Association, did not appear as scheduled.

(a) Kenneth Wae chter, 3127 We st Tufts Avenue, expressed his concerns
over the possibility of closing the Federal Fire Station and the consequent
11<>ving of the fire equipment to the Sheridan Fire Station. He stressed that
when the Centennial Acres area was annexed to the city 28 years ago, the
citizens were pr011lsed fire protection and a fire station in the area. He ad -
vised Council that the continuance of the Feder1l fire station w1s very iinpor -
tant to ill citizens of the city, not just Centennial Acres . He called to
Councll 's attention petitions which were presented to Council In 1986 which
contained hundreds of na.es frOll all over the city in favor of keep ing the
Federal fire stat ion open . He asked that Council do whatever ts necessary to
fulfl ll pr0111ses ude to th• 28 years ago . He was assured th1t adequate
cover age to the Centennial Acres area ts of pri .. illpOrtance to Council, th1t
th utter was still being studied. Mr . Waechter requested to be Involved in
Council's review of the aatter, and he suggested that line personnel frOll th

plant fe•ale Cottonwoods, Siberian Elm, or Box Elder trees (11-5-8-B); it also
defines what is considered to be a mature tree which would not be subject to
removal. He explained that 11-5-8-A as proposed is more restrictive than at
present. After further discussion, Mr. DeWitt explained that an "ugly, un -
sightly or i111properly trilllled tree" is not interpreted as being "injurious to
the health and safety of citizens." Council Metlber Clayton stated the concern
that if the ordinance is passed, the City would be inundated with calls from
peop 1 e who want to ret10ve smeone' s tree because of bugs or because it is
ugly, and the ordinance as written does not give that authority . He also
pointed out that if passed it would be another nuisance ordinance, which is
smething this Council has been trying to curtail. Mayor Van Dyke suggested
that an a.endlient to the ordinance should be offered or the .. tter should be
tabled at this ti• for further study. Council Metlber Byrne explained that
she wanted to start a beautification drive in Englewood as far as the planting
of trees is concerned . Council Mellber Habenicht suggested that the wording in 11 -5-8-A be as follows:
PUBLIC DANGERS : The City Forester shall have the authority to designate
unlawful trees or plants and to order the ret10val of existing trees or
plants, where their existence 1s injurious to the health and safety of citizens or property .

brief synopsis of the changes, explaining that the .. tter would be presented

brochure •Ballot Issues 1988.• He advised Council that SOiie of the issues on
the ballot would have r .. ifications for 111.1nicip1l govern11ents.
(b) Council was advised that a resolution concerning the Dart.auth/
Downing intersection would be sut.itted for their consideration on the Novem -
ber 7th agenda.
(c) Copies of 1 letter fro. the attorney representing South Arapahoe
Sanitation District relative to the Connector's Agree11ent were trans•itted .
(d) Mr. DeWitt passed out copies of 1 resolution concerning the liquor
license at the £ngle.ood Municipal Golf Course Clubhouse . He explained that a
vote in favor of the resolution would authorize the City to apply for the
1 icense, 1 vote in opposition would require the concessionaire to apply for
the license . The consideration of this aatter was delayed until later in the
•eting.

Concerns were expressed by Council Metlbers Habenicht and Clayton regarding the
license being in the n111e of the City . Further clarification was offered by
Mr. Vargas concerning the proposed licensing procedures., i.e .,
-the license, at the present ti11e, would be in the n1111e of the City
-when the concessionaire is selected, the City would transfer the license to the concessionaire
-the contract with the concessionaire would contain 1 provis i on that the
license be transferred back to the City should the contract expire or be canceled for any reason . Discussion ensued.

1989, BASED ON RECOMMENDATIONS PRESENTED IY DIRECTOR FREEMAN. No second was •ade at t his time .
Ms. Freeman explained that the bill for an ordinance bei ng considered con -
tained a secti on establishing and certifying the mill levy for the Englewood
Downtown Development Authority . Input from the EDDA has not been received ,
and if Council did not wish to establish the mill levy for the EDDA at this
ti11e, th at secti on wo uld need to be stricken fro• the ordin ance.

