(a) Mickey Horton, 2870 South Acoma Street, addressed Council concern-
ing the near drowning of his daughter at Cushing Park. He requested that
Council consider installing a fence around both ponds to alleviate the danger
of a similar occurrence. He stated that the City's code required that swim -
ming pools be fenced; he felt a si•ilar requirement should be applied to the
ponds. Mayor Van Dyke assured Mr. Horton the Council would consider his
request and advise him of its dec is ion after consulting with staff. A two -
week time period was agreed upon.
(b) Audrey Horton, 2261 South Fox Street, explained she was the
grand.other of the girl who al.ost drowned at Cushing Park. She informed
Council that two years ago she had requested the City to consider fencing the
ponds but had not been given serious consideration. She reiterated her con -
cerns and asked Council to seriously look at the proble..
(c) Betty Keena, representing the South Metro Denver Chamber of Com -
merce, was present. She introduced two other representatives of the Chamber:
Dick Harrison, President, and Brian Voight, Vice President in charge of
econa.ic develo~nt. Ms . Keena stated that the South Metro Denver Chamber of
Ca.merce strongly supported the establishment of an Englewood Economic
Develo~nt Coalition -Agenda lteta ll(c). As a IIM!tlber of the Englewood Down -
town Task Force, she felt the Task Force had achieved its purpose and had been
successful; she and others who had been involved believe it is ti.e to be con -
cerned about the econ011ic develo~nt of the City as 1 whole, not just the
downtown area. She again stated the Cha.ber's support of the Resolution to be
considered under Agenda lt .. ll(c).

( 1) City Man;ager Fnser presented 1 rec011111end1t ion frOIR the Public
Works Dep1rt.ent to adopt 1 bill for ;an ordinAnce ;approving 1n ;agreement with
the U. S. Corps of Engineers for p1rti1l funding of the Oxford P1rk iMProve-
~~ents. Mr. Fraser expllined th1t the costs of the project, estiMAted It
$181,800, would be on 1 50/501 sh1re b1sis with the City providing the front
MOney of $90,246 and the Corps of Engineers a like aMOunt. The City should be
reillbursed its share by Urb1n Edges ;and South Suburban Park Found;at ion, IS
both organizations have co.itted to raise the MOney for this purpose . Mr.
Fraser stressed that it is iMPOrtant to understand that the Corps has provided
a caveat about these funds, that reillburs..ent is not 1001 guarAnteed;
however , he did assure Council that in all likelihood the funds expended by
the City would be reillbursed. He also inforwed Council that an agreeMent
between the City and Urban Edges/South Suburban Park Foundation would be
forthc011ing .
Council ~r Clayton asked the Clerk to read Council Bill Mo . 32 , entitled :
A BILL FOR AN ORDINANCE APPROVING AGREEMENT BETVEEN THE UNITED STATES OF
AMERICA AND THE CITY OF ENGLEWOOD FOR RECREATION DEVELOfiMENT OF THE SOUTH
PLATTE RIVER LOCAL FLOOD PROTECTION PROJECT DOWNSTREAM FROM CHATFIELD LAKE .
Mr . Clayton proposed a change In the ag~nt on Page 9, Article 19 , to read :

(b) Director Wanush presented a reco.endation fr011 the Depart~aent of
Community Develo~nt to adopt a resolution supporting an application for En -
glewood's participation in the Colorado Single FaMily Mortgage Revenue Bonds.
Mr. Wanush provided Council with copies of a current status report of the
Colorado Local Mortgage Bond Progra.. Mr. Wanush explained that approval of
this Resolution would authorize the City and County of Denver to apply for
housing funds on behalf of Englewood, Denver and other ~aetropolitan cities,
further that we would be delegating to Denver the authority to issue the
bonds, expense of which will be borne by Denver. He explained that the City
had participated in si•ilar consortiUMs for the past three years, that in 1987
the City had received Sl.6 •1111on and in 1988, S780,000 toward housing for
first -t1• ho.e owners . By participating in the consortiUM, the City would
save considerable expense which could have prohibited Englewood fr011 par-
ticipating on its own. Methods of pr0110ting the progra• were discussed.

