I I I : ~ c I ~ I I • I -• I I • I • I • ~· . ; ............... • BACKGROUND, , . , • The Englewood City Council has been concerned for s011e time that the property owners in an unincorporated area adjoining the southwest portion of the City were being assessed more than property owners in the City, but were not receiving the same level of services, The Council is also concerned that the individuals called to provide emergency services to the area have difficulty determining their legal jurisdiction because of the very irregular boundary lines. After considerable study, the Council determined that a sufficient canmunity of interest exists between Englewood and that area and that it could be integrated with the City in a logical extension of the City boundaries, and they initiated the action to annex. The Council took this step under the authority granted in the Municipal Annexation Act of 1965, which provides that a municipality may annex an un· incorporated area which has had more than two-thirds contiguity with that municipality for at least three years, Following this action, several of the property owners in the northernmost part of the annexation area west of South Santa Fe Drive, successfully petitioned the City ot Sheridan for annexation. This particular area which included in both the Englewood annexation proceedings and in the area petition~d to be annexed by Sheridan, became "dis· puted", and the District Court ordered that an election be held to determine the matter . An election was held on October 5, 1971, at which election property owners voted to remain as unincorporated land in Arapahoe County rather than to become part of either Englewood or Sheridan, None of the area east of South Santa Fe Drive was included in this election. Now, after considerable deliberation, the Englewood City Council has deter- lined that it is to the best interest of property owners within the area which is being considered for annexation, as well as the citizens of Englewood, to once again consider the 1atter of annexation. To this end, the Council has passed a Resolution of intent to annex, setting a Public Hearing at 8:00P.M. on Monday, April 16, 1973, This Hearing w!ll be to deteraine whether or not the proposed annexation complies with the applicable pro· visions of the "Municipal Annexation Act of 1965," Chapter 139, Article 21, Section 4, CRS 63 (1965 Pel'llanent Supple11ent). ·3· II . \ • I • I I . • ... Land to the east of South Santa Fe Drive is included in this action; it was not included in the annexation election in 1971. • • • • I • ...... I r w I I . • ~ •• •••• •••••••• THE PURPOSE OF THE PUBLIC HEARING,,,,, The purpose of the Public Hearing is to determine and to find that the territory which is proposed to be ennexed meets the following requirements: (1) The area which is proposed to be annexed has had more than two-thirds contiguity with the City of Englewood for a period of not less than three years , (2) No land which is held in identical ownership will be divided by the annexation so that a portion of that land is annexed to the City and a portion remains outside of the City, (3) No land held in identical ownership c0111prises twenty (20) acres or more and has an assessed valuation for ad valorem tax purposes in 1972, in excess of $200,000.00.• (4) Annexation proceedings have not been couenced to annex all or a part of this area to a city other than Englewood. (5) The annexation will not cause the area to be detached from its existing school district and cause the area to be attached to another school district , (6) The City Council is not imposing additional tel'lls and conditions on t he area which is proptsed to be annexed, (7) No annexation election is required, •'lbe value of both land and iaproveaents is considered in determining this value, -5- -• • I ' --·~ ' ..... (7) Codes and ordinances , adopted and enforced, to protect 1.2.!!! property, (8) Progressive Park and Recreation Program, (9) Modern and convenient municipal Library facilities, (10) Street lighting prograa, (11) llaintenuce of improved streets and traffic engineering service, AND IIANY O'lliERS II • i • l...ol I • I I I I • • I ·6· • • ••• • •• • ••• • ••• DIGEST OF INFORMATION ~ Present Status: The area east of South Santa Fe Drive which is proposed to be annexed is in the Englewood School District and the area to the west of South Santn Fe Drive is in the Sheridan School District, The area which is in the Sheridan School Di strict is also in the Arapahoe Junior College District, Effect of Annexation: The annexation will not effect the school dis trict boundaries in any way! children living within the area will continue to attend the sc hool s they are now attending , Neither will the school mill levy be changed as a result of the anaexa tion, The Arapahoe Junior College has become a State College and is now known as the Arapahoe Co111111uni ty College, Property owners in the Sheridan School