May or Taylor, presiding, called the meeting to order. The invocation was given byR Councilman Howard Brown, The Pledge of Allegiance was l ed by Mayor Taylor. The Mayor asked for a roll call. He went on to explain the computation of the average interest cost as shown in the Prospectus. Nays: A. s nt1 n Th Mayor d clar d th 110 i carr and th public h o n • • • - • • • 0 • 3 Mayor Taylor introduced the public hearing for Paving District No. 22 and he set the ground rules for the public hearing. He stated that this is a forum to get public opinion and the Council would not tolerate any abuse from individuals in the audience. City Manager Mccown gave gackground information regarding the paving district program. He stated that the paving districts started in 1956 and their purpose was to improve the streets, sidewalks,llllli gutters and alleys in Englewood. In the early years of the paving districts, he stated that they were initiated by public petition, but in the last six years or so, they have been initiated by Council action. He stated that when a paving district is created, the Council cannot add any streets to the paving district, but they can consider the deletion of any streets. He explained that the assessments depend upon several cost factors. 1. The bid price; 2. How much the City absorbs in cost; 3. Engineering; 4. Legal costs and mailing; 5. Title search. He stated that the City puts up a performance bond and makes certain guarantees on the work that is done. He went on to explain the procedure for determining the final assessment and the payment schedule for the paving district. Director of Public Works Waggomner was introduced. He detailed the Paving District No. 22. He explained t:the construction of the two types of streets, industrial and residential, and the basis for the difference in costs in each type of street. He then went into an explanation of the various methods for assessment. 1. The front foot assessment 2 . The side street assessment He stated that the City pays for all intersections, tree removal, and drainage improvements. He then introduced City Engineer Gene Sagtillo , who went into a detailed explanat ion of the different construction that would be required for the various streets in the paving district. in order Mayor Taylor stated that/to expedite the public hearing and t o make it as orderly as possible, he would take each street s parately and ask for comments both for and against the proposed paving. l. Two of the other properties that did not sign are rental properties. Lida Schuster, 4542 So. Acoma, was recognized. She asked who has the responsibility for patching the street when it is ripped up the Public Service Company by Bell Telephone by the Water and Sewer Departments? Director of Public Work s Waggoner stated that Public Service and Bell Telephone utilize private contractors in filling in any construction for which they are respoasible. When sewer or water are involved, the City has the responsibi~ity. Mrs. Clarence McDaniel , 4564 So. Acoma, was recognized. She stated that they are currently paying for the paving of an alley and that an additional assessment at this time would be financially too much. She asked when the test holes for the paving of the street were made, as two years ago two inches was the t op that was indicated on the street when this portion of South Acoma was previously turned down for paving. Mr. Waggoner stated that two holes were made in 1 972 and two holes were made in 1974. 2. West Baltic Avenue, from the east side of South Zuni Street, to the west side of South Vallejo Street. Ge rald Capesius, of West Warren Avenue, was recognized. He had questionsJDR regarding the cost of driveways and for surveys. Director of Public Works Waggoner answered his questions about driveway cost. He also stated that City recor ds are utilized for survey purposes. Mr. Capesius stated that he was very much against the paving of that portion of W st Baltic. Irving Mauck, 2285 West Iliff, was eecognized. He stated that he was th owner of building sifles on that portion of West Baltic and that West Baltic should not be pav d until the lots are built on. would Mayor Taylor asked if the paving of this street/improve• the property valu of his property. South Galapago Street, from the north side of West Oxford Avenue, to a distance of plus or minus 325 north fr. Mizzel Riddle was recognized, representing his father, Guy Riddle, 767 West Oxford. He stated that he was against including this portion in a paving district because the street ~ has access to nothing. He felt that it would be better to wait until there is a final decision on what was going to be done with the Oxford hill. He stated that his father is retired and the cost of this assessment would be approximately $8,000, which would be difficult for him to afford . Councilman Blessing stated that he lives in that area and he felt that Mr. Riddle has a valid argument. the 5. West Iliff Avenue, from/east side of South Zuni Street to the west side of South Tejon Street. Paul Krei er, 2111 West Iliff, was recognized. He was there on behalf of Donald Kelly of 2296 West Iliff. He stated that as far as they were concerned, the drainage in the area was OK and that the pavement on the street was adequate. He felt that at this time people could not accept an added assessment. fr. Edwin Young, 2770 So. Pearl, was recognized. He was a spokesman for a group of residents on that street who had had a block meeting to protest the inclusion of this portion of South Pearl in the paving district. He stated that they were of the opinion that this portion of South Pearl has held up well in the past. He stated that there are several people on the street who are retired or widowed and the cost of an assessment at this time would be difficult for them to pay. The majority of the people on the street are against the inclusion in the paving district. He offered an alternative and asked if the City would consider overlaying the street. He said the majority of the residents might consider this an acceptable alternative. Mr. Young also asked if the sidewalks might be repaired. Director of Public Waggoner explained the testing that was done on the street and in the City's opinion this was a sub-standard street that requires a complete paving job . ~verlay at this time would only prolong what will be needed in the future. He stated that two years ago the residents were told that they could, at their own cost, get