SPECIAL MEETING:
The City Council of the City of Englewood, Arapahoe
county, Colorado, met in special session on February 23, 1970
at 8:00 P.M.
Ma y or Schwab, presiding , called the meeting to order
and asked for r oll c a l l. Upon the c all of the roll, the following
were present:
Councilmen Brown, Dhori ty , Kreiling , Lay , Lone, Senti,
Schwab.
Absent: None .
The Mayor declared a quorum present.
Also present were: City Manager Dial,
City Attorney Berardini,
City Clerk Lyon.
COUNCILMAN LONE MOVED, COUNCILMAN LAY SECONDED, THAT
THE PUBLIC HEARING ON THE FORMATION OF PAVING DISTRICT NO, 19
BE OPENED. Upon the call of the roll , the vote resulted as
follows:
Ayes: Councilmen Brown, Dhority, Kreiling, Lay, Lone,
Senti, Schwab.
Nays: None.
Absent: None .
The Mayor declared the motion c arried, and the public hearing
opened at 8 :02 P.M. (A t ape recording of the public hearing is
on file with the official records .)

tion to the proposed District. Mrs. Bernhardt presented a petition
of property owners who were opposed to the District. The petition was received and read.
West Tufts Avenue
Mr. Carl G. Schneider, 3220 West Lake Avenue, in support of the proposed District.
West Chenango Avenue
Mr . Ferdinand Lauman, 488 5 South Galapago, had a question on the proposed District .
On Alley, East of South Acoma and
East of South Broadway
Mr. Gurn ey A . Ulrich, 3861 South Li ncoln, in opposition
to the proposed District . Mr. Ulrich also represented several
proper y owners in this particular area .
Mr. Ed Smith , 3818-3822 South Broadway, in support of the proposed District .
Mayor Schwab called for a show of hands of those in the
a udience in favor or opposition to the paving of this particular
section. Eleven were in opposition and two were in favor.
Mrs. Winnie Strattford, 4085 South Grant, in opposition to he proposed District.

PAVING DISTRICT NO. 1 9 HEARING
1. Paving District background -Paving District No. 6 in 1956.
2. Petitions for street improvements.
(a) Charter, majority of owners, regardless of residence.
(b) Area does not count.
3. Council-initiated improvements.
(a) Council initiates improvements with funds available.
(b) Legally, City Council initiates all street improvements
on the Paving District.
4. Show location of proposed improvements.
(a) Petitioned improvements.
(b) Council-initiated streets.
(c) After public hearing, Council cannot add streets, but
can drop them.
5. Cost.
(a) Depends upon type of improvement.
(b) Depends upon City's share of cost (intersections, arterial
widths in residential zoues, etc.).
(c) Depends upon competitive bid prices.
(d) Also, Includes costs of engineering, title checks, fiscal
agent services, legal publication costs, printing, mailing
notices, interest on money borrowed during construction,
assessment computation, etc.
(e) City sells bonds to '1owest" and best bidder.
(f) Overlay.
6. City provides ce~ paving guarantees.
(a) Performance bond during coolltruction.
(b) Two years' guarantee on cement work.
(c) Five years' guarantee on paving.
7. Assessments.
(a) Director of Public Works will explain computation of
assessments and cost.
(b) Assessments will be computed and property owners
notified in January or February, 1971._
(c) Property owners will have opportunity to appear before
Council at a public hearing regarding assessments in
February, 1971. (lnd ividual notices will be sent.)

7. As sessments. (Continued)
(d) Within thirty days after public hea ring, all or any
part of the assessment total may be paid in cash
at a five per cent (5 %) discount on the amount
actually paid.
(e) Thereafter, the property will be assesst'd with
the General Taxes (beginning in ,January, 197 :)
one-tenth (1/10th) of the assessment plus interest.
(Amount to be set by Council.)
(f) May pay in advance at any time at actual accrued
interest.
(g) If a payment is delinquent, then the full balance be-
comes due to the County. -
8. Before paving, all efforts will be made to see that utility
line replacements are made, and that property owners
tap to the utility lines.
9. Additional street rights-of-way may he needed for
specific street improvemeuts.
10. Sidewalks.
(a) Locations of walks: The Ordinance provides that
the location of sidewalks will be determined by
the Director of Public Works and that his decision
is subject to variatioo as may be approved by the
Board of Adjustment and Appeals.
(b) Width: The City's OrdiDancE' provides that the side-
walk width shall be determined by the Director of
Public Works, but does not provide for appeal from
his decision.

MAKE CERTAIN ST REET AND ALLEY IMPROVEME NTS
THEREIN, AND FOR A HEARING THEREON.
All owners of real estate and property hereinafter described,
and all persons generally, are hereby no tj fied that the City Council
of Englewood, Colorado , pursuant to its own order and upon petitions
filed by a majority of the owners of real property as designated in
the petitions has ado p t ed full details, plans and specifications for
construction of street and alley improvemen ts and appurtenances in
and for a proposed local improvement district within the corporate
limits of EngL'ewo o d , Colorado , to be known as Paving District No. 19.

(b) The description of the proposed district, and the
property to be assess d with the cost of the improvements shall be
all of the real prop erty fronting or abutting on the streets and :s
alleys between the termini hereinbefore described, including the
real property within one half (1/2) block of such streets and alleys.
Adjustme nts for the assessment of costs will be made for irregular
and odd shaped lots and parcels of property.
(c) The pro bable total cost of the improvements to be

(d) The probable amount of said total cost which the

(e) 'The b alance of the total cost which is not paid by
the City of Englew ood will be assessed against the property specially

within one-half (1/2) block or 300 ' of such intersections and corner
lots, whichever is smaller, on a zone basis in accordance with bene.-
fits conferred on such properties.
Each on -half (1/2) block or 300' section, will be divided
into six (6) parallel zones and assessments will be on the following
basis:

the proposed improvements and which ar acceptable to the City
Engineer.

