AN ORDINANCE CREATING PAVING DISTRICT NO. 28 IN THE CITY OF
ENGLEWOOD, COLORADO, ORDERING THE CONSTRUCTION AND INSTALLATION
OF STREET PAVING, CURB AND GUTTER AND SIDEWALK IMPROVEMENTS
TOGETHER WITH NECESSARY INCIDENTALS, ON CERTAIN STREETS AND
AVENUES; PROVIDING FOR THE ISSUANCE OF BONDS IN PAYMENT FOR SAID
IMPROVEMENTS; AND SETTING FORTH OTHER DETAILS IN CONNECTION WITH
TRF. DISTRICT.
WHEREAS, the City Council of Englewood, Colorado,
pursuant to the Charter and the Municipal Code of the City, and
the Laws of the State of Colorado, hereby finds and determines
that there exists a necessity for the creation of Paving District
No. 28, in the City, and the construction and installation therein
of street paving, curb and gutter and sidewalk improvements,
together with necessary incidentals, on certain streets and
avenues; and
WHEREAS, Notice of a public hearing concerning the
creation of the District and th cons ruction and installation of
h e improvements herein has been pu liah d once a week for three
consecutive week s 1n the Englewood Sen inel , a newspaper of
general circulation in he City , and in addi ion, a notice has
been mailed, postag prepaid, o ach known owner of real property
within the proposed District; and
WHEREAS, at the time and place at orth in h notic,
the City Council m t in open session for th purpoa of hearing
anv objections or protests tha migh be ade gainat th propos d

and

BE IT OR DAIN ED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLO RAD O:
Section 1 . Creation of the District. That a special
improvement district f or the construction, installation or im-
provement of the improvements hereinafter described, is hereby
created and establi shed in accordance with the Charter and the
Municipal tode of t he City, and the Laws of the State of Colorado,
and shall be known and designated as "Paving District No. 28".
All proceedings heretofore taken and adopted in connection with
the District are hereby ratified, approved and confirmed.
Sect ion 2. Engineering Plans and Specifications. That
the engineer's reports, together with all of the details, specifi-
cations, estimates, maps and schedules thereto attached or ap-
pended, are hereby approved and adopted.
Section 3. District Boundary. The extent of the
District to be assessed for the cost of the improvements and the
area to be included within the boundary of the District, shall be
all the real property specially benefited, and fronting or abutt-
ing on the streets and avenues between the termini described in
the following Section, including the real property within one-half
(1/2) block of such streets and avenues.
Sect ion 4. Description of Improvements. The k ind
of impr o vements and the streets and avenues on wh ich such improve-
ments shall be constructed or installed shall b as follows:
a. Necessary grading and excavation, paving with 6"
compac ed gravel base course and 2" asphaltic
concrete sur face, (except as noted at the end of
th l1a of street s) concrete wa lks, curb and gu ter

The improvements constructed on So. Logan St. will
consist of an s• compacted gravel base course and 3• asphaltic
concrete surface; so. Logan Street is classified asan arterial
street, and accordingly, the City will pay the difference in costs
which exceed the cost for 6• base course and 2• asphalt surface,
and the extra width cost. The improvements on West Union Avenue
will also consist of an s• compacted gravel base c ourse and 3"
asphaltic concrete surface~and because this porti o n of west Union
Avenue is located in an industrial area, the amount to be assessed
will not exceed the costs for 6• base course and 2• asphalt
surface costs.
b. Necessary preparation of present surfac , o verlaying
of same with 2-inch asphaltic concre e, and concrete
walks, curbs, and gutters, where not presently
adequate; together with appurtenances and other
incidental work on the follow i ng streets and ave-

Section 5. Improvements Authorized. The construction
or installation of the street paving, curb and gutter and sidewalk
improvements, together with necessary incidentals, in and for the
District, as shown by the plans, specifications and maps thereof,
approved by the City Council of the City, is hereby authorized and
ordered, the material to be used in the construction of said
improvements to be in accordance with such maps, plans and speci-
fications.
Section 6. Assessment of Costs. The probable total
cost of the improvements to be constructed or installed i s

approximately$ : the remainder of the cost will be assessed
against the property with in the district and specially benefited
by the construction and installation of the improvements . The
approximate share of the total cost to be assessed per front foot
against any lot or tract of land fronting or abutting on said
i mprovements will be as more particularly set forth in the resolu-
ti on passed and adopted on March 8, 1982, and which is incor-
porated herein by specific reference.
Section 7. Payment of Assessments.

