Call to Order • • • ENGLEWOOD CITY COUNCIL ENGLEWOOD, ARAPAHOE COUNTY, COLORADO Special Session April 11, 1988 The special .. eting of the Englewood City Council was called to order by Mayor Van Dyke at 7:37 p.•. The invocation was given by Council Me~r Koltay . The Pledge of Allegiance was led by Mayor Van Dyke. Roll was called. Prior to the ordinance being considered on final reading, staff would review those concerns and respond to them. If Council chose to amend the ordinance, those amendments would be considered on Hay 2, 1988; the ordinance is scheduled for final reading on Hay 16, 1988. Hr . McCown informed Council that Director Ragland, Engineering Services , would commence the staff presentation. Council Mellber Clayton explained that he and his family own property within the District; because of the possibility his actions and decisions could be interpreted as a conflict of interest, he stated he would not participate in the Public Hearing . Mr. Clayton withdrew fro. the meeting at 7:40p.m . All staff -..bers and c1t1zens testifying during the hearing were duly sworn by the City Clerk . Director Ragland, Engineering Services, gave background Information concerning Paving District No. 32, which was created by ordinance on April 20 , 1987, to Include reconstruction of ten (10) blocks and overlay of seventeen (17) blocks In the City of Englewood. She explained the final assess•nt data and the costs of the paving district . Costs wh ic h are assesuble to the ho..owner total $258,695 .28 . The costs to be borne by the City total $127,046 .60 . This data was co.pared to the est1 .. ted costs of the Di strict, I.e., estl .. ted as - sesuble costs -$585,500 .00, estl .. ted City costs -$157 ,500 .00 . She x- plained that the uvlngs wre a result of the excellent construction prices received on this project as well as the fact that a .. jorlty of the concr te work was done by private contractors at the ~rs ' option . She lnfon.ed Council that the Interest to be charted on the assessable costs was 7.51 . The schedule for the co.pletion of the Distr ict was outlIned. Mayor Van Dyke invited concerned property owners to address Council concerning their assess.ents. Fred W. Vondy, attorney for Rocky Mountain District Council of the Asse.blies of God, 300 East Ha.pden Avenue. Mr . Vondy stated the unusual circu•stances of his client having reacquired the property through foreclosure. It is their position that no benefit accrues to the property by reason of the street im - prov ... nts, that the benefits accrue to the Safeway Store and Shopping Center properties located at 201 East Jefferson Avenue. They requested to be relieved frOM the proposed assess•nt. Harold Madsen, pastor of Rocky Mountain District Council of the Ass..Oltes of God, 300 East Hlllpden Avenue, ,..Iterated Mr. Vondy 's c~nts, uphlnlng that they had just ass-.d the property as of April 1, previously owned by Bob Jones. HeMaan O.Vltegher, 4610 South Cherokee Str11t. Mr. DeVltegher stated he was one of the original property owners in hts block, having resided at that loca - tion since 1952 . He previously paid for paving, curbs and gutters n 1954 having bMn assessed SZ46. However, there does not appear to be any ,..cord of that transaction . He urged Council to absolve hi• fro~~ this current ass ss - nt based on th fact that he had been assessed previously for this rk . Mr . O.Vltegh r pr s nted his Warranty Deed dated S pt r 12 , 1952 as evfd nee of ht s r std ncy for th past 36 y ars . I . • • • Englewood City Council Minutes Public Hearing -April 11, 1988 -Page 4 responded that Royce S.ith, a real estate broker and appraiser in the City of Englewood is available. Royce L. S.ith, 7037 South Platte Canyon Road, Littleton. Mr. Smith stated he was a real estate broker, appraiser, and .. nage.ent consultant specialist for construction. He testified that he had been called upon to offer testimo - ny in respect to value in various State of Colorado and Federal courts, that he has been declared an expert appraiser in every District Court in the five .etropolitan counties. He further stated he was f .. iliar with the property in the 3500 block of South Grant. He described the street condition prior to the paving district as being •very bad•. With respect to the value of property in question, Mr. S.ith confirwed that properties which had been included in paving districts sold quicker and at h1gher prices than properties with streets which had not been included in paving districts. Repave.ent has a tr ... ndous effect on the resale of property, at ti.es increasing the value of the property by five to ten percent. Mr. DeWitt questioned whether the five to ten percent of the value of the property in question would exceed the ..aunt of assess.ent of the property at 300 East H.-pden Avenue -$3,457.69. Our home was only nine months old, when purchased. ~:e had no curbs, sidewalks, or paved street at this time. In the spring of 1954, the city of Engle\IOOd contracted to install a com- plete street with curbs and gutters , between Tufts and Union str. Ot~er paved streets included Elati, Dela~are , Bannock and Acoma, bet~een Quincy and Chenanbo---approximately fourteen blocks. All these streets are still ori&inal with only repairs during the past 34 years. r paid for our new street in 1955, to the amount of $264.00. low, ram asked to pay again ., as a retired couple at he ase of 65.
