Council Me.ber Habenicht requested that Agenda Item 9(k) be withdrawn fro. the
Consent Agenda, explaining she was opposed to passage of Council Bill No. 14 entitled:
A BILL FOR AN ORDINANCE AMENDING TITLE 1, CHAPTER 6F, ENGLEWOOD MUNICIPAL CODE
1985, BY THE ADDITION OF A NEW SECTION 11 RELATING TO EMERGENCY MEDICAL TRANS -PORT FEES .
Ms. Habenicht further explained she had concerns and questions which had not
been adequately addressed and did not feel c011fortable about supporting H.
Mr. Kozacek and Ms. Hathaway also expressed SOlie concerns.

(a) City Attorney DeWitt offered 1 reca.endation to adopt 1 bill for
an ordinance uending Title 7, Chapter 6E, Section 2, of the Englewood
Municipal Code 1985, relating to offenses involving •inors. He infor.ed Coun -
cil that passage of this revision to the Code would bring the City 's code into
COIIpliance with current state and national legislat i on relative to ages of
those per.itted to purchase and drink alcoholic beverages . He advised Council
that this .. tter had been reviewed by the Liquor Licensing Authority . Council

Council Member Clayton expressed concern that perhaps this ordinance does not
adequately address false alan.s experienced by the schools and/or hospitals. After considerable discussion,

The ••tter was further discussed. Mr. Fraser assured Council that it was not
the purpose of the ordinance to fine schools or hospitals for probl•s over
which they have no control; however, Mr. Fraser felt that the aO.tn istratton
of this ordinance could be dealt with by rules and regulations yet to be es-
tablished . He further assured Counctl that staff would be senstttve to the
specific probl .. s of schools and hospitals and that Council would have an op -
portunity to review the rules and regulations before the ordinance went Into effect.

Motion carried. Council Bill No. 17 was approved on first reading .
Council Mlllber Koltay explained hts opposition to Council 8111 No. 17, co.-
.. nttng that It appeared to be another for. of taxation which will adversely
affect the business ca..untty. In light of the general feeling of Council tn
this regard, he felt tt would have been better to table the .. tter. Council
Me.ber Habenicht stated she agreed that .. need to address abuse, but she was
concerned that the way the current ordinance Is written, It would be •address ·
tng the probl .. before the level of abuse•. Discussion ensued about whether
the ffnes should be considered a source of revenue or a deterrent to abuse.
Mr. Fraser suggested that he bring thts .. tter back to study session and pro -
vide Counct1 with copies of the .O.Intstrattve regulations to revl before
th ordinance ts considered on final . It was suggested that the regulations

agreed, explaining he had voted against it even though he feels the ordinance
was well written and well defined. However, he felt some of these questions
should have been resolved in study session thereby not burdening the public
with the specific issues of the JUtter, and that staff could have used the extra tiMe to prepare the regulations, etc.
(c) Director Fonda presented a reca..endation fro. the Water and Sewer
Board to adopt a Resolution to •ake a new appropriation of water fro. Bear
Creek, and to operate a plan of aug .. ntation and an exchange on Bear Creek and
the South Platte River. Mr. Fonda explained that Bear Creek would be a poten -
tially significant water source. He explained the Resolution, if approved,
would be filed along with the water right application. He further explained
the proposed a~ntation plan and the exchange provision.
The Resolution was assigned a nu.ber and read by title :

assured Council that the quality of water In lear Creelt, at least this year,

luncheon. Mayor Van Dyke encouraged all Council -..bars to attend.

glewood Municipal Code I985, by the addition of a new Section II relating to
e-.rgency lledical transport fees. Mr. Olsen explained that the fees would
pertain only to non-residents of the City and that the fees would be for
transport only, not para.edic service. Mr. Olsen responded to questions and
various concerns of Council. Staffing was discussed, as was the need to keep
both a.bulance units available at all ti-.s for e-.rgency responses . Council

Kr. Hinson informed the Board that regulations would soon need to be
drawn up for the uses of The Plaza at Little Dry Creek and he asked
for their input. Kr. Hinaon indicated that depending on who would
be ultiaately responsible for the area would dictate the types of
events that could be held there. Kr. Hinaon also felt that it was
not the City's place to stage events, and he hopes that the EDM
will take so-of this responaibili ty on. He also felt this spring
and su-r were pri-seasons to schedule events on a regular basis
to draw awareness to the downtown area. Kany suggestions as to
events that could be held were discussed.

