I,-A PETITION BY THE LAND OWNERS AND RESIDENTS LIVING IN THE INCORPORATED AR£A SOUGHT TO BE ANNEXED BY THE CITY OF ENGLEWOOD WHICH LIES WEST OF SOUTH SANTA FE DRIVE We, the undersigned owners and residents of the area proposed to be annexed by the City of Eng1ewood, which 1ies west o~ Santa Fe Drive, protest the proposed u.n.i.l...ate.ra.1 annexation on t..lle fol...l..owi.ng grounds: 1. That the annexation does not carry out the intent and purposes of 63 C.R ... S. 1..39 21...-2 <a• aaended) in view of the fac:"t that there are no aun.i.c:..ipal.. services furnished by the City of Engl..ewood to this area. 2 ... Further, there ca.n.not be in a. raea.aon.ab~e l..ength of t~ watar or sewer services furnished to this -·-3. Tbe --.jority of the area is not "u.rba.n.J..z.ed," but ia, in fact, an area which carries on -Lning which ia not an urban activity, and a.l..ao a&1vage ya..rd.a wh.ich is not an urban activity. As a .atter of fact, both activities are apecific~1y exc1uded ae a uae by right in the Eng1ewood zoning ordLft&nces preaentl..y in affect. ae... The onl..y purpose that Engl..ewood. c:ou..1d. have in deai.r:!...ng -to annex the area. is -to ga.i..n con'tr-01 of a tax base which they fee~ wou~d --ne.f:i.cd.a~ to the peop~e ~dy :i.n the c::i. ty and a detr:L.ent to the peop~e being ......-xed. That in vi.e.,. of the f&c:t that the -jor:i.ty of the activitie• being conducted and the .. jority of the l..and which i.s sought -to be a.n.nexed conducts ac:tivit.iea which are '"'non-conforming uses" under the City of En.g1ewoocl• s zon.i..ng ordinance, the property OWI'Mtra wil..l.. be deprived of their property w~~hout due proce•• of 1aw. It ia obvious that after annexation the non-oon1oraing aiDing uaea and the aal..vage yard uaea which wi11 then be~ non-oonforaing wi11 materia11y reduce the property va1uea of those property oloJDers. • • ]- • 6. That the water and sewer services on the west side of Santa Fe Drive are a1most entire1y we11 water and septic systems which are owner maintained. The area is a.:Lmost enti:re1y composed of 1arge tracts of 1and which are not sub- divided, and said tracts wi11 not be subdiv~ded into resi- dentia1 or other urban activities in the near future. 7. There is no community of i..nte..:reat of the activities being conducted on the vast majority of the 1a..nd which is to be annexed and that of the City of Eng1ewood who opposes the type of activities and does not ~1ow that type of activities within the City of Eng1ewood. 8-That the vast majority of the area is not capa.b1e of be.i..ng i..ntegra.ted with the City of Eng1ewood, and the services provided to other c.i"t:i..zens wi.11 not be provided wi"th basic water and sewer services that are provided to the rest of the m .u.n.icipa1.ity. This is true even though the property owners of the annexed area. ~11 necesaari1y have to •-•aUDile a. portion of the Three M.i11ion Do11a.rs C$3,000,000.00) in outstanding w:ate.r ob1iga.tions. We request the City Counc~ of the City of Eng1ewood to serious1y consider the purpose of the annexa- tion 1a..ws., the desires of th.e res.1de.n.ta of the proposed annexed a.rea west of S.anta. Fe who oppose the .a.nne.xati..on, and to give those ::rea~denta a fair and ~parti&1 hearing as opposed to -.king an arbitrary and capricious decision to annex no -.a:tte.r wba:t the 'Wishes of the prope.rty owners and without consideration of the h&r• that wi11 be done to them as a. :resu1t of this L~~ advised annexation. It is further the position of the undersigned members that this Cou.nci.1 is, :Ln fact, not gra..nti...ng a fair and i.apa..rti.a1 bearing,. and have, in fact, -.ade. up their a.inda that they intend to annex tbe area. west of Santa Fe without any consideration as to the 1ega1 :requi~ts of the statute or the consti.tutionA1 rights of the persons owning the .l.and which is to be annexed. A conference was he1d by a 2 - II • • - - • committee of the protesti~g parties with the Mayor, City Manager, P1anning Director of the City of Eng1ewood in regard to attempting to reso1ve these difficu1ties and to get zoning and use requirements which wou1d not deprive the property owners of the va1ue of their property without due process of ~aw, and after expressing their views, they were notified, by the P.l.an.n..i....ng Director, that the Council.. had,. in fact,. made up its mi.nd to go ahead a.n.d annex, and woul..d not consider cha..n.ge o~ zoning to a1l..ow the uses p ·rese.n.tl..y existing in the area to be conforming uses if they came into the City of Eng1.ewood... The purpose of the Public Hearing is to detel'llline and to find that the terri tory which is proposed to be annexed meets the following requirements : (1) The area which is proposed to be annexed has had more than two-thirds contiguity with the City of Englewood for a period of not less than three years. (2) No land which is held in identical ownership will be divided by the annexation so that a portion of that land is annexed to the City and a portion remains outside of the City. (3) No land held in identical ownership comprises twenty (20) acres or more and has an assessed valuation for ad valorem tax purposes in 1972, in excess of $200,000.00.