The City Council of the City of Englewood, Arapahoe
County, Colorado, met in sine die session on January 7, 1980, at 7:30p.m.
Mayor Taylor, presiding, called the meeting to order.
The invocation was given by former Council Member
Howard Brown. The pledge of allegiance was led by Cadet Sen-ior Troop 1765.
The Mayor asked for roll call. Upon the call of the roll, the following were present:
Council Members Williams, Giseburt, Smith, Keena, Bilo, Clayton, Taylor.
Absent : None.
The Mayor declared a quorum present.

Assistant City Manager Curnes
City Attorney Berardini
Municipal Court Judge Parkinson
Deputy City Clerk Johannisson
Deputy City Clerk Watkins

City Manager McCown noted an addition to the minutes of
the regular Council meeting of December 18, 1979. In reference
to the hearing on the Downtown Development Authority proposal, Mr.
McCown had requested that the recommendations from the Planning
and Zoning Commission be included as a direct reference and so stated in the motion.
COUNCIL MEMBER GISEBURT MOVED TO APPROVE THE MINUTES OF
THE REGULAR COUNCIL MEETING OF DECEMBER 18, 1979, AS AMENDED. Coun-
cil Member Smith seconded the motion. Upon a call of the roll, the vote resulted as follows:

COUNCIL MEMBER SMITH MOVED TO APPROVE THE MINUTES OF
THE SPECIAL MEETING OF DECEMBER 20, 1979, AS SUBMITTED. Council
Member Giseburt seconded the motion. Upon a call of the roll,
the vote resulted as follows:
Ayes: Council Members Giseburt, Smith, Keena,
Bilo, Clayton, Taylor.
Nays: None.
Abstain: Council Member Williams.
The Mayor declared the motion carried.

Mayor Taylor asked if any Council Members wanted to make closing comments.
Council Member Williams wished the new Council the best
of luck in their upcoming terms.
Council Member Giseburt stated he believed in Englewood
and had enjoyed his term. Mr. Giseburt stated he wished he was
returning. Mr. Giseburt added he would continue to be active in City government.
Council Member Smith stated it was privilege to serve.
He noted the number of people in attendance and urged each to edu-
cate themselves in Englewood government. Also, to be regular in
attendance and pray for the new Council and board members for di-
rection. Mr. Smith added he planned to be active in local govern-
ment and urged everyone to continue to participate.

the golf ball situation at the Englewood Golf Course.
Mayor Taylor explained the City of Englewood's stand in this situation
as it relates to liability. Councilman Smith thought that the staff was to prepare
a new report on the golf ball situation and present it to ColDlcil. City Manager
McCown stated that he did not understand that this was the case.

James T. Keller, Executive Director for the Downtown Development
Authority, presented the proposal of the Englewood Downtown Development Authority.
Richard Wanush, Director of Community Development for the City of
Englewood, presented a recommendation from the Planning and Zoning Commission
approving the proposal with certain exceptions.
Mayor Taylor asked if there was anyone in the audience who wanted to speak in favor of the proposal.
Fred Kaufman, 2800 South University, owner of Kaufman's Hens Wear
and Chairman of the Downtown Development Authority, spoke in favor of the proposal.
Mayor Taylor asked if there was anyone in the audience who wanted
to speak against the proposal. There were none.
City Manager McCown stated that the City had received a letter
from Ralph Murphy, President of Murphy Corporation, that was opposed to the proposal.

City Manager McCown briefed City Council on his attendance at the
National League of Cities Conference in Las Vegas, Nevada, on November 25-28,
1979. He stated that a large part of the Conference was directed toward the
discussion of General Revenue Sharing. Councilman Smith stated that the new
Council should address the revenue sharing problem as soon in January as they
can get to it. Be also stated that Comcil should appoint one of their meailers
to act as a personal representative to lobby for passage of the revenue sharing bill.

to the new City Council. The report is to contain comments from Judge Parkinson
regarding the salary of the Associate Judge.

City Manager McCown requested Director of Engineering Services
Diede to present the report about concrete spalling in Paving District No. 25.
Mr. Diede presented his report to City Council.
Councilman Smith and Councilman Bilo requested that Mr. Diede's
remarks be included in the minutes verbatim.
"My name is Gary Diede, Director of Engineering Services for the
City of Englewood. The report I submitted refers back to a report
dated November 2, 1979 which explained at that time the concrete
spalling problem that we are having on Paving District No. 25.
The latest memo dated December 12th updates that memo and explains
briefly that we are in the same situation waiting for the concrete
testing results. I have laid out two procedures, I guess, my office
would take after receiving that report. I would still go to the
contractor and demand that the spalling concrete be removed and
replaced. If we don't get results of a time schedule or action
from the contractor at that point, I think Bernie might have to
agree with this 30 days be a reasonable length of time to ask him
to respond . Then at that time we would have to take whatever legal
action our City Attorney's Office would require in order to get
the work done satisfactory to the City."

point there was a lot of discussion in the metro area with what
the problem was. Other cities were trying to get together vith
their contractors and trying to find out what the proble. vaa •

