The special meeting of the City Planning and Zoning Commission
was called to order at 7:10 p .m. by Chairman Tanguma .

sq. ft. per unit is required.
Notice of the Public Hearing did appear i n the Englewood Herald
Sentinel, and the property was posted as required. Mrs. Romans
presented the certification of post~ng to the Secretary for
the file.
Mrs. Romans stated that the subject area is bounded on the
north by the extended centerline of the West Evans Avenue/We st
Adriatic Avenue alley, on the east by the centerline of South
Tejon Street, on the south by the rear lot lines of Lots 1-19,
Block 13, Southlawn Gardens, and on the west by the centerline
of South Zuni Street. There is B-2 zoning along Evans Avenue
and industrial zoning to both the east and to the south of the
subject area. There is residential zoning to the west of
South Zuni Street, which area is in Denver.

the school population had decreased by such a percentage, they
would have to close the school and bus the children to another
school within the School District. This proposal created con-
cern on the part of the parents in this neighborhood, and with
the city staff. Mrs. Romans stated that there have been several
meetings with members of the School Board, City Council,
Planning Commission and residents of the area. Following these
meetings, the Northwest Englewood Action Committee asked the
City if they would assist in their effort to encourage develop-
ment in the area in order that the School Board would keep
the school open. The City Council referred the matter to the
Planning Commission and asked the Commission to make a study
as to whether or not it would be warranted to consider rezoning
to a higher density. The City has initiated the rezoning from
R-1-C to R-2-C, and the School Board stated that the school
would remain open during the 1976-1977 school year. Mrs.
Romans noted that the 1960 Census indicated 4,23 persons per
household in this area; the 1970 Census indicated 3,50 persons
per household in this same area.
The staff recommends approval of the rezoning as noted in the
staff report submitted to the Commission,
Mr. Tanguma asked that proponents of the rezoning now speak,
Mrs. Betty Johnson
2380 West Baltic Avenue -stated she is Chairman of the Action
Group; the reason they have asked
for the rezoning is to try to keep the school in this neighbor-
hood. They feel the rezoning is a plan which will assist thea
in getting new houses in the area which will bring aore children
into the school and, hopefully, this will enable thea to keep
the school. Mrs. Johnson stated that she feels the rezoning
will be beneficial for the area in teras of trying to build
the area up; she stated she felt it would be beneficial to the
City of Englewood as a whole, also. Mrs. Johnson stated that
petitions w re circulated in the area asking the City to initiate
the rezoning; 70 signatures were collected, and she stated she
feels this is an indication that a consid rable nuaber of people
are in favor of th r zoning. Mrs. Johnson tated she felt the

draw the people together, and that she would hope the concern
for the neighborhood would continue.
Mr. Herb Mosbarg er
2250 West Wesley -stated he was very much in favor of the
R-2-C zoning; he stated that he feels this
is the only way any building can be done in that neighborhood.
Mr. Mosbarger stated it is not possible to build a single-family
house and sell it as a low-income home. He emphasized that the
R-2-C Zone District is the only way new construction can take
place in this neighborhood . Mr. Mosbarger stated that he has
talked to contractors who are willing to build as soon as the
area is rezoned . Mr. Mosbarger noted there are presently approxi-
mately 68 vacant lots that would be a good start in redevelop-
ment of the area if the property owners would want to develop
these lots. Mr. Mosbarger stated that the neighborhood needs
to keep the school, and he feels the R-2-C zoning is one of
the best ways of doing it.
Mr. Jones asked if Mr. Mosbarger felt it would be possible to
get dedications to open additional streets? Mr. Mosbarger
stated that in soae instances, be felt the only thing to do
was to put in cul-de-sacs, or condemn for street purposes. He
stated that this is a problem.
Mr. Tanguma asked if anyone else wished to speak in favor of
the proposal? No one spoke .
Mr. Tangu•a then asked for persons to speak in opposition.
Mrs. Varde•an

this area was the advantage of the large lots
for the kids to play in --they didn't have to play in so•eone

