RESOLUTION NO. ~. SERIES OF 1970
A RESOLUTION AMENDING THE 1971 BUDGET
WHEREAS, the City Manager in accordance with the provisions of the
City Charter submitted a 1971 Budget to the City Council on September
14, 1970; and,
WHEREAS, the City Council of the City of Englewood has conducted a
public hearing on said Budget on October 5, 1970, and has given con-
siderable study to the aforementioned Budget on numerous occasions;
and,
WHEREAS, it is the intent of the City Council to amend the 1971 Budget
as submitted;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Englewood, Colorado, as follows:
Section 1. The following changes are to be made In the General Fund

be amended to reflect that which is set forth below:

county, State of Colorado, met in special session Monday,
November 30, 1970 at 8:00 P. M.

Mayor Schwab, presiding, called the meeting to order

THAT THE MINUTES OF THE REGULAR MEETING OF NOVEMBER 16, 1970
BE APPROVED AS READ. Upon the call of the roll, the vote
resulted as follows:
Ayes: councilmen Brown, Dhority, Kreiling, Lay,
Senti, Schwab.
Abstaining: Lone
Nays: None
Absent: None
The Mayor declared the motion carried.

A memorandum from Mr. wm. A. Hamilton, Fire Chief,
recommending that we equip two pumpers with 5" hose was
received for the record.
Fire Chief Hamilton appeared before the City council.
Mr. Hamilton stated that he was converting to a 5" hose for the
Fire Department to better utilize the pumping capacity; to
achieve a better flow in large fires; and for usage of the
same adaptors as the Littleton Fire Department under the Mutual
Aid Agreement.
City Manag e r Dial stated that in the 1971 Budget
the replacement of the hose would not take place, and instead
the City would buy 5" hose.

Fire Chief Hamilton reappeared before City Council
and discussed the specifications.
Mr. Dial stated that it was hoped that bids would
be received in the latter part of December and reviewed by
City Council in the first part of January, 1971.
Fire Chief Hamilton stated that the anticipated
cost of the pump er was $45,000.

The minutes of the Board of Adjustment and Appeals
meeting of October 14, 1970 were received for the record.

The minutes of the Water and Sewer Board meeting of
November 17, 1970 were received for the record with three
recommendations attached.
City council discussed the recommendation for the
inclusion of additional land in the South Arapahoe Sanitation
District.
Assistant City Manager McDivitt appeared before
City Council and stated that the recommended supplement would
include approximately eighty acres to be served by the Englewood
Sewage Treatment Plant and would be bounded generally on the
east by South Holly and on the south by Dry creek Road.
COUNCILMAN LAY MOVED, COUNCILMAN LONE SECONDED,
THAT SUPPLEMENT NO. 20 TO THE SOUTH ARAPAHOE SANITATION DISTRICT
AGREEMENT BE APPROVED AND THAT THE MAYOR AND CITY CLERK BE
AUTHORIZED TO EXECUTE THE CONTRACT DOCUMENTS . Upon the call
of the roll, the vote resulted as follows:
Ayes: councilmen Brown, Dhority, Kreiling, Lay,
Lone, Senti, Schwab.
Nays: None

The city Council discussed the recommendation of
the Water and Sewer Board that additional land be included in
the Southga ~e Sanitation District.
Assistant City Manager McDivitt appeared before
city council and stated that approximately 160 acres would be
included within the district and that the area to be served
would be bounded generally on the south by Arapahoe Road and on
the east by Quebec. Mr. McDivitt stated that on May 4, 1970
the City had executed a letter to Celebrity Holmes, Inc.
stating that it would consider the inclusion of the 160 acres
into the Southgate Sanitation District.

THAT SUPPLEMENT NO . 27 TO THE SOUTHGATE SANITATION DISTRICT BE
APPROVED AND THE MAYOR AND CITY CLERK BE AUTHORIZED TO EXECUTE

city council discussed the streets to be included in
Paving District No. 20. At the conclusion of the discussion it
was the consensus of the council that the streets to be included
in Paving District No. 20 will be finalized at an informal
meeting on December 14, 1970.

city Manager Dial discussed a letter received from
District Attorney Gallagher in regard to the proposed purchase
of video tape equipment for the Police Department.
Mr. Dial stated that an order to obtain LEAA matching
funds, $3,200, should be appropriated at the December 21 meeting.

Mayor Schwab and City Manager Dial discussed the
planting of a Christmas tree at the South Broadway, u. s. 285
interchange.
Mayor Schwab stated that the merchants had donated
$1,200 for the tree, and that the City would have to expend more
than $500 to put lights on the tree.
City Manager Dial discussed an agreement with the
State Highway Department concerning liability for the tree.

THAT CITY MANAGER DIAL BE AUTHORIZED TO EXECUTE A LETTER TO THE
STATE HIGHWAY DEPARTMENT ACCEPTING FULL RESPONSIBILITY FOR
THE CHRISTMAS TREE: THAT THE TREE WOULD BE PLANTED AT THE SOUTH
BROADWAY, U. S. 285 INTERCHANGE: THAT THE CITY BE AUTHORIZED
TO DECORATE THE TREE. Upon the call of the roll, the vote

Mr . Supin g er displayed a map o f the City of Englewood on which were
de p icted the 100-year f lood plain areas for the South Platte River,

wa s prepared by the City Engineering Department from information
obt a i ned f rom the Corps of Engineers. Copies of a proposed resolution,
the appr oval of which is necessary to qualify the City for eligibility
o f f lood insurance, had previously been delivered to Commission members
f or their consideration. Mr. Supinger stated that the adoption o f the
resolution, c opies of the map, and formal presentation to the Depart-
ment of HUD with a letter of request asking for inclusion in the
emergency flood insurance program are needed to secure the eligibility
o f the City. Once these steps have been accomplished, the City must
take act i on to insure the flood plain will not be encroached upon.
It is anticipated that flood plain regulations will be established in
the revised zoning ordinance, the adoption of which must be completed
by December 31, 1971,

Englewood followed,

The City Coun cil, at it s meeting October 19, 1970, referred to the
Planning Commi sion for con ideration a drnft resolution which would
partially qualify the Ci ty for participation in the National Flood
Insurance Program. 1~is progra m was established in 1968 to make flood
insurance, which was previously unavnilnblc, available to property
owners by means of a Federal subsidy .