During the spring, we came up with a final pWlch list because as
the winter went on last year we foWld that oore and more areas
were spalling. So, I believe, in May we came out with the original
list of the sections in the City that had spalling. The contractor
didn't agree with those. We met back in the field later, I think
in July, going over every stone that we felt was spalled. He said
that he had problems with it. He didn't feel that he was liable
for it, and so on. Anyhow, we completed our punch list and at
that time the cities and contractors were going to go together
and hire a laboratory testing and consulting engineer to try to
determine what was causing the problem because we didn't want to
go out and just repour the concrete if we didn't know what was
causing it to spall. This problem isn't just in Englewood, it's
in Denver, Aurora, it's in Wyoming, it's in Idaho, it's in a lot
of states and there is a lot of speculation because we imported
cement to mix with the concrete. Nobody really knows at this point
and there are millions of dollars out there and millions of dollars
in liability for someone. If they start replacing it at the contractors
expense, there are a lot of contractors that are going to go under
and they don't want to take that responsibility. So they are stick-
ing pretty much together saying, "It's an industry-wide problem,
nobody knows what is causing it, so how can you hold a contractor
liable." Anyhow, after we went through this process during the
summer, the contractors decided that they did not want to participate
with the municipalities in this area to do the testing. So, the
Cities of Lakewood, Denver, Aurora, and Englewood decided that we
were about the four cities left that were going to really attack
the problem. Littleton said that they had so little concrete that
they were just going to let it go and replace it on their ,own.
Some of the other cities didn't think they had a bad enough problem
so they decided not to go along. So the four cities I just mentioned
decided to have the concrete testing performed. Lakewood said they
would carry the ball. They would investigate laboratories and so
on and they came up with a list of four people to actually do the
work. In the process of Lakewood putting the progr-together,
the guy that was doing that resigned and he vent to work for some-
one else and in the process we have to start all over again. And
that is why we are so late at this point. So we are fairly assured
now that we are going to get the test results before December 31st,
but if the laboratories don't have their concrete testing done for
all four cities at that time, they don't want to submit a report.
They want to submit one report for all four cities and not one
individually for Englwood and one individually for Aurora. So we
have to wait for all four reports to be combined into one."

City Attorney Berardini felt that the Nativity Scene had been a
part of the Denver display for about 50 years. But could not support that
information. Councilman Giseburt stated that he was 54 years old and the scene
has been there ever since he can remed>er. The Mayor felt that the Resolution
should read "for -.my years" rather than "for over 50 years."

Councilman Clayton accepted the amendment to his motion of deleting
the words "over 50" and inserting the word "many."
City Attorney Berardini announced that this was a draft only if
there were other corrections Council wanted to make.
Councilman Giseburt suggested that Council collect donations to
help support the cost of $2,000 for the maintenance of the Nativity Scene.
Councilman Giseburt stated that this was a motion but Councilman Clayton
stated that they already had one motion already on the floor and Councilman
Giseburt changed his mind stating that he would like this an amenduent. Mayor
Taylor reiterated that Councilman Giseburt wanted the City to take donations
to support the Nativity Scene and Councilman Giseburt agreed. Councilman
Giseburt stated that there had been some offers from various church groups for
funding and that was why he wanted the amendment added.
Mayor Taylor stated that the ACLU is basing their case on the fact
that tax money is being used as well as public property. Mayor Taylor thought
that the Council should pass this Resolution and then send a letter signed by
Council stating that Council would support donations by private parties.
Acting City Manager Curnes stated that he was at a meeting with
Ed Sullivan from Mayor McNichols Office and told Mr. Sullivan that the Englewood
City Council was meeting tonight to consider a Resolution supporting the
retention of the Nativity Scene. Mr. Ed Sullivan stated that a Resolution
from Englewood would be very well received. Acting City Manager Curnes
felt that Council could transmit the Resolution with a cover letter.
Councilwoman Keena questioned the Christian aspect rather than
traditional aspect. She felt that the third paragraph might need some revision.
City Attorney Berardini based his wording on the ass~tion that
this was a Christian nation. Be thought traditional might be a good idea.
CouncilwOIUD Keena wanted to make sure that Englewood was doing
something supportive rather than damaging.
City Attorney Berardini felt that this was a Christian nation
rather than Islamic and didn't feel that this would be used in a court of law.
City Attorney Berardini thought traditional might be more legally acceptable.
Councilwoman Keena felt that "traditional Christmas spirit in our
community and in the United States" would be better than what is stated in the
third paragraph.
Councilman Smith stated that this is a Christian nation and cited

City Attorney Berardini stated that the constitutional amendment
relating to church and state is designed to remove the national or state govern-
ment to espouse any one religion.
Councilwoman Keena didn't want to offend any particular religion
or Jewish people who have nothing but support for the Nativity Scene from the
traditional sense.
Judge Parkinson addressed the Council as a citizen and as a former
melliler of the ACLU Legal Panel for quite some time. He gave a brief history
and asked Council to take caution in their actions by calling an iq~roq~tu
meeting without any participation in the adversary hearing and without any of the
other side of the constitutional issues being presented. He wanted to make sure
that all of our constituents are represented when Council calls an iq~romptu meeting
to discuss the matter among just themselves, no public hearing, no viewing of
another side of any case and come down with a Resolution which purports to be
the sense of the citizens of the City of Englewood. He felt that if a poll
were taken that most of the citizens of Englewood would probably belong to a
Christian faith which supports the Nativity Scene but wondered what were the
rights of the lllinority. He then again urged Council to take caution.
City Attorney Berardini questioned Judge Parkinson whether he
thought Englewood City Council could support the actions of the Denver City
Council in the Nativity Scene matter. Judge Parkinson felt that it was within
their authority, and stated that they consider their actions.