District will continue to pay a nominal levy for this College ---the 1972 levy is ,5 0 mills. ARAPAHOE REGIONAL LIBRARY DISTRICT: Present Status: Unincorporated areas of Arapahoe County and muni ci palitie s 1 1 such as Sheridan which do not provide library service, are in the Arapahoe Regional Library District, Persons living in these areas pay the assessment for this District and are then entitled to library service from participating municipal libraries, such as Englewood's , The levy for this District is 1.40 mills, Effect of Annexation: ,Upon annexation to the City of Englewood, the area will autoaaticaily be withdrawn !r011 the Arapahoe Regional Library District and the 1.40 1111 levy will be dropped, Residents will have convenient access to our municipal library at the north side of the City Hall at 3400 South Elati Street . riU PROTECTION: Present Status; Part of the area east of South Santa Fe Drive is in the Littleton Fire Protection District and the remainder of the area is not within any municipal or special Fire Protection District, This latter area receives "free-willed" assistance from the Englewood and Sheridan Fire Departments, but is not auured of protection, The -7- • i • I r I .. • • • ••••••••• • ••••••• irregular boundaries of this area cause much confusion to the firemen called to thi s area in determining who has jurisdiction, Effect of Annexation: The City would assist those persons In the Ll ttleton Fire Protection District in petitioning to withdraw from that District, Upon wl thdrawol from the District, the 6,00 m111 levy would be dropped, That area, then, as well as th e area not now in any fire protection district, would come under the jurisdiction of the Englewood Fire Department, and would be provided fire protection by a well-trained , full - time professional fire department with modern fire-fighting equipment. New fire and police facilities are nearly completed at West I thica Avenue and South Elati Street AND the City of Englewood has purchased land on the northwest corner of South Federal Boulevard and West Oxford Avenue and will be letting bids on the constru ction of a three-bay fire station on this land in April of 1973! 'ftlis Engine Company w111 se rve the property in the extreme southwest section of the City of Englewood and w111 hav e excellent access to the area being considered in this annexation . In addition, the Fire Station at South Fox Street and West Bellevie w Avenue will provide protection to the area east of South Santa Fe Drive and could supplement the equipn~ent west of South Santa Fe Drive, were it ever necessary, POL! CE PROTECTION : Present Status: This area is presently under the jurisdiction of the Arapahoe County Sheriff's Office. Again, because of the very irregular boundaries, it is often very difficult to determine which agency has juriBdiction In the event of a call. Englewood and Sheridan police "cover" calls to the area but do not exercise their author! ty in the area, They lend assistance to the Sheriff's Department only, The levy for the Arapahoe County Law Enforcnent Authority is 2,60 mills. Effect of Annexation: Annexation to Englewood w111 result in intensified police protection to the area, 11iere is greater police coverage in the City per square aile of area than in the unincorporated area under the Sheriff's jurisdiction, There will be uninhibited access from the Englewood Police station at South Ehti Street and West Ithi ca Avenue to this area----average response time throughout the City is less than four minutes, The Englewood Police Department now has a staff of 65 men and women, dedicated to making our City a safe and pleasant place to live and to do business. -8- II . N X ·-I ••••• ••••••••••••• POLICE PROTECTION: Effect of Annexation: (Continued) The 2.60 Mill levy for the Law Enforcement Authority would be dropped upon annexation to the City of Englewood, PARKS AND RECREATION: Present Status: All of the propertie s i n this area except one, Rl'e in the South Suburban Metropolitan Recreation and Park District, The levy for this Distri ct is 4.00 mills. Effect of Annexation: Englewood is fort unate to have one of the finest recreation program s ln the area and has eleven (11) parks with llO acres of park land, Three of these parks are near the Santa Fe-Union area : Bellevie w Park, located at West Bellevie w and South Inca Street; Jason Park, located at West Qu incy Avenue and South Jason Street; and Centennial Park at West Union Avenue and South Decatur Street, All of these parks have picnic facilities, children's play areas and ball fields. The City will petition the Board of Directors of South Suburban Metropolitan Recreation and Pa rk District to per- mit the wit hdrawal of the annexation area fran that district and if it is successful in its petition to withdraw, it will result in a 4 mill decrease in your taxes. ~: Present Status: At this tile most of the subje ct area has no water service.
