The invocation was given by Council Member Higday . The pledge of allegiance was led by Mayor Otis. Mayor Otis asked for roll call. Upon a call of the roll, the following were present: Council Members Higday, Van Dyke , Vobejda , Kozacek , Bilo, Bradshaw , Otis. Absent : None . The Mayor declared a quorum present. * * * * * Also present were: City Manager McCown Assistant City Manager Vargas City Attorney Olsen Acting Director of Engineering Services Kahm Deputy City Clerk Crow. * * * * * COUNCIL MEMBER KOZACEK MOVED, SECONDED BY COUNCIL MEMBER BRADSHAW, TO OPEN THE PUBLIC HEARING TO CONSIDER THE FORMATION OF PAVING DISTRICT NO . 31. Upon a call of the roll, the following vote resulted: Ayes: Council Members Higday, Van Dyke, Vobejda, Kozacek , Bilo Bradshaw , Otis. Nays: None. • I . • • City Co u ncil Mee t ing February 24 , 19 8 6 Pa ge 2 .. • • • The Mayor declared the motion carried . * * * * * Acting Director of Engineering Services Kahm presented general background information on Paving Districts in Englewood, followed by cost and assessment information, timetable, and method of payment of Paving District No . 31. He also presented specific information on the type of proposed improvements which would be included in Paving District No. 31. Mayor Otis set the forum for receiving public comments, stating that no decision would be made by City Council at this meeting . A decision concerning the bill for an ordinance will be made at the March 17, 1986, regular Council meeting; the ordinance creating Paving District No. 31 will be considered on final reading on April 7, 1986, at which time another public hearing will take place prior to the vote of City Council. All comments made at this meeting (February 24, 1986) will be taken into consideration by the City Council . Council Member Higday addressed the audience concerning previous Paving Districts. He invited any of those present to contact him if they were interested in knowing of research done by Council and/or staff . He mentioned that when he was first elected to Council, one of the items brought to his attention was that the residents of District III wanted something done about Clarkson Street. However, Clarkson is a unique street in that it borders two cities with the majority of the street in the city limits of Englewood , but a significant amount of it is in Cherry Hills Village and it is only recently that Cherry Hills Village has indicated an interest in participating in an effort to bring the street up to standard. He concluded by stating that it is a foregone conclusion that Clarkson will be paved, but that he encouraged comments and would support anything that a majority of the residents of each block requests. He further stated that the Paving District would take into consideration individual neighborhood needs. Entered into the record was the publisher's affidavit stating the public hearing to consider Paving District No. 31 was published January 22 through February 5, 1986 in the Englewood Sentinel. Also entered into the record wa s a letter from Mayor Joan R. Duncan of Cherry Hills Village in favor of the creation of Paving District NO . 31. Clarkson Street • • • Remove and replace deteriorated or off -grade concrete ; overlay at City cost. No comments . 3700 s. Clarkson Street Remove and replace deteriorated or off-grade concrete; Paving Section I. Mr. Clyde B. Taylor, 3705 South Clarkson, questioned Council about the responsibility of paving and concrete costs. He was also concerned about scheduling our paving and concrete work after all work at the bridge (utility work) is completed. He was assured by Mr. Kahm that his only financial responsibility would be for concrete work (installing a 4' sidewalk). Council Member Higday also assured him that the coordination of projects would not cause work to be repeated. Council Member Higday informed the audience that the Russian Olive trees in the 3700 block will not be destroyed as a result of the paving district . 3800 S. Clarkson Street Remove and replace deteriorated or off-grade concrete, Paving Section I. Jim Bakarich, 3829 South Clarkson, questioned the size of the sidewalk as proposed; the usage Clarkson Street receives compared to most residential streets; the timing of the assessments and estimated costs. His concerns were addressed by Council Members and Mr. Kahm. Harold Rust, 3811 South Clarkson, spoke in favor of the project; howe ver, he expressed concern over speeding and heavy truck traffic on Clarkson Street, stating the weight limits should be lowered and the area should be patrolled . Mayor Otis commented that the City Council had been discussing the speeding problem, and would pass on Mr. Rust's comments concerning the trucks . It was also stated that the eight-ton weight limit will continue in effect . Residents were encouraged to report offenders so that citations could be issued . Jene Sombar , 13601 E. Marina Drive, owner of 3801 South Clarkson, felt the paving district was long overdue , but was concerned over information she had received from the Engineering Department concerning costs. She also que sti oned why she would have to pay for replacement of curbing which was orig i nally put in by the City . Staff was requested to double check the information given Ms. Sombar and to check the markings at this location. Ms. Sombar also is concerned about the speeding on Clarkson . 