(a) Werner Schnackenberg, 3675 South Cherokee Street, expressed disap -
point•nt about Council's cut of funds to Interfaith hsk Force (IFTF). He
stated he hoped this would be 1 te.porary cut. He e.phasized that in almost
every category of service provided by IFTF, Englewood citizens comprised the
largest nUiber; he felt IFTF deserves to receive strong support from the City
of Englewood, and he urged Council to assign a high priority to its future
support. Mr. Schnackenberg was advised that Council would consider alloca-
tions of 1990 contribution funds at the budget retreat in Septe.ber.
(b) Willi .. Klibbe, 2905 South Delaware Street, scheduled to speak con -cerning skateboarding, did not appear.

(a) Shtrun Salazar, 4742 South Decatur Street, addressed Council on
behalf of several citizens who recently experienced probl .. s with sewage back -
flow fro. the Valley Sanitation District service. Mr. Salazar asked what the
City of Englewood plans to do to assist those people relative to expenses in-
curred, etc. City Manager Fraser infor.ed Mr . Salazar that the Valley Sanita -
tion Dfstrtct hid been advised of the City's concerns, and suggestions for
appropriate action are being .. de directly to the District . It was also
pointed out that It is not within the City's authority to intervene directly
In this .. tter. City Attorney DeWitt stated research had been done concerning
this .. tter, that a nu.btr of alternatives were available; however, those al -
ternatives had not been revtewct with Council. Mr . Salazar was provided a
copy of Mr. DeVitt 's research data, and it was strongly suggested that the
group consider legal action against Valley Sanitation District . Mr . Salazar
reiterated hfs position and asked If the City would accept the tnsunnce
clal... Mayor Van Dyke assured Mr . Salazar that Council was still reviewing

Mr. Woika, Utilities Manager, confin.ed that the bid of SZ6,666 was lower than
the Engineer's esti.ate. It was also stated that this work is being done in conjunction with Paving District No. 33.
(c) City Nanager Fraser presented 1 reca..endation fro. the departments
of Financial Services and Public Works regarding award of bids for four pieces
of equi~nt under the Capital £qui~nt Replace~ent Fund (C£RF). Mr . Fraser
concurred in the reca..endation as set forth in the Council COMmUnication for
Jt .. s 1, 2, and 4. Concerning lt .. 3, Mr. Fraser explained that it has been
suggested by the Utili ties Depart•nt that the award for the Rubber tired
wheel loader/backhoe should be .ade to Case Power & £qui~nt in the amount of
$56,910.77 rather than to Honnen £quiP~tnt Co.pany in the amount of S64,500.

a task force for the Englewood School District, and stated that statistics

The l.,ortance of an Econ0111c Develo,..nt Progr .. for the City was discussed,
and Mr. Wanush stated that he Is of the opinion that It Is necessary that the
"poliCJ aakers• be Involved. He envisions a diversity of viewpoints and while
the Planning c .. lsslon needs to have Input, the llellbership of the EconOIIIC
Devel~nt c .. tttee should not constitute any one "group". Mr . Wanush
stated that sa.e .. tters that would be considered tn the Econ0111c Develo,.ent
Progr• do COle within the purview of the C .. lsslon, and ctted density, land
use, transportation, etc.
Mr. Ftsh suggested that •econoatc devela,.ent• ts a "buzz• .ord of the '80's

