Since your memo of October 5, 1976, I have discussed with Denver
the pavi ng of 1-lest Evans Avenue. I indicated to them that "'e definitely
want the additional one block i mp rove d so that all of the Englewood side
will be completed, and I a l so discussed the possibility of a five-foot
sidewalk vs. eight-foot, and seven inches of asphalt vs. nine inches.
'!here didn 't seem to be any problem with them putting in a five-foot
sidewalk on our side, and they were going to check on the soils condi-
tion to see how seven inches of paving v;ou ld work. We could tell them
that we definitely want only sev en inches of asphalt .
With Lhe decreases in quantiti es as stated above, we would reduce the
City's share of the paving costs from the $83,000 original figure to
approxi~~tel y $58 ,000. We would, however, need to finance the property
owners' share (approximately $69,000) until the assessments were paid off.

Transmitted herewith is a schedu le for Paving DisLrict No. 24
(N est Evans Avenue from Raritan to Zuni ).
The actua l design for the street will be compl eted by lhe City
and County o f Denver, as wel l as the bidding , construction,
inspection , elc . There will be an agreement submit ed at a
later date to be signed by the City of Englewood relating the
coop era tive efforts of the two cities to accomplish the project.
Once the project is completed , a cos t tabulation will be sub-
mitted to us for calcu l ation of the assessments to the owners
invo lved.

has d e t e r min e d that it is necessa ry to c r ea te a s p e ci al i mp rove-
~e nt ·district within the City , for the purpose of constructing ~nd
in s talling s treet paving, curb a nd gutter and sidewalk improve-
r;.e nts, tog e her with ne cc s s ,ary in c identals , on a po r tion of West
Evans Ave nue, a s s e t f o rth in this re s olution , and to a ssess the
c ost of lhe i mpr o v em ents ag a inst the property s pe c i~lly ben e fited
b y the i mpr ov eme nts and in c luded within the district; and
WHE REAS, pursuant to the Charter of the City and
Ch a pte r 14 of the Mu n i cipal Co de of t he City , the C i ty Council has
determined to c o n s truct and i n s tall s uch ifl'lpro veme nls, provided
h o wever, that the City Co un c il s hall consider all protests
and o~ject ions that may be n ade in c o nnection with the proposed
improve me nts, before ord e r i ng the construction thereof: an d
'r l HEREAS, pur s uant to an order of the City Council,
the Engineer of the City for the proposed specia l improve ment
project has prepar e d and fil e d prelimina ry plans, specifications,
esti mates of cost, maps and s ch e dules for the propo sed i mprove-'
ments ;
BE IT RESOLVED BY THE CITY COUNCIL OF TH E CITY OF
ENGLEHOOD, COLORADO:
1. That the City Council has determined there exists
a nece s sity for the construction and installati o n of lht! street
paving, curb and gutter and sidewalk ir.~provements , together
with ne ce s sar y incidentals, on that portion of West Evans·Avenue,
as more particularly se t forth i n the notice of h earing, and to
create a special i ~provement district !or such purpose.·
2. That 'the Engineer's reports, together with the
preliminary details, spe cif icatio ns, estimates of cost , mapa
and schedules prepa red and filed with the City Clerk be and the
same are hereby approved and adopted by the City Council !or use
in the construction and i n st allat i on of the i mprovements t.o
be made in said improve ~ent district.
3. That r.~aterials to be u s ed in c onstructing and
install i ng the propo~ed i ~prove me nts are stated fn the Notice
hereinafter set forth.

4. That the asses s ments to be l evie d agains t the

me n ts, s hall b e due an d payable within thir t y days fr om and afte r
the f inal publication of the ordinance assessing t he whole actual
cost of sai d improvements against the rea l property in S di d
district, provided, howe ve r, t hat any owner who sha ll p a y the
entire amou nt of the assessment within s aid perjod of time, s hall
be entit led to a n allowance of 5\ of the amou nt of the asse ssn e nt.
In the even t any o ••ne r of real estate sh all fail to pa y the •·h ole
of such assessmen t against his propert y within sai d th!rty da ys ,
then the whole cos t of sai d irnprov eme ns s o assessed against his
property s hall be payable in ten (10) cgu al annua l in s tall r.>cn ts o f
assessme n ts. The interest rate on the unpaid installments
of asses sm~nts will be es tablished by ordinance to be ~dopted by
the City Counc il at a later date. The fir st o f sa id installme nts
of principal and interest shall b~ due and pa y a ble at suc h time as
ma y b~ determined in and by the assessmen t ordinance, an d th~
remainder of the annual installments of princ ip al and in terest
shall be due and payable successivel y on the sam e day in each year
thereafter until all ar~ paid in full.
5. That the property to be a sse ssed Cor sa td improve-
ments sha ll be the property speciall y benefited by said in>pr o ve-
ments an d included within the improvement district, an d more
particu larly descr-ibed in the Notice hereinafter set f orth.
6. That there shall be prepared an ordin anc e creating
within the corpor ate limits of lhe City, a special improveme nt
district to be known a s Paving District No. 2 4, providing for
the constructi on and installation of the improvements, all as
described in this Resolution, and in accordan ce with the pre-
liminary report, plans, maps , s pecifications, detai l s an d es ti-
mates of costs of the Engineer, herein referred to and now on file
in the office of the Director of Public Works. The proposed
ordinance will be considered f or passage on first reading by the
City Council at a regular meeting thereof t o be held on Ma rch 7,
1977.
7. Notice of the public hearing on t he creation of
the di strict sh all be published once a week for three weeks
in the Englewood Herald Sentinel, a newsp~per of g~neral circula-
tion i n the City. In addition, a copy of such notice shall be
mailed, postage prepaid, to each known owner of real property
'within the propos•d distric t.

