" .. . .. . .. , ......:::.;.-: ~ ~ .............. .....--................................. ,. . .....__ ....... ....... 1-1111111 l11Et01·1 • I • • • • • RESOLUTION NO. jl), SERIES OF 1984 A RESOLUTION AUTHORIZING THE NOTIFICATION OF PROPERTY OWNERS OF ASSESSMEN'fS WI TIIIN PA VIN G DI STRICT NO. 29 AND ESTABLISHING A DATE FOR . A PUBLIC HEARING ON THE ASSESSMENTS. WHEREAS, the street paving, curb, gutter and sidewalk improvements within Paving District No. 29, in Englewood, Colorado, have been satisfactorily completed and have been accepted by the City of Englewood; and WHEREAS, a statement showing the whole cost of the improvemenls and a proposed apportionment of the same against the property within the District ha s been filed with the Director of Finance; an<.l WllERE AS, THE City Coun cil has considered the special benefits accruing on each lot or tract of land within the District by reason of the making of the improvements and has determined that the apportionment of the assessments for said improvements, as set forth in the assessment roll, is in accordance with such benefits; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY Or' ENGLE~OOD, COLORADO : 1. That the Director of Finance is hereby authorized and directed to notify the owners of the property to be assessed for the improvements by publication of this resolution in three consecutive weekly issues of The Englewood Sentinel, a newspaper published and of general circulation in the City of Englewood, that the improvements have been comp leted and accepted, that the cost thereof has been apportioned according to benefits and that a hearing on the ssessment roll will be held on Mon ,lay, May 14, 1984, at the Municipal Building, at 7:30 P.M. or at such later time as Council is able to hear it in its normal course, prior to the final pass g of the ssessment onlin nc •. ln ddi tion, notice of the time, date and place of the hearing shall be mailed to each property owner to be assessed with the cost of improvem nLs, on or about the d te of th 1st public~tion of this resolution. • I • • • • • .. • 2. The whole cost of said improvements within Paving District No. 29 is the amount of $448,069.36, said amount including costs of inspection, collection, incidentals and interest as allowed by law. The City of Englewood will pay approximately '$1 78,399.89 toward the total cost , leaving the amount of $269,669.47 to be assessed against the property specially benefited and included within the District. The amount to be assessed against each loL or tract of lan<l is set forth in the assessment roll filed with the City Council. 3. WHeREAS, by Ordinance No. 16, Series of 1983, finally passed a n d ad opted on April 4, 1983, the City Council has created Paving District No. 29, within the City of t:nglewood, for t11e purpose of constructing and installing street paving, curb, gutter and sidewalk improvements, together with necessary incidentals, on certain streets within the City; and WHEREAS, the improvements authorized by said Ordinance have been completed and accepted by the City and the whole cost of such improvements has been determined; and WHEREAS, an assessment roll has been prepared and a statement showing the total cost of the improvements has been duly filed with the City Council; and WHEREAS, from the statement made and filed with the City Council, it appears that the whole cost of said improvements is the amount of $448,069.36 of which amount the City of Englewood will pay $178 ,399.89, leaving $269,669.47 to be assessed against the real property within the District, said amount including costs of i nspection, collection and other incidentals and also including interest as allowed by law; and WH ERE AS, from said statement it also a ppears that the City Council has a pportion ecl a share of the whol e cost to each lot or tract of land with in the Dis trict, in accordance with the benefits to be derive(} by saill property anll in the proportions and amounts severa lly set fort h in Exhibit A attached to this Ordinance; -1 I • • • • • BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO: Section l. Confirmation of Assessment Roll. 'I'hat the whole cos t and apportiorvnent of the same within the District is hereby approved and confirmed , and said apportionment is hereby declared to be in accordance with the special benefits which the property in the District will receive by reason of the consLruction of said improvements , and a shar e of said cost is hereby assessed to and upon each lot or tract of land within the District in the proportions and amounts as set forth in the assessmeul ro ll, attached hereto as Exhibit A. Section 2. Payment of Assessments. That the us sess menLs shul l be due and payul>le ilt the office of the Director of Finance of the City of Englewood, within thirty days after the final publicat ion of this ordinance, without demand; provided that all such assessments may, at the election of the property owner, be paid in installments, with interest as hereinafter provided. Failure to pay the whole assessment within said period of thirty days shall be conclusively considered and held an election on the part of all persons interested, whether under disability or otherwise, to pay in said installments. Such election shall be conclusively held and considered as a waiver of any right to question the power or jurisdiction of the City to construct the improvements, the quality of the work, the regularity or sufficiency of the proceedings, or the validity or the correctness of the assessments, or the validity of the lien thereof. In the event of such election to pay in installments, the assessments shall be payable at the office of the County Treasurer of Arapahoe County, Colorado in ten (10) equal annual installments of principal, the first of which installments of principal shall be due and payable on or before the lst day of January, 1985, and the remainder of said installments shall be due and payable successively on or before the lst day of January, in each year thereafter until paid in full, with interest on the unpaid principal amount at the rate of 9.50\ per annum, conmencing 2 - I • • • • • • on the date of publication of this ordinance by title following final passage and payable each year at the time of paying installments of assessments . Section 3. Penalty for Default or Non-Payment. Failure to pay any installment , whether of principal or interest, when due shall cause the whole of the unpaid principal to become due and payable immediately, and the whole amount of the unpaid principal and accrued interest shall thereafter draw intere st at the rate of one per centum (1%) per month, or fraction of a month, until the date of tax sale, as provided by law. At any time prior to the date of the tax sale, the owner may pay the amount of all unpaid installments with interest at one per centum (1 %) per month, or fr<.Jctio n o( il monLh, ano ;:11.1 pcn:1lties accrued .:111t1 sll-:~11 thereupon be restored to the right thereafter to pay in installments in the same manner as if default had not been suffered. Section 4. Discount on Payment of Assessments. Payments may be made to the Director of Finance at any time within thirty days after the final publication of this ordinance, and an allowance of five per cent (5\) will be made on all payments made during such period, but not thereafter. The discount of 5\ shall apply to all such payments, whether the payment is the entire amount of assessment due, or a part of the assessment. Immediately after the expiration of such thirty day period, the assessments shall be certified to the County Treasurer of Arapahoe County, Color do, for collection, as prov1ded by law. Sect ion 5. Assessment Lien. All assessments levied against the real property within the District, together with all interest thereon anJ penalties for Jefault in payment thereof, and all costs in collecting the same, shall constitute, from the date of the final publication of this ordinance, a perpetual lien in the sever 1 runounts ssesseu gainst each tot or tract of land.