ten ( 10) equal annual installments of principal. The first of
s uch installments of principal shall be due and payable at such
time as will be determined in the assessing ordinance and the
i:emainder of said installments shall be due and payable succes-
sively on the same day in each year thereafter, until all are paid
in full. The maximum rate of interest to be paid on unpaid and
deferred installments shall not exceed 18\ per annum, and will be
established by ordinance to be adopted by the City Council
at a later date.
Section 8. Special Improvement Bonds. By virtue of and
pursuant to said laws and the Charter and the Municipal Code of
the City, local improvement bonds of the City shall be issued for
the purposP. of paying for the local improvements described in this
Ordinance, in an amount not to exceed the cost and expenses of
said improvements, including engineer i ng, legal and incidental
expenses, as provided by law. The bonds shall be issued based
upon estimates approved by the C i ty Council, and as authorized by
an Ordin ance to be passed by the City Council at a later date.
The maximum rate of interes t on special improvement bonds for
Paving District No. 28, shall not exceed eighteen ( 18) pe r cent
per annum. The bonds and the interest thereon shall be payable
out of special assessments to be levied against the real property
included within the District and specially benefited by the
improvements to be constructed or installed.
Section 9. General Benefits. The City Council hereby
finds and determines that the improvements proposed to be con -
structed and installed will confer a special benefit upon the
property within the District and a general benefit upon the
City as a whole.
Section 10. severability. That if any one or more
sections or parts of this Ordinance shall be adjudged unenforce-
able or invalid, such judgment shall not affect, impair or inval-
idate the remaining provisions of this Ordinance, it being the
intention that the various provisions her of are sev rable.

THE undersigned are all the owners of the real property
situated in the 3000 block South Acoma Street from the South line
of Lehigh Avenue to the North line of Mansfield Avenue in the
City of Englewood, Colorado.
THE above mentioned Resolution proposes to assess the
cost of the improvements consisting of street paving, curb and
gutter and sidewalk improvements, against the property SPECIALLY
BENEFITTED by the improvements and included within the District.
THE above mentioned Resolution provide• the City Council
shall consider all protests and objections that may be made in
connection with the proposed improvements before ordering the
construction thereof.

of all the real property situated in the 3800 block South

ENGLEWOOD, COLORADO, ORDERING THE CONSTRUCTION AND INSTALLATION
OF STREET PAVING, CURB AND GUTTER AND SIDEWALK IMPROVEMENTS
TOGETHER WITH NECESSARY INCIDENTALS, ON CERTAIN STREETS AND
AVENUES; PROVIDING FOR THE ISSUANCE OF BONDS IN PAYMENT FOR SAID
IMPROVEMENTS; AND SETTING FORTH OTHER DETAILS IN CONNECTION WITH
THF. DISTRICT.
WHEREAS, the City Council of Englewood, Colorado,
pursuant to the Charter and the Municipal Code of the City, and
the Laws of the State of Colorado, hereby finds and determines
that there exists a necessity for the creation of Paving District
No. 28, in the City, and the construction and installation therein
of street paving, curb and gutter and sidewalk improvements,
together with necessary incidenta ls , on certain streets and
avenues; and
WHEREAS, Notice of a public hear ing concerning the
creation of the District and the construction and install at ion of
th e improvements therein has been published once a week for three
c onsecutive week s in the Englewood Se ntinel, a newspaper of
gene ral circulation in the City, and in add ition , a notice has
been mailed, postage prepaid, to each known owner of real property
within the proposed District; and
WHEREAS, at the time and place set forth in the notice,
the City Council met in open session for the purpose of hearing
anv objections or protests that might be made against the proposed
district or the improvements to be constructed or installed;
and
WHEREAS, the Council has determined that such protests
and objections should be overruled1

BE IT OR DA INED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO :
Section 1 . Creation of the District. That a special
improvement district for the construction, installation or i m-
provement of the improvements hereinafter described, is hereby
created and established in accordance with the Charter and the
Municipal Code of the City, and the Laws of the State of Colorado,
and shall be known and designated as "Paving District No. 28".
Al 1 proceedings heretofore taken and adopted in connection with
the District are hereby ratified, approved and confirmed.
Section 2. Engineering Plans and Specifications. That
the engineer's reports, together with all of the details, specifi-
cations, estimates, maps and schedules thereto attached or ap-
pended, are hereby approved and adopted.
Section 3. District Boundary. The extent of the
Di strict to be assessed for the cost of the improvements and the
area to be included within the boundary of the District, shall be
all the real property specially benefited, and fronting or abutt-
ing on the streets and avenues between the termini descr i bed in
the following Section, including the real property wi th i n one-half
(1/2) block of such streets and avenues.