Council Mellber Koltay stated his opposition to raising the mill levy as he
felt Council had set a pathway to adequate revenue reserves . He agreed that
any increase in expenditure by the business or residential communities had to
be viewed as a tax increase.
Counc i1 Mellber Byrne suggested a C0111prot1i se frOll Option 4 to Option 3 which
would result in slightly less revenues to the city but which would match those
revenues received by the city in 1988. Mayor Yan Dyke explained that it would
be possible to lobby Council between now and the time the ordinance is con-
sidered on second to make such changes.
The fund balance and reserve balance were explained and discussed .
Mayor Yan Dyke stated she did not look upon raising the mill levy as a tax
increase but rather as an adjustment to 11aintain the same dollar amount paid
by a resident in 1988. As Z~ of the city's revenues come frOll property tax,
less than am; of all revenues for operating expenses must come frOll other
sources. Even with the rec01111ended adjustment Englewood, a full -service city,
would still enjoy one of the lowest property taxes per capita in the
•tropolitan arH .
The need for a special meeting was discussed, and it was stated that to meet
the certification deadline the last date any 111endllents could be ade to Coun -
cil Bill No. 34 is October 13, 1988 .

(c) Acting City Manager Vargas presented a rec01M1endation from the De-
part11ent of COllm!Unity DeveloPllM!nt to approve by motion the 1989-1990 Highway
Work Progru, explaining this is done on an annual basis upon request of
Arapahoe County Board of COlllllssioners. Mr. Vargas stated the projects being
requested are not new projects and have basically remained the sa111e for the
past five years; however, he did 11entlon one significant change as being the
inclusion of West Quincy Avenue on the South Santa Fe corridor as an access .
He also •ntioned that the US285/South Broadway underpass is included. He
explained the tl11e constraints which had 11ade It necessary to bring this dl -~tly to City Council and assured Council that the Plann i ng and Zoning COll-
•tssion had been provided copies of the report . Discussion ensued concerning
an alternate street to the Quincy underpass . Mr . Vargas responded to ques -
tions concerning the federal aid on the Federal Urban Syst projec s. The

Council Member Kozacek stated his opposition to this amendment and urged Coun-
c;l to support his posit;on.
Council Member Clayton pointed out that the real issue in this matter is that
another road is needed between Oxford and Quincy down to Belleview and up to
Hampden for conwnerc ial/indus trial traffic which would relieve that burden from
the residential areas .
Council Mellber Kozacek agreed, but requested Council's support of his proposed
study of traffic t111p1cts by the continued closure of Lipan at Oxford.

With methodical precision during he night of Wednesday,
ovember 9th, and early morning of Thursday, November 10th, 1938,
SA, SS and Nazi stormtroopers, disguised in plain clothes,
assembled in pre-arranged meeting places and fanned out to
selected targets in the Je wish co unities of Germany, Austria
and the occupied Sudetenland (the T ird Reich). Following
Gestapo ins ructions, these Nazi agents axed windows, demolished
furn1a inga, wrecked houses, smashed store fronts, ravaged
erchandiae, torched synagogues , and arrested thousands of Jews .

compensate for the damages wrought by the Nazis. Goering
expropriated all remaining Jewish businesses by transferring
their ownership to •Aryan• hands. Thus, surviving Jews were not
only robbed and assaulted, but they were made to absorb the cost
of destroyed property belonging to them without any means of
income.
Panic pervaded the Jewish communities. Thousands packed
Western European and American consulates pleading for exit visas .
Only a small percentage managed to escape, since the total
requests far exceeded the stringent immigration rules and
regulations established by such countries as France, Great
Britain, the United States, Canada and others. In despera ion,
some Jews committed suicide. A few thousand others anaged to
emigrate to Shanghai (China), British-controlled Pal stine, Sou h
America, South Africa and Australia. Of approx i a ely S O,O o

group representing barely one percent of the total popula ion ,
about 160,000 were able to get out (nearly one out of very

The events of November 9-10 were a significant advancement
of the Nazis' "final solution of the Jewish question .• Within
two months following "Kristallnacht,• Hitler, in a major address
to the German Parliament , promised the destruction of the Jewish
people throughout Europe should there be war . Thus , the Jews
were inexorably consigned to the Nazis ' Kingdom of Night.
Under what pretext had the Nazis unleased such blatant
criminal violence agains t the Jews at this time? In Paris,
France , on Monday , November 7, 1938 , Herschel Gryns z pan , a
teenage immig ra nt Jew , shot Ernst vom Rath , the Thi r d Secretary
in the German Embassy in Paris . Grynszpan was protesting the
Nazi Government's forced expulsion of his family from Germany
back to Poland as part of the Nazis ' anti-Jewish policy (known as
the Zbonszyn Incident).
Following on the news of vo Rath's death at 4:00 p •• on
ove ber 9, what purported to be •spontaneous• attacks on Jews,
synagogues, and other Jewish prop rty broke out throughout the
Third Reich. Th s were surreptitiously organized by local azi
Party officials , instiga ted by the anti-Semitic Reich Propaganda