Kr. Hinson noted that the new Phar-Mor store will be open for business

Engineering Services , Densel Ragland, the problem of lclng of sidewalks on
Little Dry Creek at the US 285 and South Broadway and at US 285 and Sherman
St . Kavlnsky explained that water runs down the cement slopes under the
bridges and across the walkways and fraezes . He stated that when the Parks
crews are on duty , the lee build up ls taken care of, but there ls no crew on
duty to take care of late afternoon and weekend thaws/freezes . Discuss i on

A RESOLUTION ACCEPTING DEDICATION OF THE INCA WAY STREET
RIGHT-OF-WAY BY THE CITY OF ENGLEWOOD FROM ENGLEWOOD URBAN
RENEWAL AUTHORITY.
\'lHEREAS, by an agreement with the City, Englewood Urban
Renewal Authority (EURA) agreed that the Authority would be
responsible for acquiring properties necessary for public
improvements and constructing the improvements; and
WHEREAS, upon completion of the improvements, EURA agreed
to dedicate these inprovenents to the City for purposes of
control and aintenance; and
I~EREAS, EURA authorized the dedication of the Inca Way
right-of-way to the City by EURA Resolution No. 1, Series of 1989
at its meeting of February 1, 1989;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ENGLEWOOD, COLORADO, THAT:

REGARDING THE REVENUE ASPECTS OF THIS BILL, AND I NOTICED ON THE
TAPE, CHIEF STANLEY TALKED ABOUT THE HONEY THIS WAS GOING TO RAISE.
I'D PERSONALLY HOPE THAT THIS OOESN'T RAISE US ANY HONEY, AND I
THINK THAT WE HAVE TO DIFFERENTIATE BETWEEN BILLS THAT WE EXPECT TO
RAISE US MONEY AND BILLS THAT WE HOPE WILL NOT. I THINK THAT IF WE
LOOK AT THIS AS A MONEY-RAISING BILL, THEN WE ARE GOING OUR
CITIZENS A DISSERVICE. WE NHO TO FINO WAYS TO ELIMINATE FALSE
ALARMS AND NOT INCREASE OUR REVENUE THROUGH FINES FOR FALSE ALARMS.
VAN DYKE: MY PERSONAL PERCEPTIONS WAS THAT IT WAS TO ELIMINATE, NOT TO MAKE
HONEY, BUT THE REVENUES HERE ARE JUST A SUPPLEMENT, THE AMOUNT OF HONEY HE ESTIMATED TO SPENO ON FALSE ALARMS.
CLAYTON: I UNDERSTAND, BUT I ALSO UNDERSTOOD FROM THE TAPE THAT A CON -
SIDERABLE AMOUNT OF TIME WAS SPENT ON REVENUE PROJECTTIONS AND THE
AMOUNT OF HONEY IT COST FOR A FALSE ALARM, AND THAT THIS WOULD BE
SOME OFFSET. AGAIN, I WOULD HOPE, AND HAVING BEEN IN BUSINESS FOR
A NUMBER OF YEARS AND EXPERIENCED THE PROBLEMS OF BURGULAR ALARMS
AND BURGULARIES -WHEN I HAVE A BURGULARY OR A R088ERY, I WANT THE POLICE TO RESPOND WITH THEIR GUNS DRAWN AND BAZOOKAS READY. AND I
DON'T WANT THEM TO BE THINKING, WELL, THIS IS JUST ANOTHER FALSE
ALARM AT THIS PLACE, AND I THINK THAT THAT SHOULD CERTAINLY BE OUR
INTENTION TO ELIMINATE THESE FALSE ALAAMS . AND I, YOU KNOW, FROM
THAT POINT Of VIEW . SO I, UH, I THINK THAT MOST BUSINESSMEN AND I
WOULD DIFFER WITH ALEX, BUSINESSMEN THAT I HAVE TALKED TO THAT HAVE

