"' o"' • 0 0 I • • - • • March 29, 1982 TO THE CITY COUNCIL CITY OF ENGLEWOOD, COLORADO Re: Resolution No. 15, Series of 1982 declaring the Intention of the City Council of Englewood, Colorado, to create a special Improvement District in the City, to be designated as Paving District No. 28 THE undersigned are all the owners of the real property situated in the 3000 block South Acoma Street from the South line of Lehigh Avenue to the North line of Mansfield Avenue in the City of Englewood, Colorado. THE above mentioned Resolution proposes to assess the cost of the improvements consisting of street pavinq, curb and gutter and sidewalk improvements, against the property SPECIALLY BENEFITTED by the improvements and included within the District . THE above mentioned Resolution provides the City Counci shall consider all protests and objections that may be mace in connection with the proposed i~provements before ordering the construction thereof. THE undersigned respectfully protest the inclusion of all the real property situated in the 3800 block South Acoma Street from the South line of Lehigh Avenue to the North line of Mansfield Avenue in said proposed Paving District No. 28 for the following reasons: THE PROPOSED IMPROVEMENTS OF STREET PAVING, CURB AND GUTTER AND SIDEWALK IMPROVEMENTS WILL NOT BE A SPECIFIC BENEFIT TO THE PROPERTY OWNED BY THEM BECAUSE THE STREET DOES NOT REQUIRE PAVING, THERE ARE NO CURBS AND GUTTERS REQUIRED AND ANY SIDEWALK IMPROVEMENTS WILL BE MADE BY THE INDIVIDUAL PROPERTY OWNERS. tIBEREFORE, the undersigned respectfully request the City Council of the City of Englewood, Colorado to delete all the property in the 3800 Block of South Acoma Street from the South Line of Lehigh Avenue to the North line of Mansfield Avenue from this proposed Paving District No. 28. 3800 So. The proposal calls for re-construction, asphalt over lay, or concrete repair on some 17 Englewood streets. Within the Re solution , there are basically three categories of construction : Cat eg ory 1 -Streets Proposed for Re-construction : 3600 through 4000 blocks S. Acoma St. 4500 block S. Acoma St. 2700 through 3200 blocks S. Cherokee St. 3700 & 3800 blocks S. Lincoln St. 2700 through 3000 blocks S. Logan St . 2200 through 2700 blocks W. Union Ave. Category 2 -Streets Proposed for Asphalt Overlay and Sidewalk, Curb, and Gutter Repairs: 3300 through 3500 blocks W. Chenango Ave. 3300 through 3500 blocks W. Grand Ave. 3000 block W. At this time, I would reco11111end that the 2700 block of South Logan not be widened, which would create an approximate $90,000 savings to the City. This would reduce the estimated City's cost to approximately $280,000, still in excess of the $200,000 available. Pending Council action subsequent to the March 2g Public Hearing on this project, the Engineering Services Department will re-establish the perimeters of construc- tion on West Union Avenue and make the necessary adjustments to cause the City's share to fall within the available $200,000. ~J ~ //? Been a resident at this address for the past 34 years . What I intend to discuss tonight is in reference to the paving district that is outlined a little later on in the agenda. There's some comments I would like to make concerning the paving district and I would like to hand out some ••. I must apologize because I don't have enough to go around to everybody (inaudible). Outlined in the last Englewood Sentinel was a million dollar street project to be discussed at this meeting in connection and it is an item on the last page of the agenda and it is to be considered as a resolution for tonight. I am not saying that the st~eet has not been maintained as far as chuckholes and they have done an excellent job in connection in repairing those holes, putting substantial base material and asphalt mix for those patches. But due to the fact that there has not been a sealcoat or any preservation of the surface area, there is beginning to form a real situation as related to the surface breaking down, and in my opinion, the, this particular area could be best served in connection with minimum expense opposed to a major rebuilding operation which would m an tearing up the street and putting in, removing all the asphalt and present base, lowering the surf ace down to meet the curb line and pan area of the vertical curb section, and complet ly rebuilding the street. The street from Dartmouth south to Floyd was originally constructed as outlined in that map on Acoma Street down as far as about mid-42 block with Cherokee only originally constructed in the 27 and 2800 block as depicted in the map. We have a situation in north Englewood where we have two extremes as far as age groups are concerned. We have the older age group that are to a great extent widows who are having a difficult time trying to get a sufficient income to sustain themselves. And then we have a number of new families, young families starting out. We have five in my block alone in 2700 block that are having a struggle trying to get started on buying new homes. And I think this imposition is related to a major project of this