SPECIAL MEETING:
The City Council of the City of Englewood, Arapahoe County , Colorado
met in special session on September 12, 1977 at 7:00 P,M,
Mayor Taylor, presiding, called the meeting to order ,
The invocation was given by Councilman Howa r d Brown , The Pledge
of Allegiance was led by Mayor Taylor ,
Mayor Taylor asked for roll call, Upon the call of the roll, the
following were present:
Council Members Williams, Sovern, Smith, Br own, Mann, Clayton, Taylor,
Absent: None
The Mayor declared a quorum present,
Also present were: City Manager McCown

COUNCILMAN SMITH MOVED TO OPEN THE PUBLIC HEARING TO CONSIDER AN
ORDINANCE REQUIRING THE CONVERSION TO METERS AT THE TIME OF TRANSFER OF
OWNERSHIP OF PROPERTY. Councilman Mann , seconded the motion . Upon a call
o f the roll, the vote resulted as follows:
Ayes: Counc il Members Mann, Brown, Clayton, Williams, Sovern,
Smith, Taylor

Mayo r Tayl o r began the public hearing by addr es sing t he pub l ic
in attendance and stating the ground r ules for this me eting 's he aring ,
Mayor Taylor stated that the ordinance pass ed on the fi rst reading an d
vi ll come up for final reading September 1 9, 1977 , Howev er , the City
Co uncil ruled that a public hearing should be set on this ordinan ce
to receive input from the public prior to consi de rati on f or final passage
on September 19, 1977, Mayor Taylor stated that c l arification o f the
meaning of the ordi nance is in order , May or Taylor explained that people
living in their homes nov vould not be required t o go on meters until they
sold their house o r sold their property and at that time the nev owner v ould
be required to instal l a meter in the house . The purpose of the o r dinance vas
t o phase out the flat rates over a long period of time but if peopl e vho
vere nov living in their homes wanted a meter, they coul d request the Water
Department t o install the meters in their homes.
May or Taylor asked if there vas a nyone i n t he a ud i ence v ho
wished to speak in f avor o f th e ordinance.
Emily Bocko; 7181 S . Harris on Way, Littleton, President of the
League o f Women Voters appeared before the Council and stated that the League
has studi e d the prob lem of vater shortage fo r numerous years. Ms . Boeke stated
that the League supported the ordinance s o people vould s tart c onserving vate r
nov instead of vhen vater shortage becomes a real crisis ,
Mayor Taylor asked if there vas anyone in t he audien ce v ho v ished
t o speak against the ordinance,
Maurice Jones, 5020 S. Washington, appe ared before the Co un cil and
stated that he vas neither f or or against the ordinance , Mr, Jones stated that
meters vould definitely lover consumption of vater, but s omething must be
done to improve the filtration an d purification o f vater, He also stated
that if the consumption vas l evered the revenue vould also be reduced.
Eva Eisenburg, 4955 s. Galapago, appeared before the Council and
stated that the vater pressure needs to be improved and even though she is
against the vater meters, she vas under the impression that the vater p re ssure
v ou l d be imp rove d regardless of whether meters vere installed o r not .
Ms . Eisenburg stat ed that she hoped improved vater pressure di d not hinge o n
whether people used vater meters or not.
Jack Martin , 3153 S , Gay lord, appeared before the Counci l and state d
that he vas against vater meteri ng and vou ld like t o see the City encourage
a voluntary vater conservation program first.
Melvin Minni ck, 4564 S , Pearl , appeared before t he Co uncil and
stated that he vas aginst vater metering and that the distribution o f vater
needs to be improved before any consideration should be given to installing
vat er meters ,