KOLTAY: YOUR HONOR, I'D JUST LIKE TO STATE FOR THE RECORD, MY OPPOSITION TO
COUNCIL BILL NO. 17 IS QUITE VARIED. I BELIEVE THAT ONE OF THE
THINGS THIS ISSUE BRINGS UP IS AN ISSUE THAT I'VE HEARD BY SEVERAL
OTHER COUNCIL PEOPLE THAT IT'S ANOTHER FORM OF TAXATION OF OUR
BUSINESSMEN. 1 BELIEVE THAT THERE IS VERY MUCH CAUSE AND VERY MUCH
CONCERN FOR THE ALARM SYSTEM OF SEVERAL BUSINESSES GOING OFF AT
INOPPORTUNE TIMES AND US MAKING RESPONSES TO IT. IT'S TIME I
BELIEVE THERE ARE SEVERAL BILLS THAT ARE GOING TO BE APPROACHED
INCLUDING THE AMBULANCE TRANSPORT FEE AS WELL AS THE ALARM BILL TO
BRING UP THE ISSUES OF A TAXATION IMPOSED ON SOMEBODY SOMEWHERE . I
THINK IT WOULD BEHOOVE ALL OF US ON COUNCIL TO DISCUSS WHAT WE FEEL
THESE FEES WE'RE IMPOSING ARE GOING TO ACCOMPLISH AND AT THE SAME
TIME WHAT WE ARE EXPECTING TO GET A RESULT FROM. I BELIEVE THIS
BILL WAS A GOOD BILL IN THE DRAFT MODE. AFTER I 'VE HEARD SEVERAL
DISCUSSIONS ABOUT IT BACK AND FORTH TO BRING IT ON THE TABLE. I
JUST REALLY BELIEVE THAT WE ARE TALKING ABOUT IT IN CIRCLES . AND I
THINK IT WOULD HAVE BEEN MORE PRUDENT TO TABLE IT.
HABENICHT; YOUR HONOR, I'D LIKE TO SHARE TOO THAT, AND IF THIS ISN'T APPROPRI -
ATE, PLEAS£ TELL HE, BUT I'D LIKE TO SHARE TOO THAT ONE OF MY CON -
CERNS CAM£ AND I HAVEN'T HAD A CHANCE TO SHARE IT WITH COUNCIL IN
TERMS OF MEETING WITH SOME BUSINESSES ON AN INDUSTRIAL TASK FORCE
BEFORE I HAD EVEN GIVEN SOME THOUGHT TO THIS WAS THAT ON£ OF THE
BUSINESSMEN INDICATED HOW HE APPRECIATED HOW OUR CITY DEALT WITH
fAlSE ALARMS, THEY DIDN'T HAVE TOO MANY , BUT THEY DIDN'T FEEL THAT
THEY WERE UNDER A LOT OF PRESSURE , AND THIS WAS ONE OF THE REALLY
POSITIVE BENEFITS OF HAYING A BUSINESS IN THE C(JilJNITY, AND I
HAVEN 'T HAD THE OPPORTUNITY TO SHARE THAT CONVERSATION WITH COUN -
CIL, AND MY CONCERN IS THAT WE REAlLY DO NEED TO ADDRESS THE ABUSE,
BUT MY CONCERN IS THE WAY THE CURRENT ORDINANCE IS GOING TO ADDRESS TH PROBL(M BEFORE TH LEVEL OF ABUSE .
