AN ORDINANCE APPROVING THE WHOLE COST OF THE IMPROVE-
MENTS MADE IN AND FOR SIDEWALK IMPROVEMENT DISTRICT
NO. 70 IN THE CITY OF ENGLEWOOD, COLORADO; APPROVING
AND CONFIRMING THE APPORTIONMENT OF SAID COST TO EACH
LOT OR TRACT OF LAND IN SAID DISTRICT; ASSESSING A SHARE
OF SAID COST AGAINST EACH LOT OR TRACT OF LAND IN THE
DISTRICT; AND PRESCRIBING THE MANNER OF COLLECTION AND
PAYMENT OF SAID ASSESSMENTS.
WHEREAS, the City Council of the City of Englewood,
Colorado, pursuant to the Charter and Ordinance No. 14,
Series of 1965, of said City and the Laws of the State
of Colorado, enacted Ordinance No. 30, Series of 1970,
creating Sidewalk Improvement District No. 70, and pro-
viding for the construction therein of sidewalk improve-
ments; and
WHEREAS, the City Manager and Director of Finance
advertised for bids to construct such improvements in
three (3) consecutive weekly issues of the ENGLEWOOD
HERALD; and
WHEREAS, on September 8, 1970, the City Council of
the City of Englewood, Colorado, accepted the bid of
J & N Concrete in the amount of $5,278.65 as the lowest
and best bid and authorized the Mayor and City Clerk to
execute contract documents; and
WHEREAS, the construction of such improvements has
been completed and the total costs of such improvements
have been reliably ascertained; and
WHEREAS, a statement showing the total cost of the
improvements has been duly filed with the City Council;
and
WHEREAS, from the statement made and filed with the
City Council, it appears that the whole cost of said im-
provements is the sum of $10,312.41, said amount including
costs of inspection, collection and other incidentals and
also including interest as allowed by law; and
WHEREAS, from said statement it also appears that
the City Council has apportioned a share of the said
whole cost to each lot or tract of land in said District,
in accordance with the benefits to be derived by said
property and in the proportions and amounts severally
set forth in a Resolution adopted by the City Council on
the 1st day of February, 1971, which Resolution is by
referenc e made a part hereof; and

WHEREAS, Notice of a public hearing concerning the
levying of assessments on the real property in the Dis-
trict and upon this ordinance has been published once
a week for three (3) weeks in the ENGLEWOOD HERALD, a
newspaper of general circulation in the City, and, in
addition, a copy of the Notice has been mailed, postage
prepaid, to each known owner of real property within the
District, which Notice is by reference made a part hereof;
and
WHEREAS, at the time and place specified in said
Notice , the City Council met in open session for the
purpose of hearing any objections or protests that might
be made against said assessments; and
WHEREAS, all objections and complaints having been
duly heard and considered, the Council has determined
that such objections should be denied except as this
Ordinance has accepted them and incorporated herein
changes in said assessments based upon said objections;
and
WHEREAS, on the 15th day of March, 1971, a Bill
for an Ordinance Approving The Whole Cost Of The Im-
provements Made In And For Sidewalk Improvement District
No. 70, In The City Of Englewood, Colorado; Approving
And Confirming The Apportionment Of Said Cost To Each
Lot Or Tract Of Land In Said Dist ict ; c:.Ssessing A
Share Of Said Cost Against Each Lot Or Tract Of Land
In The District; And Prescribing The Manner of Collec-
tion And Payment Of Said Assessments, was introduced
and was passed on first reading.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ENGLEWOOD, COLORADO, as follows:
Section 1. That the whole cost and apportionment
of the same, as set forth in said Resolution and Notice
and as amended herein, is hereby approved and confirmed,
and said apportionment is hereby declared to be in accor-
dance with the benefits which the property in said Dis-
trict will receive by reason of the construction of said
improvements; and a share of said cost is hereby assessed
to and upon each lot or tract of land within the District
i n the proportions and amounts set forth in said Resolu-
t ion and Notice .
Section 2. That of the whole cost of $10,312.41,
the City of Englewood will pay $4,091.81, leaving a
balance of $6,220.56 to be assessed against the real
prope rty in s aid District, in accordance with Resolution
No. 9, Series of 1971.

