The tree rephce.nt progr• and the assess.ent process wre ex - plained. Standards for concrete work for sidewalks, curbs and gutters, widths for streets, and style of curbwalks wre ~~entioned. Office Engineer KaM , duly sworn, stated he will be the project engineer for Paving District llo. 33, and would be involved in the coordination of the design, overseeing the acquisition of rights-of-way/ease.ents, phns and specifications for the project, unagaent of the construction during 1989, and preparation of the final asseswent roll in 1990. Mr . KaM offered to .eet with any of the property owners who •ight have questions or concerns. He wnt over in detail the handout et~titled "Propo sed Pning District Mo . 33", specifying the streets which are to be involved i n the proposed district, the schedule as proposed, the various typical paving sections as wll as alternate pave.ent sections . Costs for the various assess.ents wre defined and explAined. Nayor Van Dyte expllined that it was Council's intet~t to take into consider- at ton all c.-nts by those present COftCerning the creation of Paving District llo . 33, and she set the fo,.. for receiving public c.-nts, stating those c.-nts will be ude on a street-by -street basis . S.U.l "· Va,...n, Vardeun l Solis Junk Yards, 1915 W. Baker Ave . - stated these assess.nts would be unjust and unfair to taxpayers . He questioned what happens to tax _...y paid by the citizens. He felt paving caused pollution tlltlich would affect waterways . He questioned the a•unt of property for street right -of-way , s tat ing they had donated property already for the ins tallation of streets, s.ett• in the 1960s. He felt the dirt street had sufficed all these years and did not feel it was necessary to change. Council ....,_r Clayton inquired if he was of the opinion that 1800 -1900 W. Baker Ave . should be re.oved fro. the pav i ng district . Mr . Vardelun stated for hitielf, yes. He confinled that he was speaking only for the 1900 block . Discussion followd regarding selection of contractors, why the City does not use tax •ney to construct the streets, and the high level of taxes. Guy Sandritter , 1835 W. Baker Ave . • expressed concern about cost, but stated he was in favor of the paving district as Iaker Ave . is quite naM"OW and when i t rains, erost011 creates a Pf'Obl•. Baltic Place -Construct 32 '-wide paving (6 I 2), install CWII on north and south sides. Relocate poles to north side of street. llorvin Larson, 2020 W. Warren/2033 W. Baltic Pl. -strongly opposed the asses~t. stating taxes were already too high and that the property was already assessed for .,re than it could be sold for. He was concerned, since .,st of the lots were vacant, that when they were sold and developed the street would have to be torn up to access utilities. He COIIPlained that in the past Councils have not gone along with the taxpayer, but have sided with the Engineering Depart.ettt. He inforwed Council that the City had taken 6• of his property when Tejon was widened and he resented having to pa,y for the street construction. Council Nellber HathM~ay assured Mr. Larson thd his concerns would be considered. She inforwed Mr. larson that she knew fn. her own experience that it was possible to h.ve deferred or deleted certain streets fn. paving districts. She also advised hi• that 80S of the proposed paving district lies within Council District I which she represents; if enough public opinion is expressed in opposition to a particular street, she would follow through on that position. Further discussion ensued. Pat fkhoney, 2000 W. Warren Av. -spoke in favor of Baltic Ave . being paved based 011 the fact that the property in the area is building up and uny -.11 child"" ..., Hve in the neighborltood. He stated that one reason ~ of the lots ,..in vacut with bad erosion is because there is no way to ct..nel the draiuge . He did question the installation of •Holl1"00d curtts• Md would prefer 6• curbs and a 4 ' sidewalk. He requested that this be considered. Further discussion followd concerning costs, labor, dratuge. curb cuts for driveways if vertical curbs are installed. It was c011firwed that vertical curb and gutter would be acceptable tf the rest of the property owners agreed . Director Ragland pointed out for tftt"JJM's info,...tion that the utility poles which are currently ._ the •iddle of Baltic would be .oved to the north side of the r tgllt-of-way , keeping the poles within the right-of-way of the street; further that electrical and telephone services to the houses would be overhead . 3500 S. Bannock St. -CCMtstruct 32 '-wide paving (6 I 2), ,...,,e and replace existing vertical curb I gutter with 5 ' walk on east I west sides u necessary . Mike Cooper, 3597 S. Bannock St. -questioned the width of sidewalks and suggested that 4 ' width be installed instead of 5'. It was explained to Mr. Cooper that tn order to uintain uniforwity with what is already in his block, 5' sidewalks would be installed. He also questioned why the asphalt could not be resealed. Mr . Ita• explained the probl•s which exist wfth the high C"*ll, whid1 will be elt•tnated wtth excavating the street to a lower level, lowering the gas and water 1 ines (those costs to be absorbed by Publtc Service and the Water Depart.nt). Mr. Cooper info.