SPECIAL MEETING:
The City Council of the City of Englewood, Arapahoe
County, Colorado, met in special session on March 31, 1980, at 7:30 p.m.
to order. Mayor Pro Tem Bradshaw, presiding, called the meeting
The invocation was given by Council Member Fitzpatrick.
The pledge of allegiance was led by Mayor Pro Tem Bradshaw.
Mayor Pro Tem Bradshaw asked for roll call. Upon a call
of the roll, the following were present:
Council Members Higday, Neal, Fitzpatrick, Keena, Bilo,
Bradshaw.
Absent : Mayor Otis.
Mayor Pro Tem Bradshaw declared a quorum present.

ON PAVING DISTRICT NO. 27. Council Member Bilo seconded the mo-
tion. Upon a call of the roll, the vote resulted as follows:

Director of Engineering Services Diede presented techni-
cal information on paving sections, criteria for assessment, and
type of construction recommended for various streets and alleys pro-posed for Paving District No. 27.
Mayor Pro Tern Bradshaw explained the format for the pub-
lic hearing was Co receive public comnent in regard to the street
and alleys proposed for this paving district. Decisions regard-
ing the district would be made by Monday, April 7, at which time
the ordinance would be presented on first reading. Second read-
ing will be on April 21 following another public hearing. No in-
dividual notices would be sent in regard to the second public hear-
ing. It was the intent of the City to eventually bring all streets
up to City standards; and once a street has been in a paving dis-
trict the City takes on the responsibility for maintenance of the
street. The four main areas considered in making a decision on this district were:
1. The need for the improvement.
2. The kind or character of the improvement.
3. The cost of the improvement -is the cost justified?
4. The method of assessment -is the property benefited
as a result of the improvement?
Mayor Pro Tem Bradshaw read the list of proposed improve-
ment blocks -block by block -and asked for those people to speak
who were in favor of the improvements and then for those opposed.

M. S. Holland, 2969 South Lincoln, opposed on the basis there was
no need for improvement. Mr. Holland stated the installation
of a storm sewer caused the damage to the street and should
have been repaved correctly following the con•truction.
Isabella Knight, 3021 South Lincoln, opposed on the basis there
was no need for improvement.
Mrs. Ellenburger, 2968 South Lincoln, opposed on the basis there was no need.

Don Emis, 193 East Cornell Avenue, opposed on the basis there was no need.

Richard Gallatin, 2980 South Sherman, opposed on the basis there was no need.
Raymond Satter, 3001 South Grant, opposed on the basis there
was no need for improvement, and the cost of improvement
would be a financial hardship on many people. Mr. Satter
also was against removing any trees in order to do the construction.
John Segeser, 2961 South Grant, opposed on the basis there
was no need for improvement. Mr. Segeser questioned
how the sidewalk would be finished.
Director Diede stated sidewalk construction would be
whatever was appropriate for that block.
300 East Cornell Avenue

R. L. Lunders, 3000 South Washington, asked if the ditch
was going to be piped.
Director Diede stated there was no requirement; however,
the sidewalk would be so close it would necessitate pip-ing.
Suzanne Stevens, 2965 South Logan, opposed on the basis it
wou l d create financial hardships for people and suggested
i f the street was paved, that the costs be kept to
a min i mum.

