NOTICE OF CALL BY THE MAYOR
FOR A SPECIAL ESSION OF THE CITY COUNCIL
MONDAY , JUNE 24 , 1974
7:00 P .M.
The City Council of the City of Englewood , Arapahoe County,. Colorado ,
is hereby called to a special meetin at the City Hall , 3~00 South
Elati Street, for the purpose of conducting a public hearing to:
Consider the creation of Sidewalk District No. 74 .

COUNCILMAN BLESSING MOVED AND COUNCILMAN BROWN SECONDED
A MOTION TO OPEN THE PUBLIC HEARING TO CONSIDER THE CREATION OF
SIDEWALK DISTRICT NO . 74. Upon a call of the roll, the vote
resulted as follows:
Ayes: Council Members Jones , Sovern, Clayton , Brown,
Blessing and Taylor .
Nays: None
The Mayor declared the motion carried .
A tape recording of this Public Hearing is held on file
in the City Clerk 's office.
City Clerk Nollenberger read the resolution into the
record.
Councilman Blessin inquired whether letters had been
sent out to all those affected. Acting City Manager Waggoner
replied in the affirmative. He stated that the sidewalk district
concept was founded about five years ago in order to help people
fund the sidewalk improvements. He stated that the people have
a right to complain about the quality of the work which is done
after the sidewalk contractor is finished. The City pays ~f~-~~~
curb and gutter at all intersections. Estimated cost to be
assessed is $52,000 .""; $14 ,600.te would be paid for by the City .

recited he peoples' a ility to put in their own sidewalk if they
so desired .
Mr . Rick Kahm , Office Engineer , gave a description of
the cross sections and engineerin de ails to the Council and the

Mayor Taylor inquired whether any individuals would like

was in bad shape, since the water ran away from the pan constantly
throughout the year . Mr. Howard stated that the street could not
be rebuilt at this time, ·-ri1w1l y , but the residents would desire
some relief for the perpetual problem of running water .
Councilman Brown stated that he would like to see the
City Manajer look at the site in order to have his opinion .

Mr . Short y Becraft~E Dartmouth Avenue , appeared before
Council . He stated that twice,vin the amount of time he has lived
inhis house , the water had come within four feet of the house
a nd had not been running across the street at all .
Mr . Robert Ruggera , 4590 o . Kalamath , appeared before
Council . He stated that the City wal\:O ~me for the needed
improvemen in his sidewal~l_' ut he we~IA:~ told that he would have
to pay or it. The section'·oroks.,in half by g r avel trucks , ~•k x n•

it some time before . He stated that it was the same thing on the
lot next door to him. The City had hired the gravel trucks and
this had happened in 1957 0?'1\58. Acting City Manager Waggoner
stated that i could have happened when the street was coa ed at
that time. Mr . Ruggera stated that Mr . Harry Do'lier was the neighbo r
next door wh o also has the same problem.
Mrs . Carol Trujillo, 3616 So . Acoma , appeared before
Council. She stated that she had two trees which were marked for
removal, and ie-6AePe inquired whether there was any way they
could be saved . She felt tha perhaps the root&« could be cut
down. Councilman Sovern stated that we should refer this to the
County Forester for a possible solution . Actin~City Manager
Wa goner stated that sometim s you can cu too ~ into the roots,
and the tree will become unstable as a result thereof.
Mrs . Trujillo stated tha she would like to see the tree saved
if a all possible.
Mr. Ca rl Blansce , 3700 o. Galapago appeared before
Counc i l . He stated that he had several slabs marked for removal.

Mrs . Walter Chores appeared before Council . She stated
that the City should share the cost of replacement. City g r aders
had broken up some concrete on her intersection ttrying to get
ice out .
Councilman Clayton stated that City Council should consider
a request for cost sharing in these areas.
Ma yor Taylor inquired a s to when the last sidewalk district
was held.
Acting City Manager Waggoner stated that the last one had
been in 1971.
Mayor Taylor inquired as to what the p r ocedure or policy
was on s idewalks that the City vehicles had dama ed. Acting City
Manager Wag oner stated that there had no been one in the past .
Mr . Dou Kelley appeared before Council . He stated that
crackin of the sidewalk had helped it o erode away, and that the
City should consider taking care of the sidewalks as they are
cracked .
Actin City Manager read a letter from Wilkerson Corporation
and stated that i was up to the Council to take their sidewalk out
of the District but it sounds like it would be damaged a ain in the
very near future if it was not eliminated . He stated that he would
recommend excluding it from the Dis rict at this time. Mayor Taylor
inquired as to whe her the let er was le ally indin . City Attorney

There will, however, be one budgeted for 1975.
Councilman Blessing inquired as to the ultimate pur~o~~~
of this public hearing. Ac-ing City Manager waggoner stated~to
let people's thoughts be heard and be considered by City Council .
City Attorney Berardini stated that there was room in
the final assessment ordinance as passed by Council ~/terthe
District was completed for City -sharing of costs whe Rever the
Council felt ti shoudl be done. He felt the policy of the city's
paying should be itemized before the passage of the ordinance .

Mr . Howard Turner , 4630 So. Cherokee appeared before
Council. He inquired as to how long the new sidewalk would last .
Acting City Manager Wag goner stated that he specifica ions called
for a guarantee of two years , but that there was no real assurances
of its life; it should last 30 to 40 years.
Councilman Sovern stated the concrete should las 50 years
if quality control is enforced .
Mayor Taylor asked for any other comments from the
audience.
No persons appeared.

Councilman Blessing recommended that the Mayor and City
Attorney sit down and draw up a resolution for that purpose .
Mayor Taylor stated that the Council changed cert 21 r 1 y because of
the Plan. Three new members were elected to kill the glan . He
stated that they must not allow the public to feel that the Council
was still considering the Plan in any manner. He felt it would
be better to forget about the $165 ,000 .~ in costs spent and let
the people feel at rest.
Councilman Sovern stated that the City needed to investi-
gate new legislation concerning firemen 's hours.
Assistant City Manager Mccown stated tha the

Mayor Taylor s ated tha there would be a
Wednesday night with th Sheridan Ci Council on
Golf Course .

Dear Mr. Sagrillo:
We received a letter from lCella Waggoner dated Hay 30, 1974 atating that our
property located at 3800 South Kalamath, Englewood, Colorado ia to be in-
cluded in Sidewalk I11proveaent Diatrict 74.
We are temporarily uafog this aite to etore backfill for our fa c tory addition
unde r construction at Kal ... th and Manafield. We wi ll be removing this fill
dirt, baaed on our preaent achedule, before the middle of Septe mb e r. By the
middle of October, -plan to replace e:1:iating '.daaaged aidewalk plus any ad-
ditional aidevalk that aay be damaged during the hauling of the fill dirt.
We plan to cons ult with you at that ti.me to be aura that all aidewalka needing
replacement will be properly identified.
W desire an e :1:tanaion for completion of our aidevalk project to be compatible
with our conatruction.