sta ll e d are as follows:
Nec essa ry grading a nd e xc avatio n, paving with a
5" asphaltic concrete base course, an d a 2" asphalti c
concrete surface; concre te s i dew alk , a nd cu rb and gutter
whe re not alr ead y instal led, together w i th necessar y
appurte nan ces and incidentals, o n the south o ne -half o f
\·i est Evans Avenue, f[om the center 1 i ne o f South Zuni
Str ee t to the c en te r line of South Ra rit a n Stree t.
The North one -ha lf of Wes t Evans Avenue, between
South Zuni Street a nd South Raritan Street, which is
l oca ted within the city l imits of th e City and Count y of
Den ver, will be imp roved by th e City an d County of
De nver at the sair'e ti~e, but the ir.provc:Jent s to the
north half of the street , and the cos t thereof, will not
be included in this District. It is anticipated that
the City of Engl e ~o od and the City and County of Denver
will ente r into .!n Ag re eine nt relating to the ad vertise-
me nt of construction bids, the a ward of the co n str u c tion
contract and cert a in other matters rela ti ng to the
const ruction of the proj ect .
(b) The descc iption of the proposed dis'trict,
and the property t o be assessed with the cost of the imP.rovements
shall be all of the real property fronting or abutting on West
Evans Av enue bet~e en the termini hereinbefore d escribed, includi ng
the real property within one half (1/2) block of such evenue.
Adjustments foe the as s e ssment of costs will be ma de for irr e gular
and odd s haped lots and parcels of property.
(c) The probable total cost of the imp rov eme nts
to be constructed and install ed is $127,000 •
(d) The probable amount of the total cost wh ich
the City shall pay is a p pr o•im ately 5 58 ,000.
(e) T he balance of the total cost which is not
paid by the City of Cngl ewood wIll be assesse d against the pro-
perty special ly benefited by the improvements, and included
within the District. Probable costs per f r ont foot for said

Upon co mpletion of s aid i mprov em ents, or as s oon as
t he total c o st th e r e of is d e fini te ly a scer tained, such c ost shall
be apporti o ne d to the pro perty in the Di s trict. Notice of such
appo rti o nme nt shall be given a nd a He aring will be h el d prior
to the adoption of an ordinan c e as s e s s ing such cost, all as
p r o vid e d by law.
(f) Said a s se ssments will be due and payable
with o ut d e mand within thirty days from an d after the final publi-
c ation of an ordinance a s sessing the whole cost of s aid i rr.p rove-
r.&ents against th e rc:oal property in s aid District; provide d,
however, that any owner who shall pay the full as sessment within
s aid period of thirty days shall be entit l ed to an all o·.-ance of
five per ce nt (5\). In the eve nt that an o wner of r e al pr o perty
s hall fail to p a y the whole of suc h a ssessr.>ent a g ainst the pro-
pert y within said thirty dc!ys, th e n the whole cost of sai d im-
provement s o as s es sed a gainst the property shal l be pay a ble in ten
equal annual in s tall ments of principal. The first of such in-
stallments of p rincipal shall be due and payable at such time as
may be determined in and by the assessing ordinance, and the
r em a indec of s aid install menls shall be payable on the sar.~e dat e

interest to be paid on unpaid and deferred installments will be
e stablished by o rdi n an c e to be ado;>ted by the City Council at a
later date.
(g) 1\ Hearing on t he ccea t ion of the Distc ict
w i ll be held by the Co un cil on Monday, the 28th day of February,
1977, at 7 :30 P.M., at the Mun ici pal Build i ng in Englewood . A
public hearing s h all also be held pr i or to the final passage of
the ordinance , at the regular rne etin9 at 7:30 P.H. on Monday,
March 21, 1977.
(h) Any person desiring to be heard upon the
issue of the c r e ati o n of th~ di5trict oc upon the c o nstruction,
ir:stallation or i rn pro v e r.t ent of the i mprovements involv e d, may
appear at the ti n ~ and place set foe the public hearing thereon