The improvements constructed on So. Logan St. will
consist of an 8" compacted gravel base course and 3" asphaltic
concrete surface; So. Logan Street is classified as an arterial
street, and accordingly, the City will pay the difference in costs
which exceed the cost for 6" base course and 2" asphalt surface,
and the extra width cost. The improvements on West Union Avenue
will also consist of an 8" compacted gravel base course and 3"
asphaltic concrete surface-;-and because this portion of West Union
Avenue is located in an industrial area, the amount to be assessed
will not exceed the costs for 6" base course and 2" asphalt
surface costs.
b. Necessary preparation of present surface, overlaying
of same with 2-inch asphaltic concrete, and concrete
walks, curbs, and gutters, where not presently
adequate 1 together with appurtenances and other

AN ORDINANCE CREATING PAVING DISTRICT NO. 28 IN THE CITY OF
ENGLEWOOD, COLORADO, ORDERING THE CONSTRUCTION AND INSTALLATION
OF STREET PAVING, CURB AND GUTTER AND SIDEWALK IMPROVEMENTS
TOGETHER WITH NECESSARY INCIDENTALS, ON CERTAIN STREETS AND
AVENUES; PROVIDING FOR THE ISSUANCE OF BONDS IN PAYMENT FOR SAID
IMPROVEMENTS; AND SETTING FORTH OTHER DETAILS IN CONNECTION WITH
THF. DISTRICT.
WHEREAS, the City Council of Englewood, Colorado,
pursuant to the Charter and the Mun icipal Code of the City, and
the Laws of the State of Colorado, hereby finds and determines
that there exists a necessity for the creation of Paving District
No. 28, in the City, and the construction and installation therein
of street paving, curb and gutter and sidewalk improvements,
together with necessary incidentals, on certain streets and
avenues; and
WHEREAS, Notice of a public hearing concerning the
creation of the District and the construct ion and instal la tion of
the improvements therein has been published once a week for three
c onsecutive week s in the Englewood Sentinel, a newspaper o f
general circulation in the Ci ty, and in addition, a notice has
been mailed , postage prepaid, to each known o wner of real proper ty
within the proposed District; and
WllEREAS, at the time and plac st forth in the notice,
th City Council m t in open session for the purpose of hearing
anv objections or protests that might b made against the proposed
dis rict or th improvements to be constructed or installed;
and
WllEREAS, th Council has determin d that such protests
nd objec ions ahould b overrul d;

BE IT OR DAI NED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO :
Section 1. Creation of the District. That a special
improvement district for the construction, installation or i m-
provement of the improvements hereinafter described, is hereby
created and established in accordance wi th the Charter and the
Municipal tode of the City, and the Laws of the State of Colorado,
and shall be known and designated as "Paving District No. 28".
All proceedings heretofore taken and adopted in connection wi th
the District are hereby ratified, approved and confirmed.
Section 2. Engineering Plans and Specifications. That
the engineer's reports, together with all of the details, specif i -
cations, estimates, maps and schedules thereto attached or ap-
pended, are hereby approved and adopted.
Section 3. District Boundary. The extent of the
Distr i ct to be assessed for the cost of the i mprovement s and the
area to be included within the boundary of the Dis t ri ct, s h al l be
all the real property specially benefited, and fr o nt i ng o r abutt-
ing on the streets and avenues between the t erm ini d e scr i bed in
the following Section, including the real property wi th i n o n e -half
(1/2) block of such streets and avenues.
Section 4 . Descr i ption of Improvements. The k ind
o f im pr o vement s and the s treets and avenues o n whi ch such i mpr o ve -
ments sh a ll be constr u c ted or i nsta l led s h al l be a s f o llows:

The improvements constructed on So. Logan St. will
consist of an 8" compacted gravel base course and 3" asphaltic
concrete surface; So. Logan Street is classified as an arterial
street, and accordingly, the City will pay the difference in costs
which exceed the cost for 6" base course and 2" asphalt surface,
and the extra width cost. The improvements on West Union Avenue
will also consist of an 8" compacted gravel base course and 3"
asphaltic concrete surface-;-and because this portion of West Union
Avenue is located in an industrial area, the amount to be assessed
will not exceed the costs for 6" base course and 2" asphalt
surface costs.
b. Necessary preparation of present surface, overlaying
of same with 2-inch asphaltic concrete, and concrete
walks, curbs, and gutters, where not presently
adequate; together with appurtenances and other
incidental work on the following streets and ave-
nues:

Section 5. Improvements Authorized. The construction
or installation of the street paving, curb and gutter and sidewalk
improvements, together with necessary incidentals, in and for the
District, as shown by the plans, specifications and maps thereof,
approved by the City Council of the City, is hereby authorized and
ordered, the material to be used in the construction of said
improvements to be in accordance with such maps, plans and speci-
fications.
Section 6. Assessment of Costs. The probable total
cost of the improvements to be constructed or installed is
$ it is proposed that the City of Eng lewood will pay
approximately$ : the remainder of the cost wil l be assessed
aqa inst the property with i n the d istrict and specially benefited
by the construct ion and inst allation of the improvements . The
approximate share of the total cost to be assessed per front foot
aqainst any lot or tract of land fronting or abutting on said
improvements will be as more particularly set forth in the resolu-
tion passed and adopted on March 8, 1982, and which is incor-
porated herein by specific reference.
Section 7. Payment of Assessments. The assessments
will be due and payable without demand within thirty (30) days
from and after the final publication of the Ordinance assessing
the whole cost of said improvements against the real property
in the District. In the event any o wner of real estate shall

f ail to pay the whole of such assessment against his or her
property within said thirty (30) days, then the whole cost of the
improvements so assessed against such property shall be payable in
ten (10) equal annual installments of principal. The first of
such installments of principal shall be due and payable at such
time as will be determined in the assessing ordinance and the
i::emainder of said installments shall be due and payable succes-
sively on the same day in each year thereafter, until all are paid
in full. The maximum rate of interest to be paid on unpaid and
deferred installments shall not exceed 181 per annum, and will be
established by ordinance to be adopted by the City Council
at a later date.
Section 8. Special Improvement Bonds. By virtue of and
pursuant to said laws and the Charter and the Municipal Code of
the City, local improvement bonds of the City sha ll be issued for
the purpose of paying for the local improvements described in this
Ordinance, in an amount not to exceed the cost and expenses of
said improvements, including engineering, legal and incidental
expenses, as provided by law. The bonds shall be issued based
upon estimates approved by the City Council, and as authorized by
an Ordinance to be passed by the City Council at a later date.
The maximum rate of i nterest on special improvement bonds for
Paving District No. 28, shall not exceed eighteen ( 18) per cent
per annum. The bonds and the interest thereon shall be payable
out of special assessments to be levied against the real property
included within the District and specially benefited by the
improvements to be constructed or installed.
Section 9. General Benefits. The City Council hereby
finds and determines that the improvements proposed to be con-
structed and installed will confer a special benefit upon the
property within the District and a general benefit upon the
City as a whole.
Section 10. Severability. That if any one or more
sections or parts of this Ordinance shall be adjudged unenforc -
able or i nvalid, such judgment shall not aff ct , impair or inval-
idate th r maininq provisions of this Ordinanc , it being the
in ntion that the various proviaions hereof ar • v rable.

Section 11. Hearing. In accordance with Section
4 0 of the City Charter, the City Council shall hold a public
h ea rinq on thi • ordina nce , before final passage, at 7:30 P.M. on
Monday, April 19, 1982.
S e ction 12. Publication and Effective Date. Thi s
Ordinance , after it s final pa•sage, •hall be numbered and record-
ed, and the adoption and publication shall be authenticated by the
s ign ature of the Mayor and the Director of Finance, ex-offic io
City Clerk-Treasurer, and by the Certificate of Publication. This
ordinance shall becoae effective thirty (30) day• after publica-
tion following final pas•age.
Introduced, read in full, and passed on first reading on
the 5th day of April, 1 982.
Published as a Bill for an Ordinance on the 7th day of April,
1982.

