(a) Werner Schnackenberg, 3675 South Cherokee Street, expressed disap-
pointment about Council's cut of funds to Interfaith Task Force (IFTF). He
stated he hoped this would be a te.porary cut. He eMphasized that in almost
every category of service provided by IFTF, Englewood citizens comprised the
largest nu.oer; he felt IFTF deserves to receive strong support fro. the City
of Englewood, and he urged Council to assign a high priority to Its future
support. Mr . Schnackenberg was advised that Council would consider alloca -
tions of 1990 contribution funds at the budget retreat in Septe.ber .
(b) William Klibbe, 2905 South Delaware Street, scheduled to speak con -cerning skateboarding, did not appear .
7. Non-scheduled VIsitors
(a) Shenun Salazar, 4742 South Decatur Street, addressed Council on
behalf of several citizens who recently experienced probl .. s with sewage back -
flow fro. the Valley Sanitation District service . Mr . Salazar asked what the
City of Englewood plans to do to assist those people relative to expenses in -
curred, etc. City Manager Fraser infonled Mr . Salazar that the Vall ey Sanita -
tion District had been advised of the City 's concerns, and suggestions for
appropriate action are being Mde directly to the District . It was also
pointed out that it is not with in the City's authority to intervene directly
in this Mtter . City Attorney DeVItt stated research had been done concerning
this Mtter, that a nu.ber of alternatives were available; however , those al -
ternatives had not been reviewed with Council . Mr . Salazar was provided a
copy of Mr . DeVitt 's research data, and It wa s strongly SU99tsted that the
group consider 1-val action against Valley Santtatton Dtstrtct . Mr . Salazar
reiterated hts posttton and asked tf the Ctty .ould accept t Insurance

(a) Director Wanush presented a reco-.endation from the Department of
Community Develo~nt concerning a bill for an ordinance which would approve
the transfer of funds ($300,000) to the Housing Authority for the administra -
tion of the Housing Rehabilitation Progra•. The funds which are to be trans -
ferred are fra. the recently approved C~nity Develop~ent Block Grant .
Mr. Wanush provided infonaation concerning regulations and incOMe guidel ines.
He also info~ Council that the City has been operating this program for 13
year s in cooperation with the Englewood Housing Authority.
Council "--ber Koltay asked the Clerk to read Council Bill No . 29, Series of
1989 , entitled:

Mr. Woika, Utilities Manager, confirmed that the bid of $26,666 was lower than
the Engineer's estiMate. It was also stated that this work is being done in
conjunction with Paving District No. 33.
(c) City Manager Fraser presented a reco..endation frOM the departments
of Financial Services and Public Works regarding award of bids for four piece s
of equip.ent under the Capital Equip.ent Replaca.ent Fund (CERF). Mr . Fraser
concurred In the reca..endation as set forth in the Council Ca..untcatton for
It .. s 1, 2, and 4 . Concerning It .. 3, Mr . Fraser explained that it has been
suggested by the UtilIties Oepart•nt that the award for the Rubber tired
wheel loader/backhoe should be aade to Case Power & Equip-.nt in the a.ount of
$56,910 .7 7 rather than to Honnen Equip-.nt Ca.pany In the ~.aunt of $64 ,500.
The Utilities Oepart•nt has decided that the equtp.ent bid by Case, wi th

(a) Mr. DeWitt provided infor.ation to Council concerning:
(1) lowry landfill Suit
(it) Waste Disposal & Recycling
(itt) Swedish Medical Center Air Rights. Mr. DeWitt stated the bill
for an ordinance approving air rights lease would be on July 17, 1989, agenda.
(tv) Draft of ordinance a~~ending the Englewood Municipal Code to
confor. to the recent reorganization of Ad•inistrative Services. Mr. DeWitt
stated the bill for an ordinance would be presented to Council during August .
Mr. DeWitt agreed to provide Council with a su.ary of said bill . The City
Clerk was instructed to have copies of the drafted bill available for the public.

could prioritize the results of the report.

