Nays: None Absent: None The May o r declared the motion carried , and the meeting was adjourned at 6 :15 P.M • "' - • • • - • • 0 I • - RESOLUTION NO. /J , SERIES OF 1974 A RESOLUTION DECLARING THE INTENT OF TllE CITY COUNCIL OF THE CITY OF ENGLEWOOD, CO LORADO, TO CREATE A:-J IMPROVEMENT DISTRICT IN SAID CITY, TO BE KNOWN AS SIDEWALK U1PROVE!>IT:NT DISTRICT NO. 74; ADOPTING DETAILS AND SPECIFICATIONS THl:REFOR; ESTABLISHING A DATE AND PLACE FOR A PUBLIC HEARING UPON THE CREATION OF SAID DISTRICT; AND ORDERING PUBLICATION AND MAILING OF NOTICE THEREOF TO TllE OWNERS OF PROPERTY TO BE ASSESS ED WITHIN THE DISTRICT. ~l'J-IEREAS, Article X, Section 107, of the Charter of the City of Englewood, and the provisions of Chepter 1, Title XII, 1969 Englewood Municipal Code, authorize the City Council of the City of Englewood on its own initiative and without the necessity of any petition by the affected land- owners, to create local improvement districts for the con- struction, installation or improvement of any public improve- ment, or any appurtenances, extensions or renewals thereof, which confer a special benefit upon the property within the district; and WHEREAS, City Council has heretofore determined that the construction and installation of those improvements described hereinbelow would serve· the public welfare and would confer a special benefit upon the r al property abutting the same and, for this reason, has caused the Director of Public Works to prepare preliminary surveys, estimates and maps in relation thereto, which surveys, estimates and maps are now on file in the office of the Director of Public Works. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COU CIL OF THE CITY OF ENGLEWOOD, COLORADO, as follows: 1. That the surveys, estimates and maps hereto- fore prepared by the Director of Public Works are hereby approved and adopted by this Council for use in the con- struction and installation of those improvements to be made in the proposed improvement district. 3. That the assessments to be levied for said improvements shall be due and payable within thirty days from and after the final publication of the ordinance assessing the whole actual cost of said improvements against the real property in said district. In case any owner of real estate shall fail to pay the whole of such assessment against his property within said thirty days, then the whole cost of the improvements so assessed against his property shall be payable in five equal annual installments of prin- cipal, with interest on unpaid installments at the rate of five per cent (5%) per anntun, payable annually; the first of said installments of said principal and interest shall be due and payable at such time as may be determined in and by the assessing ordinance, and the remainder of said annual installments of principal and interest shall be due and payable successively on the same day in each year thereafter until all are paid in full. 4. That the property to be assessed for said im- -provements shall be the property within the district specially benefited by said improv ments, as more particularly des- cribed in the notice hereinafter set forth. 5. That there shall be prepared an ordinance in conformity with the provisions of the City Chart r and Chapter 1, Title XII, 1969 Englewood Municipal Code, er ating within the corporate limits of said City a local improve nt district to be known as Sidewalk Improvemen~ District No. 74; providing for th construction in said district of th improv nts all a is in thi s Re o l ution s t forth and d scrib d, and in accord c with th report, plans, maps, p cificationa, d tails and eatimat a of th Director of Public Works of 1aid City, h r in referred to. 6. That a public hearing upon the cre ation of such district and upon the Bi 11 for an Ordinance, r e ferre d to above, shall be held before City Council at City Ha l l, 3400 South El ati, Englewood, Colorado, to comm ence at 8:00 o'clock P.M. on Monday, June 24, 1974, and that notice o f the proposed improvements be given by the City Clerk and published in the Englewood Herald-Sentinel, a newspap e r publi s hed and of general circulation in said City, in three consecutive weekly editions, therein giving notice to the owners of the property to be assessed of the matters and thing s required by law. At or about the time of the first publication, notice shall also be given by prepaid mail to all known owners of property to be assessed with the cost of said improveme nts. 8. The notice to be published shall be in sub- stantially the fol l owing form: NOTICE OF PUBLIC HEARI NG UPON CREATIO N OF A LOCAL IMPROVE ME NT DI STRICT IN ENGLEWOOD, COLORADO, TO BE KNOWN AS SIDEWAL K IMPROVEMENT DI STR I CT NO. 74, TO MAKE CERTAIN INSTAL LATIONS AND IMPROVEMENTS TO SIDEWALKS THEREIN, AND OF A HEARING UPON A BI LL FOR AN ORD- INANCE CREATI NG SUCH DI ST RICT. Said per on s a r f urth r notifi d a follows: -3- • ........ • • • • • (a) The improvements to be installed in said district consist of the necessary installation , removal and replacement of concrete sidewalk, curb and gutter, together with the appurtenances and incidentals, in the City's right-of-way contiguous to the following lots and blocks: See Attached (b) The .real property to be included within the district shall consist of realty described hereinabove. (c) The probable total cost of the improvements within said district is $66,600.00 and the amount of funds of the City which is to be devoted to said improvements is approximately $14 ,600.00. The bal- ance of the total probable cost (being approximately $52,000.00) is to be paid by special assessments to be levied upon each parcel of the real property hereinabove described. (d) All assessments levied against the afore- said parcels of real property will be due and pay- able, without demand, within thirty (30) days from and after the final publications of an ordinance assessing the costs of said improvements against the real property in the district. In case any owner of real property shall fail to pay whole of such assessment against his property within said thirty (30) days, then the pro rata cost of said improvements so assessed against his property, to- gether with interest at the rate of 5 per cent (5%) per annum on any unpaid balance, shall be payable in five equal annual installments. DECLARATION OF PURPOSE The legislative body of the City of Sheridan, Colorado and Englewood, Colorado, are desirous of providing parks, open space, bicycle and walking trails, and other recreational areas for the residents of the City of Sheridan and the City of Englewood and enter into this agreement to accomplish this objective. In furtherance of this goal it is the purpose of this agreement: 1. To promote the health and general welfare of the resi- dents of the two cities. 