City Manager D~al.. gave a presentation covering the major
portions of the pertinent information concerning PavLnq D1strict
&o. 21-He reviewed the creation of the d1strict~ the size of the
district. fLna1 assessment procedures and methods of payment on tax
stat4!!!1De.n.t.s fro1n Arapah.oe county. He stated that the City of Eng1e-
wood in 1972 a~arded a contract to the 1ow bidder for construction
in P aving District Ho. 21. Besides construction costs~ other costs
inc1ude engineering~ administrative overhead and interest during the
c onstruction period _ He exp1ained that the City of Eng1ewood bore
some of the cost in areas in ~hich ~arger streets were constructed-
The 1and owners bore the cost only to the degree necessary for a
street in a residential-zoned area_ He stated that any individuals
paying their assess~t by Hay 21 1 1973~ ~o u1d be a11o~ed a 5% dis-
count on their bi11. X£. ho~ever~ they chose to finance the i~prove
ment over a ten-year period~ they would be charged a rate of 5% per
year as billed by the County Treasurer on a year1y property tax
statement_ The fizst statement on January 1 1 1974 would bear no
interest after which tLma interest ~u1d begin to app1y_ If the
asaess::JDel1t Wllltre not paid in a t.i.me1y fashion. the t.ota1. am.ount of
the bi11 became immediately due and co11ectLb1e under the county •s
norma1 co11ect1on ~ethod.

estab1iament of Paving District NO-21; not~ee to the property
owners had been given and pub1ic hearings had been he1d.

Mr. Dona1d Arthur~ 3853 S . Broadway, questioned ~y the
City paved a ded-end a11ey, creating an assessment on his property.
Director of Pub1ic Works waggoner stated that the a11ey ~as not a
ded-end a11ey but rather empt1ed out in an L-shaped fashion.
Mr_ M -A. Ke1th Questioned ho~ property cou1d have assess-
m ents ca1cu1ated against it ~en no ~provements had been made to
the property . Director of Pub1ic Works Waggoner stated that a Lot
on a fronta1 street ~as assessed at a higher basis. However, 1ots
1ocated ~1tbin a certain distance of any paved street, were e1igLb1e
for assessment a1so-Mr. M . A. Ke1th questioned why the peop1e 1n
the pav1ng distrct were not notified pr1or to its estab1ishment.
C1ty ~anager Dia1 stated that a pub1ic bearing was he1d 1ast year
prev1ous to the estab1is~ent of the dLatr1ct and that 1ega1 notices
were pub11shed in the paper. AdditLona11y, notices ~ere ma11ed to
the o'-'Oe.r on record at the county of each property ..

quest1o~ed Mr. waggoner of the tota1 cost of the contract and 1ts
subsequent breakdo~ for adm1n1strative ovexhead coats. Director
of Pub1Lc works waggoner stated that the contract cost was ~253,068
onto which an additiona1 29% had been added for the other factors
to come up ~ith the tota1 cost.

Mr. M. A. Kieth, 3070 So. Wyandot -appeared before Counci1
concerning the assess~ent. He stated that the street which he ~as
being assessed for had no businesses bordering the street. The Street
was one and a ha1£ b~ocks a~ay from his business. When he app~ied for
a bui1ding permit at origina~ construction of his business~ he had to
donate a 3o• right-of-way for a street to be put in in the future. He
questioned that the need to pave this street at this time. City
Manager Dia1 stated the City has had a program to try to get a11 the
streets in the City paved and that this one was chosen for the current
paving district year.

Mr. Duane Pomrening~ 2100 West Corne11 appeared before
Counci1 in connection with the assessment. He stated that since the
ne~ street has gone in, it bas created much water and mud prob1ema
for his home. Due to the e1evation of the street in re1ation to his
ho~e~ he expects a basement fu11 of water at the next rainstorm.

Counci1 meeting. He stated that in 1.946, the Schmi..a~·s had bought
this 1and on the assumption that 61. ft. of i..t existed a1.ong West
Harvard. The City had said that the Schmidt"& 6hyY owned 55 ft.
of the 1.and, ho~eveE, they have ca1.cu1ated based on 61 ft.
Director of Pub1i.c Works Waggoner stated that the ca1cu1.ati..ons
~re ~ade on a 55 ft. basis even though the 1ega1 description i.n
the paper reads 61. ft. as it does a t the Arapahoe county courthouse.
Mr. Criswe1.1. stated that there ~as not $4,600 worth of increase i.n
v a1.ue to the property at that 1oca tion . He fe1.t that there were

CounciL wouLd have that information avaiLabLe in a maiLed response.
City Attorney Berardini stated that there wouLd be another
pUbLic hearing after the introduction o£ the BiLL for an Ordinance
assessing the money. These protests wi11 become a part of that record
for that hearing.

Counci1man Brown stated that he appreciated the peop1e
comi..ng to the pub1ic hearing and assured them that the Council..
wou1d study the questions on their property and make amends if
necessary_

A question from the audience inquired as to how the gas tax
in the City is used. City Manager Dia1 stated that the State gives a
1itt1e over $200,000 to the City each year from the highway users tax
fund. Current1y. the expenses o£ the Ptib1ic Works function are over
$500,000.
CounciLman Schnackenberg stated that in the past he a1so had
been assessed for paving district... The City needed good paved streets
for its deve1opment... He fe1t that the individua1s invo1ved wou1d get
the cost back out of their property when ao1d ...

Eng1ewood Munici~ Code specifica11y stated that an owner ~ust receive a
be.ne..f.i.t to h.i.s property frOID an .i..mprovement before he can be assessed for said
i.m.provement. Thi.s was not the case he fe1t wi.th the :improvement assessed to
the property at 835 East Corne11.
He referred to a 1etter dated March 2, 1972, add.ressed to the Ci.ty
C1erk and written by John A. Cr~swe11, Attorney at Law. Mr. Criswe11•s 1etter
referred to a court case ~stituted by the City be£ore the District Court
against C&ro1.i.ne B. Weist and Pau1 Wo1f, Civi1 Action No. 29255. 1n this case
the City had condemned 10 feet of property for roadway purposes and it was the
contention o£ the defendants that they shou1d be compensated for &11eged accrued
~its now deprived them by 1osa o£ their property.
City Attorney BerardLni. reca11ed the case and stated that the matter
o:r bene..fita was not at issue. He reca11ed that :Ln. arguing the case he hAd.
..ai.ntai.ned that (1) because right-of-way on1y had been requ..i...red and the C.i..ty