J. J. Van Stelten, 3008 South Logan, opposed on the basis there
was no need to widen Cornell. Mr. Van Stelten agreed the
street needed repaving but did not need curb, gutter,
and sidewalk.
Donald L. R. Smith, 3165 South Sherman, who owns property
at 2975 South Pennsylvania, on the basis there was no
need for widening Cornell since most of the traffic was
local. Mr. Smith had no objection to repaving the street.
Mr. Smith stated earth moving equipment destroyed the
street when Bates-Logan Park was constructed and he asked
that the City pay a high portion of the assessment cost
as a result.
Mary Jackson, 2998 South Logan, opposed on the basis there was
no need for widening Cornell. Ms. Jackson stated the street
needed to be paved.
Tim Philibosian, 2985 South Pennsylvania, opposed on the basis
there was no need to widen Cornell. Mr. Philibosian
asked the Council reconsider the timing to do this
project due to the state of the national economy.
R. L. Lunders, 3000 South Washington, oppoaed on the basis there
was no need to widen Cornell and the cost could not be
justified. Mr. Lunders submitted a petition containing
158 signatures of residents who oppoaed the widening
of Cornell. Mr. Lunders also submitted a protest letter from himself.
Lynn Philibosian, 2985 South Pennsylvania, oppoeed on the
on the basis there was no need to widen Cornell. She
stated she would like to see the holes fized.
Sam Porter, 2996 South Logan, opposed on the baaia there
was no need to widen Cornell. Mr. Porter atated tvo
years ago would have been a better time.
500 East Cornell Avenue
In Favor -None
In Opposition -
Bill Sigler, 555 East Cornell Avenue, opposed on the basis
there was no need for improvement until the storm
sewers were installed and the heavy equipment used for
construction caused the damage. Mr. Sigler stated the
street did not need to wid~ned. Mr. Sigler asked that

Mayor Pro Tem Bradshaw declared a recess at 9:35 p.m. Council reconvened at 9:45 p.m.
Don Howery, 3001 South Pearl, opposed on the basis there
was no need to widen Cornell nor to put in sidewalks.
Mr. Howery stated the street did need repaving.
Mrs. Moore, 603 East Cornell, opposed on the basis that
it would create a financial hardship on her since
she was on a fixed income. Mrs. Moore stated the
street did not need to be widened.
Laverne Donaldson, 607 East Cornell, opposed on the basis
there was no to widen Cornell, resurfacing the street
would be appropriate. Mr. Donaldson was opposed to
on-street parking on one side of the street.
Earl Pfeufer, 3000 South Pearl, opposed on the basis there was no need to widen Cornell.
Donald Hotopp, 615 East Cornell Avenue, opposed on the basis
there was no need to widen Cornell.
600 East Cornell Avenue
In Favor -None.
In Opposition -
Orlie Cooper, 2950 South Washington, opposed on the basis there
was no need to improve this area at all. Mr. Cooper sug-
gested that speed bumps be installed if the street was
paved. He was also opposed to on-street parking.
Eugene Michaud, 3046 South Washington, asked Council to monitor
costs as closely as possible if they decide to pave the street.
700 East Cornell Avenue
In Favor -None
In Opposition -
Zoe Oberg , 705 East Cornell Avenue, opposed on the basis there
was no need for improvement and she opposed on-street parking •
Lyn Nyquist, 729 East Cornell Avenue, oppposed on the basis
there was no need to improve nor widen the street.

there was no to widen the street and he opposed
on-street parking.

Jerry De Hoff, 3195 South Delaware, opposed on the basis
there was no need to repair the street.
Tim Jeffers, 3235 South Delaware, asked Council to delay the
project because he had other -assessments to pay.
Fred Gassert, 3210 South Elati, opposed on the basis there
was no need for improvement•

Deputy Clerk Watkins entered into the record a letter from
Hrs. Hively, 3215 South Bannock, stating the street
was in good condition prior to the installation of the
main and that the City should pay fully for the street
repair •

Juanita Collins, 3200 South Bannock, stated the curb in fron
of her property was broken but it was not her fault. Ms.
Collins stated she did not think she should be responsi-
ble for the curb repair •

Director Diede stated his department would check the
curb to determine if it needed repair.
Council Member Higday stated similar problems were ex-
perienced by other citizens. Mr. Higday stated it was
sometimes caused by the contractor and he cautioned
staff members to oversee the project closely to make
sure the contractor does neglect his construction re-sponsibilities.
Michael Day, 126 West Eastman, stated he would pay for the
assessment; however, he was distrubed at getting ticketed for parking on his street.
Council Member Fitzpatrick advised Mr. Day to obtain
a parking permit to allow on-street parking.

