The proposed R-2-C District zoning would have a stabilizing and protective effect on the existing residential mix of one and two-family units in this area. The proposed zoning for this area would exclude dwellings in excess of a two-family use, as well as to prot ct against encroachm nt of general, commercial or industrial uses. Four members of the P lanning nd Zoning Commi s1on and members of the Plann i ng staff were also in att ndance. After considerable discus sion at that meeting regarding the two possible alternatives for .f utur zoning --R-1-C or R-2, a large majority of those pres nt vo t0d in favor of d wn -zon1 ng the subject area from R-2 -A, Two -famil Res i denc to R-1-C , Single-family Residence. It wa agreed that th City would post the area for R-1-C z on in g as the y request d . A Public Hearing wa s h ld October 21 befor Planning and Zoning Commission. Under the p r ovjsions of the new R-2-C District , a two-family unit c an be built on a 50 foot frontage, with a maximum of two uni t s under one roof . The new R-2-C District incorporates , as best a q possible, two situations t o the satisfaction of the r e s i dents of the neighborhood . Th e R-2-C a llows for the development of two-family units, and at the s ame t i m l i mi ts new developmen to a density and size th a 1 would be compatible wi t h the prediminately single-fam)ly c harac ter of this neighborhood. '' Mrs. Romans stated that 106 permitted uses in the B-1 Zon District hav been listed; and subsection 107 authorizes the Planning Commission to permit u es that are similar to the li t d permitted uses, but which are not sp cif ically listed . Mr. Tanguma asked the applicant to pr sent his case. lr. Frey #9 Niblick Lan -stated that th structure at 3550 South Bro adway is about 100 yards north of U.S. Highway #285. H stat ed that his sales and warehousi~g business is now occupying 3554 South Broadway. He noted there is very little walking trafiic in this particular section on Broadway. Mr. Frey also noted there ar two curb cuts f or entrances to parking lots in this immediate ar a --one to the Surplus Store p.rking lot , and another to the H. Salt Eq. parking lot. Mr. Frey stated that the center window on the structure was a garage door at one time --the structure was a taxi garage many years ago ; the window would be r placed with a garage door. Gerald Stacy 3900 South Sherman -stated that the use sounded like an auto upholst ery shop. Mrs. Romans stated that some residents are now carrying petitions to gain support for a proposed change of zoning from R-1-C, Single- family Residence, to R-2-C, Two-family Residence. The residents and staff feel there is a possibility for new development in the area, as well as redevelopment . If street rights-of-way are acquired, additional building sites will be available. The petitions ask that the City initiate the zoning procedure. In conjunction with this, the City Council asked that the Commission members give two or three alternate dates convenient to the Commission when they might be available for a meeting with City Council and with residents of the area. The School Board has indicated the residents must pres nt some concr t plans by March th. Mrs. Romans stated that the acqui ition of street rights-of-way is proceeding. SIZE OF DISTRICT The District, as it was finally constructed, involved 18 blocks of new construction and· three blocks of overlay. The total cost of the District was $498,139.36 of which the City's share was $66,440.40, leaving $431,698.96 to be assessed against the properties. FINAL ASSESSMENTS The City accepted bids for the construction work on April 30, 1975 and awarded a contract on May 5, 1975 to Rocky Mountain Paving Co. whose bid was the lowest out of a total of six bids submitted. In addition to the actual contract amount, the assessments include a factor to. cover engineering services, administrative overhead, legal ' fiscal fees, bond interest, and other direct costs related to the Diatrict. !be •ctual assessment depends upon the nature of the improvement, that is: width .of street, zoning of property, type pf concrete work, etc. The City does pay for street and alley intersections including paving and concrete work. The list of assessments was published in the Englewood Herald Sentinel on February 25, 1976 and i ndividual notices were mailed on February 27, 1976. Mail ings were made on the basis of the Arapahoe County ownership lista. (Total of 262 separate letters (assesments) -8 r turned, 6 re-aailed-only 2 were not notified.) PAYMENT OF ASSESSMENTS Assessments may be paid in as ntially two ways. One is by c sh prior to 5:00 p.m. on May 21, 1976 in order to receiv a 5 discount on the asses nt.