In order to qualify the City for Emergency Flood insurance, the following
three actions must be tnkc n:
l. Adoption of a Flood Plain Resolution (sec draft copy attached).
2. Submit two copies of a map of the city identifying the flood plain
areas s ubject to specific flood hazards (100 yenr flood).
3. Presentntion of above two item to II D with an offi c ial letter
requesting inclusion in the Emergen y Flood In uJ·nnce P1·o g rnm.
After qualification, and as set forth in the t•esolution, the City is
committed to "positive ncUon" hy December 31, 1971. By ''positive acti•J n"
is meant adoption of zoning measures, s uch as Flood Plain Districts, which
would prevent future encroachment upon the flood plains .

QUESTIONS AND ANSWERS
1. Q. What is the National Flood Insurance Program and what is
it designed to do?
A. The program was established under the Housing and Urban
Development Act of 1968 to make I lmited amounts of flood
insurance, which was previously unavailable from private
insurers, available to property owners by means of a
Federal subsidy. In return for this subsidy, the Act
requires that State and local governments adopt and enforce
land use and control measures that will guide future devel-
opment of land in flood-prone areas in order to avoid or
reduce future flood damage. A 1969 Amendment to the Act
expand~ the definition of flood to include muds! ides.
2. Q. Who is responsible for the operation of the program?
A. The Federal Insurance Administrator in the u. S. Department
of Housing and Urban Development (451 -7th Street, s. w.,
Washington, D. c. 20410) has been delegated this authority
by the Secretary ~f HUO. An advisory Committee composed of
representatives ot the insurance Industry, State and local
governments, tending Institutions, the home building Industry,
and the general pub I ic assists the Administrator in carrying
out the program.
3. Q. How does a community become et iglble for flood insurance?
A. A community may qualify for eliglbll tty by submitting to the
Administrator a complete appi !cation which meets all of the
requirements of the regulation s (24 C.F.R. 1910) governing the
flood insurance program.

directly from the Federal Insurance Administration. In
addition, the Governor s of most States have appointed a State
coordinating agency to assi st their communities in qual lfying
for this coverage and In the development of acceptable land
use and control measure s .
7. Q. How will It be knOloti\When a community becomes eligible?
A. Notice Is publIshed in the Federal Register when a community
becomes el lgible, and official s of the community are advised
of the date when Insurance wil I be made available. Press
releases are also made available to the local papers and

B. Q. How does a property owner obtain a flood insurance pol icy?
A. After a community is declared eligible and flood insurance
is made available, flood insurance policies may be purchased
from any local property and casualty insurance agent or broker
licensed to do business within the State.
9. Q. What types of properties are eligible for flood insurance
coverage?
A. One-to four-family dwellings, properties principally occupied
by small business concerns, and the contents of these types
of properties, are thus far the only types of-properties for
which flood insurance is avai I able.
10. Q. What is a small business concern?,
A. For flood insurance purposes, a small business concern is
defined as one which, together with its affiliates~ does
not have assets in excess of $5 million, does not have
a net worth in excess of $2 ~ million, and does not have
an average net income per year after Federal income taxes
for the preceding 2 fiscal years in excess of $250,000
(average net income to be computed without benefit of any
carryover . I oss).
11. Q. How are claims handled under this program?
A. Flood loss claims are processed in the same way as loss
claims for other types of property insurance. A claim is
filed with the local insurance agent or broker who sold the
policy or with the local insurance company which serviced
the pol icy.
12. Q. What losses are covered by flood insurance?
A. The pol icy covers losses resulting from the inundation of
normally dry land areas from (1) the overflow of inland or
tidal water, (2) the unusual and rapid accumulation or runoff of
surface waters from any source, and (3) mudslides which are
caused by accumulations of water on or under the ground. It
does not, however, cover water damage which results
principally from causes on ~he insured's property or within
his control, or from a condition that does not cause general
flooding in the area.

13. Q. What are the premium rates for flood insurance?
A. Insurance at subsidized premium rates may be purchased for
existing properties anywhere In the community and for new .
construction outside the areas of special flood hazards. ·
Construction which was begun after the date of identification
of the areas having special flood hazards cannot be covered
until a detailed rate study for the community can be ·
completed. Actuarial premium rates will then apply to such
coverage. The following is a table of the subsidized premium

A. After a rate study has been completed and actuarial premium
rates have been established for the area, an additional
$17,500 on a single-family structure and an additional $5,000
on contents wll I be available. Additional coverages for two-
to four-family structures and for small businesses up to a
maximum of $30,000 for the structure and $5,000 for the contents
of each unit will also be available. All additional coverages
are at actuarial premium rates.

15. Q. Is there a requirement for minimum coverage?
A. No minimum amount of insurance coverage is required. However,
the amount of insurance carried should be adequate to cover
anticipated losses. The minimum premium charged on each policy
Is $25, with a $4 minimum charge for any change in coverage
during the life of a policy.
16. Q. Do flood Insurance policies have a deductible clause?·
A. Yes. The amount of the deductible, applicable separately to
both the structure and the contents, is either $200 or 2
percent of the amount of insurance covering the type of loss,
whichever is greater. ·
17. Q. Is It possible to obtain Federal disaster relief in addition
to flood Insurance?
A. The Act is designed to encourage Individuals who reside In
flood-prone areas to pay at least part of the cost of
Insurance against flood damage. In order to avoid any
duplication of benefits, the legislation provides that Federal
disaster benefits ordinarily will not be available to reimburse
losses covered under flood insurance policies. However, certain
types of emergency relief--evacuation, temporary shelter and
feeding, medical care, and loans for the reconstruction of
structures _for which adequate flood Insurance cannot be
obtained--will remain available.
18. Q. What if a property owner doesn't buy Insurance once It is
available, and his property is damaged by flood?
A. Unless he Is a low-Income person for whom such a restriction
would cause undue hardship, the owner will not be able to get
Federal disaster relief to the extent that he could have
obtained flood insurance coverage. This restriction against
the duplication of Federal benefits applies only if flood
Insurance has been made available in the area for more than a
year and the damaged property is eligible for flood Insurance.
19. Q. What Is the difference between the "emergency program" and the
"regular program"?

