Council ~r Van Dyke referred to 1 state.ent which was published in
the Sentinel stating her opposition to the landscape Ordinance 16.4 -1 8.
She stated for the record she was not opposed to passage in spite of
serious concerns about the c0111p0sit ion of the ordinance, however she
planned to 1 isten to the Public Hearing with an open mind in order to
.. ke 1 decision based upon facts, opinions and viewpoints as presented to the Counc 11 .
Mayor Otis stated that because of the serious concerns that Council Me•-
ber Van Dyke had spoken of and because of the concerns expressed by the
Cha.ber of Ca..erce and the Planning and Zoning Co..ission, the Planning
and Zoning Co..ission had asked the Council to table the Landscape Or-dinance 16.4-18 and r ... nd it back to the. for further review.

ORDINANCE, SECTION 16.4-18, AND REMAND IT BACK TO PLANNING AND ZONING CONMISSION .

Acting Director Ro.ans was sworn in. Mrs. Ro.ans sut.itted the affidavit
of the Notice of Public Hearing published May 20, 1987. She stated that
there wre five sections of the C011prehenstve Zoning Ordinance being con-
sidered for ... ~nt during this Public Hearing, Sections 16 .4-1
(Restrictions), 16.4-16 (Flood Plain Regulations), 16.5 (General Regula -
tions), 16.7 -4 (VIolation and Penalty), and 16.8 (Definitions). She not -ed that each section would be considered separately.
Mrs . Ro.ans requested that they be allowed to show SOlie slides revealing
SOlie of the probl•s and concerns of the cfttzens. Mrs. R-.ns

Mrs. Ro.ans read into the record a letter from Joel B. Huston, 3290 South
Galapago, stating his support of the a~~~end111ent to the Zoning Ordinance Section 16.4-1.
Mrs. Ro.ans responded to questions from Council Member Kozacek, clarify-ing concerns about 16.4 -1.
Mrs. Ra.ans read Into the record a letter fro. the South Suburban Board
of Realtors stating their support of the a~~~endlllent to the Zoning Or-dinance Section 16.4-1.
Council Me.ber Van Dyke asked how these changes ca.pared to ca.parable
ordinances in the Metro area. Mrs. Ra.ans responded that it was her
understanding that Denver does not perwit the parking of recreational
vehicles, trailers, detached snowplows, or trucks on the street .
Carol Salus, 4459 South Pearl, duly sworn, was concerned about a neighbor
on the north that is fhing, restoring, and towing auta.obiles on his
property whtch he works on throvgh the day, usually quttttng by 1:30 a.•.
She filed a ca.plaint with the Pollee Depart .. nt June 5, 1987. Ms . Salus
wanted to know what her ri9hts as a citizen are. Mayor Otts stated that
thts ... ndllent was directed to exactly this type of situation. Joyce
Parsons, Code Enforc ... nt Officer for the City of Englewood, was sworn in
for testt.any. She stated that the City has 9tven a notice of violation
regarding working on cars tn a front driveway, that both she and the
Police Oepart .. nt have ticketed the tow trucks. Ms . Parsons stated they
had done all they could and that the passage of this ordinance would pro -vide .are enforc ... nt .
Wallace S.tth, 4308 South Pearl, duly sworn, stated he works for a con -
struct ton ca.pany and th to four t t•s a week drives a dUIIp truck
(13060 pounds MPty t9ht) tto., which h parked overnight. He asked
that a provision be lllde r'e9ardtng a ti .. li•tt, such as 24 hours , to

Erline Holten, 4439 South Pearl, duly sworn, stated she was in favor of the ordinance.
Doyle Irwin, 1101 West Quincy, duly sworn, stated he was in favor of the ordinance.
Ruth Manon, 4450 South Pearl, duly sworn, expressed her displeasure with the towing business being run in her neighborhood.
Howard Brown, 3183 South Race, duly sworn, stated he was in favor of the
ordinance and urged Council to pass the ordinance and clean up sa.e of the •eyesores• in the neighborhoods.
LIMor Warren, 3820 South Galapago, duly sworn, stated she was in favor of the ordinance.
SECTION 16.4 -16 (FLOOD PLAIN REGULATIONS):
Harold Stitt, City Planner II, duly sworn, stated the City of Englewood
had received notification fro. the Federal E .. rgency Manag ... nt Agency,
that there .. re certain ... nd-.nts and revisions to the Flood Plain Or -
dinance that .. re •ndated by Federal Rl9ulatton. The changes are neces -
sary to brtnv the local ordinance into co.pltance with the Federal Reg -
ulations and as such, in one sense, these regulations are •ndatory. We
have until Septlllber 25, 1917 to have this ordinance adopted and for -
warded to Washtnvton for their review. The Colorado Water Conservat ton
Board has reviewed and approved these ... nd-.nts. He further stated that
the proposed ... nd-.nts are necessary so .. can •tntatn the Flood In -
surance Progr .. within the City of Entlewood. If the ... nd-.nts are not approved, .. risk losing that insurance progr ...
SECTION 16.5 (GENERAL REGULATIONS):
Joseph B. Pltzga , City Traffic Engineer, duly sworn, discussed ~nts
proposed to this Section of the Co.p,....stve Zoning Ordinance. He pres -
ented slides showing the logistics of the proposed ... nct..nts, which
would i!lprove sight distances at intersections and decrease accidents .
He responded to questions of various Counct18111bers; it wa s SU9flsttd
that this section of the ndllents shcM.Ild be reviewed further 111 study
session. Discussion nsued concernt119 other changes to Section 16 .5.