liquor licensing Authority to adopt a bill for an ordinance which would pro-
vide for the pa~t of a fine tn lieu of suspension of a liquor license. Mr .
DeWitt explained that this would provide an option to the Authority in deter -
•tntfll appropriate action to take concerning violations. Mr. DeWitt conftr.ed
that thts procedure COIIP11ed wtth state statutes, also that several other
.untcipaltttes had adopted s1•11ar legislation. After further discussion,

Council has requested legal alternatives avAilable in the matter of
Valley water and Sanitation District and the residents of the City of
Englewood. 'nle relnant facts in this particular matter are that Valley Water
and Sanitation District serves oert&in residences and portions of the City of
Englewood and those properties are located in the Centennial Area. At the
present time Englewood provides only treatment service, it does not provide
ocllection services, i.e. the MNer collection system. My understanding is
that the residents of the Centennial Area do not pay to the City of f))glewood
fer the collecticn services the City provides to other residents 1olho do pay the City's rate.

experience in the put that district 'IIOters do not have sufficient interests
in the operation of the district to vote in or otherwiM pArtici~te in this

ity. The coun's re"ie~~o· of the contract or, if the municipality and the s~cial
district . after &ood faith neaot ia tions arc unable to aaree upon a contract,
the coun's order shall be in accordance "''ith the criteria set fonh in para-
lflphs (b). (c). and {d) of subsection (2) of this section. The s~cial district
shall continue in existence for the purpose of fulfillina any obliaation
imposed upon it b~ the contract with the municipali ty or otherwise.
(c) Any election held pul'5uant to this subsection (7) shall be held and
conducted. and the results thereof determined. in the manner pro"ided i n
pan 8 of this article.

Chairaan To.ooka asked that everyone turn their attention to the
letter dated April 15, 1981, fro. for.er Mayor Eugene Otis to Barbara
Holthaus, Chair.an of EDDA at that time. Chairman To1110oka noted
that he spoke vith Joe Plizga in hopes that an agree~~rnt could be
ude as to tlho 1a ulti-tely responsible for •intdning the parking
lot (corner of South Lincoln and East Haapden). It was felt that
the letter vas a~vhat vasue, but, Hr. Wanuah noted that he felt
that were thia letter to have been directed to hU. he would have
interpreted it as clearly stating that the City of Englewood is responsible
for repairs. Hs. Dietrich, as well u for.er Mayor Otis had been
contacted regardiftl this aaree.ent. There waa considerable discussion
regardina the re•ining loan to Hr. Litvak Sachter. It wu decided
that Chalraan To.aoka vaa to contact Hr. Sachter regarding the payoff
a.aunt. The EDM in turn would deed the parking lot over to the
City of Englewood. It vaa the ,eneral feeling of the Board th at

Independence Fair: Ms. Hayes explained the KOOL-105 promotion (which
Ms. Hayes explained is totally up to the merchants), the possiblity
of .. tchins funds with the aerchants for advertisins before the event,
and the list of sponeors for the two-day fair.
Ms. Hayes noted that she had been approached regarding donations
for fireworks for the 4th of July. She explained that when she
beaan puttina toaether the Fair the Jaycees were aoins to handle
that pr~tion. Since that tiae the Jaycees have teaporarily postponed
their firework project until further notice.

The Regular Meeting of the Englewood Downtown Developaent Authority Board
of Director's was called to order by Cbairaan Walt toaoolta at 12:10
p.m., on June 14, 1989. Cbair.an to.ooka noted that everyone present

Board of Directors, Chairman Tomooka asked for approval. Mr. Green moved,
seconded by Ms. Hathaway. The motion passed unanimously. As is customary
Mr. Pendleton 's request and subsequent approval will be submitted to
the City Council for their approval.
EDDA Parking Lot -Meeting with Mr. Sachter
Chairman Tomooka said that he had met with Mr. Sachter regarding the
portion of the parking lot on South Lincoln and Hampden Avenue, owned
by the EDDA. Chairman Tomoou said Mr. Sachter would prefer to have
monthly payments until the note matures in 1990, but if deeding the
parking lot over to the City of Englewood is more agreeable with th
EDDA and the Board of Directors, he has no objection. He did ask Chairman
Tomoou 1f he could obtain a copy of the amortization schedule. Curr~t
monthly payments are $502.00. The balance is approximately $8,300.00. Discuasion ensued .
Chairman Tomooka then asked Ma. Hayes to delay her first agenda it
and continue discusaion of this matt r.