David Visser, 3201 South Lincoln, opposed on the basis
the street was in good condition until the storm sewer was installed.
Lawrence Willis, 3186 South Lincoln, opposed on the basis
it would create a financial hardship for people on fixed income.
Eugene Kottenstette, 3176 South Lincoln, opposed to the dis-
trict as proposed. Mr. Kottenstette suggested using
the money for another area such as Clarkson and patch Eastman.

Jim Thomas, 3183 South Grant, opposed on the basis the
street was in good condition and he did not want to
loose the trees due to construction. Hr. Thomas
asked Council to consider the timing in view of the
state of the economy.

Deputy Clerk Watkins entered into the record a letter in op-
position from the First Christian Church, 3190 South
Grant. The Trustees objected to the assessment as they
would be affected by the property running from South
Grant Street to South Logan Street on Eastman and the
majority of South Grant from East Dartmouth to East Eastman.
Donald L. R. Smith, 3165 South Sherman, apoke in opposi-
tion on behalf of the church.
Tom Townsend, 3201 South Logan, on the baaia there was no
need to widen the street.
3000 South Grant Street

Deputy Clerk Watkins entered into the record a petition re-
ceived in the City Clerk's office. The petition contained
69 signatures of residents objecting to the project in
the 3000, 3100 and 3200 blocks of South Grant Street.
Raymond Satter, 3001 South Grant, reiterated his co111Dents
made earlier in this hearing.
Sarah Morton, 3000 South Grant, opposed on the basis she
thought the street was in good condition and she
could not afford to pay the assessment •
Pam Moore, 3096 South Grant, opposed on the basis there
was no need for repair and it would create a financial hardship.

Don Chiras, 3127 South Grant, opposed on the basis there was
no need for repair. Mr. Chiras stated he was not on a
fixed income, but still had problems making ends meet.
David Strohman, 3106 South Grant, opposed on the basis there
was no need for repair but an overlay probably would work.
Pauline Skidmore, 3111 South Grant, opposed on the basis
there was no need for repair.
3200 South Grant Street

In Opposition -
Ralph White, 3150 South Grant, opposed on the basis there was no need.
Pat Sullivan, 3211 South Grant, opposed the project in general.
Walt Sanders, 3283 South Grant, asked if he could reset his
present sidewalk and conform to the standards.
Director Diede stated he has that option but needed a
permit. Mr. Diede stated the Engineering Services De-
partment would have to inspect it when completed.
John Woolley, 3284 South Grant, opposed on the basis there
was no need for improvement and it would create a
financial hardship for him.

Myron Bot t, 3 10 1 South Downing, opposed on the basis he was
on a fi xe d i ncome and it would be difficult for him to
pay the assessment. Mr. Bot submitted a petition con-
taining 8 signatures of residents opposed to improving this alley.
Laurence Guilford, 3150 South Corona, stated he was not op-
posed to paving the alley, but queried whether it was
a good time to do it due to the state of the economy.
Mr. Guilford suggested installing speed bl.DDps if the alley gets paved.
Dominic Dreiling, 1125 East Eastman, stated he would like
to see it paved but the cost was too high.
Ray Barlow, 3120 South Corona, stated he would like to see
it paved but the cost was too high.
David Felgar, 3191 South Downing, stated he would like to
see it paved but the cost was too high.
Mrs. Pike, 3172 South Corona, stated she would like to
see it paved but the cost was too high. Mrs. Pike
stated she thought the alley belonged to the pro-
perty owners anyway.
Bruce Armstrong, 3215 South Grant, opposed on the basis there
was no need for improvement.
Bob Pritchard, 3100 South Downing, opposed on the baais the
assessment was too high. Mr. Pritchard au&aeated laying gravel instead.
Council Member Neal read into the record the following
people who had contacted him either in favor or
opposition to the paving of this alley:

The establishment of paving districts always seems to raise
questions regarding all phases of administering a district.
Therefore, I thought I would relate to you the process, policies
etc., that effect district procedures.
Paving districts are formed in accordance with our City Charter
and Municipal Code (copies of related portions attached).
A street or alley may be proposed for a district in two ways,
i.e . petition by a majority of the property owners of the real
property along the block or by Council's own initiative. Even
in the event of a successful petition, Council is not compelled
to act favorably and include the street or alley in the district.
A simplified procedure for a district would be: List of Proposed
Streets; Resolution of Intention; Notice of Public Hearing (pub-
lished and mailed); Public Hearing; Ordinance (creating district);
Bidding and Construction; Bill for Ordinance (assessing costs);
Notice of Public Hearing; Public Hearing; Ordinance (assessing
costs); certification of assessments to Arapahoe County.
The list of proposed streets presented to Council is an accumulation
from several areas; requests from citizens, petitions, requests
from business or industrial properties, physical inspections, review
of past districts, review of maintenance problems, requests from
Council, etc.
Since Paving Distric t No. 6 in 1956, there have been 20 districts
completed. This has improved approximately 78 miles of streets,
4 0 alleys and num e rous overlays.
Streets that have not been in a paving district and show signs of
distress are tested for thickness of base course and thickness of
asphaltic concrete. Where the thickness does not meet City stan-
dards (6" of basecourse -2" of asphalt on residential streets
a nd 8" of basecourse -3" of asphalt on business, industrial or
arterial streets), the street is re-constructed, brought to City
standards and assessed. Where the thickness does not meet City
standards and an overlay would bring the street to that standard,
then the overlay is constructed and assessed. Where the thickness

meets City standards the overlay is a cost to the City, and is
usually done under the overlay program paid for by monies received
from the Arapahoe County Road and Bridge Levy. Any street that
has been in a previous district and shows signs of distress is
either seal coated or overlayed at City cost.
Streets are assessed at full constructed width and depth, except
for arterial and collector streets in an area zoned residential.
Then the assessment is for the standard residential street i.e.
36 feet wide from flow line to flow line with 6" of basecourse
and 2" of asphalt, with the City bearing any additional costs for
extra widths and depths.
All new concrete is assessed to adjacent property. Existing con-
crete that is broken, displaced or deteriorated, regardless of grade
or alignment, is removed and replaced, and assessed to the adjacent
property. Existing concrete that is in good condition that is
removed and replaced for engineering purposes (grade or alignment
change) is paid for by the City.
An assessment district is divided into two parts: Section A, the
property owners' portion of the construction: and Section B, the
City's portion of construction.
The following items are costs borne by the property owners:
A. Construction Contract. All costs not specifically set forth
as chargeable to the City.
B. Engineering Services. Actual salary expenses including social
security, workme n's compensation, health and life insurance,
and bonding incurred in the design, construction, and assess-
ment of the improvements.
c. Administrative overhead. Ten percent of the engineering ser-
vices charges. Representing expenses incurred by the City
for services, which are primarily provided by the following ·
individuals or departments:
1. Director of Public Works
2. Director of Engineering Services
3. Secretary to Director of Public Works
4. City Manager's Office
5. Department of Finance
6. Law Department (other than those directly chargeable to
acquisition of property)

