The City Council of the City of Englewood, Arapahoe
County, Colorado, met in special sess i on on February 5 , 1981,
at 7 :00 p.m.
Mayor Otis, presiding, called the meeting to order.
The invocation was given by Council Member Thomas
Fitzpatrick. The pledge of allegiance was led by Mayor Otis.
Mayor Otis asked for roll call. Upon a call of the
roll, the following were present:
Council Members Higday, Neal , Fitzpatrick, Keena,
Bilo, Bradshaw, Otis.
Absent: None.
The Mayor declared a quorum present.

ING TO CONSIDER THE ORDINANCE ON FINAL READING AMENDING CHAPTER 22
CONSTITUTING THE COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF
ENGLEWOOD, COLORADO, ORDINANCE NO. 26, SERIES OF 1963, AS AMENDED,
BY ADDING SECTIONS 22.4-lOh., 22.4-11 h., 22.4-13 k., 22.14 i,
TEMPORARILY PROHIBITING THE ESTABLISHMENT IN CERTAIN AREAS OF THE
CITY OF ENGLEWOOD, "ADULT ENTERTAINMENT" BUSINESS, AS DEFINED HEREIN
AND DECLARING AN EMERGENCY. Council Member Bilo seconded the mo-

OF FACT FROM THE PLANNING AND ZONING CO MMI SSION CONCERNING THIS
MATTER. Council Member Bradshaw seconded the motion. Upon a call
of the roll, the vote resulted as follows :

The Mayor declared the motion carried.
Director of Community Development Powers appeared before
Council and gave testimony concerning the proposed amendments. Ms.
Powers test ified the propo sed amendments would affect areas which
are zoned business and ind us tr ial districts and would eliminate
non-conforming uses, spec ifi cal ly adult entertainment businesses.
She testified the proposed amendments would define "adult enter-
tainment" businesses and wou ld prohibit the establishment of any
adult en tertainment businesses within 1,000 feet of : 1) another
such establ ishment; 2) a residentially zoned district; and 3)
any church, school, park playground or public building. Ms.
Powennoted the ordinance was a t emporary ordinance and would
be effective for six months. Ms. Powers stated it was the re-
commendation of the Planning and Zoning Commission that these
amendments be approved by City Council. Ms. Powers submitted
a petition signed by approximately 663 Englewood citizens that
was submitted to the Planning and Zoning Commission's hearing
on January 27 , 1981, in opposition to the adult entertainment
business at 4370 South Broadway. Ms. Powe~ stated if the ordi-
nance is passed the business owner would have 180 days to eli-
minate inventory or move. Ms. Powers stated the ordinance was
compatible with the goals of the Comprehensive Plan.
City Attorney DeWitt stated the ordinance addresses
the issue of zoning. Mr. DeWitt stated the Planning and Zon-
ing Commission is concerned about what effect the subject busi-
ness would have on a neighborhood. The ordinance deals with
certain adult usages which are not compatible with the neigh-
borhood. Establishments existing under this ordinance would
become non-conforming uses and prohibited.
Mayor Otis asked for those wishing to speak in favor
of the ordinance to come forth.
Don Smith, 3165 South Sherman, appeared before Council.
Mr. Smith complimented the City Council, City staff and Planning
and Zoning Commission for approaching the problem and putting
efforts into preparing an ordinance that has legal precedence •

Mr. Smith asked if the "non-conforming use " provision was addressed
i n the ordinance , which was t he 180 day termination.
City Attorney DeWitt stated at the present t ime it was
not addressed in the ordinance. Mr. DeWitt stated the provi s i on
was part of the package that Council would be considering.
Mr. Smith stated he was the spokesperson for several
people who supported the ordinance.
Mr. Smith expressed his concerns about the length
of time involved in enforcing the business owner to vacate if
the 180 day non-conforming use provision is not included. Mr.
Smith stated without the provision it could be conceivable that
the business owner could take up to a year to vacate. Mr. Smith
suggested making the vacat i on immediate.
At this time Mayor Otis asked for those people for whom
Mr. Smith was speaking to come forward, state their names and ad-
dresses and state whether or not they agreed with Mr. Smith's com-