duplexes in this area, and again emphasized that if someone
from City Council would go to the Banks and Public Service
Company to make the money and gas taps availa~le, the property
owners could build, Mrs . Vardeman stated that if no more gas
taps are available, as she has been informed, what is the use
of rezontng it for higher density?
Don Saith stated he understood there are about 50 taps available
at the present time for this area. He noted that the proposed
R-a-e is in compliance with the Comprehensive Plan, which pro-
jects a medium density development for this area. Mr. Smith
asked Mrs. Vardeman if she was concerned that the area would
become "instant duplexes?" Mrs , Vardeman pointed out that
Mr. Mosbarger had stated he has talked to contractors who are
prepared to build once the area is rezoned, Mr . Smith asked
Mrs, Vardeman if she had attended the meetings on the proposal?
Mrs, Vardeman stated that she had attended the meetings that
were held at the school,
Mr. Jorgenson asked what Mrs. Vardeman's objection was to a
duplex? Mrs. Vardeman stated she wanted open space between
she and her neighbor,
Mr. Tanguma asked if anyone else wished to speak in opposition?
No one indicated a desire to speak,
Mrs. Roaans stated that as a point of clarification : in the
singl -family aone district, which is applied to this area to-
day, a minimum setback of 10 ft. total is required, with a
minimum of three ft. side-yard tback ; the R-a-e ould re-
quire a ainimua of 14 ft. etback, or a side setback of five
ft. ainimua.

Mr. Don Smith stated that in iew of some 77 signatures on
petitions which wer submitte d to City Council asking f or the
rezoning, and in view of the discussion at the many meetings
he had attended, he feels the majority of the people in this
area are in favor of the rezoning. During the turmoil of the
school being threatened, the neighborhood seems to be willing
to work to develop this area. He stated in his opinion, even
if some duplexes were to be constructed, the area would retain
its single-family character. He stated it seemed to be th
desire of the residents of the area that the rezoning occur,
and it was on their request to City Council that the matter
was initiated.
Mrs. Romans pointed out that this matter will be forwarded o
City Council, who will then hold a Public Hearing on the rezoning.
The property will be posted again, and a public notic will b
in the Englewood Herald . Mrs. Romans pointed out that th
Hearing before City Council will probably not be un il early
June, and that persons residing in the neighborhood will h v
another oppoertunity to voice their opinion on this matter.
Mrs. Vardeman stated that the time given on tre signs was
for 7 :30 p.m.; she stated she arrived shortly before 7 :30 p.m.
and the Hearing was in progress. Mrs. Romans referred to th
certification of posting, which has a picture of each sign
that was posted; 7:00 p.m. is listed as the meeting time on
the signs, and the Public Notice published in the paper did ay
7 :00 p.m. also. Mr. House, Associate Planner, tated that to
th best of his knowledge, every ign in the area gav 7 :00 p.m.

approval of the Plaza de Medico PD, made reference to Mr.
Carroll's memorandum. The following day, the matter was dis-
cussed with Mr. Carroll, and he indicated that possibly the
initial memorandum was in error, and the matter should be
approved by the City Council. The situation was also discussed
with City Attorney Berardini and Assistant City Attorney DeWitt.
In these discussions, it was determined that the Water Board
should review encroachments on the City Ditch and eaaeaents which
run to the Water Board, but that it is sufficient for the City
Council to approve the encroachment in this particular case.
The Utilities Department's interest is protected because the
applicant will not receive sewer service unless steps are taken
to encase the sewer line existing in the easeaent to the
Departments' specifications, or to relocate the line outside
the present easement and grant a new easeaent. Mrs. Roaans
stated that Utilities Director Carroll had subaitted a new
aeaorandua dated April 13th, which states that he does feel,
upon reflection, that the encroachment into the easeaent aust be
approved by the City Council, but not necessarily by the
Water Board. Mrs. Roaans stated she felt the aatter should be
clarified before the reco .. endation is sent to the City Council.
Mrs. Roaans suggested that possibly reference to a aeaorandua
froa Mr. Carroll could be eliainated fro• the aotion. Dis-
cussion followed.

he had discussed the matter with Mr. Mock, a resident of the
northwest Englewood area, very briefly following the Public
Hearing. Mr. Jones stated that he is of the opinion that
opening streets up in that area is a necessity to further the
development and redevelopment of the land.
It was noted that Commission members would meet at General
Iron at 5:00p.m., April 20th, to review the street vacation
request, and would go into the regular meeting a 7 :00 p.m .
The meeting adjourned at 8:25 p.m.

