M. Clerk: The following "Notice of Call" was read by the City NOTICE OF CALL BY THE MAYOR FOR A SPECIAL SESSION OF THE CITY COUNCIL MONDAY, JANUARY 25, 1971 8:00 P. M. The City Council of the City of Englewood, Arapahoe County, Colorado, is hereby called to a special meeting at the City Hall, 3400 South Elati Street, to consider the following agendaz 1. Bill for an Ordinance rezoning certain property from R-1-B to R-2-B in the vicinity of South Lowell Boulevard and West · .. ufts Avenue. Suggested date of public hearing would be February 16, 1971. (Copies will be available at the session.) 2. Public hearing to consider the formation of Paving District No. 20. The following items transmitted herewithz (a) Memorandum from Mr. Stanley H. Dial, City Manager, outlining the nature of the City's paving program. (b) Display sheet of types of improvements included with- in the Paving District. (c) Resolution declaring the intent of the Council to create Paving District No. 20. (d) Letter of intent to form the District which was sent to affected property owners. Also present were: City Manager Dial, Assistant City Manager McDivitt, City Attorney Berardini, City Clerk Lyon. * * * * * * City Attorney Berardini stated that due to an error in posting of the property, a new bill for an ordinance rezoning the property located in the vicinity of South Lowell Boulevard and West Tufts Avenue had been prepared setting the date for public hearing on February 16, 1971. Introduced as a Bill by Councilman Lone and read in full. Set forth below is a listing of the items officially received by the City Council at the public hearing on Paving District No. 20. (1) A memorandum from Mr. Stanley H. Director of Public Works Waggoner appeared before City Council and explained the various types of improvements to be included within Paving District No. 20, the areas which would be improved, and the method of assessment. Mr. Rick Trotter, 2780 South Ogden, appeared before City Council to ask a question concerning assessment policies, use of concrete in construction of alleys and alley drainage. ON-West Baker Avenue (FROM-East line of South Zuni Street TO-West ~ine,oL South Tejon Street) Mr. Stanley Rhodus, 2323 West Harvard Avenue, (owning property at 2324 West Baker) requested hollywood curb and gutter instead of vertical curb and gutter. Mr. Bill Miller, 2319 West Harvard, requested hollywood curb and gutter instead of vertical curb and gutter. C OLo. 1. Paving District background -Paving District No. 6 in 1956. 2. Petitions for street improvements. (a) Charter, majority of owners, regardless of residence. (b) Area does not count. 3. Council-initiated improvements. (a) Council initiates improvements with funds available. (b) Legally , City Council initiates alJ street improvements on the Paving District. 4. Show location of proposed improvements. (a) Petitioned improvements. (b) Council-initiated streets. (c) After public hearing, Council cannot add streets, but can drop them. 5. Cost. (a) Depends upon type of improvement. (b) Depends upon City's share of cost (intersections, arterial widths in residential zones, etc.). (c) Depends upon competitive bid prices. (d) Also, includes costs of engineering, title checks, fiscal agent services, legal publication costs, printing, mailing notices, Interest on money borrowed during construction, assessment computation, etc. (e) City sells bonds to "lowest" and best bidder. (f) Overlay. 6. City provides certain paving guarantees. (a) Performance bond during construction. (b) Two years' guarantee on cement work. (c) Five years' guarantee on paving. 7. Assessments. (a) Director of Public Works will explain computation of assessments and cost. (b) Assessments will be computed and property owners notified in January or February, 1972. (c) Property owners will have opportunity to appear before Council at a public hearing rega rding assessments in February, 197 2. (Individual notices will be sent.) (Continued) • (d) Within thirty day s after public hearing, all or any part of th e assessment total may be paid in cash at a five per cent (5%) discount on the amount actually paid. (e) The reafter, the property will be assessed with the General Taxes (beginning in January, 1973) one- t e nth (1 /10th) of the assessment plus interest. (Am ount to be s e t by Council.) (f) May pay in advance at any time at actual accrued interest. (g) If a pay ment is delinquent, then the full balance be- comes due to the County. 8. Before paving, all efforts wtll be made to see that utlllty line replacements are made, and that property owners tap to the utility lines. 9. Additional street rights-of-way may be needed for specific street improvements. 10. Water line replacement. 11. Sidewalks. (a) Locations of walks: The Ordinance provides that the location of sidewalks will be determined by the Director of Public Works and that his decision is subject to variation as may be approved by the Board of Adjustment and Appeals. (b) Width: 1be City's Ordinance provides that the sidewalk width shall be determined by the Director of Public Works, but does not provide for appeal from his decision. 12. That the m a terials to be used In constructing the pro- posed improvem ents are stated ln the Not ice hereinafter set forth . 4. That the assessments to be levied tor said Improvements shall be due and payable within thirty days from and alter the flnal publication of the ordi n · ance assessing the whole a !t :Jal cost of said lmproven ,e"ts against the real propert:t in said District ; provided, however, that any owner who shall pay the full assessment within said period of thirty days, shall be entitled to an allowance of five percent (5 o/c) of the amount so assessed aealnst his prope rty and paid by him. In the event any owner of r eal e!llate shall fall to pay the whole of such aasessment against h ls property within sald thirty days, then the whole cost of the Improve- ments so assessed aeainst his property shall be payable In ten equal annual Installments of principal . The Interest rate on the unpaid installments of u- sessments will be established by ordinance to be adopted by the City Council at a later date . The first of said intltaliments of prin- cipal and Interest shaH be due and payable at such time as may be determined ln and by the as- sessment ordinance, and the re- mainder of the annual install- ments o f principal and interes t shall be due and paya ble s u c- cessive ly on the same day in each year thereaftter until all are paid In full . 5. At the time the petition circulated, my wife and I signed this petit i on in favor of the paving . I reques t tha t both my wife s and my name be de l eted from th a t petition . We have recently signed a petition a ga inst t he paving of the a lley d ue primarily to the cost which is approxi mately $9DD.OO, and from discuss ing this with several neighbors who are either re tired or under financial hard ship , found this added cost would c reate even add it ional hardships for them.
