INITIATED BY Englewood Ur ban Renewal Authority ACT I ON PROPOSED Amend the Eng lewood Downtown Redevelopment Plan by Listing Additional Property for Acquisition. INTRODUCTION AND BACKGROUND . As preliminary planning for Englewood Parkway and Little Dry Creek flood control im- provements has progressed, properties have been identified which will be necessary to be used in the co nstruction of these public improvements. An amendment to the Down- town Redevelopment Plan approved on March 26, 1984 listed additional properties identi- fied by project engineers which were needed as right-of-way fo r the Parkway. Since preparation and approval by Council of the March 26, 1984 amendment, which added several parking lots along West Girard Avenue to the Urban Renewal Authority acquisition list, several parcels along the east and west side of the 3400 sec tion of South Cherokee Street have been deemed necessary by Parkway e ng i neers for right-of-way. These parcels are illustrated on the attached map. Parcels on the nor th and east side of South Cherokee are currently vacant land with no improvements whatsoever. Parcels on the west side of South Cherokee both north and south of Hampden Place encompass the eastern- most portion of two large parking lots. Amendment #7 , also attached to this Communica- tion, lists the parcels described above by Permanent Parcel Identification (P.P.I.) number. Currently, bids are being sought for placement of sewer and water lines in the right- of-way of Englewood Parkway, and for the construction of the large conduit at the Gi rard/Ch e rokee intersection. It is imperative that the Authority gain control of the parcels under consideration to facilitate the placement of these water/sewer lines and prevent costly delays in the selected contractor 's work schedule . Negotiations are currently being conducted with the owner of the parcels, First National Bank of Englewood and the lessee of one of the parking lots, and will continue to be conducted with the goal of achieving a mutually acceptable selling price for the land. The listing of the parcels in the Downtown Redevelopment Plan will assure that they are made available for co nstruction in a timely fashion. ( RECOMMENDATION: • In order to substantially amend the Downtown Redevelopment Plan (Urban Renewal Plan) the Planning and Zoning Commission must determine that an amendment is in compliance • I • • - ( • • • • with the Englewood Comprehensive Plan. At its October 16, 1984, meeting, the Com- mission made such a determination and has forwarded its findings to Council for consideration. Based upon the findings of the Planning and Zoning Commission, a determination by the Urban Renewal Authority that this amendment is necessary for implementation of the Downtown Redevelopment Plan and the reasoning presented above, staff recommends that Council adopt Plan Amendment #7 which lists portions of vacant land and portions of parking lots along 3400 South Cherokee Street to be used as right-of-way for Englewood Parkway. WHEREAS, a Downto~~ Redevelopment Plan (Urban Renewal Plan) has b een adopted by the Englewood Urban Renewal Authority and the Engle- wood City Council; and ~¥.EREAS, the Urban Renewal Authority has been designated by Council as the agency responsible for implementing said Plan; and WHEREAS, the acquisition of certain properties by the Authority has been deemed necessary for implementation of the Plan; and WHEREAS, additional properties, not listed heretofore in the Downtown Redevelopment Plan for acquisition have been identified as necessary for the construction of certain elements of the Plan. INTRODUCTION AND BACKGROUND: Statutes of the Urban Renewal Authority of the State of Colorado require that all pro- posed Urban Renewal Plans and amendments to such plans be reviewed by the Planning Com- mission of the municipality for which the Plan and/or amendments are proposed prior to adoption by City Council. This review is for the purpose of determining compliance of the plans and/or amendments with the commu nity's Comprehensive Plan. The Englewood Planning and Zoning Commission previously examined the Englewood Downtown Redevelopment Plan and determined that the aforementioned requirement of compliance was met. On October 16, 1984, the Commission reviewed proposed amendment #7 to the Downtown Redevelopment Plan, and determined that this amendment was also in compliance with the City Comprehensive Plan. RECOMMENDATION: The Englewood Planning and Zoning Commission recommends that City Council formally accepts its fin dings that proposed amendment 07 to the Englewood Downtown Redevelopment Plan is in compliance with the Englewood Comprehensive Plan. • I • • Resolution No. 5 Series of 1984 • • • GITY OF ENGLEWOOD, COLORADO Planning and Zoning Commission A RESOLUTIOK OF THE ENGLEWOOD PLANNING AND ZONING COMMISSION INDICATING THAT THE PROPOSED AMENDMENT TO THE ENGLEWOOD DOWNTOWN REDEVELOEMENT PLAN HAS BEEN DETERMINED TO BE IN CONFORMANCE WITH THE GENERAL PLAN OF THE CITY OF ENGLEWOOD. WHEREAS, the Englewood Downtown Redevelopment Plan (Urban Re- newal Plan) has been adopted by the Englewood Urban Renew al Authorit y and Englewood City Council and amended on December 21, 1982, March 26, 1984 and April 30, 1984; and WHEREAS, the Urban Renewal Authority, at i ts October 3, 1984 meeting determined that an additional amendment to the Plan is necessary for said Plan's implementation; and WHEREAS, the Urban Renewal Authority has recommended to City Council that the Downtown Redevelopment Plan be amended to include ad- ditional properties required for the construction of public improvements; and WHEREAS, the City Council has submitted the proposed Downtown Redevelopment Plan, as amended, to the Englewood Planning and Zoning Com- mission for review and recommendation as to its conformity to the General Plan for the development of the municipality as a whole in accordance with Section 31-25-107 (2) C.R.S. 1973, as amended; and WHEREAS, a review has been conducted by the Englewood Planning and Zoning Commission. WHEREAS, the City of Englewood adopted a Downtown Redevelopment Plan in accordance with the Urban Renewal Statutes of the State of Colorado; and WHEREAS, the engineers responsible for the design of the Little Dry Creek Flood Control Project and the Englewood Parkway Project have identified certain additional properties which will be required for these projects; and WHEREAS, the proposed amendment to the Plan was referred t o the Planning and Zoning Commission for its review to determine the Plan amend- ment's co nformance to the Comprehensive Plan; and WHEREAS, the Planning and Zoning Commission conducted a review of the proposed amendment on October 16, 1984, and concluded that th e amendment is in compliance with the Plan; and WHEREAS, off icial notice has been given and a public hearing was held o n October 29, 1984 to solicit comments on the proposed amend- me nt t o the Downtown Redevelopment Plan as required by C.R.S. 31-25-107-(3). NOW, THE REFORE, BE IT RESOLVED by the Cit y Cou ncil of the City of Englewood, Colorado , that: 1 98 4. Sec tion 1. The proposed amendment to the Englewood Downtown Redevelop- ment Plan is deemed necessary to the successful implementation of the Plan and is cons idered benefic ial to the c ommunity as a whole.