Cl a r enc e Arnett , 4242 S , Log an, appe ared before t he Co unci l and
stated that he was agains t water meters . Mr , Arnett stated t hat t he cost
of installing a meter would be added to the price of a home when the house
was s old thus raising real e s tate prices . Mr . Arnett s tated that meters
offered no s olution t o improving the distribution of wa t er .
Wayne Hardesty, 3841 S . Cherokee, appeare d b efore the Coun cil a nd
stated that he was against water meters because o f the extra money that would
be spent installing the meters an d paying peopl e t o read them . Mr , Hardesty
stated that the money should be spent for operating a treatment plant properly,
Richard Edisel , 329 5 s . Franklin , appea red b e f ore the Co uncil and
stated that he was a gainst water meters , Mr. Edisel stated that he felt n o
one would object to paying f o r improvements in water distribution through
increased water rates, but he wondered why the people should be forced to
pay for unnecessary e xpen ditures like water meters when there are other
alternatives for bringing in revenues .
John Fawn, 4355 S . Clarks on, appeared b e fore the Co uncil and stated
that he was against water meters because of th e initial expense in insta llation.
Mr , Fawn stated that water meters would not deter people from wasting water
because people will simply pay f or what water they use or waste. Mr. Fawn
stated that improvements in water treatment are needed instead. Mr. Fawn further
stated that people should be educated in water conservation first before
restrictions are placed on them .
Jeffrey Ge orge , 1311 E. Bates , appeared before the Council and stated
that he was against water meters . Mr . George stated t hat the cost of installation
would promote escalation in the real estate market because sellers would be
f orced t o a dd the ins tall ati on c o st t o their selling price . Thie escalation
in real estate prices might prohibit young people from buying homes thus c ausing
seve r repercussions to the whole economy . Mr . George stated that the rates
should be increa sed instead .
Norma Wi er, 487 0 S . Cherokee, appeared before the Council and
stated that she was agai nst water meters because of the burden it would
p l a c e on people wh o are l ivi ng o n f ixed incomes.
Werner Schnackenberg , 4601 S . Bannock, appeared before the Council
a nd stat e d that h e wa s i n favor o f water meters, Mr. Schnackenberg stated
that water me t ers p l a ces an i n centive on the people to c onserve water and
prov ides fo r a f air way t o pay for the water they use. Mr . Schnackenberg
s t a ted that seni or citizens are g enerally frugal people and paying f o r
water u seage throug h the meter method could prove advantageous f or them .
Bi ll Clayton , Jr,, 958 E. Co rnell, appeared before the Council and
s t ated that he wa s a gainst water meters, Mr. Clayton stat ed that the Council
should calculate that if the people install meters -will that much water be

saved and will just as much revenue be taken in. Mr . Cl ayton s tated that if
people cut back and les s revenue is br ought in -wi ll the Council choose to
raise the rates. The final result being not o nl y wi ll meters be in the homes ,
but also increased water rates . Mr . Clayton s ugg ested that people must be
educated first in wat er conservation . Mr. Clayton also s ugg e sted that people
wh o waste water be penalized .
Be a Lane, 4397 s . Huron , appeared before the Counci l and stated that
s he was a g ainst water meters because of the expense to pay people to read
and maintain the meters.
Eleanor Smith, 4100 S. Galapago, appeared before the Council and
stated that she wa s surprised the City Co uncil was considering install ing
water meters. Mr . Smith stated that when the City of Englewood t oo k ov er the
water provision from Denver the City promised its citizens that they would not have to be metered,
Mrs. Co ffin, 3057 S , Galapago , appeare d before t he Co unci l and
reca lled the f act that during Mayor Allen's t erm of o ffice, the Mayor promised
the citizens that no meters would be installed and that the citizens e v en
petitioned against t he meters.
Clayton Smith , 4100 S. Galapago, appeared before the Council
and stated that he still had the meter that was disconnected when Denver
discontinued providing water and turned the provision over t o Englewood .
Mr, Smith stated that the meter was probably outmoded and he did not want
to have to go to the expense of buying a new meter,
Stanley Rowdu ss, 2323 W. Harvard , appeared before the Council
and suggested that if the meters were installed the cost should be borne by
the City of Englewood from the profits they receive from the sell of water to Thornton.
Eva Eisenberg, 4595 s . Galapago , appeared again before the Council
and inquired about the next step that the City Council would take in this issue.
Mayor Taylor stated that the City Council would conduct a study
ses sion to review and consider the input that was received at this meeting
The City Council would comp ile answers to the ques tions brought forth and
hold another session with the public to explain and discuss the answers .
Mayor Taylor assured Ms , Eisenburg that the Ci ty Council would not pass
the ordinanc e until the public wa nted it ,
Harlas Glasco , 5040 S , Galapago , appeared before the Council and stated that h e was a gainst meters ,
William Clayton , 3201 S . Franklin , appeared before the Council and
stated that he was against meters for the same reas ons stated by other opp osers.
John Cryling, 3131 S, High, appeared before t he Counc il and suggested
that t h e City of Englewood contact other cities that have installed water meters
to ob tai n statistics and pertinent information to help evaluate the necessity
of metering. Mr . Cryli ng stated that he wa s for water meters.