The provision of tax substdles for new businesses was discussed . Mr . Fish

Mr. Carson discussed the possibility of rezoning a portion of the industrial
area south of U. S. 285 to prevent construction of additional "warehouses".
Mrs. R0111ans suggested there 111y be a need for a new zone district to be developed.
Mr. Volk ... stated that he is of the opinion that the Phnning Co11111ission
should have a lot of tnput on the EconOMic Develo~nt program, but cautioned
against getting •nit picky•. He asked if the staff could draft a proposal for
further discussion. Mr. Wanush stated that he 1s writing something for the
City Manager on Econa.ic Develo~nt. Further brief discussion ensued.
IY. CCIIPIEJDSIYE PLM
Mr. Wanush asked how ....,.rs of the C~ission envision the COIIprehensive
Plan. Do they want to see 110re detail; what do they think a COIIIprehensive Plan is?
Mr. Fish stated that in reviewing the 1979 Ca.prehensive Plan, he does not see
1 •Plan•. In his opinion, this docu.ent is a stat ... nt of where we are , but
does not set forth what the City is to work toward. Mr. Fish stated that he
f .. ls the -.dical area is one of the strongest points Englewood has, and this
should receive stronger lllphash in the Ca.prehensive Plan. Hr . Volke~~a
agreed, and noted that the area betwten Ha.pden Avenue and U.S . 285 could be
redeveloped because .. ny of the hOllies in that area are in poor condition . Hr .
Wanush stated it appears that the Ca..ission is looking for an •action plan•;
he pointed out that the City has legislative and infrastructure respon sibili -
ties, but that the full 1-,l ... ntation of a plan depends upon private decisions.
Mr. Volk .. stated that the designation of Swedish Medical Center as the
regional trauaa center is a great asset to the City, and that we could en -cour~t~ businesses that are -.dically oriented . Hr. Volk .. stated that froa
c-.nts he has heard, it s .... that SfiC personnel have gained tht perception
that the •city doesn't care fort~·. Mr . Schultz stated that he has heard
froa several SCMirces that the City was anti -business . He stated that he feels
there is a need to •advertise ourselves•, pointing out that the City is close
in to Denver, and offers lots of services; there Is a need to provide an atti -tude that would be attractive to businesses .

V. CODE REVIEW COMNITTEE UPDATE
Mr. tarson reported on the progress of the Code Review Committee. He stated
that during the .. etlngs he has attended, 1t does not appear that there will
be that -.ny changes .ade In the codes and ordinances.
Mr. Wanush stated that there will be so.e consolidation of restrictions into
one ordinance, rather than having restrictions cited In two ordinances. Mr.
Wanush also discussed the reorganization of the Depart .. nt of Community
DeveloPMnt, in which the responsibilities for Code EnforceiiN!nt will now be
assigned to the Planning Division rather than Building and Safety. There will
be two full-ti .. Code Enforc ... nt Officers, and during the summer months, the
Fire Prevention Inspector/Code Enforc ... nt Officer will assist on a part time basis.
Mr. Schultz suggested that flex-ti .. •ight be considered during the sunner
IIOflths, also; this could provide an officer on duty on weekends or 1fter 5
P.M. He discussed a probl .. he had experienced with a pack of dogs running
in his neighborhood, and the fact that there were no Code Enforce .. nt person -
nel to respond to the probl .. until lZ hours after he had called in the co.-
plaint. Mrs. Ro.ans pointed out that Code Enforc ... nt Officers do not handle
proble.s with ant .. ls; that is the responsibility of the Anl•al Control Divi -sion . Discussion ensued.
VI. MOUSI. TASl FOICE
Mr . Draper stated that -..btrs of the Housing Task Force were taken on a tour
of the City recently to view the housing stock In the City. He stated that
rs of the Task force were very favorably illlpressed with the new houses
constructed by the Alternative High School students in northwest Englewood,
and wtth the Modular housing units that the Englewood Housing Authority fs
develop 1ng and sell i ng, as well as the units that are being rehabilitated by
t e using Authority for rental and/or sale. Mr. Draper acknowledged that
there are areu of hous i ng wre Mdtti011al help and/or rehabilitation 1s
needed, and there are areas of very ntce housing.