Council Member Higday asked City Attorney DeWitt to ex-
plain the implications of 180 day clause that Don Smith referred
to earlier.
City Attorney DeWitt stated Mr. Smith indicated the 180
day non-conforming termination clause would effectively terminate
on the day that the ordinance terminated. There might be another
running of the 180 days from then on which would be a year period
for the non-conforming terminating clause to be effective.
Mayor Otis stated he was looking to a permanent ordinance
to be put before Council in 90 days which would be well before the
180 day period has passed.
Mayor Otis asked for the next person wishing to speak
in favor of the proposed ordinance •

Marjorie Becker, 644 E. Yale Place, appeared before
Council. Mrs. Becker gave testimony in that she agreed with
Hr. Smith's earlier comments. She urged Counci l to act expedi-
tiously getting a permanent ordinance against adult entertain-
ment businesses.
Reverend Smith, First Baptist Church, 3170 South Broad -
way, appeared before Council. Reverend Smith gave testimony that
the business had a detrimental effect on the neighborhood and re-
lated several incidence s that happened at the church since the
business moved in. Reverend Smith stated he agreed with Don Smith
and urged Council not to delay action on this matter.
Tim Arsbahl, business owner at 4509 South Broadway, ap-
peared before Council. Hr. Arsbahl gave testimony that the since
the adult entertainment business moved in the area has gone down-
hill and cautioned there would be a continuous downgrade trend if
the business was allow to stay.
James Copeland, business owner at 4595 South Broadway,
appeared before Council. Hr. Copeland gave testimony that he
understood the City Attorney's position but felt Council should
assert itself and go with what the citizens believe in and not
with legislation that they think will go through. Hr. Copeland
described how the shops and people who work in the area have be-
come frightened.
Jim Jeffers, owner of Lock & Key, 4371 South Broadway,
appeared before Council. Hr. Jeffers gave testimony that his
business was located across from the adult entertainment busi-
ness and that permission to allow the book store to remain was
just asking for people to put bars on businesses and homes.
George Hall, 4298 South Pearl , appeared before Coun-
cil. Hr. Hall gave testimony that he agreed with Don Smith and
suggested looking into the wrecking yard ordinance for research
purposes.
Adrian House, First Christian Church, 3190 South Grant,
appeared before Council. Hr. House gave testimony commending the
City Council for their community concern in this effort. Hr. House
stated the adult entertainment business was not conducive to a
family community and there was no proven reason of any social value
for its existence.
Barbara Blair, 4409 South Bannock, appeared before
Council. Mrs. Blair gave testimony expressing appreciation for
Council's efforts for this legislation. Ms. Blair stated she

Judy McGruder, 4 66 0 South Gala pago, appeared be f ore
Coun cil . Mrs. McGruder testified t hat sh e was appa l led t h at

were hard enough to r a i s e, l et a l one havi ng the s tore's i n fluenc e .
Debb ie Bl omb e rg, 4527 South Lincoln, appeared before
Council. Mrs. Blomb e rg tes ti fied that she felt people who visited
the adult book s t ore wou ld l eave magazines and paraphernalia in
the neighborhood pa rk s, lik e t hey leave newspapers. Mrs. Blomberg
stated that the 1 ,000 feet promixity for the location of the book store
to a church and s chool was too close.
Counc il Member Higday asked Police Chief Holmes if he
had i ncreased t he pa t rol in the vicinity of the book store.
Pol i ce Chief Robert Holmes appeared before Council. The
Chief testified that patrol had increased and further testified
to the legislation under which he can enforce policing in this
area. Chief Holmes stated it had been his experience that in
every sex-related case that he or his officers have investigated,
that the perpetrator has been stimulated by pornography. However,
if the pornography was not available, he did not know if the crime
would have been committed. Chief Holmes continued to state how
strongly he felt the need for public protection in this matter.
Lee W. Fowler, 3926 South Pennsylvania, appeared before
Council. Mr. Fowler gave testimony in support of the ordinance.
Mayor Otis declared a recess at 8 :25 p.m. The Council
reconvened at 8 :40 p.m. Mayor Otis asked for roll call. Upon
a call of the roll, the following were present:

Bilo, Bradshaw, Otis.
Absent: None.
The Mayor declared a quorum present.
Mayor Otis asked for further comments from the audience
who wished to speak in support of the ordinance.
Ellen Velesquez, 80 East Tufts Ave., appeared before
Council. Mrs. Velesquez gave testimony that she felt the child-
ren would learn enough from the "streets" without going to a

adult book store. She stated she was afraid to walk home from
work which was only a block away. She hoped t h e o rdinance would
be made permanent and t hat no more adult book sto res would b e
permitted.
Bill Taylor, 4350 South Penns y lvan i a , appeared before
Council. Mr. Taylor gave testimony that he was appearing on
behalf of his daughter. He told of an inc i dent in which someone
tried to break into and enter his house and commended the police
for the swift response to his call. Mr. Taylor asked Council to
keep the adult entertainment businesses from coming in t o the Ci ty.
There were no further comments from the aud i ence in
support of the ordinance.
Mayor Otis asked if anyone wanted to speak against the
ordinance. No one responded.
Council Member Higday entered into the record letters
from Cindy Rausch -no address, and Nancy Conklin, 4795 South
Kalamath, both in support of the ordinance and protesting the
existing adult book store.

City Attorney DeWitt commented on the rationale behind
the City's efforts to make the proposed amendments responsible and
effective legislation that would pass in Court. The temporary or-
dinance was a "stop gag" measure to provide research time to pre-
pare a permanent and successful ordinance. Mr. DeWitt spoke on
what other cities throughout the United States have done along
this line.
Mayor Otis called for a vote on the original motion.

NO. 26, SERIES OF 1963, AS AMENDED, BY ADDING SECTIONS 22.4-10 h.,
22.4-11 h., 22.4-13 k~ 22.14 i. TEMPORARILY PROHIBITING THE
ESTABLISHMENT IN CERTAIN AREAS OF THE CITY OF ENGLEWOOD "ADULT
ENTERTAINMENT" BUSINESS AS DEFINED HEREIN AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD,
COLORADO:
Section 1. There is hereby added to Chapter 22 of the Comprehensive
Zon1ng Ordinance, Ordinance No. 26, Series of 1963, as amended, the
following:
22.4-10 h. (1) LEGISLATIVE DECLARATION.
The City Council finds that the concentration of certain
"adult entertainment" businesses in cities tends to result
in the blighting and deteriorat i on of the areas of such
concentration. Accordingly, it is necessary that these
businesses be regulated in such a manner as to prevent the
erosion of the character of affected neighborhoods. Pend-
ing further study of these deleterious effects and the
development and adoption of appropriate remedial zoning
regulations, it is necessary to prohibit on an interim basis
the establishment of such "adult entertainment" businesses
within close proximity to existing "adult e nte rtainment"
businesses, residentially zoned areas, and public buildings,
schools, churches, parks and play gro unds, so as to avoid
substantially negating the ultima t e ef f e c t of such remedial
regulations.
22.4-10 h. (2) PURPOSE.
The purpose is to establish t he z o nin g f or and l o cation
of sexually-oriented busin e sses and ac t i v itie s whi c h:
(a) are not a nuis a nce, a nd
(b) do not violate the prov i sions of the Colorado Criminal
Code regarding sexual conduct, obscene matter or
harmful matter.
Nothing in this section authorizes, legalizes or permits the
establishment, operation or maintenance of any business,
building or activity which violates any municipal ordinance