A. The Federal Insurance Administration has been authorized to
provide flood insurance for a two-year emergency period ending
December 31, 1971, without the necessity of first determining
the individual community's actuarial premium rates, which is
a prerequisite for coverage under the regular program. No
substantive change was made in the Act's requirements for the
adoption of local land use and control measures as a condition
of obtaining flood insurance, and no change was made in the
requirement that new construction in special flood hazard areas
must pay full actuarial premium rates. The emer-gency program

is intended primarily as an interim program to provide earlier
coverage for potential flood victims pending the comp.letion of
actuarial studies. The Federal Insurance Administration has no
authority under the emergency program either lo offer additional
limits of coverage or subsidized premium rates to new construc-
tion in special flood hazard areas. New construction within a
special flood hazard area cannot be covered by any Federal
flood insurance under the emergency program but it must wait
until actuarial premium rates are established.
What is a special hazard area?
~
The statute requires the identification of areas having special
flood and mudsl Ide hazards. For Inland and coastal regions,
an area of special flood hazards generally means the area of the
flood plal.n which is I ikely to be flooded at l,i~St once ever.x
hundred ~ears. The spec1al mudsl ide hazard area is the area
;here mu slr.fes can reasonably be anticipated by engineers and
geologists. These are the areas where property damage could
result from slope failure because their soil and geologic
characteristics make them subject to instability, when water
accumulates above or below the surface of the ground.
Can apartment buildings be considered small businesses?
No. However, the Secretary of HUD Is authorized, once he has
determined it to be feasible, to extend flood insurance
coverage to other residential properties, such as apartment
houses and to other types of properties not presently
covered.
It Is anticipated that, as the program develops, coverage will
ultimately be extended to these classes of property.

22. Q. What is the National Flood Insurers Association?
A. The N'"IA Is an association of private Insurance companies
formed specifically to provide flood lnsurarice under the ·
cooperative Government-industry program. It is open to all
qual lfied companies I icensed to write property insurance under
the laws of any State. The N'"IA consists of more than 95
property insurance companies which have subscribed a total of
over $40 mill ion of risk capital. Companies that do nof wish
to pledge risk capital may act as fiscal agents for the
association; thus, smal I companies with 1 imited capital
resources are not excluded from participating in the program.
The National Flood lnsu~ers Association is governed ·by a
constitution and by an agreement with the Federal Insurance
Administrator. -
23. Q. What are land use regulations?
A. These are measures such as zoning ordinances; subdivision
regulations; building codes; health regulations and other
controls for the health, safety and welfare of the people.
In flood hazard areas, these are designed to minimize the
risks from flooding and/or the impact of flowing water. The
objectives are to develop the wisest or most economic use
compatible with the flood risks. As an example: (1) The
areas most frequently flooded can be reserved for open space
types of ~se, such as playgrounds, parks, parking areas,
agriculture, storage areas, etc; (2) Areas less frequently
flooded can be used for industrial, commercial and multi-
story residential use, with controls on first floor elevations
or use, to minimize damages from flooding; (3) The fringe
areas, least frequently flooded, might permit all uses
Including si~gle f~miiY homes, provided the structures are
anchored properly and first floors are above a safe elevation.
24. Q. Who establishes and enforces the land use regulations?
A. Each State has the primary authority to control land use.
In most cases, however, local governments are granted the
authority through enabling legislation to adopt the necessary
land use controls.
25. Q. What Is the meaning of adequat~ land use and control measures?
A. The Federal Insurance Administration's pol Icy Is that the
minimum area for control and regulations related to Its

Flood Insurance Program should be predicated on the risks
associated with the 100-year flood probability. Regional
differences in storms of record and topographical charac-
teristics as related to flood hazards must be conslderea. It
is expected that local governing bodies, ·w·orking with State
agencies, wil I develop standards for land use that will meet
the criteria in the flood insurance regulations.
26. Q. Once regulations are establIshed, do existing structures have
to meet the new building requirements?
A. Generally, no. There is ordinarily no requirement to either
Improve or modify existing structures for flood damage
protection, since zoning and subdivision regulations are not
usually retroactive. However, the flood proofing of existing
structures should be an objective of sound flood plain
management in developing the highest and best uses of land and
in protecting owners against unnecessary losses.
27. Q. Who approves the required land use and control measures?
A. Under the flood insurance program, the Federal . Insurance
Administration is responsible for establ lshing the criteria
for the required land use and control measures and ascer-
taining that State and local regulations are consistent with
these criteria. The States are also given an opportunity to
review local regulations to insure that they meet the objectives
of any. statewide program for flood plain management. However,
final authority for approval, for insurance purposes, lies with
the Federal Insurance Administrator.
28. Q. What will happen If land use and control measures are not
adopted by communities by December 31, 1971?
...
A. The National Flood Insurance Act of 1968, as amended, requires
that adequate land use and control measures with effective
enforcement provisions be adopted and maintained by this date \
in those communities in which flood insurance is being sold.
If this provision Is not met, the statute prohibits any new \
flood Insurance from being sold within the community after that

RESOLUTION NO . ~i', SERIES OF 1970
A RESOLUTION RELATIVE TO FLOOD INSURANCE AS AUTHORIZED BY THE NATIONAL
FLOOD INSURANCE ACT OF 1968, AS A~lliNDED.
WHEREAS, certain areas of the City of Englewood are subject to
periodic flooding from the South Platte River, Little Dry Creek, Big
Dry Creek, and other drainage areas, causing serious damages to
residential properties within these areas, and
WHEREAS, relief is available in the f orm of flood insurance as
authorized by the National Flood Insurance Act of 1968, as amended,
and
WHEREAS, it is the intent of the City Council to comply with land
u se and management criteria regulations as required in said act, and
WHEREAS, it is also the intent of the City Council to recognize
and duly evaluate flood hazards in all official actions relating to
land use in the flood plain areas having special flood hazards, and
WHEREAS, the City of Englewood, Colorado has authority in
accordance with Article 1, Section 3 of the Home Rule Charter of the
City of Englewood, adopted July 8, 1958, as well as Chapter 139,
Articles 32, 59 and 60, C.R.S. '63, as amended, to adopt land use and
control measures.
NOW, THEREFORE, BE IT RESOLVED, that the City Council hereby
assures the Federal Insurance Administration that it will take
legislative action as follows:
(1) Enact by December 31, 1971, and maintain in force for
those areas, adequate land use and control measures with effective
enforcement provi sions consistent with the criteria set forth in Sub-
part B of Section 1910 of the National Flood Insurance Regulations,
(2) If necessary, seek State enabling legislation conferring
authority to enact land use and control measures designed to reduce
the exposure of property to flood loss, and
(3) Take such other official action as may be reasonably necessary
to carry out the objectives of the program. Such actions will include
but not limited to:
•
(a) Assist i ng the Federal Insurance Administrator, at
his request, in delineating the limits of the flood
plain having special flood hazard on available local
maps of sufficient scale to identify the location of
building sites.
(b) After flood ins urance is made available, furnishing
representatives of appropriate Federal or State
agencies or of the National Flood Insurance Association
information, as requested, concer n i ng new or sub-
stantially im proved structures within the area of
s p ecial flood hazard. Th1s information will include
floor elevations and, 1f there is a basement, the
distance between the first floor and the bottom of
the lowest opening where water flowing on the ground
wil1 enter.

