Council has requested legal alternatives avAilable in the matter of Valley water and Sanitation District and the residents of the City of Englewood. 'nle relnant facts in this particular matter are that Valley Water and Sanitation District serves oert&in residences and portions of the City of Englewood and those properties are located in the Centennial Area. At the present time Englewood provides only treatment service, it does not provide ocllection services, i.e. the MNer collection system. My understanding is that the residents of the Centennial Area do not pay to the City of f))glewood fer the collecticn services the City provides to other residents 1olho do pay the City's rate. 'nlere are basically three c:ptia'I.S availele in this matter. 'lheM c:ptiCI'IS are: 1. NecJotiate a total rvice contract for MWIIr services to Englewood resic!ents. We <:urrently do this with respect to .,..ter service for cert.J..n Valley~. 2. Deannex !rcn the district all prcpertie:s loc:.t.d in the City of Englewood. 'nlese requii:WIIents are .et forth in the atuched statutes fer Cowlcil reference. It should be noted that this is a citizen move not a nove that a city can make. ~ of the OCIIIIIOn criticism of the district approach is that citizens do not maintain oontiiCt with their elected representatives to the board. 'lhis is not meant as a criticism of the citizens it is 111:1re the priiCtic:&l reality of doinCJ business with districts. 'nlere is virtually no ~gninCJ, there is no ocntact with their uBers, i.e. the citizens. Frankly it hu been my experience in the put that district 'IIOters do not have sufficient interests in the operation of the district to vote in or otherwiM pArtici~te in this fonn of goverr'l!l!nt.