4. In a time when growth on t he periphery of a large metro-
politan area is becoming unworkable and wasteful, placing
an undue burden on over-extended services and facilities
needed to accommodate that growth, an opportunity to accoamo-
date some of the growth in or near the core of the metro-
politan area should be encouraged. The site of the rezoning
is situated where services and facilities are already
existing, and it is well within the aetropolitan area.

are considering at this time, to determine whether or not the
majority o f the propert y owner in the area would wan to have
th area zoned R-2-B, Two-famil y Residence. A majority of the
people were not in opposition to that zoning, but they preferred
that certain am ndmen ts be m ~d to the R-2-B regu la tions to
incre ase the minimum floor area . No one actively pursued the
matter, how ever, and it was o on dropped .
In the tall of 1974, a r quest was made by Mr. Irving
Mock, a long-time resident of this area, to rezone his prop rty

Arapahoe County, Colorado and contains 97.995 acres more or less.

R-1-C, Single-family Residence and was so zoned by Ordinance
No. 26, Series of 1963.
That the land to the north of the area with which
Case No. 13-76 is concerned, is zoned B-2, Business; to the
east and south of the subject area, the land is zoned 1-1.
Light Industrial and to the west, which land is no t in the
City of Englewood, the land is zoned for single-family residential
use by the City and County of Denver.
That the subject area includes 97.995 acres and that
most of the ownerships are in one-half acre and one acre Lots.
That most of the homes in the subject area were
constructed prior to the annexation of the area to the City
of Englewood in 1957 and that most of the houses occupy only
a portion of the Lot, leaving sufficient room on the back of
the Lot for a second residential unit, were additional access
to be aade available.
That there are 168 single-family residences in the
area at this time; 68 additional building sites could be mad
available as the land is now divided, and, were additional
rights-of-way to be provided for avenues within the area, 95

CONCLUSIONS
That proper public notice of the Public Hearing was
given by both posting the property and publishing in the official
City newspaper, the Englewood Herald-Sentinel.
That the area which is the subject of Case #13-76,
which area is proposed to be zoned R-2-C, Medium Density Resi-
dence, is one in which both single-family and two-family units
can be adequately acco.aodated and two-family units would be
compatible with the existing development.
That th proposed R-2-C Medium Density Residence
District zoning would provide a suitable transition between
the Industrial zoninc to the east of the subject are a and
the single-family residential area to the west.
'lbat under the :proposed R-2-C Medium Density Residence
District, the construction of new dwellings in excess of two
units would not b permitted, and the R-2-C Zone Di trtct would
protec t against the encroachment of general coamercial or in-
dustrial uses into the area.
That increased industrial developaen in the Industrial
Districts to the east and south of the subject area, have caused
changes in the character of the area since the zoning was last
considered in 1963.

will continue to conserve and stabilize the value of property ,
secure safety from fire and other danger, prevent undue concentra-
tion of population and traffic and promote the heal h, saf ty,

the Comprehensive Plan of the City of Englewood , Colorado,
which Plan was adopted by Resolution No . 28, S ri of 1969 ,

The particular charac ter of this residential area was
established by the original p latting which laid out very large
blocks, mos t of them almost fou r times as l arge as the average
city block n Eng ewood. The frontage of the lots average be-
tween 60f t. and 84 ., and they are as much as 295ft. in
depth. The area was platted with se en foot easements
paralleling the front and rear property lines, and s ometimes
on the sides, which were intended t o be used for irr gation
ditches. These lots were probably envi sioned as one-half
acre and acre garden plots at the tim of the platting,
Several of the residential sites are used as such at the
present time.
The subject area is bounded on its south and east

Notice of the Public Hearing did appear in the Englewood Herald
Sentinel, and the property was posted as required . Mrs. Romans
presented the certification of posting to the Secretary f or
the file.
Mrs. Romans stated that the subject area is bounded on the
north by the extended centerline of the West Evans Avenue/Wes t
Adriatic Avenue alley, on the east by the centerline of South
Tejon Street, on the south by the rear lot lines of Lots 1-19,
Block 13, Southlawn Gardens, and on the west by the centerline
of South Zuni Street. There is B-2 zoning along Evans Avenue
and industrial zoning to both the east and to the south o f the
subject area. There is residential zoning to the west of
South Zuni Street, which area is in Denver.