public hearing on said Budget on October 5, 1970, and has given con-
siderable study to the aforementioned Budget on numerous occasions;
and,
WHEREAS, it is the intent of the City Council to amend the 1971 Budget
as submitted;

Section 2. The foregoing appropriations shall be considered to be
appropriations to groups within a sub-program, program, or depart-
ment within the fund indicated, but shall not be c onstrued to be appropri-
a tions to line items within any group, even though such line items may
be set forth in the adopted budget for the fiscal year 1971.
Section 3. That all monies in the hands of the Director of Finance or
to come into his hands for the fiscal y ear 1971 may be applied on the
outstanding claims now due or to become due in the said fiscal year of
1971.
Section 4. That all unappropriated monies that may come into the hands
of the Director of Finance during the year 1971 may be so distributed
among the respective funds herein as the City Council may deem best
under such control as is provided by law.
Section 5. That during or at the close of the fiscal year of 1970, any
surplus money In any of the respective funds, after all claims for 1971

There is hereby adopted with the same force and

f o r th purpose o f prescribing regulations, governing con-
dition s h azardous to life and property from fire or ex-
plosion, that certain Fire Prevention Code published by
the American Insurance Association, successor to the National
Bo ard of Fire Un d e rwriters, being particularly the 1970
Edition thereof, and the whole thereof, save and except
Arti cl 13 thereof and appendices C and D theret o of which
Code n o t l e ss than three (3) copies have been and now are
filed in the office of the Director of Finance, ex officio
City Clerk-Treasurer of the City of Englewood.
2-3 -2: ENFORCEMENT OF FIRE PREVENTION CODE
The provisions of the Fire Prevention Code shall
be enforced by the Chi ef of the Englewood Fire Department,
o r an y designee th er~of, who shall carry on such inspections
and investigations and sh a ll issue such p rmits and orders
as ma y be ne e ssary to s cure th e enforc e ment of said pro-
vis ions and the cam p ianc e therewith by all persons.

2 -3-4: ESTABLISHMENT OF LIMITS Of DISTRICTS IN WHICH
STORAGE OF CERTAIN AGENTS, LIQUIDS AND GASSES
ARE RESTRICTED
The limits referred to in Section 12.5(b) of the
Fire Prevention Code, in which the storage of explosives
and blasting a g ents is prohibited, in Section 16.22(a)
in which the storage of flammable liquids in outside,
above-ground tanks is prohibited, in Section 16 .5 1, in
which new bulk plants for flammable or combustible liquids
are prohibited, and in Section 21.6 (a) in which bulk storage
of liquified petrole um gas i s restricted, are those limits
of that area known as "Fire Zone No. 2" as set forth in
Section 3-2-3(1) of this Code.
2-3-5: ESTABLISHMENT OF MOTOR VEHICLE ROUTES FOR
VEHICLES TRANSPORTING EXPLOSIVES AND BLASTING
AGENTS
The routes referred to in Section 12.7(m) of the
Fire Prevention Code for vehicles transporting explosives
and blasting agents shall be established by Ordinance or
Resolution duly passed by the City Council of the City of
Englewood .
2 -3-6: ESTABLISHMENT OF MOTOR VEHICLE ROUTES OF
VEHICLES TRANSPORTING HAZARDOUS CHEMICALS
OR OTHER DANGEROUS ARTICLES
The routes referred to in Section 20.14 of the

vention Code do not apply in the ma nner in which th Chief

that the t rue intent and meaning of the Code have been
misconstrued o r wrongly interpreted by the Chief of the
Fire Departme nt, an y pers on aggrieved thereby may appeal
from the d ecision of chc Chi f of the Fire Department
to the Englewood Board of Adjustment and Appeals within
thirty (30) days from th dat of the d ecis ion appeale d,
which Board shall r eview the decis i on of the Chief of the
Fire Department and r e nder a final and binding decision
thereupon. In conside r ing such appeals, the Englewood
Board of Adjustment and Appeals shall have the powers

l. The contract o r s hall show satisfactory evidence of hi s ability

2 . The complete apparatus with the exception of tires and batteries
s hall be guarant ePd for a period of not less than three (3) years on
parts and one (l) year labor. Each bidder to cl early stat e the
terms of h is warranty.
3 . Each bid to be accompanied by a detailed description of the
apparatus and quipment which it is propo sed to furnish and to
which the appara tu s furnished under the contract must conform. It
is the intent of these specifications to cover the minimum require-
ments of the City of Englewood, Colorado, and each bidder shall meet
all requirement ~ or submit a letter of exception and clearly state
wherein he cannot comply. Failure on the part of any bidder in
this respect shall be cause for rejection of that bid. All material,
workmanship and finish where not otherwise mentioned are left to the
discretion of the manufacturer, who shall be solely respon sible for
the design and contruc t i on of all features . )
4 . The apparatus shall be modern in design, embodying the latest
automotive engineering practices deisnged to suit the nature of
the service which the apparatus must perform. Each bidder shall
make accurate statements in his specifications as to the weight,
wheelbase, turning radius and all principle dimen sions. Each
bidder must submit with his proposal a line drawing showing the
top view, side view and rear view, giving the dimension s of the
general compartment arrangements as specified .
5 . Th contractor shall assume all liabilities and defend all suits
for any or all laims made against th City of Englewood, Colorado
or any of it s a ents for th use of any patented process, devic

