The City Council of the City of En glewood , Colo rado , received a request
for thirty-day postponement of the public hearing scheduled f or July 11 , 1977 at
7:00 p .m. concerning Hampden Professional Park Subdivisi on final plat . Up on
re ceipt of this request , the City Co un cil was p olled concerning the p ostponement
and setting a tentative date f o r the continuance of the public hearing on
August 22, 1977 at 7 :00 p .m. in the City Council Chambers .
As a result of the poll, this spe cial City Council meeti ng was
postponed; and City Council will take o ffi cial acti o n on the continuation
date for the public hearing at the regular City Council meeting o n July 18 ,
1977.
A c o py of the results of the poll of the City Council Members is
attached t o these minutes as a matter of record .

SU BJEC T : POSTPONEMENT OF PUBLIC HEARING
On July 11, 1977, the City Council was polled c oncerning the postpone ment
of the Public Hearing scheduled for July 11, 1977, conce rning the Hampden
Hills Professional Park Subdivision final plat. 'This action was taken in
light of the info rmation received from the at t orne ys for both parties
stating th e ir intention to request an additional thirty day postponement
from Council. While polling Council as to po s tponement, a t e ntative date
for the co ntinuat i on of the public hearing was also set for August 22, 1977,
at 7:00 p .m. in Council Chambers.
Followi ng are the r es ults of the poll:
Ma yor Ta ylor -out o f the City; h a d already stated he would not be in
attendance.
Mayor Pro Tem Clayton -postponement okay; August 2 2nd date okay.
Howard Brown, Councilman -unable to contact direct; left me ssage with
Mrs. Brown.

Re: Regan Subdivision
Dear Bill:
With respect to the above matter, this letter will serve to
confirm the recent series of telephone conferenceswhich we have
had.
As you know, when the representatives from Larwin came from
California to meet with you, Mr. Regan, my clients and I, we were
successful in reaching an agreement whereby, in return for Larwin's
and Regan's agreement to place restrictive covenants upon all of
the remaining undeveloped portions of the Larwin site, my clients
agreed not to continue to object to the City's approval of the
presently pending subdivision plat.
Shortly thereafter, however, you and your client began dis-
cussions with representatives of neighboring Cherry Hills Village
residents and you last informed me that those discussions were
still continuing, although you were encouraged that an agreement
would be reached with them. I attempted to reach you today in
order to obtain a further status report from you with respect to
these negotiations, but were informed that you were out of the
office.
In any event, in our previous discussions, you and I both
agreed that, because of the substantial amount of technical data
which will have to be assimilated, and the considerable amount of
time that may be involved in drafting the terms of the agreement

between Larwin, your client and the Kent Village residents, it
would serve no worthwhile purpose to conunence this assimilation
and drafting until we know the terms of any possible agreement
reached by you with the Cherry Hills people. In addition, I re-
ceived, just today, certain technical data needed to prepare that
agreement from the City and I will, of course, need some further
technical data, in the form of title commitments, etc., which you
informed me you had.
Because of these various factors, both you and I agreed that
we should request from Council an additional thirty day postpone-
ment in the scheduled hearing on your client's subdivision plat,
with the understanding that, by mid-August, we should be in a
position to have our agreement in final form and have it signed
by the various parties who signatures will be requried. I indi-
cated to you that I will be out of the State on Monday, July 11,
and, for that matter, the remainder of that week, but that, if
necessary, I could have an attorney present for the Council hear-
ing. In speaking informally with Rich Wanush, it was his informal
opinion (although we both recognized he could not, in any manner,
make any commitments for Council), that, so long as you were pre-
sent, it would be unnecessary for us to be present.
Therefore, I do not plan on having anyone from my office
present at that Council meeting. However, if, after reviewing
the contents of this letter, it is your view that someone from
this office should be there, I would appreciate your contacting
Gary Patterson of this office sometime on Monday, who will make
arrangements for the Kent Village residents to be represented be-
fore the City Council meeting Monday evening.