SECTION 16.7 -4 (VIOLATIONS AND PENALTY):
Mrs. ROllins stated that Mcause there were so uny conflicts In the
Municipal COde on the violations and penalty sections we are att-.pttng
to reference everything to Title 1.4 -1 which says that any violation of
the zoning ordinance would co.e under the general penalty section of the Municipal Code .
SECTION 16 .8 (DEFINITIONS):

tioned the Intent of Section 16 .5-Z. She wanted to have th fs clari fied
as she felt ft could be an Invasion of privacy . Mayor Otis stated that

Aa you will recall, the City undertook a rather coaplete review
ot the coaprehenaive Zoning Ordinance approxiaately three years
ago which reaulted in extenaive aaendaenta to the Ordinance. One
ot the aajor reviaiona waa the adoption ot a new aection, Section
16.4-18, the Landacape Ordinance, which waa one ot the goala
identified in the otticial Coaprehen.tve Plan.
In aubaequent review ot the Coaprehenaive Zoning Ordinance, the
Planning co .. iaaion decided there were certain aectiona which
needed to be aoditied, and conaidered theae aectiona at a Public
He ring on April 21, 1987. One ot theae aectiona waa the
Landacape Ordinance, and one peraon addreaaed the co .. iaaion
during the Hearing relative to theae aaendaenta, aaking that they be approved.
At the eeting ot the Planning co .. iaaion on June 2, 1987,
aeveral aeabera ot the Governaental Liaison co .. ittee ot the
ere ter Englewood Chaaber ot co ... rce attended the .. eting and
apologized tor not having at ended the Public He ring in April.

Council requeatin9 the Landacape Ordinance be
tabled to perait further atudy by the
Coaaiaaion of the propoaed aaendaenta to the
Landacapinq Ordinance 1 and that ..abera of the
Coaaiaaion attend the public hearinq on June
29, 1987 to expreaa their concerna1 and
further that a coaaittee aade up of aeabera of
the Ca.aiaaion and the Chaaber and ataff
review the propoaed a.enct.enta before the
Council takea action in thia aatter.
The aix ..abera of the Ca.aiaaion vbo were preaent voted in favor of the aotion.
Purauant to the action taken by the Coa.iaaion on June 16th, on

by passing ordinances that will enhance the appearance of the • City; and

screen. Trash and garbage shall not be
stored in the REQUIRED front yard for more
than twenty-four (24) hours.

a. FINDINGS OF FACT.
( 1) THE FLOOD HAZARD AREAS OF ENGLEWOOD ARE SUBJECT TO
PERIODIC INUNDATION WHICH RESULTS IN LOSS OF LIFE AND
PROPERTY, HEALTH AND SAFETY HAZARDS, DISRUPTION OF COM-
HERCE AND GOVERNMENTAL SERVICES, EXTRAORDINARY PUBLIC
EXPENDITURES FOR FLOOD PROTECTION AND RELIEF, AND IM-
PAimtENT OF THE TAX BASE, ALL OF WHICH ADVERSELY AFFECT
THE PUBLIC HEALTH, SAFETY AND GENERAL WELFARE.
(2) THESE FLOOD LOSSES ARE CAUSED BY THE CUHULATIVE EFFECT
OF OBSTRUCTIONS IN AREAS OF SPECIAL FLOOD HAZARDS WHICH
INCREASE FLOOD HEIGHTS AND VELOCITIES, AND WHEN INADE-
QUATELY ANCHORED, DAMAGE USES IN OTHER AREAS. USES

(a) Regulating the manner in which structures designed
for human occupancy may be constructed so as to
prevent danger to human life within such structures.
(b) Regulating the method of construction of water
supply and sanitation systems so as to prevent
disease, contamination and unsanitary conditions.
(c) Delineating and describing areas that could be
inundated by flood so as to protect individuals
from purchasing flood plain lands for purposes
which are not in fact suitable.
(3) To protect the public from the burden of extraordinary
financial expenditures for flood control and relief by
regulating all uses within the flood plain areas so as
to produce a method of construction and a pattern of
development which will minimize the probability of
damage to property and loss of life or in j ury to the

