Paving Distri ct No. 20. he noted. -ou1d have $385.000 o f the c o sts
paid by the pro per y o wners benefiting from the ~pr o ve~ents whi1e the C1ty
-ou1d pay $108 .000. The City •s share is to cover such items as intersection
paving. ditch crossings . etc.
The City Manager Lndicated that bids f o r construct1o n are advert1sed
and that a contract 1s 1et t o the 1owest and best b1dder. In addition to the
contract cost ~ other expenses , Lnc1uding engineer1ng assessment c o mputat1o n and
interest during c o ns~ruc i on, are ~c1ude.d in th cos~ of the d1strict . He
further exp1aLned that tho s perso ns paying part or a11 of their assessments
o n o r befo re May 22 . 1972 . wou1d rece1ve a S percc ~ d.i.sco unt . Perso ns choos Lng
to d o so c o u1d pay the.i.r assessments over a ten -year period at an Lnterest rate
of 5 percent . At any rate . the first payment due on January 1~ 1973 , docs not

1-nch thicknesses on stree s designated as arter1a1 w.i.thin residentia1 zoning
as of January 4~ 1971 . -ere to be paid by the City. Most of the assessments
1n the d1stricts w ere of a front -foot nature and cost $7.51 per fro nt foot .
He exp1a1ned that the bids came in higher than expected. Hence, it
-as possilo1e that some owners received assessment higher than they had
or.i.gina1~y expected . Excavatio n costs in part1cu1ar , he noted, w ere c ons1derabl.y
higher than anticipated.

M%~ Gary Patterson. Attorney at Law. appeared on behalf of Caro line B~
Weist . 835 East Cornell. Mr . Patterso n stated that Sectio n 12-1 -8 o £ the
Englewood Municipal Code specifica11y stated that an o wner must receive a
benefit to his property fro m an Lmpro vement befo re he can be assessed f o r said
Lmprovement. This was not the case he £e1t with the Lmpro vement assessed to
the pro perty at 835 East C o rne11 .
He referred t o a letter dated March 2 , 1972 , addressed to the City
Clerk and written by John A . Criswe11 , Atto%ney at Law . Mr . Criswe11 "s letter
referred t o a c ourt case instituted by the City before the D~strict C ourt
against Caro line B. Weist and Paul Wolf . Civil Actio n No. 29255 . Xn this case
the City had c ondemned 10 feet of pro perty for roadway purposes and it was the
c o ntention of the defendants that they sho uld be compensated f or a11eged accrued
benefits n ow deprived thom by l o ss of their property.
City Attorney Berardini recalled the case and stated that the matter
o f benef1ts wa s n o t at issue. He recalled that in arguing the case he had
maintained that (1) because right -of--ay o nly had been requi...red and the City
had n o t ~proved said right-of -way. no benefits c ould be assigned t o the
abutting property. and (2) that the re.aaa.ini.ng pro perty while i...n th then
proposed paving district had n o t yet been Lmpro ved; therefore. the quest1on
o f benefit accruing t o the abutting pro perty ~as m oot -
Mr . Berardini cited Mr. Criswe11 "s letter o f March 2 , espec1a11y
paragraph 2. which stated in part:
The proposed assessment is n o t based upon the benefits
accruing fro m the improvements to the property involved and.
indeed. it is the undersigned •s understanding that ne~ther
the administrative staff of the City. nor City Council, has.
or w i11 . take any e vidence o r info rmatio n upon the increased
value o f th~s realty resulting from the c o nstructio n of the
~pr o vements involved .
Mr. Berardini inquired o f Mr . Patterson if he, Mr. Cris-e11 , o r their
client had submitted t o C ounci1 any evidence which the Council had refused t o
hear~ Mr . Patterson indicated that no evidence had been presented.
Mr . Berardini asked ..i.f he (Mr . Patterson) c o uld show an Lncrease in
the value o f the pro perty . Hr. Patterso n said h e did n o t understand. Mr~
Bcrardini referred again to the letter saying that it was his interpret ~t1 o n
that Mr. Criswe11 was Lmp1ying that the Co~nci1 re£used t o bear any evidence
as t o whether o r n o t the value o f the pro perty in ques t i on had been affected by
the ~pr o vement . Mr. Patterson said that he (Mr . Crisw e11) o n1y meant t o Lmp1y
that the City•s method o f assessing pro perty owners in the district w as based
upon a mathematical f o rmula and n o t benefit . He did n o t mean to Lmp1y that the
Council was unwilling to hear testLmony relating t o the property value •

ru1ed that the Ci y was not requ~red to show wh thcr there was any va1ue. He
said that th CJ..ty had the opt1on of presentung v1denc of an increase in the
va1uc of the property as a resu1t of ~he improv m~nts but ha i chose no