J, Peters, 3100 S . Pearl , appeared before the Counc il and stated
that he was against water meters because people would probably call a plumber
to install the mete rs rather than install the meters themselves and the expense
would be enormous , Mr. Peters stated that he would rather pay higher water rates than be metered,
Clayton Smith, 4100 S, Galapago, appeared again before the Council
and stated that gathering statistics and information from other cities would
not be oeneficial, Mr. Smith stated that the City of Englewood should examine
the Denver decision in rejecting the water meter system if the City wanted t o evaluate such a project,
Bill Cox , 4433 S, Acoma, appeared before the Counc il and state d that
he was against water meters. Mr, Cox stated that the citizens of Englewood
could manage to conserve the water if they needed to do so ; and he thanked
the Cou ncil for conducting this open hearing ,
Paul Stinsky , 4260 S, Elati , appeared before the Council and stated
that he was against water meters, Mr, Stinsky suggested that the Council
support a public effort to conserve water on a voluntary basis and penalize
those people who waste the water ,
Katherine Fishb ack, 4425 s. Acoma appeared before the Council and
st ated that she was against water meters. Ms, Fishback stated that she would
rather pay higher rates .
Lynette Warren , 3820 S , Galapago , appeared before the Council and
stated that she was against water mete rs, Ms. Warren suggested that the people
who are wasteing the water be penalized ,
Mike Kuh n, 2 724 s. Che r okee , appeared before the Council and stated
that he was a gainst water meters, Mr. Kuhn stated that he objected to the
initial expense of installing the meter and suggested that support be placed
behind voluntarily conserving water,
Herman Fl ager, 4610 S , Ch erokee, appeared before the Coun cil and
stated that he was for water metering , Mr. Flager stated that if people were
placed on a metering sy stem they will be more careful ab out using water and
they would be willing t o pay for the any extra amount of water they use,
Larry Bochelle , 1430 E, Co rnell, appeared before the Council and
stated that he was against water meters because the cost of installing a
meter wil l be added to the selling price of the house thus increasing real estate costs.

Wayne Burget , 4108 S, Inca, appea red before th e Council an d stated
that he was against water meters, Mr , Burget stated that if th e populat i on
o f Englewood expands as predicted then mo re water service wo uld have to
b e generated. Co nsequently, a larger plant would have t o be c onstructed
anyway in o rder to adequately supply the water. Mr. Burget asked the Counci l to
consider means of supplying more water instead o f installi ng water meters.
Roy Smith , 4490 s. Hu r on , appeared befor e the Co uncil an d stated
that he was against water meters of the expense of installing a meter and
the necessity of adding the instal l ati on cost on to the selling price of a home.
Mr. Smith stated that he wa s o f the opinion that the Ci ty wou ld receive
less revenue as a result, Mr, Smith stated t hat he would prefer to pay
higher rat e s.
Werner Schnackenberg, 4601 S . Bann o ck, appeared again befo re th e Council
and stated that the City is trying to save $3.2 million by not building the
larger plant to guarantee enough treated water f or the flat rate users, If
the citizens want t o continue the flat rate then they will have to pay for
the larger plant. Mr. Schnackenberg stated that if the City passed the ordinan ce
on water meters then a possible solution for lowering the base rate for senior
citizens could be worked out.
Bill Clayton, Jr., 958 E. Cornell , appeared again before the Council
and requested that the figure of $3,2 million be examined to determine whether
the cost of the meters was c onsidered .
Clayton Smith , 4100 S , Galapago , appeared again before t he Counc il
and stated that h e would probably live in his house as a senior c i tizen and
preferred to save the money required to install a me ter t o use as income
when he gets older than pay out any mo ney at all .
Mayor Taylor entere d into the record two letters ob j ecting to water
meters one from Mr. Arthur Rose and Mrs . Rita Rose and the second from
Mr •. J ames Miller .

and asked if the mon ey needed to build a lar ger plant could com e from the
sale of water to other areas.