Re: Resolution No. 15, Series of 1982 declaring the
Intention of the City Council of Englewood,

THE undersigned are all the owners of the real property
situated in the 3000 block South Acoma Street from the South line
of Lehigh Avenue to the North line of Mansfield Avenue in the
City of Englewood, Colorado.
THE above mentioned Resolution proposes to assess the
cost of the improvements consisting of street paving, curb and
gutter and sidewalk improvements, against the property SPECIALLY
BENEFI'M'ED b)" the improvements and included within the District.
THE above mentioned Resolution provides the City Council
shall consider all protests and objections that may be made in
connection with the proposed improvements before ordering the
construction thereof.
THE undersigned respectfully protest the inclusion
of all the real property situated in the 3800 block South
Acoaa Street from the South line of Lehigh Avenue to the North
line of Mansfield Avenue in said proposed Paving District No.
28 for the following reasons:
THE PROPOSED IMPROVEMENTS OF STREET PAVING, CURB
AND GUTTER AND SIDEWALK IMPROVEMENTS WILL NOT
BE A SPECIFIC BENEFIT TO THE PROPERTY OWNED
BY THEM BECAUSE THE STREET DOES NOT REQUIRE
PAVING, THERE ARE NO CURBS AND GUTTERS REQUIRED ,
AND ANY SIDEWALK IMPROVEMENTS WILL BE MADE BY THE
INDIVIDUAL PROPERTY OWNERS .
WHEREFORE, the under signed respectfully request the City
Council of the City of Englewood, Colorado to delete all the
property in the 3800 Block of South Acoma Street from the South
Line of Lehigh Avenue to the North line of Ma nsfield Av enue fron
this proposed Paving District No. 28.

Dear Members of the Council,
It is getting down to the wire, now and the final decision
will soon be made. I want you to know that I was really
quite impressed at the March 29 meeting. Each of you sat
there for hours with, in my opinion, a great deal of patience
while many residents complained --repetitiously. That is
not the best way to spend an evening to say the least.
But after reading some of your comments in the Sentinel
last week I felt a little disappointed. I thought you
were all listening, but it seemed that only Jim Higday
and Mr. Neal had really heard what we had to say.
How can we possibly be unfai r to our neighbors in asking
that streets which are very useable not be torn up and
replaced? Regardless of the 85 % which other councils have
been responsible for in the past ,you v o te for today and now.
I have not dr ive n all the street s in the pav ing di strict
which have been recommended for replacement. However I
live on the 3700 block of South Lincoln and have carefully
looked at both the 3700 and 3800 blocks. They are not in
need of r epa ir . It is not inconveniencing anyone at the
present time . Th e y are clearly passable and the r e are no
bumps o r hole s which make driving them either miserable or
unsaf e . Not bei ng a thru s treet I expect i t wi ll last f or years!

Re: Resolution No. 15, Series of 1982 declaring the
Intention of the City Council of Englewood,
Colorado, to create a special Improvement District
in the City, to be designated as Paving District
No. 28
THE undersigned are all the owners of the real property
situated in the 3800 block South Acoma Street from the South line
of Lehigh Avenue to the North line of Mansfield Avenue in the
City of Englewood, Colorado.
THE above mentioned Resolution proposes to assess the
cost of the improvements consisting of street paving, curb and
gutter and sidewalk improvements, against the property SPECIALLY
BENEFITTED l;>y the improvements and included within the District.
THE above mentioned Resolution provides the City Council
shall consider all protests and objections that may be made in
connection with the proposed improvements before ordering the
construction thereof.
THE undersigned respectfully protest the inclusion
of all the real property situated in the 3800 block South
Acoma Street from the South line of Lehigh Avenue to the North
line of Mansfield Avenue in said proposed Paving District No.
28 for the following reasons:
THE PROPOSED IMPROVEMENTS OF STREET PAVING, CURB
AND GUTTER AND SIDEWALK IMPROVEMENTS WILL NOT
BE A SPECIFIC BENF~IT TO THE PROPERTY OWNED
BY THEM BECAUSE THE STREET DOES NOT REQUIRE
PAVING, THERE ARE NO CURBS AND GUTTERS REQUIRED :
AND ANY SIDEWALK IMPROVEMENTS WILL BE MADE BY THE
INDIVIDUAL PROPERTY OWNERS.
WHEREFORE, the undersigned respectfully request the City
Council of the City of Englewood, Colorado to delete all the
property in the 3800 Block of South Acoma Street from the South
Line of Lehigh Avenue to the North line of Mansfield Avenue from
this proposed Paving District No. 28.