COOLI NG SYST EM:

mounted on two s upport s from a heavy cro ss member to elimina te
stress in the radiator from frame distortion when operating on
uneven streets. A thermostat of .the automatic type shall b e
provided to perm i t a quick warm-up of the engine. The rad ia tor
and tanks shall be made of brass, and th e frontal area shall b e
not less than 850 s q. in.
9. AUXILIARY COOLER:
An aux1liary cool e r ~hall be provided, mounted in top of r ad iator,
for use while pumping, if needed, and be so constructed that the
water from the fire pump does not mix with the water in the
radiator. The control for this cooler s hall be on the pump
operator's panel and be convenient to the operation. A se pa r ate
line shall be in s talled for the purpos e of filling the radiat or
f rom the discharge side of the fire pump.
10. WIRING:
All lighting and primary wiring shall be run in conduit or loom
and be neatly installed with proper keepers. All circuit s a r e to
be protected with automatic reset thermal circuit breakers. All
wiring to be color coded.
11. ALTERNATOR:
A 100 amp. Leece-Neville alternator shall be provided.
A 110 Volt, 3500 Watt power unit to be installed on engine with
two (2) outlets each side of pumper.
12. MUFFLER:
Heavy duty type, blow-out proof.

23. PUMP:
The pump shall be midship mounted and be of the parallel-series
type, two (2) or more stages . The impellers to be bronze, mou nt ed
on a stainless ste l s haft. The impellers shall be in both
dynamic and static balance to insure against vibration . The
pump transmission s h all be an integral part of the pump and s hall
be internally water cooled. The pump engagement control s hall
be in the cab.
The pump impellers s h all be a m1n1mum of lO-Y ' in diameter.
Pump speed shall not exceed 3300 RPM when pumping 1250 GPM at
150 PSI .
The pump shall be capable of pumping 1250 GPM N.F.P .A. Rating
Class "A". Each bidder must submit a copy of an N.F.P.A. test
showing this performance. Alternat e bid on 1500 GPM pump will
be acceptable.
Pumps with only one packing gland (on suction side) will be
preferred. The pump housing shall be of hy-tensile fine g rain
bronze.
24. TANK FILL:
A 1-Y' line shall be piped from the discharge side o f the pump
to the water tank.
25. SUCTION PORTS:
6" suct1on ports with centers not more than 38" from the g round
shall be provided on each side of the apparatus adapted to 4-~". These ports to be fitted with removable strainers and
chrome plated, long handled caps to be supplied . ·
26. DISCHARGE GATES:
A minimum o£ £1ve (5) NST discharge gates to be provided, three
on right side, two on left side . All discharg gates to be
controlled from the pump operator's panel on the left side of the
apparatus. The valves for these dischar ge gates to be installed
behind the panel with only the operating handl s and outlets protrudin~. Discharge gates to be full 2-\" waterway, ball valve
with lock1ng type handl es . Chrome plated caps to be install d
on all 2-~" gates with chains. Handl es for di s charge at s to
be chrom plated. Travel of the operating handles and cut-out

before applying a rust resistant preparation. The top of the
tank shall be removable for easy checking and maintenance .
Top of the tank to have a minimum of two (2) inspe ction plat es
covering not less than 80% of the top of the tank. Opening s
s hall be flanged around all edges with stainles~ s teel studs
welded to flanges with a maximum of h'' between tach stud.
Inspection plates to be secured by stainless stc l nuts and
1-1 /4" sponge rubber, Bottom of the tank to be fit ted with a
sump to insure maximum gallonage discharge without cavitation.
Levelometer type tank water gauge to be provided.
37. REAR AND SIDE STEPS (ALUMINUM}:

Council on behalf of Mr. Darrell Skelton who is developing the
property locate d at 2300 and 2310 South Tejon Street. Mr. Lind
s tated that the water tap fee had been increased from $1 50 to
$1 ,020 for the property on May 4, 1970. Mr. Lind stated that he
had entered into a con t ract to develop the property on May 1 and
had obtained a building p e r mit on Jun e 8, 1970. Mr. Lind also
stated that prior to May 4 he had contacted the Wat er Department
to determine the tap assessment on the property and ha d learned
that the old rates were in effect. Mr. Lind requested a refund
of $870 .
Note: Mr. Lind submitted a packet in regard to the
water connection charge s etting forth the dates application for
the connection an d building permit had been made, the recei pts
concerning the connection, and various other correspondence
pertinent to his claim .

Mr . Jack L . Clasby , Chief of Police , appeared before
City Council to demonstrate the potential use of a video tape
unit in the Pol ice Department and other mu nicipal departments.
Mr. Clasby stated that the Police Department had been experiment-
ing with a ta p e for the last 12 months and that the judges had
indicated that it was usable evidence. Mr. Clasby discussed its
usage in other departments and training . Mr. Clasby stated that
of the estimated $8 ,000 cost the City could obtain 60 per cent
L .E .A .A. funds r educing its cost to $3 ,2 00.
Mr. William K. Davis of Video Electronics appeared
before City Council and demonstrated the tape unit.

City Attorney Berardini pres en ted a draft bill for an
ordinance adopting the 1970 Fire Prevention Code. Mr. Berardini
stated that the sections dealing with vehicle routes for trans-
porting explosives, vehicle routes fo r transporting hazardous
chemicals or other dangerous ar icles and the establishment of
fi r e lanes on private property devoted to public use were set forth
by citing the authority of the t ra ffic engi neer under the Mod el
Traffic Code. Mr. Be rar di ni stated that it appeared to him that
these routes and lanes should be cited with specific City Council
adoption either by ordinance o r resolution . Mr . Berardini stated
that he would res arc h he delegation of authori y for this action
to the traffic engineer .

Utilities Commission had approved the transfer of PUC Permit
50 from Mr. Ern est He rber t son to the City subject to the com-
pletion of certain routine documents .

