HomeMy WebLinkAbout2026 Resolution No. 006RESOLUTION NO. 6 SERIES OF 2026 A RESOLUTION URGING IMPLEMENTATION OF BEST PRACTICES AND A REFLECTION OF COMMUNITY VALUES BY ALL LAW ENFORCEMENT AGENCIES THAT MAY ACT WITHIN THIS JURISDICTION WHEREAS, the Englewood City Council has the utmost respect for our local law enforcement officers and staff, which have worked diligently to impose accountability and implement best practices to establish and maintain community trust; and WHEREAS, the Englewood Police Department functions with a high level of professionalism and honor while performing duties in the City of Englewood; and WHEREAS, the Englewood City Council affirms its commitment to public safety policies rooted in investments in violence prevention, de-escalation, education, economic opportunity, mental health support, accountability, constitutionally-compliant policing and respect for civil and human rights for all, as taught to and utilized by peace officers within Englewood Police Department; and WHEREAS, any failure of agencies that enforce laws—local, state and federal—to follow such public safety policies erodes community trust and impairs the effectiveness and credibility of unrelated departments, like our own Englewood Police Department; and WHEREAS, to establish accountability in law enforcement, pursuant to City policy and operational requirements, outside of undercover or surveillance operations, Englewood officers do not intentionally disguise or conceal their identities when taking official action in public; and WHEREAS, Englewood officers wear body cameras to document all official action in public and ensure accountability for all police actions; and WHEREAS, therefore, aside from extenuating weather circumstances or for officer health or safety, the wearing of masks or face coverings in law enforcement activity in Englewood is prohibited; and WHEREAS, in order protect the ability for residents to utilize due process rights, all law enforcement agents are required to wear clothing and identification that clearly labels their agency, last name and rank; and Docusign Envelope ID: 2D4C4DB3-2D5F-4B0B-A00D-4BADAD595B62 WHEREAS, all other law enforcement officers, including federal agents and members of the military that operate or may operate in Englewood, are urged to adhere to these public safety policies to align with the values of our community, protect public safety, and promote accountability. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS: Section 1. That should federal law enforcement, military or any state or federal official authorized to effectuate an arrest or otherwise serve a civil detainer or warrant take official action within the City of Englewood, this Council requires they adhere to best practices and local standards of lawful enforcement and accountability and take action in such a way that respects and reflects the values of our community: violence prevention, de-escalation, education, economic opportunity, mental health support, accountability, constitutionally-compliant policing and respect for civil and human rights for all. This includes recognition of and strict compliance with rights granted under the United States Constitution and other law, including: First Amendment (right to religion, speech, press, assembly, petition), Second Amendment (right to bear arms), Fourth Amendment (unreasonable search and seizure, excessive force), Fifth Amendment (due process), 10th Amendment (reservation of rights to the states), 14th Amendment (equal protection). Section 2. Englewood Police Department will continue to pursue its guiding mission to protect and serve by focusing on community and personal safety and respect for all. Englewood Police Department further will comply with applicable Colorado state laws, including: • C.R.S. 24-76.6-102(2) (HB19-1124), which forbids local law enforcement officers from arresting or detaining an individual solely based on a civil immigration detainer. • SB25-276 (2025), which restricts state and local agencies from sharing private information of undocumented individuals. • SB25-276/HB19-1124, which prohibits local governments from entering into or renewing contracts to house detainees for civil immigration purposes. • HB21-1057, which prohibits threatening to report a person's immigration status to pressure them. Section 3. That this resolution be stated in the minutes of Council and that copies be provided to U.S. Senator Michael Bennet, U.S. Senator John Hickenlooper, and Representative Jason Crow, whose districts include the City of Englewood.