• (4) Annexation proceedings have not been coiDJIIenced to annex all or a part of this area to a city other than Englewood. (5) The annexation will not cause the area to be detached from its existing school district and cause the area to be attached to another school district . (6) The City Council is not imposing additional terms and conditions on the area which is proptsed to be annexed. ' • ••••• • ••••••••••• DIGEST OF INFORMATION ~ Present Status: The area east of South Santa Fe Drive which is proposed to be annexed is in the Englewood School District and the area to the west of South Santa Fe Drive is in the Sheridan School District, The area which is in the Sheridan School Di strict is also in the Arapahoe Junior College District. Effect of Annexation: The annexation will not effect the school di s tri ct boundaries in any way! Children living within the area will continue to attend the schools they are now attending. Neither will the school mill levy be changed as a result of the an1exa tion, The Arapahoe Junior College has become a State College and is now known as the Arapahoe Community College, Property owners in the Sheridan School District will continue to pay a n011inal levy for this College ---the 1972 levy is .50 mills, ARAPAHOE REGIONAL LIBRARY DISTRICT: Present Status: Unincorporated areas of Arapahoe County and municipalities such as Sheridan which do not provide library nrvice, are in the Arapahoe Regional Library District, Persons living in these areas pay the assessment for this Distr ict and are then entitled to library service from participating municipal libraries, such as Englewood's. The levy for this District is 1.40 11ills. Effect of Annexation: Upon annexation to the City of Englewood, the area will aut01atica1ly be withdrawn fr011 the Arapahoe Regional Library Distric t and the 1.40 1ill levy will be dropped. Residents will have convenient access to our municipal library at the north side of the City Hall at 3400 South Elat! Street. FIRE PROTECTION: Preeent Statusj Part of the area east of South Santa Fe Drive is in the Littleton Fire Protection District and the rnainder of the area is not within any municipal or special Fire Protection District. '., .. . 7 I . . • ~ (N 1\) X ' •••••••••••• irregular boundaries of this area cause much confusion to the firemen called to this area in determining who has jurisdiction, Effect of Annexation: The City would assist those persons in the Littleton Fire Protection District in petitioning to withdraw from that District, Upon withdrawal from the District, the 6,00 mill levy would be dropped, That area, then, as well as the area not now in any fire protection district, would come under the jurisdiction of the Englewood Fire Department, and would be provided fire protection by a well-trained, full- time professional fire department with modern fire-fighting equipment. New fire and police facilities are nearly completed at West Ithica Avenue and South Elati Street AND the City of Englewood has purchased land on the northwest corner of South Federal Boulevard and West Oxford Avenue and will be letting bids on the construction of a three-bay fire station on this land in April of 1973! 'ltlis Engine Company will serve the property in the extreme southwest section of the City of Englewood and will have excellent access to the area being considered in this annexation, In addition, the Fire Station at South Fox Street and West Belleview Avenue will provide protection to the area east of South Santa Fe Drive and could supplement the equipment west of South Santa Fe Drive, were it ever necessary, POLICE PROTECTION: Present Status: This area is presently under the jurisdiction of the Arapahoe County Sheriff's Office. Again, because of the very irregular boundaries, it is often very difficult to determine which agency has jurisdiction in the event of a call. Englewood and Sheridan police "cover" calls to the area but do not exercise their authority in the area, They lend aasistance to the Sheriff's Department only, The levy for the Anpahoe County Law Bnforce1ent Authority is 2,60 mills, Effect of Annexation: Annexation to Englewood will result in intensitied police protection to the area, There is greater police coverage in the City per square mile of area than in the unincorporated area under the Sheriff's jurisdiction, There will be uninhibited acceas fr011 the Englewood Police station at South Elati Street and West Ithica Avenue to this aree----average response time throughout the City is less than four minutes, The Englewood Police Department now has a staff of 65 men and women, dedicated to making our City a safe and pleasant place to live and to do business. -8- II . Effect of Annexation: Englewood is fortunate to have one of the finest recreation prograas in the area and has eleven (ll) parks with llO acres of park land. Three of these parks are near the Santa Fe-Union area : Belleview Park, lo cated at West Belleview and South Inca Street; Jason Park, located at West Quincy Avenue and South Jason Street; and Centennial Park at West Union Avenue and South Decatur Street. All of these parks have picnic facllitles, chlldren's play areas and ball fields. In those areu which do not have water service and in which fire hydrants cannot be installed, there will be s011e savings, but not as auch as there would be were water avaihble.