the school population had decreased by such a percentage, they
would have to close the school and bus the children to another
school within the School District. This proposal created con-
cern on the part of the parents in this neighborhood, and with
the city staff. Mrs. Romans stated that there have been several
meetings with members of the School Board, City Council,
Planning Commission and residents of the area. Following these
meetings, the Northwest Englewood Action Committee asked the
City if they would assist in their effort to encourage develop-
aent in the area in order that the School Board would keep
the school open. The City Council referred the matter to the
Planning Coaaission and asked the Coaaission to aake a study
as to whether or not it would be warranted to consider rezoning
to a higher density. The City has initiated the rezoning from
R-1-C to R-2-C, and the School Board stated that the school
would remain open during the 1976-1977 school year. Mrs.
Romans noted that the 1960 Census indicated 4,23 persons per
household in this area; the 1970 Census indicated 3.50 persons
per household in this saae area.
The staff recoaaends approval of the rezoning as noted in the
staff report subaitted to the Caa.ission.
Mr. Tanguaa asked that pro90nents of the rezoning now speak.

for the rezoning is to try to keep the school in this neighbor-

the school population had decreased by such a percentage, they
would have to close the school and bus the children to another
school within the School District. This proposal created con-
cern on the part of the parents in this neighborhood, and with
the city staff. Mrs. Romans stated that there have been several
meetings with members of the School Board, City Council,
Planning Commission and residents of the area. Following these
meetings, the Northwest Englewood Action Committee asked the
City if they would assist in their effort to encourage develop-
Merit in the area in order that the School Board would keep
the school open. The City Council referred the matter to the
Planning co .. ission and asked the co-ission to make a study
as to whether or not it would be warranted to consider rezoning
to 'a higher density. The City has initiated the rezoning from
R~l-C to R-2-C, and the School Board stated that the school
•auld remain open during the 1976-1977 school year. Mrs.
Romans noted that the 1960 Census indicated 4.23 persons per
~ousehold in this area ; the 1970 Census indicated 3.50 persons
p,er household in this same area.
The staff recommends approval of the rezoning as noted in the

Mr. Don Smith stated that in view of some 77 signatures on
petitions which were submitted to City Council asking for the
rezoning, and in view of the discussion at the many meetings
he had attended, he feels the majority of the people in this
area are in favor of the rezoning. During the turmoil of the
school being threatened, the neighborhood seems to be willing
to work to develop this area. He stated in his opinion, even
if some duplexes were to be constructed, the area would retain
its single-family character. He stated it seemed to be the
desire of the residents of the area that the rezoning occur,
and it was on their request to City Council that the matter
was initiated.
Mrs. Romans pointed out that this matter will be forwarded to
City Council, who will then hold a Public Hearing on the rezoning.
The property will be posted again, and a public notice will be
in the Englewood Herald . Mrs. Romans pointed out that the
Hearing before City Council will probably not be until early
June, and that persons residing in the neighborhood will have
another oppoertunity to voice their opinion on this matter.
Mrs. Vardeman stated that the time given on tre signs was
for 7 :30 p.m.; she stated she arrived shortly before 7 :30 p.m.
and the Hearing was in progress. Mrs. Romans re f erred to the
certification of posting , which has a p f cture of each sign
that was posted ; 7:00 p.m. is listed as the meeting time on
th sign , and th Public Notice published in the paper did say
7 :00 p.m. also. Mr. House, As ociate Planner, stated that to
th best of his knowledg , every sign in the area gav 7 :00 p.m.