FINDINGS, DECISION AND ORDER
Introduction and Statement of the Case
This a grievance which ca.es to the Career Service Board under Article 28, Grievance Procedure, of the contract between the City of Englewood and the
Englewood E~loyees Association for the period January 1, 1988 through December
31, 1990. Pursuant to step 4 of the Article, the Career Service Board is vested
with the authority to hear and deten.ine grievances that are unre solved through
prior steps of the grievance procedure. All parties agree that the prior steps
of the grievance procedure had been ca.plied with and that it was procedurally appropriate for the •atter to be before the Board.
This grievance was filed on May 25, 1989. The ~loyee filing the
grievance is Peter Juene•ann, EEA/AFSME President, on behalf of the Englewood E~loyees Association . The hearing was held on July 6, 1989 .
FINDINGS OF FACT
The Board hereby finds the following fact established by the evidence presented tn this case:

EDDA Parking Lot -Meeting with Mr. Sachter
Chairman Tomooka said that he had met with Mr. Sachter r egarding th e
portion of th parking lot on South Lincoln and Hampden Avenu , owned
by the EDDA. Chairman To110oka said Mr. Sachter would prefer to have
monthly payment s until the note matures in 1990, but if d ding th

Hr. Pendleton made the comaent that the downtown businesses should consider
theaaelves in an opportunithtic position with the Far.er's Market right
downtown because it would create a draw of people that otherwise would
be bypassing the merchants on South Broadway. Several ideas of promoting
local merchants this one day each week were discussed.

~Is . Hayes reported that to date the response and turnout for the
weekly noon concerts in The Plaza has been better than ex pee ted.
She also noted that probably the most we 11 at tended concert was that
of the Hilltoppers which Gordon Close, (an EDDA Board member) is
a member . of. She also noted that the wea ther impacts attendance .
Ms. Hayes made a point to say that the Englewood Chamber of Commerce
is by far the greatest supporter of the noontime concert s. The
first evening cone rt was a total success with Th e Plaza area completely
filled. Ms. Hathaway not d that even with the sc hedul ch<~ng betw en
the Rockin' Reveliers and the Bronco Band, e veryon in attendance
enjoyed th concert. Hs. Hay s also not d that Chai rl':lan Tomooka
was generous enough to off r the se rvices of his employees to build
a permanent wooden billboard for banners at the south entrance to
the Englewood Marketplace (Ponderosa Steakhouse) which Hs. Hay will

was in each of the board member's packet. To date she had not recejved
any response to the offer the EDDA Boa rd made in which the EDDA
agrees to maintain the parking lot on South Lincoln and Old Hampden
Avenue, (electricity, water/sewer, snow removal) until Decembe r 31,
1989 at which time the City of Englewood will take th e responsibility
of all maintenance costs. In the interim the EDDA would deed th e
property over to the City, as wa s agreeable with Mr. Sachter a s well.

by the Englewood Chamber of Commerce to be the Chairperson for this
year's 3rd Annual Business Fair, tentativ ly scheduled for som tim
in the first part of October. Hs. Hayes also noted that she had

The regular monthly meeting of the Englewood Parks and Recreation Comnisston
was called to order at 5:34p.m. by Chairman Neyer at the Englewood Public Library Conference Roo..

Chainaan Neyer asked if there were any additions or corrections to the ~inutes
of May 8, 1989. There were none. A motion was •ade and seconded that the minutes
be approved as presented. The motion passed with one abstention from Commissioner Arwstrong.
Director Winkle reviewed some background inforwation regarding recreation
progr .. s such as canoeing, sailing, rafting, etc. that have been offered in the past
stating that interest in this area has been very low. Ca..tssioner Clayton stated
that he is interested in instigating a perwtt progra. that would allow individuals
to use Centennial Lake for boating, canoeing, etc . There was considerable
discussion regarding a perm it system of this type, including size of groups , the
effect boating .ay have on fishing, the necessity of a boat launch, control of a perwit syst .. , liability insurance, etc.
Director Waggoner stated hat many ComMU nities have discontinued boating on
their lakes due to the high cost of liability Insurance, and for lake sizes under 50
acres . Wanoner stated that the Colorado Division of Wildlife has requested, should
boating be peraftted at Cent nn1al Lake, that fishing be allowed fro. boats.

