Mayor Van Dyke announced that the purpose of the Public Hearing was to con-
sider ~nding sections of the Englewood Municipal Code relating to the Flood Plain Ordinance.

Motion carried and the public hearing opened.
Director Wanush, duly sworn, offered Proof of Publication that notice of the
public hearing was published in the Englewood Sentinel on March 16, 1989. Mr.
llanush provided background inforution concerning the Flood Plain Ordinance
and the changes which have been requested by the Federal E.argency Manage.ant
Agency (FEMA) to bring our ordinance into ca.pliance with federal regulations.
He explained that the Planning Co.aission held a public hearing on the pro -
posed uend.ants on February 22, 1989 to consider the amendments; it is the
reca..endation of the Planning Co.aission that City Council approve the ~nd
•nts. Mr . llanush also entered into the record one copy of the Flood In -
surance Rate Map (FIRM) .,.fch will be in effect April 17, 1989. Mr . llanush
identified the three .. jor flood plain area s located in Englewood as: I) lit -
tle Dry Creek fro. approxi .. tely Clarkson and US285 to the area where it
crosses under Santa Fe at approxi .. tely Oart.outh; 2) Big Dry Creek at Broad-
way at the southern city li•its, diagonally through Belleview Park and exiting
the City at Santa Fe; 3) various areas along the South Platte River. Also
identified .. ,.. three •inor s~at undefined areas located in nort~st En-
glewood, northeast Englewood, and across the southern part of Englewood. Mr .
Wanush further advised Council that FEMA would be furnished inforution rela -
tive to the little Dry Creek ii!IProve.nts fch would further uend the flood
plain, resulting tn the -..ttre do!MtCM~ area being taken out of the flood Plain Dtstrtct.

relating to Municipal Court contetnpt powers and protection against d0111estic
violence. Council Me.ber Byrne asked the City Clerk to read Council Bill No. 16 entitled:
A BILL FOR AN ORDINANCE AMENDING TITLE 1, CHAPTER 7, SECTION 2, ENGLEWOOD
MUNICIPAL CODE 1985, BY ADDING NEW SUBPARAGRAPHS RELATING TO JURISDICTION AND POWER OF THE ENGLEWOOD MUNICIPAL COURT .

Council Member Koltay informed Council that these items were reviewed by the
Retirement Board and it had been determined by the Board that clarification
was necessary. Financial i Mpact upon the City was questioned; it was
clarified by City Manager Fraser that the changes be i ng considered would not
affect the budget in ten~s of the City 's contr i but i on . After further discus -
sion , Council Member Koltay called for the quest i on . Vote results :

the purpose of the ordinance to fine schools or hospitals for probl"s over
which they have no control; however, ~. fraser felt that the a~inistration
of this ordinance could be dealt with by rules and regulations yet to be es -
tablished. He further assured Council that staff would be sensitive to the
specific probl .. s of schools and hospitals and that Council would have an op -
portunity to review the rules and regulations before the ordinance went into effect.

was well written and well defined. However, he felt sa.e of these questions
should have been resolved in study session thereby not burdening the public
with the specific issues of the utter, and that staff could have used the
extra ti .. to prepare the regulations, etc.
(c) Director Fonda presented a rec-..dation fro~~ the Water and Sewer
Board to adopt a Resolution to uke a new appropriation of water fro~~ Bear
Creek, and to operate a plan of aug~~entation and an exchange on Bear Creek and
the South Platte River. Mr. Fonda explained that Bear Creek would be a poten-
tially significant water source. He explained the Resolution, if approved,
would be filed along with the water right application. He further explained
the proposed aug~~e~~tation plan and the exchange provision.

were to fall under the guidelines of a "park" -liquor sales would
be prohibited. Fees for existing vendors tJhen special events are

It uas generally agreed that fees will need to offset the costs
the City will incur for maintenance. It uas suggested that the

In connection vi th Hs. Hirsch's presentation the promotional calendar
had been passed out at the beginning of the meeting. There was
general discussion of the projects listed on Ms. Hayes calendar,
all of which vere very well received. Ms. Hayes also stated that
she is very open to a ny suggestions the Board may have and encouraged
each of them to give her their input. It was suggested that an
event revolving around a particular flO\Ier l>e organized. At this
point Chair1014n To1110oka asked Ms. Hathaway to verify the "Ca rnation
City " label Englewood supposedly had in the past.