3900 South Clarkson Remove and replace deter iorated or off-grade concrete ; Paving Sec. I. James Phillippe, 6466 East Fair Avenue, owner of 4087 and 4089 South Clarkson , was concerned about the loss of the six cottonwood trees and the 100 ft. of hedge at this location . He felt the trees and hedge contributed greatly to the value of the property. He was informed the trees would have to be removed as they are a hazard to traffic and appear to be rotting out and leaning over Clarkson; however, the hedge will not need to be removed. Staff was requested to discuss the tree replacement program with Mr. Phillippe. Rolland Hendee, 4045 South Clarkson, questioned the usage of gas tax money, and was assured that the funds the City received from the State were normally used for maintenance of streets which had been improved in previous paving districts. He spoke in favor of the project . He questioned the thickness of concrete as compared to the thickness required on owner's driveways. He also questioned the need to replace his driveway, feeling it was in good shape. Council Member Higday assured Mr. Hendee he would personally check the driveway with Mr . Kahm to determine the replacement need. Mr. Hendee is also concerned about the increased traffic and speeding. Council Member Higday assured the audience that various methods of speed control are being considered by Council. Mr . Hendee stated that he felt the Cherry Hills Village side should also have curb and gutter . Doris Peacock, 4055 South Clarkson, spoke concerning the increased traffic on Clarkson due to the new development on Mockingbird Lane and suggested we install ordinary stop signs. She felt the current situation increased pollution and a devaluation of property. She requested whatever could be done to limit industrial business trucks. 4100 South Clarkson Remove and replace deteriorated or off-grade concrete; Paving Section II . Mrs. Ben ·amin Martinez 4115 South Clarkson , spoke concerning the three blue spruce trees and how the sidewa k instal ation would affect them. She was assured the trees would remain; however, she was warned that at some point in time the trees would probably need trimming to comply with the code requirements . She questioned the "B" mark on the driveway, and was assured staff will check the markings. John Mack, 4139 South Clarkson, requested information concerning the lack of markings on his property and was assured if no marker was present, the concrete would not have to be replaced. Lyle Bilger, 4195 South Clarkson, commented upon a lack of communication from Council Member Higday. This was discussed briefly . He then asked concerning a rumor he had heard regarding Arapahoe County taking over Clarkson Street. He wa s assured by Council that this wa s a rumor. A br ief history of Clarkson Street was given by Council Member Higday. He asked about the concrete marked around the corner on Princeton Street and about the alignment of his proposed sidewalk on Clarkson. Mr. Kahm explained that the concrete around the corner is cons~dered intersection work at no charge to Mr. Bilger ; that the sidewalk will extend along the same line as his neighbor to the north. 4600 South Clarkson Remove and replace deteriorated or off-grade concrete; Paving Section II; transition to Paving Section I at south end. Carl Welker, 4611 South Clarkson, supported the paving of the block , but expressed concern about the traffic and would support a stop light at the Tufts intersection. Helen McCreary, 4635 South Clarkson, spoke in favor of the paving district . She preferred a 2 ft. sidewalk rather than the 4 ft. sidewalk as proposed . Council Member Higday confirmed that as the project now stood , the 4 ft. sidewalk would be installed, but he commented that perhaps this could be negotiated since this particular block has a lot to lose with the installation of a 4 ft . sidewalk. Mayor Otis commented that this request will be taken under consideration. Elmer Lundberg, 4685 South Clarkson, stated his concern about the dip at Union Avenue. Staff was requested to investigate this matter to make sure the drainage would not be affected to his detriment. He also asked about water shut-offs and how they fit with the new sidewalks. He also requested that he be allowed to remove his own curb. He was urged to work with the Engineering Department in doing this. 4700 South Clarkson Remove and replace deteriorated or off-grade concrete; Paving Section I. Ralph Gies, 4725 South Clarkson, questioned Council Member Higday's statement concerning the majority of residents on Clarkson wanting the improvements. He asked Council about the paving charges on West Dartmouth from Paving District No. 23. Mr. Kahm explained the assessment procedure on West Dartmouth. He brought to Council's attention the poor qual ity of some installation of curb and gutter in Paving District No. 30 (700 East Mansfield). Mr. Kahm explained that Mansfield was taken out of Paving District No . 30 because surface studies showed that it met City standards. Mansfield was overlayed under the City 's regular maintenance program; however, concrete repairs are still the responsibility of the owners . He brought to Council 's attention the lack of traffic control on Clarkson; he would like to see stop signs on Oxford, Tufts and Layton. As a result of Mr. Gies' comments, the City Manager was directed to have the Police Chief supply patrol of the area during the hours of 7 to 8:30 a.m . and 3:30 to 5 p .m. It was confirmed by Mr. Kahm that the property owner is assessed only for 16 ft . of paving width . • I • • • City Co un cil Meeting Feb ruary 24 , 1986 Page 6 • • • Rose Winkler, 4717 South Clarkson, stated her concern about the condition of the water main in Clarkson Street . Council directed the City Manager to have the Utility Department investigate this concern and to ensure that any repairs will