Safeway Stores Inc. of Judge Foote's decision that the City Council

City Attorney Berardini stated that he had appeared
before Judge Kelley 's cour t on November 10 and November 16 in
regard to the Santa Fe-Union Annexation. Mr. Berardini stated
that Judge Kelley ruled a temporary restraining order against the
annexation of the area to the City and that an election commission
for an election of the area to the City of Sheridan not be appointed
and that briefs be filed with the court on the matter.

of Finance Lyon regarding an adjustment to the Recreation Fund

Dear Sir:
Please note the attached article from the June, 1970
issue of Fire Chief publication.
This demonstration we witnessed, and I believe exemplifies
the advantages of 5" hose capabilities even better than I
might in a separate detailed report of some length.
We are most anxious to equip at least two (2) of our
pumpers with such a capability for some very obvious
reasons:
a. To better utilize our pumping capacity.
b. To better utilize our water flows to large fires.
c. To expedite large volums of water in supply lines
to the fire area.
d. And most important that we u se the same adapters
as Littleton because of our Mutual Aid involvement.
I hav been in touch with Chief Wi se and other chiefs in
th M Lropolitan Area and they too are planning the same
capabilities and recognize the advantages of standardization
of Lhe hook-up.
Cost? At present the cost of 5" hose is approximately $2.65
p r foot . Adapters -$50.00 each. Two (2) required each
pumper.
Considering 500 ' the m1n1mwn for one (l) pumper, ~lus
adapters , the cost for each pump er would be app. ~1,500.00.

Other adjustments are:
a. Th e ho se bed ha s to be partitioned to 18 " in
that th is ho se l ays flat, instead o f the conventional
edge load used with 2 ~" fire hos e .
b. Each pumper has to be e quipped with a sled-lay
device to prevent coupling dama ge as it hiT s the street.
And both can be provided in our Shop at minimum cost.
At the present time we only know of three s uppliers for
this particular type of hos e and adapters and it is my
understanding that all of the se at present are purchasing
the hose from a manufacturer in Germany.
Delivery date not too certain. However we are at this
time searching the market to see if any manufacturer
within the United States is anticipated.

for the City of Engl ewood, as formulated by the Denver Regional Council of Governments.

This report :.news that Engl ewood average per capita consumption has fluctuated from 135
gallons per day to 210 gallons per day in the period 1952 through 1968, in a system which
has been mostly no n-metered.
Future requirements have been projected from a 1968 figure of 199 gcd to 206 gcd in 1975,
after which it is ant1.cipated that Englewood will convert to a canpletely ~~etered syst.l
which should tend to conserve water consumption.
After consideration and discussion on the report,

Sanitation District. Such land is contiguous to the existing boundary of the district,
at the Northwest corner of the intersection of Dry Creek Road and South Holly Street and
is 80 acres in size. It is in apparent good position tor sever service through the system
of the district and the Englewood sewage treatinent plant.

160 acres of land involved i n Supplement No , 27 at it's regular meeting held April 21 1 1970, and had recommend ed to City Council that a letter be written to Celebrity Homes,
Inc., developers, advi sing that the City of Englewood would favorably consider entering
into a supple!'llen tal agreement to the Connector 1 s Agreement between the City of Englewood
and Southg ate Sanitation District, providing for inclusion of such land into said district
and for Englewoo~ ... ...,<>e treatment service.
Mr. Carroll advised the Board that an May 4, 1970, City Council approved this recommenda-
tion and that the letter of intent was subsequently written.

Re: Southgate Sanitation District
We have received a petition for annexation to the area of
So uthgate Sanitation Distr ict with respec t to the following
described proper ty :
Block or Lot 36, Clark Colony No. 2, a
Subdivision of Sec ti on 29, Township S South,
Range 67 West of the 6th P.M., Arapahoe
County, Colorado .
You are aware of the s ituation as to the location of this
p r ope rty, it be ing comple t ely surrounded by property of the
Hayutin group; however, they have never had title and, when
the District was condemning for the easement through the
Hayutin property, it was necessary to go through Block }6,
it being learned at the time of the condemnation proceedings
that the Hayu tins did not actually have title. Accordingly,
ne gotiations were undertaken for an easement through Block
36 and, due to the fact that the property was in an estate,
it was impossible to get a good title at that time.
In our recent negotiations, the attorney representing
the estate has advised that title is now clear and the ease-
men t can be conveyed , They are willing to convey the easemen t
to the District in exchange for the cost of bringing the
property within the area of the District for service from the
lines of the Distri ct. The Board of Directors of the District
is recept~ve to this proposal; however, it is understood that
this can only be undertaken if the City of Engle110od consents
to amen ding its Connector 1 s Agreement to allow service to this
area.
For t he f oregoing reasons, we respectfUlly request favorable
action on the part of the City and, should this be approved, we
submit the enclosed Amendment to Connector's Agreement for use
in modi fyi ng t he Agreement to i nclude t his area.
For your i nformation, there is enclosed a photocopy of the
area comprising Block )6, outlining the ease~~~ent and the area
involved.

take the water without effecting an exchange?
Mr. Shivers advised that the intent of the Agreement is that Denver is entitled to all

Mr. Supinger stated the property is on West Dartmouth Avenue in
an I-2 (Heavy Industrial) zone district. Mr. and Mrs. Harrington,
who have an option to purchase this property, raise and show dogs.
They want to relocate to an area where adequate space will be pro-
vided f or their dogs. Mr. Supinger pointed out that kennels are
not specifically mentioned as a permitted use in the Zoning Ordinance,
and this is the reason the request ~ before the Planning Commission.
Mr. Sup;i.nger stated that it is his understanding the "kennels" will
not be a commercial use, but is rather a "hobby" of the Harrington's,
and that the dogs are pets of the family. He noted that Mrs.
Harrington has indicated that some puppies may be sold , but they
intend to provide for 10 dogs maximum , and the main interest will
be in showing the dogs. Mr. Supinger noted that he felt the pro-
posed use would be compatible with the surrounding area, which is
industrially developed or vacant land. It was then noted that
Mr. and Mrs. Harrington will reside on the property, which is present-
ly used residentially, and will construct the kennels with outside
runs on the western portion o f the property.
Mrs. Henning noted that the s taf f report indicates that residential
uses must c ease in the I-2 (Heavy Industrial) zone district by 1977,
a cc ording to the Zoning Ordinance. She asked if this would have
any a f fe ct on the desirability of the property for the Harringtons?
Mr. Supinge r c ommente d tha t the use a s a r esidence would be required
t o ce a se in 1977 if it were "truly a non-c onforming use"; he commented
t hat h e fe l t t h e pr i mar y use o f the property would be considered the

Discussion followed, Mrs. Gladys Nies stated she was the real
estate agent selling the property; she noted that she herself has
raised show dogs, and that this is a business and is listed as such
by the Internal Revenue Department. She pointed out that show dogs
c an easily be sold for $500 to $1,000 per dog. She concurred that
t he residential use would be secondary to the primary use of the
property as a kennel, and that the Harringtons would be "caretakers"
of their kennels.
Mrs. Henning noted that animal hospitals are a permitted use, and
that she felt the kennels fell within the same general classification.