regarding nuisances, sexual conduct, obscene matter or
harmful matter.
22.4-10 h. (3) DEFINITIONS.
(a) As used in this ordinance, the terms "sexual conduct"
~"specified anatomical areas" shall mean as follows:
(1) "Sexual conduct" includes the following:
a. the fondling or other touching of human
genitals, pubic region, buttocks, or
female breasts;
b. ultimate sex acts, normal or perverted,
actual or simulated, including intercourse,
oral copulation, sodomy;
c. masturbation;
d. excretory functions as part of or in
connection with any of the activities set
forth in a. through c. above.
(2) "Specified anatomical areas" include the
following: human genitals, pubic region,
buttocks, and female breasts below a point
immediately above the top of the areola.
(b) For purposes of this ordinance, 22.4-10 h., the
term "adult entertainment" businesses are defined as follows:
(1) Adult Bookstore. An establishment having as
a significant portion of its stock in trade
books, films, magazines and other periodicals
which are distinguished or characterized by
an emphasis on depicting or describing
"sexual conduct" or "specified anatomical areas".
(2) Adult Mini Motion Picture Theater. An enclosed
building with a capacity of less than 50 per-
sons used for presenting material distinguished
or characterized by an emphasis on depicting
or describ i ng "sexual conduct" or "specified
anatomical areas".
(3) Adult Motel. A motel wherein material is
presented wh i ch is distingu ished or characterized
by an emphasis on d epicting or describing "sexual
conduct" o r "specified anatomical areas".
(4) Adult Motion Picture Arcade. Any place to
which the public is permitted or invited
wherein coin or slug -operated or electronically,
electrically or mec hanically controlled still

or motion picture machines, projectors or other
image-producing devices are maintained to show
images to five or fewer persona per machine at
any one time, and where the images eo displayed
are distinguished or characterized by an
emphasis on depicting or describing "sexual
conduct" or "specified anatomical areas•.
Adult Motion Picture Theater. An enclosed build-
ing with a capacity of 50 or more persons used
for presenting material distinguished or charac-
terized by an emphasis on depicting or describing
"sexual conduct" or "specified anatomical areas".
Cabaret. A nightclub, theater or other establish-
ment which features live performances by topless
and/or bottomless dancers, "go-go" dancers,
exotic dancers, strippers or similar entertainers
where such performances are distinguished or
characterized by an emphasis on "sexual conduct"
or "specified anatomical areas".
Massage Parlor. Any place where, for any forms
of consideration or gratuity, massage, alcohol
rub, administration of fomentations, electric
or magnetic treatments, or any other treatment
or manipulation of the human body occurs as
part of or in connection with "sexual conduct"
or where any person providing such treatment,
manipulation or service related thereto exposes
"specified anatomical areas".
Model Studio. Any establishment or business
which provides, as a substantial or significant
part of its business, the services or modeling
of adults distinguished or characterized by
emphasis on depicting "sexual conduct" or
"specified anatomical areas" by means of
photography, painting, sketching, drawing or
sculpture by persons paying any form of con-
sideration or gratuity.
(9) Sexual Encounter Center. Any business, agency
or person who, for any form of consideration
or gratuity, provides a place where three or
more persons, not all members of the same family,
may congregate, assemble or associate for the
purpose of engaging in "sexual conduct" or
exposing "specified anatomical areas".

(c) As used in this ordinance, the t e rms "public bui lding"
and "school" are defined as follows:
(1) Public Building. Any building owned, leased or
held by the United States of America, the State
of Colorado, the County of Arapahoe, the City
of Englewood, any special d i strict, school
district or any other agency or political sub-
division of the State of Colorado or the United
States of America, which building is used for
governmental purposes.
(2) School. Any public or private educational facility,
including child day care facilities, nursery schools,
preschools, kindergartens, elementary schools,
primary schools, intermediate schools, junior high
schools, middle schools, high schools, vocational
schools, secondary schools, continuation schools,
special education schools, colleges and universi-
ties. "School" includes the schoolgrounds but
does not include facilities used primarily for
another purpose and only incidentally as a school.
22.4-10 h. (4) PROHIBITION.
For a period of six months, or until such time as a perma-
nent "adult entertainment" zoning ordinance is adopted, which-
ever should first occur, no person shall cause or permit the
establishment of an Adult Bookstore, Adult Mini Motion Picture
Theater, Adult Motel, Adult Motion Picture Arcade, Adult
Motion Picture Theater, Cabaret, Massage Parlor, Model Studio
or Sexual Encounter Center, as each is defined in Section
22.4-10 h. (3) hereof and provided that such "adult entertain-
ment" business shall not be established within 1,000 feet of
the property line of another such business or within 1,000
feet of the property line of any church, school, park, play-
ground or public building, or within 1,000 feet of any
property zoned R-1-A, R-1-B, R-1-C, R-2, R-2-C, R-3, or R-4
as the same are defined in the City Zoning Ordinance.
The "establishment" of an "adult entertainment" business
shall include the opening of such business as a new business,
the relocation of such bus i ness, or the conversion of an
existing business location to any of the uses described in
Section 22.4-10 h. (3).
22.4-10 h. (5) NONCONFORMING USES .
Uses made nonconforming by this ordinance shall be
governed by the City of Englewood Zoning Ordinance. However,
no property right is afforded solely by the existence of this
ordinance.