nature is really going to be ••• even though it can be paid out over a ten year period, the cost of retiring that debt which will be a lien against their property is going to be a considerable, bas d on th problems involved in connection with complete r construction. Presumably, anybody who has driven Cherokee can readily understand that those two blocks involved from Dartmouth to Floyd has a great deal of traffic and the street shows it because it has been repaired ••• there's patches on patches in that particular two blocks. And, of course, that particular street was not designed ••. when that street was put in ther~ that was a residential street clear on down to the Denny Miller park area and at that time when Cinderella City went in, of course, the use of that street was changed. WIRTH , RADCLIFF DRIVE HO MEO WNE RS ASS OC IATI ON , REGARDING THE INCLUSIO N OF RADCLIFF DRIVE'S 3000 BLOCK IN PROPOS ED PAV ING DISTRICT NO . 28 , MA RC H 29 , 1982 • The City Council of Englewood has included Radcliff Drive 's 3000 block in its proposed Paving District No . 28. Although all of the hom e own e rs on our street are economically situated such that the assessment resulting from our inclu ·ion will pose a h eavy financial burd en , we feel obligated to support a civic improvement proj e ct s uch as the Paving Dist rict. llouevcr , \le have a numbe r of problems with what the city plans to charge for upgrading the quality of our street to meet the City's code for residential streets such as our s and with what the city plans to do in t erms of asphalt over l ay . My remarks are limited to the costs tha t the city intends to assess each homeowner o n our block . Another member of our Association, Bob Laur , will address the engineering and t echn ical aspects of what the City proposes to do . After receiv i ng the certified letter in the mail concerning our inclusion in the proposed Pa ving District , the Radcliff Drive Homeowners Association attempted to gather as much relevant information as possible concerning costs, spec i ficat ion s , and rationale with respect to Paving District No. 28 and past paving districts. In the cost area, we found that the City of Englewood ' estimated assessments were established in the following manner: First , it was estimated that a two inch asphalt overlay would cost $5.25 per square yard installed . If the actual constructlon cost turns out match this figure , each hoMeown er on our block will pay a minimum of $9.33 per front foot or $700 in actual construction co s t s for the two inch overlay. Obviously, the purchase being forced upon us by the City , primarily for the betterment of the City, is quite substantial even without the additional costs with which the City wishes to burden us. In our view, these costs should be born e by the City of Englewood not by the members of the Radcliff Drive Homeowner s Associa tion. The remaining two categories, legal & bonding fees and int erest expense , fall into an area which is n ot as clear cut with respect to who ought to pay for them. Clearly , we would prefer the Cit y to pay for these , however , one could argu~ that this would re sult in subsidizing the members of the Paving District . What 's at stake is approximately $1.83 per front foot or $137.25 for the members of the Radcliff Drive Homeowners Association. We urge the City to consider whether the City as a whole does not benefit at least as much and perhaps more than the individual homeowner from improving the City streets. If the City as a whole doe s in fact benefit, some or all of the costs associated with legal and bond ing fees and interest expense should be paid for by the City rather than by the homeowner. In sum, we the members of the Radcliff Drive Homeowners Association are not asking that we be relieved of doing ou r civic duty. We think it is appropriate and important for the City streets to be in good condition. However, we feel that the City of Englewood need s to bear a larger burden of the Paving District costs . Radcliff Drive in proposed Paving District No . 28: (1) Homeowners should only be assessed for actual construction costs, and (2) An inch and a hal f asphalt overlay is all that is needed to bring our street up to code . (because l" of asphalt is wo rth more than l" of base). WHEREAS, the City Council of Englewood, Colorado, has determined that it is necessary to create a special i•prove- ment district within the City, for the purpose of constructing and installing street paving, curb and gutter and sidewalk im- provements, together with necessary incidentals, on a certain streets and avenues as set forth in this resolution, and to assess the cost of the improvements against the property specially benefited by the improvements and included within the district; and WHEREAS, pursuant to the Charter of the City and Chapter 14 of the Municipal Code of the City, the City Council has de- termined to construct and install such improvements, provided however, that the City Council shall consider all protests and objections that may be made in connection with the proposed improvements, before ordering the construction thereof; and WHEREAS, pursuant to an order of the City Council, the Engineer of the City for the proposed special improvement project has prepared and filed preliminary plans, specifications, esti- mates of cost, maps and schedules for the proposed improvments; BE IT RESOLVED BY THE CITY COUNCIL OP THE CITY OF ENGLEWOOD, COLORADO: 1. That materials to be used in constructing and installing the proposed improvements are stated in the Notice hereinafter set forth. 