The reco1111endation of the review committee was submitted to the Planning Commission
nd the Comaission considered the 11111endments proposed by the review co111111ittee at a
ublic Hearing on October 4, 1988 .
The substantive &11endllents which were considered at the Public Hearing would delete
automobile sales lots as a Conditional Use and to designate them as a PeI'lllitted
Principal Use. Other &11endments which were proposed were for clarification.

After giving careful consideration to the proposed &11endllents to §16-4-12, Busine ss
Zone District regulations, and after considering the proposed amendments at a Publi c
Hearing, it is the opinion of the City Planning and Zoning C0911ission that the City

of deterioration that some persons felt was intruding i n t o the business district along South Broadway .
After many meetings with car dealers and residents, tours of t he South Broadway area
and consideration of information from other jurisdictions and commercial insurers,
the Planning Commission members recommended that ALL automobile/vehicle related use s
should be permitted only as a Conditional Use in the B-2 Business Dis trict. It
should be noted that automobile car laundries and poli s h i ng bus i nesse s and motor
repair businesses were already Conditional Uses. Sales lots and filling stations
were to be added . As a Conditional Use , each specific automobile/vehicle-related
business would be considered at a specific location and any foreseen or a n tici pated
probleas could be addressed and hopefully resolved before the us e wa s approved .

contractors and subcontractors of such standards, rules and regulations upon
inquiry from such persons, and shall not furnish any information inconsistent
therewith . In this regard, it shall be the responsibility of the District to
obtain from the appropriate governing body the applicable requirements . The
City shall attempt to maintain and provide all requirements to the District ;
however, City does not guarantee the accuracy or completeness of government
regulations other than the City's own regulations .
3. The City's permitting requirements shall be followed by the District and its
users. All plans, specifications and m thods of work within the District shall
be submitted to the City in writing and approved by City prior to any
construction or tap in the District's approved area . No permit shall be final
and no service shall be provided to property until construction is approved in
writing by City .
4 . District shall, at all ti .. s, properly maintain its sewer system and shall
rectify any probleas or conditions which hav been determined by District or
City to be detriaental to City's treatment process . Should the City determin
that any discharge enters the sewer syst m contrary to governing laws ,
ordinances, statutes , rules , regulations or permits , District agrees to proceed
at once to take whatever lawful means may be necessary to re c tify any such
problem or condition .
5. City shall have the right to alloc a e servic und r this c ontra c t, and City raay
deny additional service for any utill t -related reason , but in no event will
City terminate any service withou c au.s . City shall hav th righ to

the term hereof, to treat said effluent and to maintain adequate facilities for
treating of the same .
8. District agrees that it will maintain, at its own expense, all of its lines, or
those lines now owned and operated by District , it being specifically agreed
that City asswaes no responsibility should any of District's lines become
clogged, damaged, or require maintenance. District shall maintain 24-hour
service to remedy disruption in service. District shall, if it deems necessary ,
notify its users of District's procedure to remedy service.
9. City is providing only sewage treatment service and, pursuant thereto, permi ts
incidental use of City's sewage lines only by this individual contract wi th
District and does not, by this contract, offer treatment service except in
strict accordance with the ter•s hereof . This contract does not offer, and
shall not be construed as offering, sewage treatment service to the public
generally or to any area outside the limits of the District's service area
herein described .
10. 'Ihis contract aay not be assigned, sold or transferred by District without
City's written consent .
11 . Should any federal law, rule, permit or regulation or should a decree or order
of a court render void or unenforceable any provisions of this contract, in
whole or in part, if possible, the reaainder shall be of full force and effect .
12 . 'Ihe District shall enforce this agreement and each of its terms and conditions
within the area described in Exhlbi "A ." Distric shall refuse to serv a us r
or potential uaer, disconnect the service of any user pursuant to appropriate
law, or take other approprla e action ln the ev nt of :

laws of the State of Colorado of all existing sever collection systems and
facilities to a governaental entity created to assume responsibility for sever
service in the area in which both City and state are a part under statutory or
constitutional authority as aay be the case .