by persons paying any form of consideration or
gratuity.
(9) Sexual Encounter Center. Any business, agency
or person who, for any form of consideration or
gratuity, provides a place where three or more
persons, not all members of the same family,
may congregate, assemble or associate for the·
purpose of engaging in "sexual conduct" or
exposing "specified anatomical areas".
(c) As used in this ordinance, the terms "public building
and "school" are defined as follows:
(1) Public Building. Any building owned, leased or
held by the United States of America, the State
of Colorado, the County of Arapahoe, the City of
Englewood, any special district, school district
or any other agency or political subdivision of
the State of Colorado or the United States of
America, which building is used for governmental
purposes.
(2) School. Any public or private educational
facility, including child day care facilities,
nursery schools, preschools, kindergartens,
elementary schools, primary schools, intermediate
schools, junior high schools, middle schools,
high schools, vocational schools, secondary
schools, continuation schools, special education
schools, colleges and universities. "School"
includes the schoolgrounds but does not include
facilities used primarily for another purpose
and only incidentally as a school.

22.4-11 h, (4) PROHIBITION.
For a period of six months, or until such time as a
permanent wadult entertainment" zoning ordinance is adopted,
whichever should first occur, no person shall cause or permit
the establishment of an Adult Bookstore, Adult Mini Motion
Picture Theater, Adult Motel, Adult Motion Picture Arcade,
Adult Motion Picture Theater, Cabaret, Massage Parlor, Model
Studio or Sexual Encounter Center, as each is defined in
Section 22.4-11 h. (3) hereof, and provided that such "adult
entertainment" business shall not be established within 1,000
feet of the property line of another such business or within
1,000 feet of the property line of any church, school, park,
playground or public building, or within 1,000 feet of any
property zoned R-1-A, R-1-B, R-1-C, R-2, R-2-C, R-3, or R-4
as the same are defined in the City Zoning Ordinance.
The "establishment" of an "adult entertainment" business
shall include the opening of such business as a new business,
the relocation of such business, or the conversion of an
existing business location to any of the uses described in
Section 22.4-11 h. (3) hereof.
22.4-11 h .(S) NONCONFORMING USES.
Uses made nonconforming by this ordinance shall be governed
by the City of Englewood Zoning Ordinance. However, no property
right is afforded solely by th e existence of this ordinance.
Section 3. There is hereby added to Chapter 22 of the Comprehen-
S1ve Zon1ng Ordinance, Ordinance o. 26, Series of 1963, as amended,
the following:
22.4-13 k. (1) LEGISLATIVE DF.CI.ARATION.
The City Council find s that the concentration of certain
"adult entertainment" busi nes ses in cities tends to result
in the blighting and deter ioration of the areas of such
concentration. Accordingl y , it is necessary that these

erosion of the character ot ~f f ected ne ighborhoods. Pending
further study of these de l "·.e rious effects and the develop-
ment and adoption of ap p r o p r iate remedial zoning regulations,
it is necessary to prohi bit on an interim basis the establish-
ment of such "adult enterta~nme nt" businesses within close
proximity to existing "adult e ntertainment" businesses,
residentially zoned areas , aild public buildings, schools,
churches, parks and playg r u unds, so as to avoid substantially
negating the ultimate ef ect of such remedial regulations.

