Last Monday night the Council held a hearing on several amendments to the Plan. The amendments included changes to the text of the Plan and the listing of properties for acquisition by the Urban Renewal Authority. The properties we discussed at last week's hearing and that are still under cunsid e ratiun tunight include the following: 3401 Suuth Bannuck Street 3415 South Acoma Street 3427 Suuth Acuma Street 3447 -93 South Acoma Street 1 ~~8 -90 S uuth Acuma Street There are uther properties which the developer, Brady Development Corpuration, has requested that the Urban Renewal Authurity acquire . These include the following: 1 . 3311 Suuth Broadway 2. Leases within 3315 -3386 South Broadway 3340 -3384 South Acuma 33 -95 West Girard Avenue • • I • • • • • • In order f~r these properties to be acquired by the Urban Renewal Authority, the developer must provide evidence that he has made good faith efforts to acquire the property on his own. We have not received sufficient evidence to date to demonstrate that negotiations have occurred to this extent. It is my understanding that the developer will request that the Council not consider listing these properties for acquisiti~n at t~night's meeting since they have n~t hod adequate t i me to negotiate with tenants and owners. The devel~per will address the Council tonight to discus s this request. Cven t h ~ugh we held the public hearing last week, if y~u are i nterested in addressing the Council again, please feel free t~ d~ s~. The C~uncll will also c~nsidei listing the parking lot s~uth ~f First Interstate Bank for acquisition since this property is required for the construction of the new roadway through the downtown . I would like first to ask Susan Powers, Executive Director of Urban Renewal Authority, to again summarize the amendments to the Plan . • I • • • • • • C 0 U N C I L C 0 M M U N I C A T I 0 N DATE AGENDA ITEM March 21, 1984 lA SUBJECT Determination of the Compliance of Downtown Redevelopment Plan Amendment to "· .1 ,.,, _,_ n INITIATED BY Englewood Planning and Zoning Commission ACTION PROPOSED Accept the Findings of the Planning and Zoning Commission that the proposed amendment tg the Egalewgod Downtown Bedeyelapment Plan cgnfopms to INTRODUCTION AND BACKGROUND: Statutes of the Urban Renewal Authority of the State of Colorado require that all proposed Urban Renewal Plans and amendments to such plans be reviewed by the Planni g Commission of the municipality for which the Plan and/or amendments are proposed prior to adoption by City Council . This review is for the purpose of determining compliance of the plans and/or amendments with the community 's Comprehensive Plan. The Englewood Planning and Zoning Commission previously examined the Englewood Downtown Redevelopment Plan and determined that the aforementioned requirement of compliance was met. On March 20, 1984, the Commission reviewed proposed amend- ments #5 and #6 to the Downtown Redevelopment Plan and determined that these amendments were also in compliance with the City Comprehensive Plan. This lack of consideration has caused undue hardship for our business. Lack of negotiation has made strategic and long range planning impossible. Thrusting such uncertainty into our business operation is tantamount to int imj d a tion. Br a dy Corporation hopes to erode Popular Poppers bargaining positi on for fair settlement through this effort. I hope the City Co un cjl of of Englewood will not condone thill unethJcnl eJforL by further eroding the bargaining position of Englewood plaza tenants by passing amendment 16 to the Englewood Downtown Redevelopment Plan. This lack of consideration has caused undue hardship for our business. Lack of negotiation has made strategic and long range planning impossible. Thrusting such uncertainty into our business operation is tantamount to intimidation. Brady Corporation hopes to erode Popular Poppers bargaining position for fair settlement through this effort. I hope the City Counc i l of of Englewood will not condone this unethical effort by further eroding the bargaining position of Englewood plaza tenants by passing amendment 16 to the Englewood Downtown Redevelopment Plan. It is my hope that the Urban Renewal authority will recognize this concerted effort to circumvent the rights of Englewood Plaza ten a nts by the Brady Corporation, and oppose this unconscionable a mendment before you, March 26, 1984. SERIES OF 1984 • • • Ill A RESOLUTION OF THE ENGLEWOOD CITY COUNCIL TO AMEND THE ENGLEWOOD DOWN- TOWN REDEVELOPMENT PLAN. WHEREAS, the City of Englewood adopted a Downtown Redevelopment Plan in accordance with the Urban Renewal Statutes of the State of Colorado; and WHEREAS, recent economic studies have indicated the need to amend the Plan to take advantage of current market potential; and WHEREAS, additional properties have been identified as necessary to be acquired for implementation of the Plan; and WHEREAS, the proposed amendments to the Plan were referred to the Planning and Zoning Commission for its review to determine the Plan amend- ments conformance to the Comprehensive Plan; and WHEREAS, the Planning and Zoning Commission conducted reviews of the proposed amendments on February 22, 1984, and March 20, 1984, and con- cluded that the amendments are in compliance to the Comprehensive Plan; and WHEREAS, official notice has been given and public hearings have been held on March 19, 1984 and March 26, 1984 to solicit comments on the proposed amendments to the Downtown Redevelopment Plan as required by C.R.S. 31-25-107(3); NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Englewood, Colorado, that: Section 1. The proposed amendments to the Englewood Downtown Redevelop- ment Plan are deemed conducive to the successful implementation of the Plan and are considered beneficial to the community as a whole. Section 2. The document attached hereto as Exhibit A and entitled "City of Englewood Downtown Redevelopment Plan" proposed Amendment #4 March 26, 1984, is hereby approved as the Englewood Downtown Redevelopment Plan. • I • - ( • • • ATTEST: • • • -2- Section 3.