2. To prevent congestion in the streets and the overcrowding of land to facilitate adequate light, air and green belt space with- in an urban area. 3. To preserve and improve the separate identity of the two cities. 4. To quickly, economically and efficiently provide these recreational and open apace areas for the resident• of both cities. FINDINGS The legislative body of the City of Sheridan, Colorado and the City of Englewood, Colorado have studied th feasibility of pro- viding the above described recreational facilities and make th following findings: • • • • • • l. That an area between Oxford Avenue on the South and Bear Creek on the North; Clay Street on the West and Nassau Street on the East, containing approximately 224 acres of land is an area accessible and convenient to all of the residents of the City of Sheridan and to a majority of the residents of the City of Englewood. 2. That the proposed area is located entirely within the boundaries of the City of Sheridan, Colorado. 3. That acquisition of the proposed area would disrupt or dislocate few if any of the residential homes as the area is not presently zoned nor used for residential purposes. 4. That Federal and State grants will be needed for acquisi- tion of parts of the proposed area. 5. That approximately 102 acres of the proposed area is presently owned by the City of Englewood, Colorado, which minimizes the costs of additional land acquisition. 6. That without the consent and cooperation of the City of Sheridan, the City of Englewood would be unable to acquire a comparible area in size and convenience of location within the boundaries of the City of Englewood for the same projected costs. NOW THEREFORE, for and in consideration of the mutual covenants and agreement hereinafter set forth, it is mutually agreed and covenanted as follows: l. That the development of the recreational project proposed shall be in conformity with that certain report by BRAUER ' ASSOCIATES - ROCKY MOUNTAIN, INC. dated April 26, 1974 and entitled •south Platte Ri ver Redevelopment Plan -City of Englewood, Colorado -Summary Report• a copy of wh ich is attached to this agreement and incorporated into thi agr ement as fully set forth herein. 2. That title to the land in the proposed joint recreational project shall be held in the name of the City of Englewood, a Colorado Municipa l corporati o n , wi th the exception of that area set forth i n Paragraph No. 8 herein below. 4. That if necessary or advantageous, the City of Sheridan will make joint application with the City of Englewood before approp- riate state and federal grants to partially or entirely fund this project. 5. That the City of Sheridan and the City of Englewood shall jointly seek acquisition of the necessary land for the joint recrea- tional project by negotiation with the present land owners or con- demnation procedures through a court of law as necessary. 6. That the joint recreational area herein proposed shall at all times remain in and be within the municipal boundaries of the City of Sheridan, Colorado. 7. That the City of Englewood in the construction of the joint recreational project and the maintenance and operation of the fac i lity does expressly agree to comply with all state and federal laws and regulations and all ordinances and regulat i ons of the City of Sheridan, Colorado. 8. The City of Englewood does hereby covenant and agree that upon receipt of federal and state grants and the acquisition of the proposed land area, that said City of Englewood shall convey to the City of Sheridan, Colorado, that strip of land wh ich is 30 feet in North -South Width along the e nt i re Southerly Boundary of the joint recreational project. That both cities covenant and agree that the residents of both the City of Sheridan and the City of Englewood shall be granted equal use of the entire proposed recreational facility and that in the future operation of the facility there shall be no dis- crimination of any kind as to the use of t h e facility by the residents of the City of Englewood and the C i ty of Sheridan. 10. The City of Sheridan and the City of Englewood mutually covenant and agree that they are acquiring the proposed area and facility in trust for the use and enjoyment of the residents of the City of Sheridan and the City of Englewood. 11. The City of Sheridan and the City of Englewood mutually covenant and agree to construct and operate the recreational area in accordance with the Summary Report plan of April 26, 1974 attached hereto and to make full disclosure of all details to each other at all stages of progress and to not materially deviate from said plan without full consent of both cities. SEVERABILITY Should any part of this agreement for any reason be declared inval i d, such decision shall render the entire agreement void and i t i s hereby declared the intention of 1he parties hereto t h at the y would have not executed the rema i ning porti ons of t hi s agreement wi th- out including herein any such part, parts or porti on which may, for any reason, be hereafter declared invalid.
