The invocation was give n by Council Member Higday. The pledg e of allegiance was led by Mayor Otis. Mayor Otis asked for roll call. Upon a call of the roll, the following were present: Council Members Higday , Vobejda , Silo, Bradshaw, Otis . Absent: Council Member Weist, One position vacant. The Mayor declared a quorum present . * * * * * * * Also present were: City Manager McCown City Attorney Olsen * * * Assistant Director of Community Develop- ment (Planning) D. Romans Deputy City Clerk Owen * * * * MAYOR PRO TEM BRADSHAW MOVED TO OPEN THE PUBLIC HEARING TO CON- SIDER AN ORDINANCE 0~1 FINAL READING PROPOSING AMENDMENTS TO THE COMPRE- HENSIVE ZONING ORDINANCE RELATIVE TO AUTO AND RECREATION VEH IC LES SALES AND LEASE LOTS, GAS AND OIL SERVICE STATIONS. Council Member Vobejda seconded the motion. Upon a call of the roll, the vote resulted as fol-lows: Ayes: Nays: Absent: Council Members Higday, Vobejda, Silo, Bradshaw, Otis. None. I • - • • Septembe r 9 , ass Pag e 2 • • • Assistant Director of Community Development (Planning) Dorothy Romans presented the proposed amendments pertaining to the B-2 zone dis- trict commercial area. Mayor Otis asked for comments from the audience. Bob Bahne, home address of 2662 South Kearney /business addres s of 4550 South Broadway (Valley Motors) came forward. Mr. Bahne opposed the amendments and stated the amendments discriminated against his type of business. Mr. Bahne entered into the record a peti ti on s i gned by other protestants and a letter from Richard L. Leisy of Englewood Motors, Inc. 4955 South Broadway also protesting the amendments . Larry Corwin, home address of 7502 East Mansfield, Denver /busi- ness address of 2700 South Broadway (Credit Motors), came forward. Mr. Corwin opposed the amendments because he would be required to give up space normally used to display cars for s al e. Jon c. Cook, home address of 7673 Sourdough Drive, business address of 3150-3232 South Broadway, came forward. opposed the amendments because he would be required to give footage for landscaping . Morrison/- Mr. Cook up too much Richard Funk, home address 6 Belleview Way /business address 3787 South Broadway (Richard Motors) came forward. Mr. Funk opposed the amendments on the basis that it would cost him $66,000+ to comply with the amendments. He could not afford this expense. John Comer, 3587 South Hudson, Denver, came forward. Mr. Comer stated he was the attorney representing independent auto dealers. Mr. Comer opposed the amendments and argued that making the lots a condi- tional use was denial of equal rights under the law and confiscation of property. Bruce Cairns, business address 4732 South Broa dway, came for- ward. Mr. Cairns opposed the amendments and presented his cursory study on what the environmental impact would be. Joe Cocchiarilla, business address 5020 South Broadway (Colorado Car Country), came forward. Mr. Cocchiarilla opposed the amendments and stated he would lose his bus iness if he had to turn his front line dis- play space into landscaping. Lloyd Chavez, home address 3906 South Pinehurst Circle, Denver, business address (Burt on Broadway), came forward. Mr. Chavez opposed the amendments on the basis of the expense of landscaping and that it did not appear to him that other businesses along South Broadway have been ordered by the City to comply with the landscaping ordinance • • I • - • • September 9, 1985 Page 3 • • • Jim Bahne , home address 6649 South Helena Street/business ad- dress of 4550 South Broadway (Valley Mot o rs), came forward . Mr . Bahne compared the City's l o go to his perception of the subject situation and inferred that the protestant petition was an understanding of the im- perfect "E" (the City 's logo). Larry Corwin , came forward again and further protested on the basis of discrimination. Lloyd Chavez, came forward again and offered further comments opposing the amendments. Tom Garlic , 4808 South Broadway, came forward. Mr. Garlic pro- tested on the basis that he would have problems with if required to make a driveway cut. Mr. Garlic asked Council to work on enforcing current codes , not issue new ones . Jon Cook , who spoke earlier, came forward and protested that the amendments would reduce his capability to make a living . An unidentified me mber o f the audience stood up and stated the o rdina n ce would limit the number of cars on a lot and he resented the City taking away this property. There were no further comments . MAYOR PRO TEM BRADSHAW MOVED TO CLOSE THE PUBLIC HEARING. Coun- cil Member Higday seconded the motion. Upon a call of the roll, the vote resulted as follows: Ayes: Nays: Absent: Council Members Higday, Vobejda, Bilo, Bradshaw, Otis. None. Council Member Weist, One position vacant. The Mayor declared the motion carried. Mayor Otis stated because of the extensive protests registered at this hearing Council would delay consideration of the ordinance until the Council meeting on September 16th at 7:30 p.m. * * * * * * * MAYOR PRO TEM BRADSHAW MOVED TO RECEIVE THE 1986 PROPOSED BUDGET AND TO SET THE BUDGET PUBLIC HEARING FOR MONDAY, SEPTEMBER 23, 1985, AT 7:30 P.M. WHEREAS, the Planning and Zoning Catmission has reviewed the B-2 Zone District regulations to deteon i ne whether or not that section of the COmprehensive Zoning Ordinance adequately reflects the goals of the City as set forth i n the COmprehensive Plan; and WHEREAS, the Planning and Zon ing Catmission has considered the B-2 Zone District at public hearing on May 14, 1985 and announced a study sess i on for May 21, 1985; and WHEREAS, at said study session , only one person (a car lot owner) spoke; and WHEREAS, at the study session o f May 21, 1985, it was announced there would be further discussion on the B-2 Zone District on June 4, 1985 Pla nn ing and Zon ing Catmission meeting; and WHEREAS, at the June 4, 1985 discussion , three car lot dealers were present who had been present at the May 14 public hearing , but did not address the Catm ission on the B-2 Zone District matter; and WHEREAS , after said public hearing , study session and discussion , the recommend ation of the City Planning and Zoning Catmission to the City Council is that the proposed revisions to the COmprehensive Zoning Ord inance be adopted; !0-1, 'IHEREFORE, BE IT ORDI'\INED BY '!HE CITY COUNCIL OF '!HE CITY OF ENGLEl'lOOD, COLORADO: 1 • I • • • • - Section 1. I am the owner and president of Englewood Motors, Inc., at 49SS S. Broadway. I am the owner of the property from 491S through 49SS S. Broadway, with approximately 2SO feet of frontage. I am also the owner of proper ty at 1300 W. Quincy, representing approximately 200 feet of fro ntage. I must voice my strong opposition to Mr. Higday's Council Bill #SO. I opened Engle1vood Motors on March 1, 1960, and have been an Englewood businessman working long, hard hours for more than 2S years. An Independent businessman does not have a retirement program, unless he creates one for himself. Land payments I have made for the past 2S years represent ~ retirement program. I firmly believe that established Englewood businesspersons , and landowners, should not be forced into a beautification project that will do nothing but raise overhead costs and shrink profits. It is my understanding that we have laws in Englewood requiring proper maintenence of both commercial, and residential properties. I suggest that you encourage strict enforcement of these laws, rather than placing an extra burden on the businesses-or the Englewood area. Unfortunately today , many of our government leaders fail to use "old fashioned" business sense. I respectfully request that the Englewood City Council use some business sense in this matter. Al low us to tend to business and make a profit. Our success has, and will continue to generate revenue for numerous Englewood projects. Hundreds of businesses are represented along the south Broadway corridor. The city of Englewood cannot afford to endanger the livelihood of these businesses.