of the activities planned for the event. KOOL-105FM Radio has agreed
to sponsor the event along w1 th Coors, Melody Music and Sound, and Pepsi.
KOOL-105FM, through a KOOL card discount progr01 with participating merchants,
will be giving the EDDA two weeks of free advertising for the event.
Ms. Hayes also noted that she had written press releases asking for
volunteers to help throughout the two days. Although few have signed
up, she is confident by the day of the Fair volunteers will be recruited.
"Sounds of Su-r" -Concert Series:
Ms. Hayes was pleased to announce that the first concert of the series
was dee.ed a success with approxi .. tely 40-50 having attended. The somewhat
incle•nt weather vas a factor so it is hoped as t1ae paases and word
spreads and the weather is 110re predictable, that even .are people will
be attendina the event each week. Ms. Bayes also noted that she has
had nu•rou. calla, all of which were very favorable and in support
of onaoina concerts.

Mr. Pendleton made the comment that the downtown businesses should consider
themselves in an opportuni tis tic position with the Farmer's Market right
downtown because it would create a draw of people that otherwise would
be bypassing the merchants on South Broadway. Several ideas of promoting
local merchants this one day each week were discussed.
As there was no further business, the meeting was adjourned at 1:40.

staff, City Council deterained that the Clty is unable to pursue a 1989 fireworks

Council feels an activity of this kind should be organized and supported by the

sion . This 1s a new section of the Englewood Municipal Code , and draws reg-
ulations froa Title 6, Title 11 and Title 16 . This section of the Municipal
Code will pertain to Health, Sanitation, and Environ.ental Protection codes,
and deal with trash, weeds, derelict vehicles on private and public property,
ca..ercial vehicles, trailers, snowplows, recreational vehicles in residential
neipborhoods, and the distribution of handbills.

noise control ordinances, and addressina the issue of skateboarding .
Krs. Roaans stated that on Nay 1, the Code Enforce .. nt Prosr .. vas put entire-

discussed the preliminary agenda. The goa of th i s workshop is
to dra!t a mission statement (not over 100 words ) that expresses
the major service strategy of the Library for 1991-1995. After
the mi ssion statement has been adopted the Planning Committee,
Board, and stat! will continue with development of goals.
Director's Choice
Ms. winkle distributed a memo !rom Roger Fraser, City Manager,
transmitted to City Departments regarding the Budget Preparation
tor 1990. She also noted aaterials expenditures !or 1989 must be
decreased in order to compensate tor funds needed to cover
increased salary and insurance coats which were not included in
the 1989 budget. Discussion followed.
Budget information is being prepared now. She will have figures
available to discuss with the Board in July.
Information was distributed regarding the Summer Reading Program.
The prograD was prepared by Penny Lommen and will begin next week.

The City Charter is not specific regarding certain items,
but does prohibit an increase in the "monthly salaries " during
the current term of the Council Members enacting such ordinance.
What do you think the Charter meant by "monthly salaries "? Did
they mean the salary to be in addition to mandatory payroll
benefits such as Social Security, Worker's Compensation, etc., or
did they mean for the salary to be a flat fee and for the City to
object to and refuse to pay any Social Security, etc., as i n the
case of contract labor? Did they even cons i der the growth of
payroll benefits as an expected part of compensat i on that has
evolved over the paat 30 years?
Did they mean to proh i b i t off i cers of the C i t y f rom
part ici pat i ng in City benef i ts, s u c h a s health /dental p l a na,

SYSTEMS INC. (NTMSI) FOR ACQUISITION OF SL -IST TELEPHONE SYSTEM HARDWARE AND SOFTWARE.
WHEREAS, the City Council of the City of Englewood, Colorado, by
Section ll6(b) of the Home Rule Charter, can approve contracts without competitive bid; and
WHEREAS, the City Council desires to improve the telecommunications syste. of the City; and

submitted by NTMSI represents significant costs savings; and
