to CDH for approval. 4.104 Contract Documents. Print 100 reduced sets of contract documents and distribute contract documents to prospective bidders and project review offices. 4.105 Questions During Bid Period. Receive and respond to questions from bidders concerning clarifications to drawings and specifications. 4.106 Prebid Conference. A."sist Owner to schedule and conduct a prehid conference. At prebid conference, provide a tour of the site to prospective bidders. Identify and clarify bidder's questions and answer them by addendum. 4.107 Prepare Addenda. Prepare up to four addenda for revisions to the drawings and specifications for issue prior to hid date.