4. That the assessments to be levied against the property to be included within the district, for said improve- ments, shall be due and payable within thirty days from and after the final publication of the ordinance assessing the whole actual cost of said improvements against the real property in said district, provided, however, that any owner who shall pay the entire a111ount of the assessment within said period of tiae, shall be entitled to an allowance of 5' of the 81110unt of the assessment. In the event any owner of real estate shall fail to pay the whole of such assessment against his property within said thirty daya, then the whole cost of said improvements so assessed against his property shall be payable in ten (10) equal annual installments of assessments. The i nterest rate on the unpaid install111ents of assessments will be established by ordinance to be adopted by the City Council at a ~ater date. The first of said installments of principal and interest shall be due and payable at such tim as may be determined in and by the assessment ordinance, and th remainder of the annual installments of principal and interest shall be due and payable successively on the same day in ach ye r thereafter until all are paid in full. 5. The cost of improving street, avenue and alley intersec- tions throughout the District, and of paving in excess of 36' widths and 8" thickness on streets designated as arterial or collector within residential zoning as of March 8, 1982, will be paid by the City of Englewood. Property owners are specifically referred to the sched- ule of proposed assessments which will be on file in the Off ice of the Director of Engineering Services, from which the approximate amount to be assessed against any particular lot or parcel or property may be determined. Upon completion of said improvements, or as soon as the total cost thereof is definitely ascertained, such cost shall be apportioned ~o the property in the District. Notice of such apportionment shall be given and a Hearing will be held prior to the adoption of an ordinance assessing such cost, all as provided by law. I • - • • • • • City of Englewood ASSESSMENT DEFERRAL PROGRAM INFORMATION SHEET On June 1, 1981, City Council passed Ordinance #41 which established the Assessment Deferral Program. Through the Assessment Deferral Program, property owners may be eligible to defer the payment of special assessments made upon their property . As the attached letter indicates, the City Council intends to form a paving district which would include your property. In order to qualify for the deferral of a payment, a property owner must execute a promissory note and lien to the City for the deferred amount and must also meet specific guidelines as defined by City Council. Following are some of the most important guidelines: 1) Applicant must reside in property to be assessed; 2) Household income must not exceed the following: Number of Persons in Household 1 2 3 4 5 6 7 8 or more Income Limitations (Yearly) $ 7,600 $ 8,700 $ 9,750 $10,850 $11, 700 $12,600 $13,450 $14,300 3) Household must hav assets under the limit set by City Council. The two block distance, 2700 West Union Avenue and 2900 West Union Avenue is bor- dered on the one side by houses and on the other side by Centennial Park. The West Union street is used by all types of heavy equip- ment and trucks, endangering the lives of children trying to cross to the park and in general creating a hazzard for those living in this area. The heavy equipment/truck traffic passing through this two block residential area consists of but is not limited to Rock well Sand, Gravel and Concrete, Douglas County Concrete, C.D.I. Trash (now an expanded operation), Van Hause Excava-ting, etc . Santa Fe is an available adjacent artery constructed for heavy equipment use and all heavy industrial vehicles ln the recently expanding industrial area near the Platte River along West Union Avenue could just as well be directed onto Sant a Fe dissolving the problems created by this traffic through a park and residential area. The us ge of this two block residential street for heavy in- <lustrial traffic is creating an ever widening bur<lon for thu homeowner and endangering lives of those wishing to use tho park facilities. • I • • - • • • • • We, therefore; respectfully request that Mayor Otis and the Members of City Council review usage of West Union Avenue between Decatur and Federal and consider the following measures for action. I. Weight limits for heavy equipment be established and enforced. II. The now posted 25 M.P.11. (CHILDREN PLAYING) be enforced. III.