Mr. Supinger stated that the animal hospital was for the care of sick
animals, and not all hospitals have outside runs for the animals.
Kennels are for the boarding of healthy animals, which animals need
outside runs and sunlight. Discussion followed,
Dr. Walsh asked why this proposed use needed the approval of the
Planning Commission? Mr. Carlson stated that "kennels" are not a
permitted use in the Zoning Ordinance, and under §22.5-19, Uses
not Mentioned 1 the Planning Commission may recommend that a-ou!lding
permit be issued when the Commission finds the proposed use is
compatible with and not objectionable to nearby property, and tha t
the use is not hazardous to the health and property of surrounding
areas.
Mr. Car lson a s k ed how large the parcel of land the Harr1ngtons want
to purc hase is? Mr . Sup1nger stated that the parcel was approximately
1 /2 a c re. Mr. Carl son then a s ked what the time schedule to construct
the k en n el, etc, seemed to be? Mr. Harrington stated that they
would have to first sell their prese nt property, and that probably
th e kennel will be started within the next year. Further discussion
followed.

Mr. Supinger noted that the staf f report p rese nted to the Comm iss ion
is to inform members o f the staff recommendation in regard zoning
the newly annexed area. Mr. Supinger pointed out that the City is
required to establish zoning for the area within 90 day s aft r the
effective date of the annexation, by prov is1on of the Municipal
Annexation Act of 1965. Mr. Supinger noted that according to a
sc hedule worked out by the staff, the zon1ng o f the area must be
fi nal by February 18, 1971. The land use o f the area was discussed;
small maps of the subject area with land use indicated thereon were
r eviewed by the Commission , as were maps with the existing county
zoning de signations shown, and with the propose d Englewood zoning
designation. It was noted that the area east of South Santa Fe
Drive is residentially and industrially d e veloped ; the area west of
South Santa Fe Drive has mixe d u se , bu t is primarily industrial .
Mr. Supinger stated that he felt the industrial zonin g, a s proposed,
would fit the majority of the area quite well . He a c knowledged the
area east of South Santa Fe Drive that is residentially dev elo p ed

Mr. Pat rick c omm e nt e d th at the only "hurt" they could further e x-
p eri e n ce would b e if t hey w1shed to add a room to their "non-conforming"
resi dential use, and the ordinan ce restricts such additions. Mr .
Senti commented that even an addition to the home would not add to
the value of those residential us e s. Furthe r discussion followed.
V . COMMISSIONER'S CHOICE
The recommendation of the Planning Commission to the City Mana ger
on the 1971 work program for the State Highway Department was dis-
cussed and contrasted to the Manager's recommendation to the County
Commissioners for proje cts in Englewood for the 1971 State H1ghway
Department work program. It was noted that this recommendation
from the City Manager basically ignored the study and recommendation
of the Planning Commission: the matter of whether recommendations
are made to the City Council or to the adm i nistrat i on was also dis-
cussed. Mrs. Hennin g suggested that possibly an actual statement
of lines of communications to and from the Planning Commission, and
the disposition of re c ommendations and cases considered by the
Commission could be set forth. Further discussion followed.
VI. DIRECTOR'S CHOICE
Mr. Supinger statedthat City Manager Dial has mentioned the possibility
of a joi nt meeting of the Planning Commission, Board of Adjustment
and City Council in the n e ar future relat1ve to Architectural Review.
No date, time, or location has been set for this meeting.
The City Council ha s referred to t he Planning Commission consideration
of a "flood plain" zone de s 1 g nation. Mr. Supinger indicated that
Mr. D1al tated he would subm1t a written referral to the Comm1ssion
on t in s matter.

Mr. Braun thanked Mr. Murphy for d e veloping the new progress report.
He said he felt that these helped the supervisor rate an employee
more easily. Also, a member of the Board could more easily and quickly
ascertain by looking at the employee's total score, how that pe rson
•ms performing in his duties.
Mr. Deward Rich ardson and Mr. Ra y Hinkle's request to appear before
the Board to appeal their reclassifica tion from Equipment Operators
III to Equipment Operators II was consi dered . Mr. Roland Wingo
asked for the fl oo r to speak in their behalf.
Mr. Murphy asked Mr. Wingo if he represented the Employees' Asso-
ciation in any way.
Mr. Wingo replied that he was on the Board o .f Council for the Employ-
ees' Associati o n, but in no way was he representing the Association
in this mat t er.
Mr. Murphy then stated that he had received a letter from the Associa-
tion stating that it would not support Mr. Wingo's action nor the
Equipment Operato rs' appea l .
Mr. Braun a sked why Mr . Johannes was p resent and what he had to do
with the hearing .
Mr. Johanne s stated that he was the men's supervisor and worked
with them .
Mr. Wingo continued and g av e the histo r y and b a ckground of the posi-
tion of Equipment Operator. Before the Letter of Understanding was
signed in 1 968 , there was much study and discussion. At that time,
al l equip ment operators were plac e d in grade 2 0.