Interest Expenses. Expenses incurred from the date of issuance
of the bonds to the time of the first installment of the assess-
ments is made payable. The interest on previous districts has
been the nearest one-half per cent above the bond interest rate.
Legal and Fiscal Agent Fees. Agent fee costs incurred. (Fiscal
agents-rri the issuance O'l"llonds including bond counsel.)
Title Checking Fees. Expenses incurred from the checking of
ownership of parcels of property within the district.
Legal Advertising .
Equipment Rental.
Miscellaneous Supplies and Expenses. All other direct identi-
fiable expenses assessable to the property owners, such as
printing, postage, assessment books, etc.
ContingenctoReserve. Two percent of the actual expenses
incurred a ve which shall represent all future costs assess-
able, but undetermined, such as legal advertising and county
treasurers' collection fees. The two percent shall not apply
to interest expense as outlined above.
The following items are costs borne by the City-at-large through
the Public Improvement Fund.
A. Construction Contract. ·rhe City's share of construction of
the improvement. These are established as the following items:
1. Street and alley intersections (concrete and paving).
2. Arterial and collector streets through residentially
zones property. In these cases, the property owner is
assessed the cost of constructing a residential street.
The City bears the difference between the cost of a resi-
dential stre et and the cost of an arterial or collector
street.
3. Expenses for paving, sidewalk, curb, and gutter ever a
city ditch crossing (may also include piping of
a section o f the ditch or re-construction of a ditch
crossing) and adjacent to other city-owned properties.

5. Storm drainage construction, including pipes under crossings
storm sewers, storm sewer inlets, and manholes.
6. Charges by the Utilities Department for the relocation of
valves, etc., on private water services when the costs
are incurred in connection with the district.
7. Costs to remove and replace in quantity any trees eliminated
due to paving construction.
B. Land Acquisition. Costs of rights-of-way and property
necessary for construction of the improvement. Includes
recording fees, court fees in condemnation, title policies,
and other expenses directly associated with acquisition of
the parcel itself .
C. Appraisal Fees for Land Acquisition. Costs for appraisals
necessary to the acQ\iiiition of property for the improvement.
D. Attorney Fees for Land Acquisition. Fees of the City Attorney
or other counsel iii'Ciirred directly in the acquisition of
property for the district.
The cost of paving is distributed to abutting properties by
several methods, i.e. front foot method, benefit zone method or
area method depending upon the physical layout of area to be
asse ssed.
The front foot method is used predominately on streets where the
properties within the block front the improvements. The properties
are assessed for all work done adjacent to their boundary.
The benefit zone method is used predominately on avenues. The
property abutting the improvement is assessed for all concrete
work adjacent to their boundary. The cost of the paving is assessed
against all propert i es within one-half block, or 300', whichevef is
less, on a zone bas i s . Each one-half block, or 300' section, is
div i ded into six (6) parallel zones and assessments are made on the
f ollowing basis:
1st zone abutt i ng on street or avenue -2/7 or approx. 28.55 %
2nd zone -1/7 or approx. 14. 29%
3rd zone -1/7 or approx. 14.29\
4th zone -1/7 or approx. 14.29'
5th zone -1/7 or approx. 14. 29%
6th zone -1/7 or approx. 14. 29%

The area method is used where lots and areas are irregular and the
front or zone method would not provide for an equitable assessment.
When the assessments are completed and the final assessing ordinance
approved, then the owners of the properties have 30 days in which
to pay all or any part of the assessment and receive a 5\ dis-
count on the portion paid. The discount only applies if bonds were
sold to finance the improvement.
After the discount period the assessments are certified to Arapahoe
County for collection over a period of ten years. The first year's
payments are l/lOth of the principal. The second and subsequent
payments are l/lOth of the principal plus interest on the unpaid
balance. Should any of the payments not be made then the full

Members of the audience, I aa Ks. Beverly Bradshaw, Mayor
Pro Tea of the City of Bnalevood, and will be presiding at
toniaht's public beartna in the absence of Mayor Eugene
Otis, who is out of town. As has been previously stated,
the purpose of tonight'• public hearing is to seek public
C••-nt in regard to the streets and alleys proposed for
faving District No. 27. No decisions will be made tonight
in regard to the district; Council will receive the minutes
of this hearing later this week, consider the statements and
comments, and then aalte our decisions by Monday, April 7, which is
the date the ordinance creating the district will have to be
paased on first reading. The ordinance will receive final
paasqe on Honday, April 21, at which time another public
hearing will take place and you will have the opportunity
to be heard again if you so desire. Let me emphasize, however,
that no individual notices will be sent in regard to this second
hearing •
lefore hearina stateaents or protests on the proposed district,
I would like to ll&ke some aeneral co11111ents in regard to the
policy of bavtna pavin& districts. As Kr. KcCovn stated pre-
viously, the City has had paving districts since 1956. It is
the intent of the City to eventually have all streets brought
up to City standards. Once a street has been in a paving
district, the City then takes on the responsibility for