together and have an overlay job done on South Pearl. !r. Young stated that it was their opinion that the City should absorb some of the cost because the damage was caused by heavy construction vehicles going to and from construction sites in the immediate. txln:t. ~ · rt~\ ~i.) A letter was ~ into the record from Mr. and h's. Ken Chelme, at 2766 So. Pearl, who expressed their protest at being included in the pavi distric . J. . Huffmeister 2730 So. Pearl, was recognized. He expressed his ob ection to inclusion in the paving district. He has no objection to having he sidewalks fixed. In answer to his question regarding how long an overlay would last, tr. Waggoner stated that he could not ive him an answer because there are too many variables o be considered. Ar. Huffmeister stated that if there is no exception for an overlay, then some special financing should be considered for those with financial difficulties . Mr. Andy Rechak, 1725 West Harvard, was recognized, and he was in favor of inclusion in the paving district. Mr. Ramon Bitela,2100 West Harvard, was recogni zed, and he was in favor o f inclusion in the paving district. Mr. Ernest Bliss, 2056 West Baker, was recognized. He is against inclusion in the paving district. He stated that he is already being assessed on West Baker and that West Baker, which was recently paved, already has cracks in it. He also stated that a neighbor, Mabel Wellington, was against the paving district . Mrs. Mossberger, of West Wesley Avenue, was present to speak for Ur. Kisselman who is a neighbor and was not able to attend the public hearing. She stated that Mr. Kissel.man is against inclusion in the paving district . He is on a fixed income and would not be able to afford the assessment . She stated that he is already b•ing assessed on one side of his property. 11 . West Cornell Avenue, from the eas side of South Tejon Street to the east side of South Shoshone Street. Pete Feichtinger, 325 Jackson Street , Denver, was recognized. He s a ed that he owns the property at 3050 So. Tejon Street . He sta ed that he was opposed to being included in the paving district. South Raritan Street, from the South side of West Warren Avenue, to the north side of West Iliff Avenue. No persons appeared. 16. South Raritan Street, from the south side of West Harvard Avenue to the north side of West Yale Avenue. John Reffel, of South Tejon Street, was recognized. He expressed his oppositon to being included in the paving district. He expressed his concern about the economy and that he feels that because of these conditinns it precludes ttriWXJ1Wrtt .. x having this portion of South Raritan being paved. Mayor Taylor asked if having this area paved would improve his property value, and in the long run make money. Mr. REffel answered in the negative, stating that he has no plans for develoJ:lllent at this time, although this might happen in the future. 17. West Warren Avenue, from the east si•e of South Tejon Street to the west side of South Raritan Street. No persons appeared. 18. Acoma from Paving District 22. The petition is signed b y all of the property owners on the block except five. (There is a total of 23 properties.) The petition also states that there is two inches of asphalt on a substantial base. We find this to be incorrect accord- ing to the five test holes we drilled in the block, two at the north end, two at the south end, and one in the middle. These tests showed, consistently, no base, with the following results in asphalt thickness: l", 1 1/2", 1 1/2", 2" and 2 1/4". Swediah Medical Center own a all of the property on the east boundary of the aforementioned block and all but four (4) lots on the west boundary. We are currently negotiating with the owner of the remaining prop - erties and would be hopeful of concluding the purchase within the very near future. We are currently working with a sit -planning consultant to develop a com - pr hensive plan for the area bounded by Clarkson on th west , Girard on th north, Corona on the east, and Hampden on the aouth . Acoma from Paving District 22. The petition is signed by all of the property owners on the block except five. (There is a total of 23 properties.) The petition also states that there is two inches of asphalt on a substantial base. We find this to be incorrect accord- ing to the five test holes we drilled in the block, two at the north end, two at the south end, and one in the middle. These tests showed, consistently, no base, with the following results in asphalt thickness: l", 1 1/2", 1 1/2•, 2" and 2 1/4". Attached is a map showing which owners did, and which did not, sign the petition; also shown is the test hole information. Swedish Medical Center owns all of the property on the east boundary of the aforementioned block and all but four (4) lots on the west boundary . We are currently negot iating with the owner of the remaining prop- erties and would be hopeful of concluding the purchase within the very near future. We noted that this proposed paving district again includes South El.ati Street from the south side of West Yale Ave1U1e to the north side of West Bates Ave1U1e. nus is the same street that was included in the proposed paving district No. 20 in 1971. Due to petitions rendered to the City Council at that time, it was determined that this street did not have a necessity nor a desirability for improvement. The use and application of that street has not changed to this date. The resolution states that the City Council has determined there exists a neces- sity for the construction and installation of the street paving, curb and gutter and side- walk improvements... • Since this street is not a through street, has very limited traffic, and hardty any other use, other than that associated with General Iron Works Co., it is hard for us to undersuind how the City Council has determined that there exista a necessity for this improvement. Inasmuch as General Iron Works Co. owned property borders such a high percentage of this street, it does surprise and dismay us that a representative of the City did not contact our Company before going ahead with the inclusion of this stre ton the re90lution. Sine the pavina of this street would create such a large financial burden on our Company, and ceruiin other owners of property on this street, we have obtained signed petitions from this group of owners, which we are submitting to you, petitioning for the exclusion of this street from paving district No. 22.