pay able at the office of the Director of Finance, without

demand, within thirty days from and after the final pub-
lication of this Ordinance. In case any owner of real
property assessed under this Ordinance shall fail to pay
the whole of such assessment against his property within
said thirty days, then, the pro rata cost of said im-
provements so assessed against his property, together
with interest at the rate of 6-1/2 per cent per annum
on any unpaid balance, shall be payable in five equal
annual installments, the first of which installments
of principal and interest shall be due and payable on
or before January 1, 1972, and the remainder of said in-
stallments shall be due and payable successively on or
before the 1st day of January, in each year thereafter,
until said principal and interest are paid in full.
Failure to pay any installment, whether of principal or
interest, when due shall cause the whole of the unpaid
principal to become due and payable immediately, and
the whole amount of the unpaid principal and accrued
interest shall thereafter draw interest at the rate of
one per centum (1%) per month, or fraction of a month,
until the date of tax sale, as by law provided, but at
any time prior to the date of the sale, any owner may
pay the amount of all unpaid installments with interest
at one per centum (1%) per month, or fraction of a month,
upon all delinquent installments, and all penalties accrued,
and shall thereupon be restored to the right thereafter
to pay in installments in the same manner as if default
had not been suffered. The owner of any property not in
default as to any installment or payment may, at any
time, pay the whole of the unpaid principal with accrued
interest to the date of the next assessment installment
payment date. Payments may be made to the Director of
Finance at any time within thirty days after the final
publication of this Ordinance. Immediately after the
expiration of such thirty day period, said assessments
shall be certified to the County Treasurer of Arapahoe
County, Colorado, for collection, as provided by law.
Section 4. That if any one or more sections or
parts of this Ordinance shall be adjudged unenforceable
or invalid, such judgment shall not affect, impair or
invalidate the remaining provisions of this Ordinance,
it being the intention that the various provisions hereof
are severable.
Section 5. This Ordinance, after its final passage,
shall be recorded in the City Ordinance Book kept for
that purpose, shall be authenticated by the signatures
of the Mayor and City Clerk, and shall be published in
the ENGLEWOOD HERALD, a newspaper of general circulation
published in said City, within seven days after its final
passage, and shall be and remain irrepealable until the
assessments hereby made shall be paid in full.

AN ORDINANCE TO CONTRACT -AN INDEBTEDNESS ON BEHALF
OF THE CITY OF ENGL~OD, COLORADO, AND UPON THE
CREDIT THEREOF BY ISSUING GENERAL OBLIGATION WATER
IMPROVEMENT BONDS OF SAID CITY IN 111E PRINCIPAL
AMOUNT OF $2,200,000, POR THE PURPOSE OF PROVIDING
FUNDS WITH WHICH TO EXTEND AND IMPROVE THE MUNI-
CIPAL WATER SYSTEM OF SAID CITY; PRESCRIBING THE
FORM OF SAID BONDS AND PROVIDING FOR THE LEVY OF
TAXES TO PAY THE BONDS AND THE INTEREST THEREON.
WHEREAS, a majority of the taxpaying electors of the
City of Englewood, Colorado, voting on the question at an
election heretofore held in said City, by their vote approved
and authorized the City Council of said City to erect a sys-
tem of waterworka for fire and domestic purposes, the same to
be owned and operated by the City; and
WHEREAS, the City did erect and ever since said time
baa owned, operated and -1ntained a system of waterworks for
said purpose; ADd
WHEREAS, it is necessary to extend and improve the•·
water system in order to supply the City and the inhabitants
thereof with a proper and adequate .upply of water; and
WHEREAS, bonds in the amount of $2,200,000, after public
Notice of S&le, have been sold and awarded to Continental Illi-
nois National Bank and Trust Company of Chicago and A81ociatea,
the hi&ha•t and beat bidder for cash at not leas than par and
' accrued interest, said sale being in all respects by these pro-
ceeding• hereby ratified and approved;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO:
Section 1. That for the purpose of providing funds with
which to extend and improve the municipal water system of the
City of Englewood, in order to supply the City and its inhabitants

with a proper and adequate supply of water, the City shall issue
its general obligation negotiable coupon bonds in the principal
amount of $2,200,000, each to be' designated "General Obligation
Water I mprovement Bond, Series 1-971". The bonds shall be dated
April 1, 1971, shall consist of 440 bonds in the denomination of
$5,000 each, numbered 1 to 440, incluaive, shall bear interest
payable on April 1, 1972, and semi-annually thereafter on the
let day of April and the 1st day of October each year, as evi-
denced by interest coupons attached to said bonds, and shall
mature serially on April 1, as follows:

of Redemption by first class United States mail, postage prepaid,
to the original purchaser, or its successor. The Notice shall
specify the place and date of redemption, the amount and numbers
of the bonds called and that from and after such date, interest
on all bonds called for redemption shall cease.
Said bonds and the interest coupons attached thereto
shall be payable in lawful money of the United States of America,
at the First National Bank of Englewood, Englewood, Colorado, or
at the Continental Illinois National Bank and Trust Company ~f
Chicago, Chicago, Illinois, at the option of the holder.
The bonds shall be signed with the facsimile signature
of the Mayor of the City, with a facsimile of the seal of the
City affixed thereto, and attested and countersigned by the
.. aual signature of the Director of Finance, ax-officio City
Clerk-Treasurer of the City. The interest coupons attached to
said bonds shall baar the facstmile signature of the Director of
Finance, and when issued as aforesaid as part of said bonds, shall
be the binding obligations of the City according to their import.
Should any officer whose manual or facsimile signature appears
on said bonds or the interest coupons attached thereto caase to
be such officer before delivery of the bonds to the purchaser,
such .anual er facsimile signature shall nevertheless be valid
and sufficient for all purposes.
Section 2. That the bonds and the interest' coupons
attached thereto shall be in substantially the following form:

This Bond is issued by the City Council of the City of
Englewood, Colorado, for the purpose of proviru.ng funds with
which to extend and improve the municipal water system of the
City, in order to supply the City and its inhabitants with a
proper and adequate supply of water, under the authority of and
in full conformity with the Constitution and Laws of the State of
Colorado, the Charter of said City, and ~1rsuant to an Ordinance
duly adopted, published and made a law of said City prior to
the issuance of this Bond.
It is hereby certified and recited that all the require-
ments of law have been duly complied with by the proper offi-
cers of the City in the issuance of this Bond; that the total
debt of the City, including that of this Bond, does not exceed
any limit of indebtedness prescribed by the Constitution or Law.

provision has been lllllde for the levy and collection of an annual
tax on all the taxable property in the City sufficient to pay the

Section 3. When said bonds have been du ly executed, the
Director of Fir~nce is hereby directed to deliver the bonds to
the purchaser thereof on receipt ·of the agreed purchase price
therefor. The proceeds of the b~nda shall be used only for the
purpose of extending and improving the municipal water system of
said CitY and for paying the costs and expenses incurred inci-
dental to the issuance of bonds and for no other purpose whatever.
Neither the purchaser of said bonds nor the subsequent holder of
any of them shall be responsible for the application or disposal
by the City, or any of ita officers, of any of the funds derived
from the sale thereof.
Section 4. For the purpose of paying the interest ac-
cruing on said Bonds promptly as the same thereafter becomes due
and providing for the ultimate payment and redemption of said
bonds, there shall be levied upon all of the taxable property
in the City, in addition to all other taxes, direct annual taxes
in eaeh of the years 1971 to 1985, inclusive, sufficient to pay
the interest on and principal of the bonds as the same become
due and payable, respectively.
Section 5. Said taxes, when collected, shall be deposited
in a special fund to be known as "City of Englewood, General
Obligation Water Improv .... nt Bond Fund, 1971", and the proceeds
deriv.d from said taxes shall be applied only to the payment of
necessary costa and expenees of operating and maintaining the
water system and to the payment of the interest and principal of
the Water Improvement Bonds authorized herein, and for no other
purpose Whatsoever, until the indebtedness so contracted pursuant
to this Ordinance, both principal and interest, shall have been
fully paid, satisfied and discharged. Nothing herein contained

shall be so construed as to prevent the City from applying any
other funds or revenues that may be in the City treasury and
available for that purpose to the payment of said interest and
principal, as the same respectiv~ly accrue or mature, and upon
such payment, the levy or levies herein provided may thereupon
to that extent b e diminished.
Section 6. The sums herein provided to pay the inter-
est on said bonds, and to discharge the principal thereof when
due, are hereby appropriated for that purpose, and said amounts
for each year shall also be included in the annual budget and
appropriation Ordinance and bills to be adopted and passed by the
City Council of aaid City in each year, respectively, until said
Bonds have been fully paid, satisfied and discharged.
Section 7. Notwithstanding the foregoing provisions for
tax levies, the City hereby further covenants and agre .. to
establish, maintain, collect and enforce a schedule of rates,
fees, tolls and charges for connection to and use of the water
system of the City, which schedule shall be sufficient to assure
that the revenue thereby produced,' together with any other funds
which may be lawfully available, and the proceeds of general ad
valorem taxes, shall pay all reasonable costs and expenses of
operating and maintaining the water system and to pay the interest
and principal of tba General Obligation Water l~rovement Bonds,
herein authorized, promptly as the same become due .and payable,
respectively.
Section 8. It shall be the duty of the City Council of
said City, annually, at the time and in the manner provided by
law for levying other City taxes, if such action shall be neces-
sary to effectuate the provisions of this Ordinance, to ratify