Commissioner Clayton made a motion, seconded by Commissioner Armstrong, to
recommend that in 1989 permits be issued to special groups subject to restrictions
concerning liability matters. The motion was defeated with four opposing votes from
Commissioners Braucht, Gomes, Kozacek and Youth Commissioner Ramelow.
Director Winkle reported that as a result of extensive investigation by City
staff, City Council determined that the City is unable to pursue a 1989 fireworks
progra.. Winkle reviewed some information that was included in the Commission's
packets concerning a fireworks program. Commissioner Clayton stated that City
Council feels an activity of this kind should be organized and supported by the
various public service groups in this area. Clayton stated that Council is willing
to support a fireworks display financially and assist the project but they are not
willing to have a fireworks display funded by taxpayers. Clayton stated that he and
Councilwoaan Habenicht will meet in the Fall with Director Winkle and staff to lay
the groundwork for a display in 1990. Discussion included the possibility of laser
shows, different locations to consider for a fireworks display, specifically the
golf course, charging fees, etc. Commissioner Braucht aade a MOtion, seconded by
Ca..issioner Go.es, to recommend to Council that a ca..ittee be created to
coordinate the 4th of July celebration for 1990. The MOtion passed unanimously.
Director Waggoner reported that the graffiti covered walls along little Dry
Creek, as per Youth Ca.missioner Hathaway 's inquiry, are part of the old structure
which is under the aatntenance of the State Highway Depart.ent. Waggoner stated he
discussed this with the Highway Depart n Maintenance Superintendent who indicated he will check into it .
Director Waggoner reported that bi ds for lighting of the driving range at the
golf course have been received and he is await ng Council 's award of the low bid to
MAupin Electric for the sua of $45,250. aggoner stated that Council had approved
$59,000 in the 1989 golf course budget for dr ng range lighting. Waggoner stated
that the project should be completed by the end of July .

Director Winkle briefly discussed the 1990 budget preparation process and
passed out copies of a memo from City Manager Fraser.
Director Winkle passed out information concerning Senate Bill 76 for the
Ca..ission's review.
Director Winkle reported that Council approved a reca..endation fro. the Halley
Center Trust Fund Ca..ittee that an amount not to exceed S900 be expended from the
Trust Fund for the services of a property acquisition negotiator for acquisition of
property fro. the St. Louis Parish should that opportunity arise.
Director Winkle reported that City Manager Fraser has asked staff to develop
infonaation concerning the possibility of constructing a water park fac ility in
Englewood. Ca..issioner Clayton stated he believes the benefits to the City frOM a
facility of this type would be great in ten~s of recreation opportunit ies and
revenue to the City. Following sOMe discussion, Ca..issioner Kozacek aade 1 .ation,
seconded by Ca..issioner Coles, to rec~nd to City Council that staff investigate
and gather infonaation to determine the possibilities of providing 1 water park
facility in the City of Englewood . The .ation passed unani.ausly.
Ca..issioner Ga.es asked if Director Waggoner had investig ated the feasibility
of pen~itting self-contained concession carts at Belleview Park as wa s discussed at
the Ca..ission ..eting in May . Director Winkle stated she will pass this inquiry on
to Director Waggon er, since he left the meeting earlier .
Ca..tssioner &o.es also nquired about the continuous burn ng of the tennis
court lights . Discussion ensued.

and provide the City each year with 30,000 flowarbad plants, take care of 300
plants in City buildin&s and taka care of trees in the nursery on that

Mr . Schultz asked if approval of the three signs at the Englewood Marketplace
right off of U.S. 285 came through the Department ; he stated that he is of the
opinion that the number of and placeaent of the signs is "tacky". Ms . Hirsch
stated that a Planned Development was not required for the development of the
Englewood Marketplace, and the location of the signs could not be viewed be -
forehand . She stressed that this is one of the reasons for requiring a "sign

Property Tax Abatements
Mr. Wanush stated that at the meetIng of the Author! ty on May 3, 1989, Ms .
Justice was authorized to file suit on the tssue of property tax abatements.
Mr. Wanush stated that Ms . Justice is in attendance to bring the Authority up -
to-date on the status of th is issue. Mr. Wanush suggested that th is discus -sion should be in Executive Session.