( 5) Interpretation. In their interpretation and applica-
tion, the provisions of this Chapter shall be held to
be minimum requirements and shall be liberally con-
strued in favor of the governing body.
( 6) \Jarning and Disclaimer of Liability. The degree of
flood protection intended to be provided by this Chap-
ter is considered reasonable for regulatory purposes
and is based on engineering and scientific methods of
study . Larger floods may occur on occasions, or the
flood height nay be increased by man-made or natural
causes, such as ice jams and bridge openings restricted
by debris. This Chapter does not imply that the areas
outside of the flood plain area boundaries or land uses
permitted wi hin such areas will always be totally free
from flood1ng or flood damages. Nor shall there be
liability on he par of, or a cause of action against,
the City of englewood or any officer or employee there-
of for any flood damages that may result from reliance on this Chapter.

( 2) Other Structures, Temporary or Permanent, to Be Occu-
pied by People. Other structures, whether temporary or
pe rmanent, which are to be occupied by people, may be
permitted only upon a finding by the Flood Plain Ad-
ministrator that:
(a) Such structures shall comply with Section (1);
(c), (d), (e) (f), (g) and (h) above, AND SECTION
16.4-16 g (4), DEVELOPMENT PERMITS.
(b) The first floor or basement floor of any structure
to be erected, constructed, reconstructed, or

{3) Happing Disputes . The following procedure shall be
used by the Flood Plain Administrator in deciding con-
tested cases in which the location of a Flood Plain
District boundary is disputed . In all cases the person
contesting the location of the District boundary shall
be given a reasonable opportunity to present his case
to the Administrator and to submit his own technical
evidence if he so desires. The Administrator shall not
allow deviations from the boundary line as mapped un-
less the evidence clearly and conclusively establishes
that the mapped location of the line is incorrect .
{4) Process to Be Followed for Development Permits .
(a) Application For. Any use listed in this Chapter
as requiring a Development Permit may be allowed
only upon application to and the issuance of a
Development Permit by the Flood Pla1n
Administrator.

non-residential structures within zones Al-A30 on the

basement, elevated to or above the Base Flood Level .

e. Maintenance.
(1) The owner of the property, his successors , heirs, and
assigns shall he responsible for the proper maintenance
of the area subject to an approved landscaping pla n.
(2) Landscaping shall be continuously maintained including
necessary wate r ing , wee d ing , pruning, pest contro l and
replacenent of dead or diseased plant material. Re-
placement for dead or diseased plant material shall be
of the same type of plant mater1al as set forth in the
approved landscaping plan ; for e x ample , a tree must
replace a tree , a shrub must replace a shrub , a ground
cover must rerlc:ce a ground cover, etc . Replacement
shall occur in the next planting season, but in any
event, such replacement time shall not exceed one (1)
year . Any replacement which conforms to the require-
ments of this Section shall not be considered an amend-
ment to the landscaping plan .
(3) Failure to rrovide adequate ma1ntenance result1ng in
the deterioration of trees, shrubs or other l1ving
plant material violates the object1ves of th1s Or-
dinance, and the City Manager or his designee shall
have the pror rty posted giving appropr1ate not1ce of
th violation of this Ordinance and setting forth that

Location of Loading Space. THE PUBLIC RIGHT-OF-HAY SHALL
NOT BE USED AS A LOADING DOCK OR LOADING BERTH. \·lhere the
lot on which the loading space is located abuts upon an
alley, such loading space shall adjoin the alley unless,
because of the design of the building served by the loading
space, it is not feasible to have an access to the alley.
The length of the loading space may be measured
perpendicular to or parallel with the a~ ey, except that on
lots less than thirty-five (35) feet in ~idth , the length
of such loading space shall be measured perpendicular to
the alley. Where said length is parallel with the alley,
the loading space s hall extend across the full width of the
lot, except that if only two (2) such spaces are required,
the length need not exceed sixty (60) feet. The loading
berth shall be designed so that the vehicle shall not

SECTIONS 1 AND 2, ENGLEWOOD MUNICIPAL CODE 1985, RELATING TO
IIOBBY-'rYPE AND DERELICT VEHICLES.
\IHEREAS, to implement the goal of a pleasing environment to
the citizens of Englewood , City Council has imposed restrictions
on the storage of junk in yards and the number of hobby or
derelict vehicles that can be kept and/or worked on; and
mu:REAS, to implement this goal, City Council has placed
considera ble emphasls on the diligent enforcement of these
restrictions; and
WHEREAS, from tim to ime these restrictions need to be
revised as City Council deems necessary;

park such vehicl e o r to cause such vehicle to be
stopped, stood or parked in any residentially zoned
area of the City and on any street adjacent to said
residentially zoned area of said City at any time,
except wh en such vehicle is being expeditiously loaded
or unloaded or such mobile equipment is being used to
perform the special operation for which it was