and carry out the provisions hereof with reference to the
levying and collection of taxes; and the City shall levy,
cert ify and col l ect such taxes in the manner provided by law
for the purpose of creating a fund for the payment of the costs
and expenses of operating and maintaining the water system, and
the payment of the principal of the bonds and interest thereon,
and such taxes when collected shall be kept for and applied only
for such purpose, as hereinabove specified.
Section 9. That if any one or more sections or parts
of this Ordinance shall be adjudged unenforceable or invalid,
such judgment shall not affect, impair or invalidate the remain-
ing provisions of this Ordinance, it being the intention that
the various provisions hereof are severable.
Section 10. All ordinances or parts thereof in conflict
with this Ordinance are hereby repealed.
Section 11. After said bonds are issued, this Ordinance
shall be and remain irrepealable until said bonds and the in-
terest thereon shall have been fully paid, satisfied and dis-
charged.
Section 12. This Ordinance, immediately on its final
passage, shall be recorded in the Book of Ordinances kept for
that purpose, authenticated by the signatures of the Mayor and
Director of Finance, ex-officio City Clerk, and shall be pub-
lished as required by law.
Section 13. This Ordinance shall take effect thirty (30)
days after publication following final passage.

This memorandum will serve to remind you of the assessment hearing
regarding Paving District No. 19 which is scheduled for 8:00 p.m. on
Monday night.
(Attached you wlll find a copy of the official notice call for the meeting,
and of protest letters which have been received to date.)
In addition, you will find enclosed a memorandum regarding the reve-
nue sharing proposal.
Please mark your calendars for a luncheon meeting on Tuesday,
March 30th, the location of which you wtll be advised of later by a letter
from Mr. Shelby Harper of Security Life. The member of Counctl,
City Manager and City Attorney, Chairman of the Planning Commission
and Planning Director are being invited to meet with a number of Security
Life officials and other people regarding a possible sale of the KLZ site
property.
If your schedule will permit, we might wish to have a study meeting on
March 29th regarding several Items. Since our schedule calls for
setting the assessments on Paving District No. 19 on April 5th, we could
review on the 29th the information you receive on aasessments. In
addition, we have been working with Mr. Clyde Cantrell of Key Savings
and Loan on a project by which their nrm will buy a sizeable quantity of
refuse receptacles for our business areas, and we would like to visit
with you about this informally. Lastly, we wtll need to have an extensive
review of the present situation on the animal shelter. The bids were
opened y esterday, and vastly exceeded the estimate even with ten good
bidde rs. I will give you a copy of the bids Monday evening. In the mean-
time , the architect is exploring several other alternates regarding
which we will make an extensive report on the 29th, or subsequently.

In 1965 we obtained a permit from t he city of Ebglewood
to repla ce our fr o nt sidewalk, curb a nd gutter. This work wa s
performed by a qualified contractor. We receiYed an excellent
job with high quL'li t y wor kma nahip.
We were t ol d this curb and gutter would ramain intact
and juat th o two f uo t sidewalk r emoved, and we would b e charged f or
th e c dditi onal l wo feet o f walk only. Much to our surprise
and "anger this 6 i nch thick curb, gutter and walk wo e turned upside
d own t o be replace d by c oncrete 3 to 5i inches thick of inferior
qu a lity and workm b ns hi p. This winter so•e or the aeams opened
u r to t inch wide.

correct .
We r~alize that there are many people that are caught in the
strugrle of incoae versus expenses and this ls one of the
rea so n. why a pavtnc district is eet up in su c h a way that the
property owner can pay for it over a period of ten (10) years .
If you wish to spread the assessment over t h e ten year period ,
then . beglnninr •ith January , 1972 you would receive a bill
froa Arapahoe Count y Treasurer for one-tenth ot the asseeaaent
($43 .75). Ea c h year thereafter you would receive a bill f or
$43.75 plus 6 .&1 interest on the unpaid balance.
As you can see the yearly pa,.eat on the princip le amount s
to less than $4 per aonth savinas. I hope that this will help
on t he flnaacinr.

on t h e North side of lot f orty eight (4 8 )--Lehigh St. -ere we charged
for this?
I measured twenty eight (28) lineal teet of curb and gutter not re-
moved on the east sides of lots forty seven (4?) Mnd forty eight (48)--
Gr&nt street. Were we charged tor this?
Since we are to pay only two-sevenths (2/?•s) of the oost of Lehigh
s treet--the North side of lot forty eight (48)1 why should our bill be
almost ~50 0.00 more than our neig hbors to the south of us?
I am requesting that the actual cost breakdown tor Lehigh street--the
n orth side or lot forty eight (48), &nd Grant street--the east sides of
lots forty seven (4?) and forty e i ght (48) be made available, along with
the other c oats shared by our neighbors of the one-halt ti) blook of
Leh i gh mentioned e8ove.