Wayne Burgot, 34 01 s. Inca, appeared again before the Council and
and stated that if the City built a plant to make a savings of $3.2 million
would the plant still be inadequate in supplying enough treated water in the
future and would the City be forced to construct ano ther plant in order to
supply enough treated water. Mr. Burgot stated that he thought a larger
plant should be built.
Mayor Taylor a s ked if there was any one else wishing to address
the Council on this ordinance. No one replied. Mayor Taylor thanked every-
one for attending and expressing their opinions. Mayor Taylor reiterated
that the Council would consider the suggestions brought forth during their
study session and return with answers in the near future.

Sovern seconded the motion. Upon a call of the roll, the vote resulte'd· as

Public Works Director Kells Waggoner has
estimated the plan will save the city $3 .2
million in water treatment and storage
facility improvements.
The poli cy now in effect , which requires
meters on new homes , has put 660 families
on the metered system , with 8400 being
charged a flat rate. City Manager Andy Mc-
Co wn has estimated the new ordinance
would put another 450 homes each year on
meters. In 10-20 years, the entire city would
be metered.
Waggoner said metered customers Ufe less
water than unmetered customers. A !~year
Boulder study , he said, showed a 36 pct. drop
in water use after meters were installed.
City planners think F.nglewood will have a
population of 49,500 by the year 2000. Needed
storage and treatment facility Improve-
ments to serve them would cost E~glewood
more than $11 .7 mill ion if mos t of the city re-
m ains on the flat rate, Waggoner said. If the
propos ed meter ordinance is adopted , the
city would have to pay $8 .5 million fo r the
nec e ssa ry improvements.
Ci tizens would have to approve a bond is-
s ue before the improvements can be under-
taken .
Former Director of Utilities Charles B.
Carroll Jr. has estimalal that the average
metered family has a water bill of $137
nually : the average flat rate c ustimer, 106 .
He said the average metered customer 1s
presently paying 41 pct. more for the same
amount of water than the average flat rate
customer.

Waggoner said the rate structure is und er
review , but isn 't far enough along that he
could verify Carroll 's figures . He confi r med
that the city currently charges less per $1000
gallons to those who use more water.
Many cities, he said , have gone to a
"conservation rate ," wh ich encourages
water savings by charging higher rates to
those who use more water. Others have
pointed out that such a chage would be dif·
ficult for some F.nglewood industries which
use a lot of water in their process ing .

On Sept. 12 , the Englewood City Council IJ boldlng a
public hearing in regard to the ordinance to require the in-
stallation of water meters whenever a house is sold in
Englewood .
I suspect that few will attend , because the Council has
cleverly worded the ordinance to deceive the citizens of
Englewood into believing that It only affects "the other
guy," and that homeowners who don 't Intend to move won't
be affected , and won 't have to install a meter. Actually ,
this is the Council's first step toward meters for everyone.
I am sure that everyone agrees that conserving our
resources is not only a good idea , but is essential to our
lives in the years ahead , and some members of the Council
are convinced that water meters are the only way to save
water. But I feel that a closer examination of the facts will
show the costs to exceed the benefits.
The biggest fallacy of water meters Is the misconception
by consumers that they can reduce their water bill by
reducing their usage : This is true for gas and electricity but
the cost of a water system is NOT THE WATER , it is the
equipment and manpower to process and deliver the water .
These costs do not va ry much with volume , thus using less
will RAISE the price per gallon , as demonstrated all
a round the country this summer -Marin County. Calif .,
being the best example ; with water usage off 40 pct., rates
had to be continually increased to insure operating
revenue .
Of course, here in Englewood we have no forseeable
water shortage . We do have an old treatment plant that
must be replaced one of these days . But with more than
e nough water for now and the future . why are we being
asked to install water meters that will surely result in
highe r rates .
Let's look at so me more facts :
1 l Co unci lman Sovern was quoted in the Sentinel as say -
ing meters would cost SSOO-S1000 per home . That's $4-8
mill ion total.