approval of the Plaza de Medico PD, made reference to Mr.
Carroll's memorandum. The following day, the matter was dis-
cussed with Mr. Carroll, and he indicated that possibly the
initial memorandum was in error, and the matter should be
approved by the City Council. The situation was also discussed
with City Attorney Berardini and Assistant City Attorney DeWitt .
In these discussions, it was determined that the Water Board
should review encroachments on the City Ditch and easements which
run to the Water Board, but that it is sufficient for the City
Council to approve the encroachment in this particular case.
The Utilities Department's interest is protected because the
applicant will not receive sewer service unless steps are taken
to encase the sewer line existing in the easement to the
Departments• specifications, or to relocate the line outside
the present easement and grant a new easement. Mrs. Romans
stated that Utilities Director Carroll had submitted a new
memorandum dated April 13th, which states that he does feel,
upon reflection, that the encroachment into the easement ~st be
approved by the City Council, but not necessarily by the
Water Board. Mrs. Romans stated she felt the matter should be
clarified before the recoaaendation is sent to the City Council.
Mrs. Romans suggested that possibly reference to a memorandua
from Mr. Carroll could be eliminated from the motion. Dis-cussion followed.

east and south of the subject area, the land is zoned I-1.
Light Industrial and to the wes t, which land is not in the
City of Englewood, the land is zoned for single-family residential
use by the City and County of Denver.
That the subject area includes 97.995 acres and that
most of the ownerships are in one-half acre and one acre Lots.
That most of the homes in the subject area were
constructed prior to the annexation of the area to the City
of Englewood in 1957 and that most of the houses occupy only
a portion of the Lot, leavin sufficient room on th back of
the Lot for a second residential unit, were additional access
to be made available.

resid ntial use in the County at that time, and when it c ame
to the att e ntion ol th Arapahoe County official that Mr.
Hayes was using the site for a gun shop, the prop rty was
rezoned to 1-1, Light Industrial, to p rmit th gun shop us

Mr . Malone stated that Mr. Mardesen is attempting to use the
City of Englewood to accomplish his very personal goal, and that
he feels this is a very improper approach to this problem .
Mr. Malon stated that at the last hearing before the Arapaho e
County Board of Adjustment, he offered the compromise that the
south end of fue property be developed for industrial use,
and th north end of the property be used for parking and
storage; but, Mr . Mardcsen did not want to go along with this
proposal . !r. Malone stated that Mr. Mardesen's only reason
for annexing to the City and appearing before the Planning
Commission on the zoning, is to ask for the I-1 District to
nabl him to cut down on the amount of setback required .
Mr. Malon noted that this annexation will be a "fing r"
ticking up to Tufts, and will make for a very irr gular
boundary. !r. Malone stated that he fe lt th construction of
a war hous or industrial building on the north nd o thi
si t , plus the storage of construction mat rials, could cr at
a very s rious traffic hazard at Tufts and Windermer . He

Mrs . Pierson noted that th mountain view Mr . Manning wants to
preserve would be sub ject to obstruction with either z one dis-
trict. Mrs. P ierson st ated that she was not sure that pr ese rva-
tion of the mountain view is a valid reason tor denial of the
1-1 c lassi ficatio n, but asked what would happen in the event
the I-1 classification were to be denied? Mrs. Romans stated
that the burden is on the City to place this land in a proper
z on e c lassifica t ion. Discussion followed.
Mr. Williams stated that he felt the only zone classification
under conside ration was the I-1 District, and that discussion

Mr. Malone stated that Mr. Eitel has urged that this property
be zoned as it is used ; he submitted that th property is
residentially used, not industrially used. He stated that the
appropriate zo ning would be of a residential character. At
such time as Mr. Mardesen comes in with a plan for development ,
it would be appropriate to consider industrial zoning at that
time. Mr. Malon noted that eve n though much of the surrounding
land is zon d industrial, it is either vacant, or used for
resid ntial purposes. Mr . Malon urged the Commission to
wait until th re is a specific plan presented for industrial
d velopnent .

County Zoning Regulations, and even though the conditions of
the two zonin g districts are diff e rent, the area is still
predominat ly an I-1 area. The land immediately to the west
oi the subj ct site, across South Windermere Street, is in
th County, and is zoned 1-2, Heavy Industrial; south of the
subject site, in the City of Englewood, the land is zoned I-1 ,
Light Industrial; and north of the site is R-3, Residential,
which area, in his opinion, is in a state ot transition.
Mrs. Pi rson stated that she has a great deal of sympathy for
lr. and Irs. Ianning, but she would also have to vot to approve
the 1-1 zoning, for the very reasons cited by Mr. Jones.
Mr. Don Smith tated he, also, would have to vote in favor