cial Advisor to the Authority, is present to discuss the request .
Mr. Bell stated that Bel-Air Savings entered into a repurchase agree.ent with
the Englewood Urban Renewal Authority in 1986. At the ti.e the agreement was
agreed to by both parties, no one anticipated use of the Reserve Fund to the
extent that it has been used . The use of the Reserve Fund has created some
"internal accounting" probla.s for Bel-Air. Mr. Bell discussed the accounting
procedures used by Bel -Air as he understands them. Mr. Bell stated that the
request to renegotiate the Repurchase Agree.ent has no advantages for the Au -
thority, and that he has .. de this clear to ROM representatives when he has discussed the .. tter with th ...
Mr. Wanush stated that it is hi s reca..endation that the Authority not agree
to renegotiate the Agre ... nt . Di scussion ensued . It was the consensus of the
Authority that the Repurcha se Agre ... nt with Bel -Air Savings shall not be renegotiated .

VII. SALES TAX REVENUE PROJECTIONS
Mr. Stitt discussed the sales tax revenue projections, and eiiiPhasized that
these projections are just that --projections or "estiaates" which are sub-
ject to change with the changing of the retail aarket. Mr. Stitt stated that
actual revenues fro. sa.e of the recent retail outlets have not equaled the
projections that were initially 11ade. This reduces the total revenues which
were anticipated for debt service, and also affects the ..aunts that have been
drawn fro. the Reserve Fund for debt service paywent. Mr. Stitt discussed the
spread sheets that he has prepared on the projections, and stated that he has
included a colu.n for "required subsidy" to .eet the bond paywents. Mr. Stitt
pointed out that if the reaaining vacant square footage were to be leased, and
realize sales at $125/square foot, this would still require drawing on the
Reserve Fund. The required subsidy would decrease.
Mr. Stitt stated that the revenue fro. property taxes is $200,000 short be -
cause of the .. thod used by the County Assessor in applying tax abat..ents.
The possibility of leasing the vacant area for purposes other than retail was
discussed. Mr. Wanush pointed out that leasing the area for any purpose other
than retail is of no assistance to the Authority, or to the city as far as
sales tax 1nca.e is concerned. Mr . Wanush stated that he has .et with the
leasing agents for Phar-Mor Plaza and Trolley Square . He stated that the con -
cerns that Phar-Mor Plaza agents have stated is the .. tter of visibility fra.
U.S. 285 . Mr. Wanush stated that the City has taken traffic counts on the
streets adjacent to Phar -Mor Plaza to give an indication of the area traffic,
and the City will do whatever can to assist 1n the leasing of the re.aining
areas. ~. Wanush stated that the Trolley Square leasing agents have stated
that the parking factHtie s/ava i lab llty h a large Issue . Another COIIPhlnt
ts that the trees planted along South Broadway to beautify the downtown area
obscure the signs on the bu il di ng . Prospective te11a11ts hne also talked to

Ms. Byrne st&ted that she had spoken to the aanagers of Jas•ine Chinese Res -
taurant regarding the volu.e of business they did during the Independence
Fair, and apparently business w&s not very good. Discussion ensued. Mr. Voth
pointed out that it aay take several years of holding the Independence Fatr
before it •catches on• with the public.
Mr. Wanush stated that it appears the First National Bank of Englewood will
not stgn off on the cond..,.ation action for the EnglftiOOd Parkway rtght -of-
-.y, and that thts tssue will have to be settled tn Court, even though Clave -Trust has agreed to settle .

Lessor. However, in the event Lessees shall reconstruct the structure, or any

THIS DELEGATION AGREEMENT (this "Deleqation Agreement "), dated this day of August 1989, is between the CITY OF
ENGLENOoD, COLORADO, a body corporate and politic (the "Delegator"). and the CITY AND COUNTY OF DENVER, COLORADO, a
body corporate and politic (the "Delegatee ").

NHEREAs. the Delegator and the Delegatee are each
authoriaed by tbe County and Municipality Development Revenue
Bond Act, constituting artic le 3 of title 29, Colorado
Revised Statutes (the '"Act "), to finance properties to the
end that more adequate residential housing facilities for
low-and middle-income families and persons may be provided ;