mo re al a cost of 530 ,000 a year , paid for through higher
rates
31 Fla t rate billing s are in advance , providing interest-
fre e operat ing fund s in advance of use . Metered bilings are

th rough high er ra tes .
4) F lat rite billings a r e the same year round , while
metered billi ng s would flu ctua te , high in ummer , low In
winter . Hard fo r the homeo wner to budget

consumption , but what about the poor guy who is saving all
he can? He will be living in a city with plenty of water
watching his bill go up for no reason .
6) Englewood 's current rate schedule is arbitrary , unfair
and encourages waste by giving lower prices to big water
users.
With these facts in mind, I feel that the pro-water meter
Councilmen James Taylor, Doug Sovern , Vern Mann and
Dave Williams should be asked these questions :
1) During 1977 , the Denver metro area achieved an im-
pressive water conservation score. Without meters (or any
urging from our concerned Council ), Englewood 's use was
down 2S pct . Why then do we need to waste '4-8 million to
buy meters to do what we can do for free, or at low cost
through educating our citizens about water conservation?
2) Why hasn 't Council revised Englewood 's water rates
to be fair , reasonable and encourage conservation?
3) The cost of a meter is four to eight times my annual
water bill . How can Council consider a cost that is so far
out of proportion to the benefit good for the citizens of
Englewood •
4 ) How many of the pro-meter Councilmen have install'!d
meters , or is this idea of conservation only good for
''somebody else.''
5) How much will the rates increase to pay :
a ) the meter readers
b ) the increased billing costs
c) interest expense on operating funds not now required
d ) decreased volume
6) Wi t h meters , will a consumer be billed for actual
usage , or will he pay a high base rate and be billed for
usage over that rate? A high base rate is no more than a
flat rate with an expensive meter attached , and this is
Englewooo ·s cu rrent metered rate system .
7) How much will the flat rate increase along with the
metered rate? Some people think meters won 't have any
effect on their flat rate .
8 ) Why hasn 't the city tried other ways to reduce usage ,
such as selli ng water-saving shower restrictors , toilet
devices . water timers etc ., through the water department.
These certainly cost less than $50()-$1000 per home .
9) Lastly , how is it going to affect the quality of life in
Englewood to go from a sound , well financed water
system . operated at low cost to the users , to a metered
system which provides : less water at higher cost with
more city employes and more revenue collection problems
-when there is no water shortage in Englewood ?

AN ORDINANCE AMENDING SUBSECTION (a) OF SECTION 16 , CHAPTER
3, TITLE XV OF THE 1969 ENGLEWOOD MUNICIPAL CODE, BY REQUIR-
ING THE OWNERS OF ALL PROPERTY HAVING CONNECTION TO THE CITY
WATER SUPPLY TO INSTALL APPROVED WATER METERS UPON THE SALE,
T RANSFER, OR CHANGE FROM RESIDENTIAL TO COMMERCIAL OR INDUS -TRIAL USE .
WHEREAS, the Englewood Water Board meeting in Special
Sess i on of March 29, 1977, recommended to the City Council
a method whe r e b y gradua l mete ring would take place over a
per i od of time upon the sa le or transfer of all existing
unmetered accounts; and
WHEREAS, the City Council, having considered
vari ous proposals for c ap ital improvement s and the cost thereof
to provi de addit ional water treatment , f i nds that a gradua l
chan ge over to metered service of al l unmetered accounts
would b e in the best interest of the res i dents and c iti zens
of the City of Englewood, Colorado .
NOW , THEREF ORE, BE IT ORDAIN ED BY THE CITY COUNCIL
OF THE CITY OF ENGLE WOOD, CO LORADO, AS FOLLOWS:
Section l.
That Subsection (a), Section 16, Chapter 3, Title
XV of the 1969 Engl e wood Mun ici pal Code is hereby amended to
read as follows:
15-3-16: METER REQUIREMENTS:
(a) ALL OWNERS OF PROPERTY HAVING UN-
METE RED WATER SERVICE SHALL BE REQUIRED
TO I NSTALL APPROVED WAT ER METERS WITHIN
THIRTY (30) DAYS AFTER THE SALE , TRANSFER,
OR CH ANGE FROM RESIDENTIAL TO COMMERCIAL
OR INDUSTRIAL USE S OF SAID PROPERTY RE-
CEIVING WATER SERVICE THROUGH CO NNECTION
TO THE CITY WA TER SUPPLY. WHENEVER A METER
IS TO BE INSTA LLED, IT SHALL BE SUPPLI ED
BY THE WATER DIV ISION AT THE OWNER'S
COST. The rates for metered serv ice ·shall
be fi x ed by Res ol ution o f the City Council1