policy of the City in having districts and assessing the
benefited property owner for the cost is set forth in
Title XII, Chapter 1 of the Englewood Municipal Code.
There are four .. in areaa for the Council to consider tonight
in aaltillg its decision on this district. The four areas are
aa follows:

curb, &utter and aidevalk, aa applicable, proposed for
illprOVellellt.
The ltind or character of the 1aprove.ent.
The cost of the improvement -is the cost justified?
The method of aaaessment -is the property benefited as
a result of the improvement?
W~ fully realize that paving districts are usually not the
moat popular aubject a Council considers and that it of ten
impoaea fin.allcial hardship on people. However, we submit to
ycu that it ia the policy of the City to have such districts
a.Ml assess the cost to the property owners. Although we will
certainly consider all the statements and c<>1111ents 11ade at
tonight's hearing, our 11ain consideration will be given to the
four areas listed previously and we would request that you direct
your r ... rt., aa much aa poasible to these four areas.

This is to register a strong protest, in r efe rence to your letter describ-
ing the City's intent to form Paving District No . 27 , on behalf of t he
First Christian Church of Englewood, lllglewood , Colorado at 3190 South
Grant Street.
Our property affected by this Di s trict runs from So uth Grant Street to
South Logan Street on ~tcan nn d the ma ·ority of South Grant fr om East
Dartmouth to :Elru!t Eastman.
The p roposal you have will cost our church a pproximat ely S4o ,OOO which
few businesees or churches would be in ;.; posture t o pay . Since t his
blacktop, sidewalks and curbing was installed in 1950 at the c hurch's
expe nse, it would seem logical t he City of .E.nglewood s hould conti nue to
maintain this service. It also seems odd it has taken the City of
Englewood 30 years to decide this area was not in a paving distri ct and
should now be encompassed in one.
We, the First Christian Church, strongly oppose this so called improve-
ment and find the cost of such a project prohibitive to our conti nued
operation in t he City of Englewo od.

A RESOLU'l'ION DECLARING THE IN'l'EN'J.'ION OF THE CI'l'Y COUNCIL OF
ENGLEWOOD, COLORADO, TO CREA'l'E A SPECIAL IMPROVEMEN 'J.' DIS'J.'IUC'J.'
IN THE CITY TO BE DESIGNATED AS PAVING DISTRICT NO. 27, ADOPTING
DETAILS AND SPECIFICATIONS FOR THE PROPOSED DISTRICT, AND ORDERING
PUBLICATION AND MAILING OF NOTICE OF HEARING TO THE OWNERS OF THE
PROPERTY 'l'O BE ASSESSED FOR IMPROVEMENTS IN SAID DISTRICT.
WHEREAS, the City Council of Englewood, Colorado, has
determined that. it is necessary to create a special improvement
district within· the City, for the purpose of constructing and
installing street paving, curb and gutter and sidewalk improvements,
together '"ith necessary incidentals, on certain streets and avenues
as set forth in this resolution, and to assess the cost of the
improvement• against the property specially benefited by the
improvements and included within the district; and
WHEREAS, pursuant to the Charter of the City and
Chapter 14 of the Municipal Code of the City, the City Council
has determined to construct and install such improvements,
provided, however, that the City Council shall consider all protests
a nd objections that may be made in connection with the proposed
.i111prov~111enti>, before ordering the construction thereof; and
WHEREAS, pursuant to an order of the City Council, the
Engineer of the City for the proposed special improvement project
has prepared and filed preliminary plans, specifications, estimat0s
of cost, maps and schedules for the proposed improvements;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO:
1. That the City Council has determined there exists
a necessity for the construction and installation of the street
paving, curb and gutter and sidewalk improvements, together with
necessary incidentals, on those streets and avenues which are
more particularly set forth in the notice of hearing, and to
create a special improvement district for such purpose.
2. That the Engineer's reports, together with the
preliminary details, specifications, estimates of cost, maps and
schedules prepared and filed with the City Clerk be and the same
are hereby approved and adopted by the City Council for use in
the construction and installation of the improvements to be made
in said improvement district •