be done before street construction begins . She also expressed her concern about the house across the street from her home in Cherry Hills . She would like help from Englewood to see that the property is cleaned up. City Manager Mccown stated he would discuss the matter with the City Manager of Cherry Hills Village. She also asked about doing some of the curb and gutter work privately. Janice Anderson, 4733 South Clarkson, stated she is in favor of paving and sidewalk. She feels that the City should pay a larger share due to the amount of through traffic. Mrs. Anderson questioned why we can't get a better price than she can. Mrs . Anderson complained that city workers were marking concrete on Monday (a City holiday). It was explained that generally an owner can save money by hiring their own concrete contractor because they won 't have to pay the incidentals that come with an assessment (legal fees, interest, etc.) Mr. Kahm explained that the individual marking concrete on Monday does not receive overtime pay. 4800 South Clarkson Remove and replace deteriorated or off-grade concrete; Paving Section I. Bob Boardman, 4831 South Clarkson, stated that Clarkson Street needs stop signs to reduce traffic. He requested the definition of an arterial street and the present classification of South Clarkson. Mr. Kahm provided the definition of an arterial street and stated that Clarkson is an arterial on Englewood's Master Street Plan. Mr. Boardman would like Council to consider a bike path along Clarkson; Council agreed to pass along to Cherry Hills this request for a bike path. He expressed concern on his part and on the part of his neighbors about the landscaping in the 4800 block . He was assured that the landscaping and shrubbery would not be disturbed. Statistics to back up the philosophy concerning the narrowing of the street on the south end of the project were questioned. Council Member Higday asked the City Manager to look into the possibility of changing the truck tonnage weight from 8 -tons to 4-tons. He recommended having stop signs at Tufts, Quincy, Oxford and Mansfield, possibly a traffic light at Tufts. Mayor Otis stated he would present to Cherry Hills Village the desires of Englewood citizens for a bike trail along Clarkson. Abner Pain, 4891 South Clarkson, stated he was opposed to the Paving District. He brought to Council's attention that in 1968, Chenango (between Washington and Clarkson) was in a paving district and his concrete will not drain. He was assured that the City will repair Chenango at no cost to Mr . Pain. Mr. Boardman returned to the podium to address Council concerning drainage problems. Randy Fisherh 4851 South Clarkson, asked Council about the 28 L.F. of concrete in front of is house . Council Member Higda y stated the concrete in question is not to standard and must be replaced. City Attorney Olsen told Mr. Fisher to seek legal advise from his own lawyer. 4900 South Clarkson Remove and replace deteriorated or off-grade concrete; Paving Section I. No comments. 5000 South Clarkson Remove and replace deteriorated or off-grade concrete; Paving Section I. Gerald Gibson, 4891 South Clarkson, stated his concern about the Belleview intersection. He stated he doesn't want an island in Clarkson which would prevent him from going northbound from his driveway. Mr. Gibson stated that the picket fence installed by Cherry Hills is a traffic hazard and should be removed. Council Member Higday requested staff to supply him with the Belleview intersection design when available. Council Member Higday will share this information with the Clarkson Street owners. Mr. Gibson concurred in the comments made tonight about traffic and excessive speed on South Clarkson. Council Member Higday instructed staff that the final design for the 5000 block of South Clarkson, if different than presently planned, should be reviewed by him and the residents . * * * * * Acting Director Kahm introduced Royce Smith, independent real estate appraiser. Mr. Smith presented to Council specific benefits that could be expected and derived by adjacent property owners through the construction of this paving district. He reported that from his aspect, the paving district would increase the value of the property by a substantial percentage . He also stressed the need to install the 4 ft . sidewalks wherever possible. * * * * * Jim Bakarich returned to the podium relative to left turn problems and suggested some means of increasing the flow of the intersection of Clarkson and Belleview. Janice Anderson returned to the podium to que stion Mr. Smith concerning his statement relative to the increased value of the homes upon completion of the paving district. Ken Haraldsen, 3018 South Washington , questioned Council concerning the size of sidewalks in his neighborhood, stating he had been forced to install 30" sidewalk , but that his neighbor was permitted to keep the 20" sidewalk . He felt a curb or a concrete strip should be installed. Mr . Kahm explained that the gravel shoulder and drainage ditch were the only section that the Cherry Hills would approve in preliminary meetings. The gravel shoulder would be the same as any other gravel shoulder on a secondary highway. Cherry Hills will be responsible for maintaining it . Bilger 's comments will be proposed to Cherry Hill. Mr. Bilger asked who is responsible for the project after it is completed. Mr. Kahm stated that the project would have a two-year warranty, after that the responsibility does revert back to the property owners. * * * * * COUNCIL MEMBER BRADSHAW MOVED, SECONDED BY COUNCIL MEMBER HIGDAY TO CLOSE THE PUBLIC HEARING.