ORDINANCE NO. 21, SERIES OF 1977
AN ORDINANCE AMENDING SUBSECTION (a) OF SECTION 16, CHAPTER
3, TITLE XV OF THE 1969 ENGLEWOOD MUNICIPAL CODE, BY REQUIR-
ING THE OWNERS OF ALL PROPERTY HAVING CONNECTION TO THE CITY
WATER SUPPLY TO INSTALL APPROVED WATER METERS UPON THE SALE,
TRANSFER, OR CHANGE FROM RESIDENTIAL TO COMMERCIAL OR INDUS-
TRIAL USE.
WHEREAS, the Englewood Water Board meeting in Special
Session of March 29, 1977, recommended to the City Council
a method whereby gradual metering would take place over a
period of time upon the sale or transfer of all existing
unmetered accounts ; and
WHEREAS, the City Council, having considered
various proposals for cap ital improvements and the cost thereof
to provide additional water treatment, finds that a gradual
change over to metered servi c e of all unmetered accounts
would be i n the best intere st o f the res i dents and citizens
of the City of Englewood, Colorado.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ENGLEWOOD, COLORADO , AS FOLLOWS:
Section 1 .
That Subsection (a), Section 16, Chapter 3, Title
XV of the 1969 Englewood Municipal Code is hereby amended to
read as follows:
15-3-16: METER REQUIREMENTS:
(a) ALL OWNERS OF PROPERTY HAVIN G UN-
METE RED WATER SERVICE SHALL BE REQUIRED
TO INSTALL APPROVED WATER METERS WITHIN
THIRTY (30) DAYS AFTER THE SALE, TRANSFER,
OR CHANGE FROM RESIDENTIAL TO COMMERCIAL
OR INDUSTRIAL USE S OF SAID PROPERTY RE-
CEI VING WATER SERVICE THROUGH CONNECTION
TO TH E CITY WA TE R SUPPLY, WHENEVER A METER
IS TO BE INSTALLED, IT SHALL BE SUPPLIED
BY THE WATER DIVI SION AT THE OWNER'S
COST. The rates for metered serv i ce ·shall
be fi x ed by Resolution of the City Council;
provided, however, that one bill for all
water used, consi sting of the sum of
minimum cha rges for each meter used and a
single quantitative charge for all water

ING THE OWNERS OF'ALL PROPERT Y HAVING CONNECTION TO THE CITY
WATER SUPPLY TO INSTALL APPROVED WATER METERS UPON THE SALE
OR TRANSFER OF SAID PROPERT Y.
WHEREAS, the Engl e wood Wate r Board meeting in Special
S es sion of March 29, 1977, recommended to the City Council
a method whereby gradual metering would take place over a
period of time upon the sale or transfer of .all existing
unmetered accounts; and
WHEREAS, the City Council, having considered various
proposals for capital improvements and the cost thereof to
provide additional water treatment, finds that a gradual
change over to metered service of all unmetered accounts
would be in the best interest of the residents and citizens of
the City of Englewood, Colorado.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
TH E CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS:
S ection 1.
That Subsection (a), Section 16, Chapter 3, Title XV
of the 1969 Englewood Municipal Code is hereby amended to
read as follows:
15 -3-16: METER REQUIREMENTS:
(a) ALL OWNERS OF PROPERTY HAVING UN-

AT THE OWNER'S COST. The rates for
metered service s hall be fixed by Reso-
lution of the City Council; provided,
however, that one b ill for all water
used, consisting of t h e sum of minimum
charges for eac h meter used and a single
quantitative char ge fo r all water used,
may be issued in the following cases:

(1) Where water service is taken through
a combination of me ters, or through on
two (2) or more service pipes, if water
s e rviced through each of such meters and
s e rvice pipes shall be delivered and used
on the same property holding in the pro-
s e cution of one (1) general purpose, or a
single enterprise on an integrated hold-
ing of land, undivided by public streets,
roads or alleys.
(2) For all public schools, even though
the meters may be situated in separate
properties.