The major concerns are two:
1. The Agreement does not prohibit the City from charging
a premium for wastewater treatment services to its outside users.
For years, this District has wanted it expressly recognized that
the City does not have an i nvestment interest in t he treatment
plant, upon which a rate of return, payable by outside users, can
be realized. We recognize that, were the City to begin charging
our residents rates higher than those charged to the in-City
u ser s , we could bring a l awsu i t addressing the is sue. We j ust
fel t i t wou l d b e better, a nd perha ps avoi d litigation a t som e

2. In the operation of District's sanitary sewer system,
District agrees that all applicable Code provisions and :-ules
and regulations of City, including amendments thereto during
the term of the contract, shall be the minimwn standards for
District's system. District further agrees to abide by all
applicable state and federal laws, rules, regulations, or
permits, including those of the Environmental Protection
Agency (the EPA) as they become effective or implemented or
upon notice from the City. District shall inform all users,
contractors and subcontractors of such standards, rules and
regulations upon inquiry from such persons, and shall not
furnish any information inconsistent therewith. In this
regard, it shall be the responsibility of the District to
obtain from the appropriate governing body the applicable
requirements. The City sha l atte~pt to aintain and provide

7. The term of this Agreement is for a period of three (3) years
from the date of execution and automatically renewed for s i x
(6) subsequent three-(3)-year periods unless either party
gives a minimum of six months written notice, during which
time District agrees that all effluent produced from taps
within Distr ict s h a 1 not be in viol ation of any federa l ,
state or City laws, rules or regulations, or any other
applicabl e gove~ental regul ations or the permits under
which the City operates its sewage treatlllent system. City
agrees , during the tena hereof, to treat said effluent and to
ma i ntain adequate facilities for treat ing of the saJ:e.

b. Any violation or noncompliance by such user with the
terms of this agreement;
c . Violation or noncompliance by such user with the laws,

States government, including the EPA, the State of
Colorado, including the Department of Health, or other
law, rule, permit or regulation applicable.
d. Continued breac!l of this Agreement by the District
and/or its users shall be considered cause for th• City
to terminate this Agree ant.
Should th• District fail to promptly rectify a breach of
those provis ions identified herein, after notice thereof,
City may take such steps and do such work as it deel::ls
necessary to enforce this agreement, including litigation and
specif ical y a right to injunction or specific performance
against the District or any of its users as is necessary to
protect th• City's syste~ and operations. Th• prevailing
party shal be entitled to expenses and costs of suit,

A RESOLUTION APPOINTING MARY DOUNAY TO FILL THE REMAINDER OF THE
TERM VACATED BY BETTY DOUNAY ON THE PUBLIC LIBRARY BOARD OF THE
CITY OF ENGLEWOOD .
WHEREAS , because of the resignation of Betty Dounay from
the Public Library Board, council desires to appoint a new member
to fill that term expiring February 1, 1989;
UOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OP ENGLEWOOD, COLORADO, THAT:
is hereby appointed as a member of the Public Library Board to
fill the remainder of the term vacated by Betty Dounay expiring
February 1, 1989.

RESOLUTION APPROVING APPLICATION FOR LIQUOR LICENSE FROM CITY OF
SHERIDAN FOR THE PREMISES AT THE ENGLEWOOD GOLF COURSE CLUBHOUSE.
WHEREAS, Mur-Jams Corporation had the restaurant concession
and liquor license at the Englewood Golf Course Clubhouse; and
WHEREAS, Mur-Jams, by letter dated July 29, 1988, Mur-Jams
stated they ~ere terminating the lease effective September 30,
1988; and
WHEREAS, the City Council finds that the application for a
liquor license at the golf course is in the City's best interest.
NOW I THEREFORE I BE IT RESOLVED BY THE CITY cou:~CIL OF THE
CITY OF ENGLEWOOD, COLORADO, THAT:
The Acting City Manager and appropriate staff of the City
of Englewood are hereby authorized to apply to the City of
Sheridan for a liquor license in the name of th City of
Englewcod for the preDises at the Englewood Golf Coura
Clubhouse.

WHEREAS, Amendment 6, a ballot initiative, seeks to amend
the State Constitution by placing severe tax, fee, and
exnenditure limits and restrictions on state and local
governments; and
WHEREAS, decisions on taxes, expenditures, fees, and
services normally are made by elected public officials who are
subject to election and re-election; and
\1HEREAS, Amendment 6 generally replaces representative
government with government by referendum on tax issues;