Ms. Hayes deferred to Ms. Miller for an explanation. Ms. Miller
noted that the re10181nin g $24,000 for the Chamber Recruitment Program
was stil l being restricted. Ms. Miller suggest d that a 1110tion be

As there was no one present in opposition to the application, Mr. Cruz was excused.
Max Scott, Oedipus, Inc., duly sworn, test;f;ed as to the survey results of
the petitioning done by his fir. on behalf of the applicant. Mr. Scott stated
that of the 941 doorknocks, representing 1001, 272 qualified contacts were
.ade; of those contacts there were 160 signatures favoring issuance based on
needs and desires and 29 signatures favoring the issuance based on desires
only and there were 14 signatures opposing issuance based on needs and desires
and 41 signatures opposing based on desires only. Mr. Scott noted that about
901 were in favor based on needs and desires, which was an exceptionally good
statistic for an off-pr .. ise license of any type. Mr. Scott responded to
questions fro. the Authority and the petitioning was discussed in depth.
Chatnaan Styes again called for anyone in protest of the application. There were none.
The Authority recessed into Executive Session at 8:35 p.•. The public hearing

Commission have every right to reject any ad that is determined not to be in
the best interest of the Recreation Department . Chairman Neyer requested that
the word "will" in ite• #113 in the proposed policy be changed to "may•. The
Commission agreed . Further discussion included the size of ads, possible
revenues that could be generated fr~ brochure ad placeaent, and not
increasing the nu.ber of pages in the brochure to acco..odate ads but rather
accept ads on a space available basis. This proposed policy applies to the
recreation brochure and not the Kallay brochure . Youth co .. issioner Hathaway
made a motion , seconded by co .. issioner Goaes, to accept the Proposed Policy
for Parks and Recreation Brochure Advertisers and Sponsorships with the
aaendment of ite• •3 changing the word "will" to • .. y• and forward it to City
Council. The motion passed with one abstention from co .. issioner Clayton .
Clayton explained that he is concerned with the possible li•itations of item
1112 of the proposed policy where companies such as Coors .. y approach the City
with an offer to pay large suaa of money to advertise for an event or pay the
expense of publishing the brochure in order to advertise in the Recreation
Brochure. Commissioner Kozaeak stated that he voted for the proposed policy
but that he .. y wish to consider so.& variations of the policy in the future .
Director Winkle stated that she has discussed advertising in the Malley
Center Brochure with Malley Director Mickelson . It is Mickelson 's observa tion
that senior citizens are often targets of ae ... and she feels that seniors who

advertised service has been cheeked out and is baing raca.mended by the Mall y
Center . Mi ckelson also stated that users of the Kallay Canter regularly

Ms. Hirsch testified that Swedish Medical Center is the applicant, and the
request is for approval of a Planned DevelopMnt, the vacation of the South
366.10 feet of South Pennsylvania Street in the 3400 block, and the vacation
of the north 375 feet of the South Logan/South Pennsylvania alley in the 3400
block . Ks. Hirsch stated that the discussions with Swedish Medical Center
began in August, 1988 at which ti .. the Medical Center brought in plans for
Medical Office Buildina •2 (MOll II). During the course of discussions, the
plans for the total c.-pus vera brought up and the City staff suggested that,
evan thouah it is not required, it would be of assistance in evaluating the
overall plans if a Planned Devalopaent ware to be presented. The Medical Cen-
ter ca.pliad with this su&&estion, and sub.ittad an application for approval
of the Planned Develo~nt in Sapta.ber, 1988, which was subaittad to the
Planntna Caa.ission for lnforaation on October 4, 1988. A Public Hearing be-
fora the Ca.aission vas scheduled for Nova.bar 15, 1988, and was continued to
Deca.ber 13, 1988. On Dece.bar 13, 1988, followina the ca.platlon of the
Public Haartna, the Planning Coaaisslon voted to favorably reco ... nd the
Planned Devalo~nt and the vacation of the south 366.10 feat of the 3400
block of South Panrwylvania Street and the north 375 feat of the 3400 block
South Logan/South Pennsylvania allay to City Council. A Public Hearing was
held before City Council on January 16, 1989, and continued to February 21,
1989 . On February 21, 1989, the City Council voted to raaand the request froa
Swedish Medical Canter to the Plannina Coaaission for reheerina.
Ks . Hirsch stated that the Planned Devel~nt site plan enca.passes an area
bounded by East Girard Avenue , East Ha.pden Avenue , South !aerson Street and
South Logan Street. The .. in ca.pus of Swedish Medical Center is bound41d by
East Girard Avenue, &aat Haapden Avenue, South Logan Street and South Clarkson
Street, and is the sits of the proposed develo~nt . The three .. tn eoapo-
nenta of the speelfle plan for the .. tn CUipUa are the construction of the
KacSleal Offlee luUding II (MOll II); an addition on the vest side of the
hospital itself, part of which will house a new ICU unit; and a parkina struc-