-.d Council th~t he would like to see the reconstruction of ~nnock put off due to the poor econ011y. Council Mellber tqthawl} pointed out that plans for ~nnock St. are that it will re.ain a one-wl} street. It was clarified that the width of ~nnock will be 30'. Colleen Burke, 3594 S. ~nnock St. -questioned the percentage being charged now as c0111pued to what was charged in 1956. Ns . Ragland and Mr. Kat. explained that the percentage being paid by the '"--ner today is less than in the early years of the paving progr•. Up until 1982 the ho.ecMters paid for all the cost of work done in front of their property, paid for all the bond costs and interest, and the ZS contingency, and in addition they also paid for the engineering costs, all •iscellaneous costs associated with construction -about 15 or 20S mre than the current assesst~ents include. Ns. Burke pointed out that this construction h~d been delayed for about a year due to the econ_, and she did not feel the ec~ had iiiiProved . She inquired how it was decided what needed to be replaced; she did not understand the urkings. The standards for concrete rephce.ent and the urkings wre exphined, and Ns. Burke was invited to contact ""· Kat. to discuss this further. Ns. Burke objected to re110val of the trees . It was explained that the !I.e CMter has the option of not ,_ving the trees, but the !I.e CMter would have to accept future responsibility for t~. Vickie Russ, representing leo Huh, 3560 S. laMOCk St. -explained that her uncle, ""· Huh, CMM!d four lots (105' frontage), but was retired and on a li•ited tncc.e. This asseswent would be a hardship even if spread over the allowed 10-year period. The special deferral for assesS~~ents for certain !I.e o.ners was explained. Terry Schaff, 3590 S. Bannock -asked cOftCerning width of driveway cuts and he was infor.ed that the current drt...., wtdth probably dtd not ... t the City 's standards . He also questiOMd the advisability of ....,ving and replacing sc.e of the COftCrete blocks .-... the adjacent blocks wre okay. It was explained that after the street has bee reconstructed to standards, it becc.es the responsibility of the Ci ty to utntain; ~ver, concrete work (sidewalk , curb, gutter) reaain the responsibility of the '"--ner. Bill Batt representing 1......,.1 lutheran Church, 3695 S. Acou St . - stated the Church couldn 't afford the assess.ents for the property it owns at 3600 South laMock and st lerlyon, also 3700 South ~nnock . On behalf of the congregation, he requested that the work be delayed. Ms . Ragland explained that if the asseswent wasn 't paid, it would be considered & lien upon the property. At Mayor Van Dyke 's request, ..-bers of the Church who were in attendance stood up . The various pieces of property owned by the Church were identified. Mr. B&tt explained the Church 's financial predic.ent , and requested that Council t&ke that predicuent into consideration. ~rk Wolf, Ch&inun of the Board of Trustees, I..anuel Lutheran Church, 3695 S. Ac~ St. -concurred with st&te.ents -.de by Mr. B&tt, and felt it placed &n undue hardship upon the Church with both Kenyon and Bannock being in the District. He added that he felt this work could be put off for &while. 3700 S. Bannock St. -Construct 32 '-wide paving (6 l 2), rMOve and replace existing vertical curb l gutter with 5 '-w&lk on east and west sides as necessary. Dorothy Willia.s, 3766 S. Bannock St. -questioned why the curbs need to be raoved, stating she has replaced the sidewalk in front of her h011e three different ti.es in the past 14 years. She has been told that the probla is due to ground swelling, not tree roots. She objected to having trees raoved when they were not the cause of the d.age. She felt this additional tax is unwuranted &nd would create a hardship for her . ~yor Van Dyke requested Mr . Ka~ to reevaluate her sidewalks. Joyce and Pfltl bgas, 3764 S. laMOCk St . -both spoke in opposition to the paving district, and prese~~ted the following issues: I) high increase in property taxes (over lSOI within the past year), and why isn't there mney to fix the streets?; 2) And considering the general city budget of total Englewood, especially the industrial areas, such as the Denver Tech Center, why do those c-..anies not share the cost instead of assessing the property owners? COUftCtl .._.,.r Hathaway explained that the Denver Tech Center is not within the city ltaits of Englewood along with & lot of other industrial areas which aay have an Englewood aailing address. She further coa.ented and rainded Mr . and Mrs. Regas that 9a of the streets within the City of Englewood have been included in prior paving districts . Concerning the property tax, Council r Hath-.y explained that a very saall ..aunt of the property tax is ntturned to Englewood, the rest is absorbed and used by the County, School District, and other special districts. Mrs . Regas questioned why the costs for the paving district went not budgeted in the general budget. Mr. WlggOMr explained that the City's portion of t iaprov .. nts wnt budgeted. Mr . Regas e)(pressed concern about how parking would be aanaged during t construction period, and was assured that the project would be done in phases and it was hoped that the neighborftood would not be inconvenienced for aore than two to four hours; also that .. rgency access would be aaintatned. This was also done so that the owners of the property could aake any provisions they deewed necessary (hire their own contractor with possible savings in costs) over the next two years. Mr. Regu stated he disagreed with the 11ethod of aarking the concrete and suggested it would be .,re appropriate to work with the property owner individually, exphining what wu wrong and why certain sections •st be replaced. Ms. Ragland exphined there were 33 blocks within this paving district, and there was not sufficient ti11e to COIIPlY with this suggestion. Mrs. Regas inquired about the standards and stated that there was very little variance (less than 1/4") between any of their sidewalk blocks. Ms. Ragland explained that, for consistency, only one person did the aarkings and that person, bued on 17 years of experience, had lllde the decisions. She offered to have the aarkings reviewed by staff. Mr. Regas pointed out that it would be difficult to get bids during the winter .unths, and co.plained that adequate ti11e was not allocated for owners to get a private contractor and suggested this ti11e be extended. It was explained to hi•, that the calendar listed only deadlines and that the work could be done anyti .. before those deadlines. It was confi~ for Mrs. Regas that this district did not affect alleyways and that it was estiaated that four hours should be the aaxi.u. for the citizens to be without water and gas. Genevieve Tressler, 3769 S. Bannock St. -wanted to know how they could request that their block be take~~ out of the District. She wu info~ that It would be necessary to get the other property owners to sign a petition or speak up In s.-wa.y. M.,or Van Dyke exphined that the street could be raoved fro. this District, but it would have to be put back Into a District in the future to ~t the criteria established for the City. Bannock St . -Inquired If the cost of lowering the hu.p is to be assessed to the owners ; he wa Info~ that It wasn 't . He also wondered ""Y "Hollywood" curbs •re being installed, and he wu tnfo.-.d that wasn 't the case on Bannock, only on newly constructed streets . Mr . Lakin was of the opinion 1 thin coat of oil would be sufficient. Mrs . I • • • • • .. - Englewood City Council October 20, 1988, Public Hearing -Paving District No. 33, Page 7 Doug and Crystal Ol•stead, 3715 and 3715-1/2 S. Bannock St. -were of the opinion that the street was not in bad shape, that it would cost too much to do it now, and suggested we wait until it needs it. They were concerned the City was taking steps to open Bannock to two-way traffic. And they pointed out that if the potentia 1 exists for it to be made two-way traffic, we should wait until that time to reconstruct the street and do the concrete work. Council Member Kozacek interjected that the Highway Department will not allow Bannock to become a two-way street because of the islands, etc., constructed on US285. Mr. Ol•stead suggested that Bannock Street should be reevaluated to see if the construction is actually needed or if less expensive repair work would suffice. Ms. Ragland explained that the longer the street is delayed, the more expense the City incurs for maintenance and the more of a hazard it becomes for drivers. To add an overlay increases the problem with the high crown, and would not meet the City 's standards. Mrs. Ol•stead inquired about when the current road was built and was infol"'led that Bannock had not been included in any paving district since 1956, records prior to that are sketchy. Mrs. Ol•stead was of the opinion that it should be the City's responsibility to maintain the road. Mr. Ol•stead agreed, stating that it appeared as if the City was trying to avoid its responsibilities in the maintenance of Bannock. Ms . Ragland responded that the street does not meet the City's standards of all other streets which have been in paving districts since 1956, in terms of base, asphalt and crown section. Hupden Ave . - advised Council that the hospital C*Md about 901 of the 3400 block of South E .. rson , and infor.ed Council that Swedish would like to have this block deferred for about a year, possibly two. He stated it wa s Swedish 's intention to eventually close the street. He was unable to predict exactly when the street would be closed since Swedish would have to own 1001 of the property to take the street over and close it to traffic . It was explained to Mr . He c~nted that he had already paid for the i~rove.ents (through develo~nt escrow] and felt the City should go ahead with the i~rove.ents. Dean Reid, 2024 W. Harvard Ave. and 2000 W. Harvard Ave. -stated this asseswent would be a hardship, having already paid assess•nts for Harvard and Tejon. He CCIIIPlained about c~rcial parking on his street, and stated he will not dedicate his land for Hillside. He objected to the construction and paving of the street as he prefers open space which is one reason why he bought the land. He questioned whether sewer or water lines would be an added expense. Ms . Ragland explained that water and sewer lines will be installed by the Utilities Depart.ent, and further, if there is no building there now, sewer taps will be ude to the side of the road and when developed, tap fees, installation, and other pro rated costs would have to be paid; there would be no i.ediate cost assessed to Mr . Reid. He advised Council that he wuld incur additional expenses due to this construction such as fences, utility poles, etc. Ms. Ragland revl..ed the proposal for Hillside Avenue to relocate the utility poles to the back lot 1 ine eas.-nt, the eas....t on the property that would face Hillside Ave~~ue; the City would pick up the costs of relocation and negotiate with Public s.tvlce tc.pany for reducing that cost.