3. 'J.'hat materials to be used in constructing and
installing the proposed improvements are stated in the Notice
hereinafter set forth.
4. That the assessments to be levied against the
property to be ·included within the district for said improvements
shall be due and payable within thirty days from and after the
final publication of the ordinance assessing the whole actual cost
of said improvements against the real property in said district,
provided, however, that any owner who shall pay the entire amount
of the a~sessment within said period of time shall be entitled
to an allowance of s• of the amount of the assessment. In the
event any owner of real estate shall fail to pay the whole of
such assessment against his property within said thirty days,
then the whole cost of said improvements so assessed against his
property •hall be payable in ten (10) equal annual installments
of assessments. The interest rate on the unpaid installments of
asseasmeht& will be established by ordinance to be adopted by the
City Council at a later date. The first of said installments of
principal and interest shall be due and payable at such time as
may be determined in and by the assessment ordinance, and the
remainder of the annual installments of principal and interest
shall be due and payable successively on the same day in each
year thereafter until all are paid in full.
5. That the property to be assessed for said improve-
ments shall be the property specially benefited by said improve-
ments and included within the improvement district, and more
particularly described in the Notice hereinafter set forth.
6. That there shall be prepared an ordinance creating
within the corporate limits of the City a special improvement
district to be known as Paving District No. 27 providing for the
construction and installation of the improvements, all as described
in this Resolution, and in accordance with the preliminary report,
plans, maps, specifications, details and estimates of costs of the
Engineer, herein referred to and now on file in the office of the
Director of En:Jineering Servioes.The proposed ordinance will be considered
for passage on first reading by the City Council at a regular meet-
ing the~eof to be held on April 7, 1980.
7. Notice of the public hearing on the creation of
the district shall be published once a week for three weeks in
the Englewood Herald Sentinel, a newspaper of general circulation
in the City. In addition, a copy of such notice shall be mailed,
postage prepaid, to each known owner of re4l property within the
proposed district.

ON CERTAIN STREETS AND AVENUES THEREIN, AND
OF A PUBLIC HEARING THEREON.
_ All owners of real estate and property here-
inafter deacribed, and all persons generally, are hereby notified
that the City Council of Englewood, Colorado, pursuant to its own
order, ha• adopted preliminary details, plans and specifications
for conatruction of street paving, curb and gutter and sidewalk
improvements, in and for a proposed special improvement district
within the corporate limits of Englewood, Colorado, to be known
as Paving District No. 27. Said persons are further notified
as follows: (a) The improvements to be constructed or
installed are as follows:
l. Necessary grading and excavation, paving with 6"
compacted gravel base course and 2 "asphaltic concrete surface,
concrete walks, curb and gutter where not already
installed: together with appurtenances and inci-

(b) The description of the proposed district, and
the property to be assessed with the cost of the improvements
shall be all of the real property fronting or abutting on the
streets and alleys between the termini hereinbefore described,
including the real property within one-half (1/2) block of such
streets and alleys. Adjustments for the assessment of costs
will be made for irregular and odd-shaped lots and parcels of
property.
(c) The probable total cost of the improvements
to be constructed and installed is $596,200.
(d) The probable amount of the total cost which
the City shall pay is approximately $136,500.
(e) The balance of the total cost which is not
paid by the City of Englewood will be assessed against the pro-
perty specially benefited by the improvements, and included
within the District. Probable costs per front foot for said
improvements are as follows:
Asphalt paving on streets 36' wide (6 and 2) $25.55 per front
Concrete alley paving 14' wide $40.02 per front