Mr. Wingo state d that all o pe r ators were in the same grade; there was
no b reakdown. In the listing of those to get the pay raise in Jan-
uary o f 1969, these people were lis te d in grade 1 9 , and there was no
reason given. The re was then a meeting with the representatives of
the Employees' Association, the City, and all the employees c oncerned
on January 13, 1969. Mr. Dial exp lain ed that these men were placed
in the wrong grade before the l etter was signed, but they would be
k ep t in tha t grade f o r the present, In a mem o randum written to
Stephen Lyon, Fin a nce Director on January 1 6 , 19 69 , Mr. Dial stated
that a ll pre sent equipment operators would be kep t in grade 20 and
tha t a ny ope ra tors hired in the future would be put into their proper
le v el s, e i ther I, II, or III. The Equipment Operators III would be
r e d-circ led and their positions would be r e -examined in 1970 with
any corrections to be made prob abl y in January, 1 971 .
These men have occupied the p o sition of Equipment Operator III
s i nce 1969. There was no allegation that they were not performing
satisfactorily. All classified positions, according to the Letter
of Understanding of 1970, are to receive a 10% across-the-board
i ncrease in January, 1971 . Just a few days ago, the Personnel Dir-
ector told him that equipment operators would receive only a 5%
increase in January and would be re c lassified as Equipment Opera-
to rs II. The Personnel Director has rewritten the job des c rip tions
and these have been approved by the Career Service Board. The
Personnel Director, Mr. Wingo stated, contends that the men are not
qualified to hold such a position; that no one in the City of Engle-
wood is qualified to hold such a position, yet the title stil l
appears on the pay scale. Why? Because the Personnel Director said
that it would be used to laterally transfer the Senior Maintenance-
man to Equipment Operator III. Since the Personnel Director had
just told him that no one was qualified in the City to occupy such
a position, how could he transfer someone over to that p o sition ?
Mr. Wingo stated that he was closely associated with both employees.
Ray Hinkle operates the backhoes and frequently operates the other
equipment. Deward Richardson also operates the front-end loader and
frequently operates the other equipment. They are charged with respon-
sibilities not often found in these duties. Extreme skill and care
must be taken not to tear out or break underground cables, etc.
These employees have some of the most hazardous duties in the City.
They are subject to be called out for duty at anytime and expect
to take part in emergencies. Mr. Wingo said h e felt their promo-
tions were the result of the Letter of Understanding in 1968. He
asked why this is being corrected now . If th e correction was going
t o be made, why wasn't it done in 1968? He felt these men should
receive their 10% increase in January of 1971.
Mr. Murphy stated that this change was dis cussed with the negotia-
t ion committee in 1968. There wa s no doubt that there was going to
be a breakdown then. At the time , Mr. Rick Kahm sto od up and e x-
pla ined t o the Employees' Association what was to h appen. He ex-
pl a i ned the position of Equipment Operator was going to be broken
down into three group s; it had not been done in 1968 , but it would
come soon , and in 1971, the operators would be put into their proper
grade s.

Mr. Murphy replied that they would be re ceiving a 5% pay increase.
He stated that he tol d Mr. Wingo that Equipment Opera tors III op-

Mr. Wingo the n stated that it is the Equipment Operators 1 contention
they are being demo te d.
Mr . Braun stated that he could appre ci ate it if they lost money,
but it is a matter of record that they knew there was going to be
some change and that they are going t o receive a 5% i n crease.
Mr. Murphy stated that equipment o perators would h av e lost money
in 1969 if they had been left at g rade 19. The gra d e is now being
adjuste d to be in line with the salary paid to equipment operators
in the metropolitan area.
Mr . Johannes told the Board that he und erstoo d that the equipment
op erators woul d be red-circled, but that the way he saw it, one of
three things could happen: they could be demoted, they could be
promote d, o r they could remain in the same grade.
Mr. DeVivier stated that dollar-wise they woul d not be reduced.
Mr. Dial asked for the floor. First o f all , in the letter of Jan -
ua ry 16, 1969, he explained that they h ad made an error b y placing
the equipment operators in grade 20 . The grade was to o high for the
duties. The letter is c lear: the position would be reviewed and
the persons in a position too high woul d be red -circled. Secondly,
last summer when the negotiation for the Letter of Underst a nding
was com plet e d, Mr. Dial reminded the Emp loyees ' Associ at ion that
the position of Equipmen t Operator III would be corrected . The
Let er of Understanding in 1970 d id n ot cance l out the letter of 1969.
If hese people were not reclassifi e d to Equipment Operator II, then

MEMORANDUM
The Board of th e Arapahoe Regional Library Di stric t has vot e d
to increase the paym en t to the Englewood Public Library by $2500
for the year 1971 . This added amo unt is to be paid in a lump s um
during the second q uarter of the year . The amo unt offered by the
Di strict for library service to Arapahoe County residents is $32 ,750
instead of the origina l $30, 250 .
At the direc tion of Mr. Maxwe ll, Board Chairman, the mem bers of
th e Englewood Library Board were polled by telephone as to whether
or not they wished to recommend that th e City Council accept the
contract .
Of the nine Board mem bers, seven voted to reconunend acceptance
of the contract and one voted against reco11U11ending ace ptance . Mr .
Dh orily questioned the nec essi ty of an immediate decision and sug-
gested that th e Library Di rector ask the City Ma nager for more time
to nego tiate with the Di strict .
Therefore, by majority vote, the Board of the Englewood Public
Library recommends that the City Council accept the contract with
the Arapahoe Library District for the calendar year 19 71 in the a -
mo un t of $32,7 50 .

After meettng with the Public Works and Uttllttes Directors,
the Comm ittee determined that tt would be best not to dealp a system so
that all communications of Publtc Works, Uttllttes, and Parka aDd Recre-
ation would flow throogb the ceDtral facility durlDg recular office hours.
The nature of the transmlssloaa amo111 and wtthlD these departments Is
more detailed and lengthy than those required In the emerrency services.
The Information communicated tn these departmeDts vartes from those tn
the. emergency services in that they often require the participation of the
director or some other htgb level supervisor with a great deal of technical
knowledge at hts command, Consequently, It would be inefftcteat to require
all communications from such an Individual to be routed through the dis-
patcher tn the central area. The Committee, therefore, recommeoda that
a remote system similar to that In use today be employed for these depart-
meats providing, however, that the center be required to malntaiD all com-

of course, that the supervisor would be in a poaltlon to perform some re-
lief duties. Until we occupy the new bulldblg, however, the PBX-Qperator
cannot be cODBldered In our peraOIID81 eatlmates for the emergency dis-
patching function, IIDd our recommendatioaa must reflect tbts fact. The
Committee estimates that three to four poattlODB will need to be ftlled, de-
pending upon the pay grade set for dispatchers and the peraon selected as
supervtsor. At this polnt It ts help611 to DOte that commtsatoned officers
of the Pollee Department, In addition to the one patrolman already com-
mitted to dtspatchlllg, are preaeDtly performing as dispatchers. From
July 1, 1969, through June 30, 1970, a total of 283 eight-hour shUts, or
2, 264 man-hours of dispatching were covered by commissioned patrolmen
from the Pollee Department.
CLASS SPECIFICATIONS AND PAY GRADES
It Is recommended that the Pers.onnel Director be authorized
to write a class spec for the position of Comunlcatlona ~pervtsor and to
recommend a corresponding pay grade for tbls position. A testing pro-
cedure should then be developed and the position filled.