property. i.n the a~ount of $1253.25 for street i.mprovements in the 400 block
of West Cornell Avenue. Lots 23 and 24. Block 3 . s. G. Hamli.ns Addi.tion.
If you w~ll check your fi.les. you w~ll fi.nd we aubmi.tted a letter of protest
on th~s ~mprovement at the t~me ~t was begun. Acknowledgement of th~•
1etter was never rece~ved. In that letter deta~1• of my parents bea1tb
and f~nanc~al cond~t~on were fu1ly expla~ned. Aa a rem~nder of the~r a~tua
t~on. my father ~s 84 years old. He has been con£~ned to hoap~ta1a and
nura~ng homes for the past three years. the expenae of wh~cb has been borne
mostly by my mother -med~care and its benef~ta havLng fallen by the waya~de
many months ago. Mother is 82 yeara old. She ~-very feeble phya~cally and
mentally and ~-dependent upon the fam~ly for her every need. Between them.
they receLve only $109.00 a month social secur~ty and a a.al1 payment. to-
gether w~cb interest. from the sale of their farm in Arapahoe County several
years ago.
At the present t~me. it ~-coat~ng more than $500.00 a •onth for my father's
care in the nursing home. Lncluding druga and doctor fees. To be forced to
pay this exceas~ve amount for street i•prove.ent -hicb they didn•t wane in
the first pLace. as indicated in our letter of proteac. appears to be very
unfair. unjust and undemocratic. After al l. aren•c we auppoaed to be 1~ving
~n a free soc~ety where we should be able to d~ctate our own wishes and
control financ~al matters such as this where life-long sav~ngs are being so
rapidly depleted ?
We specifically protest the instalLation of the apron from the •treet onto
the property. This. -e are sure cost a considerable amount a~one and we feel

letter was never received. In that letter details of my parents health
and financial condition were fully explained. As a r~minder of their situa-
tion. my father is 84 years old. Be has been confined to hospitals and
nuraing homes for the past three years. the expense of which has been borne
mostly by my mother -medicare and its benefits having fallen by the wayside
mAny months ago. Mother is 82 years old. She is very feeble physically and

1etter vas never received. In that letter details of my parents health
and £inanc~a1 condition were fu11y expla~ned. As a rem~nder or the~r sicua-
t~on. ~ father ~s 84 years old. He baa been confined to hospitals and
nursing homes for the past three years. the expense of which has been borne
.ostly by ~ mother -~edicare and ita benefits having fallen by the vayside
.-ny months ago. Mother is 82 years old. She is very feeble physically and
~neally and ia dependent upon the fam~ly for her every need. Becween them.
they rece~ve only $109 .00 a ~onth social security and a small payment. to-
gether with ~nterest. from the sale of their farm in Arapahoe County aeveral
years ago.
At the present time. it ia costing more than $500.00 a month for my father's
eare in the nursing home. including drugs and doctor fees. To be forced to
pay this excessive amount for street i~provement which they didn't -ant in
the first pLace. as indicated in our letter of protest. appears to be very
un£air. un j ust and undemocratic. After all. aren't ve supposed to be liv i ng
in a free aociety where ve should be able co diceate our own ~shea and

Your emp1oyees made the decision that approxLmatel.y ~enty (20) feet
of si..dewal.k. curb and gutter needed rep1aci..ng due to a "l.aw" spot on
Decatur Street which was cl.aimed to prevent proper drainage. That portion
-as removed. New concrete was po~red between ~y 29, 1971 and June 6, 1971.
I do not have record of the specific day. It raLned during the night and
earl.y the £o11owi..ng morning I took a col.ored picture o£ the 1arge pudd1e
of water in the m~dd1e of the new concrete gutter. That water made a per-
fect mirror of the ye11ow and b1ack barricade sign and a1so my redwood
fence and chain 1ink fence. This picture provides me with the approxLmate
1ength of that new and imperfect concrete gutter.
Your emp1oyees arrived soon after I took said picture to inspect the
concrete poured the previous day. I expressed my disp1easure over the
qua1ity of the work done. The drainage situation was worse than before.
I was assured that it wou1d be rep1aced. or if not rep1aced. I wou1d not
be required to pay for i..t. At a 1ater date a ubac.k hoe digger., was u sed
to pu11 up and remove the new si..dewa.1k. curb and gutter. When doing th..i..s.
the machine operator misjudged what he was doing and in error pu11ed up
sidewa1k and etc. wh..i..ch was not to be rep1aced.
These actions required the rep1aci..ng of approxLmate1y forty (40) feet
of sidewa1k. curb and gutter. Thus. I have been assessed for approximate1y
cwenty (20) feet of sidewa1k and etc. which was your (the City of Eng1ewood)