Paving of other widths shall be in proportion to the above estimate.
4" thick curbwalk -Type I $21. 75 per front foot
4" thick curbwalk -Type II $25.50 per front foot
Vertical curb and gutter $13.50 per front foot

6" thick concrete slab $ 4.88 per square foot
All estimates exclude the six percent (6\) for inspection
collection, incidentals and interest as provided by law.

The costs of paving to be constructed along the
sides of corner lots within said District shall be assessed
against properties within one-half (1/2) block, or 300' of
such intersections and corner lots, whichever is smaller,
on a zone basis in accordance with benefits conferred on such
properties.
Each one-half (1/2) block, or 300' section, will
be divided into six (6) parallel zones and assessments will
be on the following basis:

No assessments will be made for curbs, gutters and
sidewalks in place which conform with the plans and specifica-
tions for the proposed improvements and which are acceptable to
the City Engineer.
The cost of improving street, avenue and alley inter-
sections throughout the District, and of paving in excess of 36'
widths and 8" thickness on streets designated as arterial or
collector within residential zoning as of March 3, 1980, will
be paid by the City of Englewood.
Property owners are specifically referred to the schedule
of proposed assessments which will be on file in the Office of
the Director of Engineering Services, from which the approximate
amount to be assessed against any particular lot or parcel or
property may be d e termined.
Upon comp l e tion of said improvements, or as soon as the
total cost thereo f i s def i n i tely ascertained, such cost shall b e
apportioned to the property in the District. Notice of such
apportionment shall be given and a Hearing will be held prior to
the adoption of an o rdinance assessing such cost, all a s provided
by law.

(fl Said assessments will be due and payable without
demand within thirty days from and after the final publication
of an ordinance assessing the whole cost of said improvements
against the real property in said District: provided, however,
that any owner who shall pay the full assessment within said
period of thirty days shall be entitled to an allowance of
five percent (5\). In the e .vent that any owner of real pro-
perty shall fail to pay the whole of such assessment against
the property within said thirty days, then the whole cost of
said improveaent so assessed against the property shall be
payable in ten equal annual installments of principal. The
first of such installments of principal shall be due and pay-
able at such time as may be determined in and by the assessing
ordinance, and the remainder of said installments thereafter
until all are paid in full. The rate of interest to be paid
on unpaid and deferred installments will be established by
ordinance to be adopted by the City Council at a later date.
(9) A Hearing on the creation of the District will
be held by tbe Council on Monday, the 31st day of March 1980,
at 7:30 o'clock P.H., at the City Hall in Englewood. A
public hearing shall be held prior to the final passage of
such ordinance, at the regular meeting at 7:30 P.M. on Monday,
April 21, 1980.
(h) Any person desiring to be heard upon the issue
of the creation of the district or upon the construction,
installation or improvement of the improvements involved,
may appear at the time and place set for the public hearing
thereon for that purpose.
(i) A map, estimate and schedule showing the approxi-
mate amount to be assessed, and all resolutions and proceed-
ings will be on file and can be seen and examined by any person
interested at the Office of the Director · of Engineering Services
at any time during business hours on or prior to the date of
hearing.

8. A copy of the notice which will be published
shall also be mailed to each property owner to be included
within the district and who will be assessed with the cost of
the improvements.
9. Should any one or more sections or provisions of
this Resolution be judicially determined invalid or unenforce-
able, such determination shall not affect, impair or invalidate
the remaining provisions hereof, the intention being that the
various provisions hereof, the intention being that the various
provisions hereof are severable.