The cost of improving street intersections throughout
the District, and of paving in excess of 36' widths and 8 '' thickness
on streets designat e d as arterial within residential zoning as of
February 2, 1970, will be paid by the City of Englewood.
Prop erty owners are specifically referred to the schedule
of proposed assess ments which will be on file in the Office of the
Director of Public Works , fro m which the approximate amount to be
assessed against any particular lot or parcel or prop erty may be
determined.
Upon completion of said improvements, or as soon as the
total cost thereof is defini ely ascertained, such cost shall be
apportioned to . the prope rty in the District. Notice of such ap-
portionment shall be given and a Hearing will be held prior to the
adoption of an ordinance assessing such cost, all as provided by
law.
(f) Sa id assessments will be due and payable without
demand within thirty days from and after the final publication of
an ordinance assessing the whole cost of said improvements against
the real property in said District; provided, howeve r, that any
owner who shall pay his full assessment within said period of thirt y
days shall be entitled to an allowance of fiv e percent (5%). In
the event that any owner of real proper ty shall fail to pay the
whole of such assessment against his property within said thirty
days, then the whole cos of said improvement so assess ed against
his property shall be payable in ten equal annual installments of
principal . The first of such installments of principal shall be
due and payable at s uch tin e as may be dete rmined in and by the as-
sessing ordinance, and the remainder of said installments shall be
due and payable successively on the same day in each year thereafter
until all are paid in full. The rate of interest to be paid on un-
paid and deferred install me nts will be established by ordinance to
be adopted by the City Council at a later date.
(g) A Hearing on the creation of the District will be
held by the Council on :~·td~y , the ~lr~ day of Februsry
1970, at the hour of eaoO o 'clock P.M~ the City Hall 1n
Englewood; and a bill for an ordinance authorizing said improvements ·
will be considered by the City Council at the regular meeting on
the 2nd day of March, 1970 .
(h) Any person desiring to be heard upon the issue of
the creation of the district or upon the construction, installation
or improvement of the improvements involved, may appear at the time
and place set for the public hearing thereon for that purpose.
(i) A map, estimate and schedule showing the approximate
amoun to be assess e d, and all resolutions and proc e ding s will be
on fil and can be seen and examin e d by any p e rson int e rested at
the Office of the Director of Public Wo rks at any time during busi-
ness hours on or prior to the date of hearing .

Reference is made to the published notice of a proposition
to create a local improvement district in Englewood, Colorado,
to be known as Paving District No. 19, to make certain street
and alley improvements thereon, and for a hearing thereon.
This office represents L. Norval Pe arce, owner of Lots
47 and 48, Mansfield Ad dition, known as and numbered 3801 and
3805 South Lincoln Street, Englel'l ood, Colorado. This property
is located at the southwest corner of Lincoln Street and East
Lehigh Avenue, an area subject to the proposed improvements.
The area of the property is zoned for two-family residence,
is so occupied, although under a duly registered nonconforming
use by reason of three units in the dwelling. The dwelling was
b uilt in 1941, then a part of Arapahoe County, and was subse-
uently annexed to the City of Englewood in 1946.
The p roposed improvements are reported as including
widening o f Lehigh S treet from Broadway east to Lincoln Street.
This would increase the size from approximately 30 feet to the
contemplated 44 feet width. From Lincoln Street east, Lehigh
is to be widened, but only to the width of 36 feet. In addition,
the street will have curb , gutter , sidewalk, and blacktop
surface installed. Presently adjacent to the property of Mr .
Pearce there exists curb, gutter , and sidewalk from the area
east of Broadway to Lincoln Street and the blacktop paving is in
fairly good condition in this particular area.
The property immediately adjacent to and in close p roximity
of the intersection of Lehigh Avenue and Lincoln Stre et may be
described as a good residential area of the city. The traffic
on Lehigh Avenue is very nominal and, in fact , the width of the I • •

existing street will support anticipated traffic. Lehigh
Avenue is used for school children wa lking to and from the
high school located some four b locks east of Broadway and, in
fact, Lehigh Avenue deadends at Logan Street at the school.
It is believed t h at the pro p osed widening of Lehiqh
Avenue to the width of 44 feet is unnecessary, that it wi ll
create a hazard in that the avenue through to Logan Street
is not to be made the same width, and this improvement will
result in certain modifications to the property of r. Pearce
as will cause the expenditure of considerable funds for modi-
fication to the residence and removal of shrubbery, trees, and
other improvements.
The prob lem created by the proposed improvement is
illustrated by th e fact t h at the south edge of the s idewalk
to be installed adjacent to t he Pearce p rop erty wi ll be less
than 5 feet from the residence structure . In addition,it is
the claim of the city that t he street right of way extends
3-1/2 feet south of the south ed e of t he sidewalk and would
p ut the property line less than 18 inches from the street r igh t
of wa y . If such is t he case, then it is also indi cated that a
p ortion of the ~arage b uilding at the rear of the Pe arce p rooerty
is actually on the street right of way . ~

When a p roblem such as this is indicated, it is belived
t h at no improvement should be made until it is determined
whe t her or not the location of t he improvements is prooer,
wh at effect t his wi ll hav e on existing roperty , and whethe r
or not modifications can b e made as will achieve the result
desired by the city and avoid as much loss and damagem t he
improvements of t h e p rope rty owner as can be agreed u p on.