22.4-13 k. (2) PURPOSE.
The purpose is to establish for the zoning for and location
of sexually-oriented businesses and activities which:
(a) are not a nuisance, and
(b) do not violate the provisions of the Colorado Criminal
Code regarding sexual conduct, obscene matter or
harmful matter.
Nothing in this section authorizes, legalizes or permits the
establishment, operation or maintenance of any business,
building or activity which violates any municipal ordinance
or provision of the Colorado Criminal Code or Civil Code
regarding nuisances, sexual conduct, obscene matter or
harmful matter.
22.4-13 k. (3) DEFINITIONS.
(a) As used in this ordinance, the terms "sexual conduct" an "specified anatomical areas" shall mean as follows:
(1) "Sexual conduct" includes the following:
a. the fondling or other touching of human
genitals, pubic region, buttocks, or
female breasts;
b. ultimate sex acts, normal or perverted,
actual or simulated, including intercourse,
oral copulation, sodomy;
c. masturbation;
d. excretory functions as part of or in
connection with any of the activities set
forth in a. through c. above.
(2) "Specified anatomical areas" include the
following: human genitals, pubic region,
buttocks, and female breasts below a point
immediately above the top of the areola.
(b) For purposes of this ordinance, 22.4-13 k, the
term "adult entertainment" businesses are defined as follows:
(1) Adult Bookstore. An establishment having as
a significant portion of its stock in trade
books, films, magazines and other periodicals
which are distinguished or characterized by
an emphasis on depicting or describing
"sexual conduct" or "specified anatomical areas".

(2) Adult Mini Motion Picture Theater. An enclosed
building with a capacity of less than 50 per-
sona used for presenting material distinguished
or characterized by an emphasis on depicting
or describing "sexual conduct" or "specified
anatomical areas".
(3) Adult Motel. A motel wherein material is
presented which is distinguished or characterized
by an emphasis on depicting or describing "sexual
conduct" or "specified anatomical areas".
(4) Adult Motion Picture Arcade. Any place to
which the public is permitted or invited
wherein coin or slug-operated or electronically,
electrically or mechanically controlled still
or motion picture machines, projectors or other
image-producing devices are maintained to show
images to five or fewer persons per machine at
any one time, and where the images so displayed
are distinguished or characterized by an
emphasis on depicting or describing "sexual
conduct" or "specified anatomical areasH.
(5) Adult Motion Picture Theater. An enclosed build-
ing with a capacity of 50 or more persons used
for presenting material distinguished or charac-
terized by an emphasis on depicting or describing
"sexual conduct" or "specified anatomical areas".
(6) Cabaret. A nightclub, theater or other establish-
ment which features live performances by topless
and/or bottomless dancers, "go-go" dancers,
exotic dancers, strippers or similar entertainers
where such performances are distinguished or
characterized by an emphasis on "sexual conduct"
or "specified anatomical areas".
(7) Massage Parlor. Any place where, for any forms
of consideration or gratuity , massage, alcohol
rub, administration of fomentations, electric
or magnetic treatments, or any other treatment
or manipulation of the human body occurs as
part of or in connection with "sexual conduct"
or where any person providing such treatment,
manipulation or service related thereto exposes
"specified anatomical areas".
(B) Model Studio. Any establishment or business
which provides, as a substantial or significant
part of its business, the services or modeling

proximity to existing "adult entertainment" businesses,
residentially zoned areas, and public buildings, schools,
churches, parks and playgrounds, so as to avoid substantially
negating the ultimate effect of such remedial regulations.

If any provision or clause of this ordinance or the applica-
tion thereof to any person or circumstance is held to be uncon-
stitutional or otherwise invalid by any court of competent juris-
diction, such invalidity shall not affect other ordinance provisions
or clauses or applications thereof which can be implemented with-
out the invalid provision, clause or application, and to this end
the provisions and clauses of this ordinance are declared to be
severable.
EXTENSION OF ORDINANCE. Section 8.
This ordinance may be continued in effect after public
hearing.
Section 9. EFFECTIVE DATE AND PUBLICATION.
The City Clerk shall certify to the adoption of this ordinance
and cause it to be published once in the official paper of the City
of Englewood.