areas for AIDS patients . The existing ICU privata roo.s do not provide toilet
facilities; these have to be brought in for the patients . There is insuffi-
cient waiting areas for f .. ily .. 8bers of patients in the ICU , and it is very
difficult to hire and retain a good nursing staff when nurses are required to
work under the conditions that prevail in the SMC ICU. The nurses take pride
in their work and they need and want a good anviron.ant so that they can pro -
vida the quality care patients expect and deserve .
Dr. Gillaspie discussed the designation of Swedish Medical Center as a trauma
center in the south .. tropolitan area . SMC is one of three aajor trauaa cen-
ters in Denver, the other two being at St . Anthony north, and at Denver
General Hospital . 'nla other two trau.a canters are "closed staff•, .. aning
that only doctors on the staff at that particular hospital aay treat the pa-
tients . Dr . Gillespie stated that it is vary i~ortant for the south

Hs . Hirsch addressed the Commission, and stated that as part of the Develop-
ment process, all development activities go before a Technical Review Commit-
tee, which is composed of representatives of the various City Departments.
The haaaerhead in the c ul -de-sac has been designed to provide emergenc y access
and .. neuverability . Actin& Fire Chief Olson has stated that adequate fire
protection can be provided via the cul -de-sac and turn -around, and that in
fact, responae would be froa three different directions : from the main sta-
tion on South Eleti, froa the Tejon Station, and from the Cherry Hills Village
station. The closure of South Pennsylvania Street will not adversely affect
fire service.

c. General Provisions.
1. Description of District. The Flood Plain District
covers that area of the City which is within the 100-
year flood plain, which is defined by computinq the
100-year flood plain liaits under existing channel and
flood plain conditions.
2. Jurisdiction. The jurisdiction of this zone district
includes all lands adjacent to any watercourse within
the City of Englewood that would be inundated by the
100-year flood for that watercourse as defined in the
Definitions Section of this Ordinance.
3. Flood Plain District Boundaries. The boundaries of the
Flood Plain District shall be identical to the areas of
special flood hazard identified by the Federal Eaerqen-
cy Manageaent Agency IN THE FLOOD INSURANCE STUDY DATED

4. Applications for Building Permits shall be reviewed on
a case-by-case basis by the Flood Plain Zoning Ad-
ainistrator to assure:
a. That the building site will be reasonably safe
from flooding.
b. That all necessary peraits have been obtained from
the Federal, State or Local governmental agencies
from which prior approval is required.
c. That where the building site is in a location that
aay have a flood hazard, all new construct i on and
subs ta n tial repairs, improvements, or a l t e rat i ons