On February 3, 1981, the Planning and Zoning Commission considered the
Findings of Fact on Case #1-81 to support the amendment of the Comprehen-

These amendments would temporarily prohibit the establishment of adult
entertainment businesses in defined areas of the City.
CONCLUSION AND RECOMMENDATION:
The City Planning and Zoning Commission voted unanimously to approve the

1979, and that 113 Englewood c i tizens and bus i n e ss people particip ate d
i n the develo~nt of that Plan.
3. That in approving the Comprehensive Plan, the City Counc il
adopted certain Goals for the City wh i ch were developed by the Co mpr ehe n-
sive Plan Review committees, which Go als aff i rm t he de sire of th e cit izens
of En&lewood to "Maintain the residential neighborhoods as the comer-
stone of our co-mity"; "To provide the environment necessary to maintai n
a stable population"; and "To insure a balance among the r e sidential, com-
-rcial and industrial areas of the City."

in cities tends to result in the blighting and deterioration of the a r eas
of such concentration and, accordingly, it is necessary that these bu sine sses
be reaulated in such a aanner as to prevent the e rosion of the character of
all affected nei&hborhoo4s.
5. That testi8ony presented at the Public Hearing demonstrates
the bli&htina effect adult enterta~nt businesses have upon adjac ent
businesses, the serious deteriorating effect s uch uses have on the cha racte r
of the adjacent residential neighborhoods, as well as the disturb an ce these
uses have on the tranquility and peace of residents residing i n these resi-
deotial ne1ahborhoo4a as a result of the unrestricted and uncontrolled lo-
cation of adult enterta~nt businesses.
6. That pendin& further study of the deleterious effects that a
concentration of adult entertatn.ent businesses have upon residential neigh-
borhoods, schools, churches, parks, playgrounds, public buildings and other
businesses, it is necessary to prohibit, on an interim basis, the establish-
..at of the follovin& adult entertainment businesses until appropriate
r.-.dial aonina reaulations can be developed and adopted: Adult Bookstore,
Adult Mini Motion Picture Theater, Adult Motel, Adult Motion Picture Arcade,
Adult Motion Picture Theater, Cabaret, Massage Parlor, Model Studio or
Sexual Encounter Center.
7. That the establishment of adult entertainment businesses
would be enjoined for a period of six (6) months or until such time as
a peraanent adult entertain~nt zoning ordinance is developed and adopted,
whichever should first occur, and that this time is necessary to permit
further study of any deleterious effects of the adult entertainment
businesses and to develop and to adopt appropriate remedial zoning regula-
tiona.
8. That nothing in the proposed amendments would authorize,
leaalize, or permit the establishment, operation or maintenance of any
business, building or activity which violates any municipal ordinance
or any provisions of the Colorado Criminal Cod e or Civil Code regarding
nuisances, sexual conduct, obscene matter or harmful matter.
9. That the foregoing is ad e quately substantiated by the
record of the aforementioned Public Hearing which is on file with the
Secretary to the City Planning and Zoning Commission •
CONCLUSIONS
1. That proper notice of the Public Hearing was given in
co.pliance with 122.3-4 of the Comprehensive Zoning Ordinance .
2. That Goals for the long-range Planning for the desired
develop .. nt of the City of Englewood, Colorado, were approved by City
Council in Resolution Number 49, Series of 1979, upon the recommenda-
tion of the City Planning and Zoning Commission and recorded in the
office of the Arapahoe County Clerk and Recorder •

and industrial areas of the City.
4. That the concentration of adult entertainment businesses
reault in the bli&htin& and deterioration of the area i n which they are
concentrated aa well as to adjacent resi dential neigh borhoods and to
churchea, achoola, parka, playgrounds, and public buildings.
5. That it ia to the best interest of the present and future
character of the reaidential neighborhoods and the necessary community
facilitiea which serve them, as well as to the business community, to
reaulate adult entertaia.ent uses in order to insure that the adverse
effecta of the concentration of those uses will not contribute to the
bli&htin& or dovnarading of those areas.
6. That further study is necessary to develop a procedure to
reaulate adult entertatn.ent businesses and, to this end, the establish-
.. nt of adult entertainment businesses within the City of Englewood should
be enjoined for six .anths or until such time as a permanent adult enter-
tain.ent buainess zoning ordinance is developed and adopted, whichever
should first occur.
RECOMMENDATIO N
Therefore, it is the recommendation of the City Planning and
Zonins Camaission to the City Council, that the Comprehensive Zoning
Ordinance, Ordinance No. 26, Series of 1963, as amended, be amended by
addin& 122.4-10 h, §22.4-11 h, §22.4-13 k, and §22.4-14 i, temporarily
prohibitina the establishment of adult entertainment businesses in certain
areas of the City of Englewood, and b y amending §22.6 to provide for the
teraination of any adult entertainment business which is determined to
be non-conforain& pursuant to the provisions of the Comprehensive Zoning
Ordinance.

RELATION OF APPLICANT TO REQUEST :
The Englewood City Council has directed the staff to
initiate procedures to control adult entertainment businesses
within _the City of Englewood. One of the means of doing so
are the subject amendments to the Comprehensive Zoning Ordinance.
ZONE DISTRICT:
The proposed ordinance amendments would affect areas which
are zoned B-1, Business, B-2, Business, and I-1 and I-2, both
industrial districts.
Bookstores, movie theaters and other forma of entertain-
ment are permitted as a use-by-right in each of these zone
districts.
DESCRIPTION OF THE PROPOSED AMENDMENTS TO THE COMPREHENSIVE
ZONING ORDINANCE:
The proposed amendments would define "adult entertain-
ment" businesses and would prohibit the establishment of any
adult entertainment business within 1 ,000 feet of:
1. Another such establishment;
2. A residentially zoned district;
3. Any church, school, park, playground or public
building.

RELATION TO C<»>PREHENSIVE PLAN:
This Ordinance is compatible with the goals of the
Comprehensive Plan, specifically to : "Provide the environ-
ment necessary to maintain a stable population" and "Maintain
the residential neighborhoods as the cornerstone of our com-
munity."
PLANNING DIVISION ANALYSIS:
Soma communities view the proliferation of movie houses
which show X-rated films, bookstores specializing in literature
aimed toward the satisfaction of a broad spectrum of sexual
appetites and other businesses similarly oriented, as a hazard
to the morals of the community and a threat to property values.
One of the methods used to control these uses --referred to
throughout the proposed amendments as "adult entertainment"
businesses --is zoning.
The City of Boston, on the apparent assumption that these
uses will be less harmful if they are confined to certain dis-
tricts specially created for the purpose, has established an
"Adult Entertainment District." The sale of adult books, pictures,
films and the like is confined to this district. The confine-
ment of these uses to the special district is intended to minimize
what is viewed as a deleterious effect which such uses have on
surrounding property. It is also felt that the concentration
will minimize the exposure of these uses to children by con-
fining them to a specific area away from schools, parks and
playgrounds and away from routes regularly used by children
traveling to and from these places .
Other cities, such as Detroit , have taken a quite different
approach by prohibiting such concentrat ion and requiring these
uses to be dispersed . This is the method being considered by
Englewood.
City Attorney DeWitt has studied the issue very carefully
and has advised both the City Council and Planning Commission
of the various Court decis ions relative to attempts to control
adult entertainment uses. He has prepared the proposed amend-
ments pursuant to the City Council's request and in a form
which hopefully will give the City the desired control over
these uses.
The proposed amendments will have the effect of dispersing
these businesses away from residential areas, schools, churches,
parks, playgrounds and public buildings, as well as from similar

zoned diatricta and an area on the western side of the central
business diatrict.
Using the propoaed 1,000 foot rule, there are no other
location• in which these uses would be permitted . (Please
refer to the attached map.)
The City Attorney will be prepared to diacusa the non-
conforming uae provision which we talked about last Tuesday
night, at the Public Hearing. This is attached for your in-
formation.