FIRM. The regulations of this Chapter shall be con-
strued as being supplementary to the regulations im-
posed on the same lands by the underlying Zona clas-
sification. When the Flood Plain Diatrict and the
underlying Zone District regulations conflict with one
another, the moat restrictive regulations shall control.
8. No structure or land shall hereafter be constructed,
located, extended, converted, or altered without full
compliance with the teras of this Ordinance and other applicable regulations.
9. This Ordinance is not intended to repeal, abrogate, or
impair any existing easement, covenants, or dead
restrictions. However, where this Ordinance and other
ordinance, easement, covenant, or deed restriction con-
flict or overlap, whichever i poses the mora stringent restrictions shall apply.
Special Provisions. The following regulations shall apply
to all uses within the Flood Plain District, notwithstanding
that such uses aay be specifically peraitted under the tenu of this Chapter.
1. The flood protection elevation or height shall cor-
respond to a point one foot (1') above the elevation or

l. Agricultural uses such as: general farming and the
raising of plants, flowers and nursery stock.
2. Public and private recreational uses not requirinq per-
manent or temporary structures designed for human
habitation such as: parks, swimminq areas, golf cour-
ses, driving ranges, picnic grounds, fishinq, and hiking and biking trails.
3. Utility facilities such as: flowaqe areas, transmis-
sion lines, pipelines, water monitoring devices, road-ways, and bridges.
4. All uses allowed by the underlying Zone District clas-
sification within the Flood Plain District shall be
peraitted as long as the conditions set forth in Sec-
tion 16-4-16 F, Developaent Peralta, are complied with.
F. Development Peralta. Any use enumerated in this Section may
be peraitted only upon application to the Flood Plain Ad-
ministrator as provided in Section 16-4-16 G 6., Process to
be Followed for Developaent Peralta.
1. Structures Accessory to Open Uses. Structures accesso-
ry to open uses peraitted in Section 16-4-16 !,
Description of Uses, whether temporary or peraanent,
aay be peraitted only upon a deteraination by the Ad-
ministrator pursuant to a finding under the procedure
required by Section 16-4-16 G 6., Process to be Fol-

d. The City shall establish an evacuation plan for
Manufactured Hoae Parka and file the same with the
appropriate disaster preparedness authorities.
6. Siailar Uses. Uses very siailar in nature to permitted
uses aay be allowed by the FlOod Plain Adainiatrator,
provided that they are consistent with the provisions o t this Chapter.
7. UNOESIGNATED FLOODWAYS. UNTIL A REGULATORY FLOODWAY IS
DESIGNATED, IT MUST BE DEMONSTRATED THAT THE CUMULATIVE
EFFECT OF THE PROPOSED DEVELOPMENT, WHEN COMBINED WITH
ALL OTHER EXISTING AND ANTICIPATED DEVELOPMENT, WILL
NOT INCREASE THE WATER SURFAC E ELEVATION OF THE BASE
PLOOD MORE THAN ONE FOOT AT ANY POINT, BEFORE ANY NEW

Chapter. The Depart.ent of Enqineerinq Services shall
provide the Flood Plain Adainistrator with a technical
review of all applications to build within the Flooc:t
Plain or a Drainaqe Way prior to the issuance of a
Flood Plain Perait.
Flood Plain Zoninq Parait. A Flood Plain Zoninq Perait
aust be obtained froa the Flood Plain Adainbtrator
before a Buildinq Perait can be iesued for any use sub-
ject to the provisions of the chapter and before any
watercourse can be altered or relocated. In the evant
of an application requestinq an alteration or reloca-
tion of a watercourse, all adjacent coaaunities and the
Colorado Water Conservation Board shall be notified
prior to any action. Copies of said notification shall

7. Conditions Attached to Development Permits. Upon con-
sideration of the factors listed above and the purposes
of this Chapter, the Flood Plain Administrator shall
attach such conditions, in addition to those required
by the Develo~ent Perait, as is necessary to further
the purposes of this Chapter. such conditions may in-
clude specifications for, without lbitation because
of, specific enu.eration, aodification of waste dis-
posal aethods and facilities, landscapinq, period of
operation, operational controls, sureties, deed
restriction, and adequate floodproofinq.
H. Floodproofinq.
1. All new construction and substantial iaproveaents of
non-residential structures within zones A-AE on the

cludinq base .. nt, elevated to or above the Base Flood
Level shall be floodproofed. All floodproofed struc-
tures, t09ether with attendant utility and sanitary
facilities, shall be so desiqned that below the Base
Flood Level, the structure is water tiqht with walls
substantially iape~able to the passaqe of water and
with structural coaponents havinq the capability of
resistinq hydrostatic and hydrodynaaic loads and ef-
fects of buoyancy. Tbe Adllinistrator shall require

Within ten days after receipt of such certification
from the applicant, the Administrator shall issue a
Certificate of Compliance only if the building or prem-
ises and the proposed use thereof, conform with all of
the requirements of this Chapter, and shall maintain a
pormanent record thereof.
J. Amendments. The boundaries of the Flood Plain District
shall be subject to periodic review and shall be amended in
the manner provided by law, to conform with any revised,
corrected or additional hydrological data available from
Federal, state or regional agencies or from a consulting
engineer retained by the City.
x. NonconfoninCJ Uses. Exiatinq Nonconforming Uses in the
Flood Plain District aay be aodified, altered, or repaired
to incorporate floodproofing aeaauresJ but such Nonconform-
ing Uses shall not be expanded.
L. Subdivision Plata.
1. All subdivision proposals shall be designed to minimize
flood daaaqe.
2. All subdivision proposals shall have public utilities
and facilities such as sewer, gas, electrical, and
water syateaa located and constructed to ainiaize flood
daaage.
3. All subdivision proposals shall have adequate drainage
provided to reduce exposure to flood daaage.
4. Base Flood Elevation Data shall be provided tor sub-
division proposals and other proposed developaent which
contain at least 50 lots or 5 acres, whichever is leas.

consider all technical evaluations, all relevant
factors, standards specified in other sections of
this Ordinance, and:

(1) The danger that materials may be swept
onto other lands to the injury of others.
(2) The danger to life and property due to
flooding or erosion damage.
(3) The susceptibility of the proposed facili-
ty and ita contents to flood damage and
the effect of such damage on the indi-
vidual owner.
(4) The i•portance of the services provided by
the proposed facility to the co .. unity.
(5) The availability of alteruative locations
for the proposed use which are not subject
to flooding or erosion da•age.
(6) The co patibility of the proposed use with
existing and anticipated develop•ent.
(7) The relationship of the proposed use to
the Coaprehenaive Plan and Flood Plain
Man g•••nt Progra• for th t area.

g. Upon consideration of the factors of Section 16-4-
16 M 1 d and the purposes of this Ordinance, the
Board of Adjustment and Appeals may attach such
conditions to the granting of variances as it
d•-• necessary to further the purposes of thia Ordinance.
h. The Flood Plain Adlliniatrator shall aaintain the
recorda of all appeal actions and report any
variances to the Federal Eaergency Kanageaent Agency upon request.
3. Conditions for Variances.
a. Variances aay be issued for the reconstruction,
rehabilitation or restoration of structures listed
on the National Register of Historic Places or the
State inventory of Historic Places, without regard
to the procedures set forth in the reaainder of this Section.
b. Variance• shall only be issued upon a deteraina-
tlon that the variance ia the ainiaua necessary,
considering the flood hazard, to afford relief.

of Bonds will provide that whenever four-fifths (4/5) of the Bonds
have been paid and cancelled, and for any reason the remaining
essess .. nts are not paid in ti•e to take up the final Bonds and
interest thereon, then the City shall pay said Bonds when due and
interest due thereon, and reillburse itself by collecting the
unpaid assess .. nts due the District.
AUTHORIZATION: An Ordinance authoriaing the issuance of
the Bonds will be considered on first reading by the City council
on Monday, May 15, 1919, and on final reading, on Monday, June 5,
1919, and will be issued in accordance with Sections 107 and 110
of the City Charter.
PURPOSE or ISSUE: The Bonds will be issued for the
purpose of paying part of the cost of constructing and installing

TAX STATUS: In the opinion of bond counsel, under
existing laws, regulations, rulings and judicial decisions, the
interest on the Bonds: (a) is excluded froa gross incoae for
federal incoaa tax purposes and (b) is not an itea of tax
preference for purposes of the federal alternative ainiaua tax
iaposed on individuals and corporations; however, it should be
noted that with respect to corporations (as defined for federal
inco-tax purposes), such interest is taken into account in
dataraining adjusted net book incoaa (adjusted current earnings
for taxable years ending attar Dacaaber 31, 1989) for the purpose
of coaputing the alternative ainiaua tax iaposed on such
corporations. The opinion sat forth in clause (a} above will be
subject to the condition that the City coaply with all
