Subject: Refunding of G. 0. Housing Bonds
In February of 1976 the City of Englewood issued $2,225,000 worth of G. 0.
Housing Bonds to construct a 104-unit apartment complex for the elderly.
This bond issue is to be paid off by the rents from the apartments . Since
the time of this issue, there have been changes in the bond market which
warrant the refunding of these bonds.
The refunding issue would be in the amount of $2,112,000. There would be
no substantial changes in the principal and interest payments except for the
final three years when most of the savings would be realized.
The refunding issue will save approximately $530,000. This is not a direct
savings to the City, but to the federal government the refunding is advan-
tageous to the City in that it shortens the length of the bond issue and
thus gives the City nwre bonding capacity in a shorter period of time. It
would be good for public relations in that we would save the taxpayers and
the federal government one-half million dollars. It should also give us an
impetus for additional rent subsidizing in the future.
Therefore, we would recommend that these bonds be refunded. Walt Imhoff
of Hanifen, Imhoff & Samford, Inc. will be present Monday night to review
the refunding issue.

ORDINANCE NO. , SERIES OF 1976
AN ORDINANC AMENDING TITLE IX OF THE 1969 ENGLEWOOD MUNICIPAL
CODE, BY ADDING A NEW CHAPTER THERETO, LICENSING AND REGULATING
VEHICLE WRECKER OR TOWING SERVICE; PROVIDING FOR INVESTIGATION
AND SUPERVISION BY THE CHIEF OF POLICE; SETTING FORTH DUTIES
OF LICENSEES; PROVIDING FOR REVOCATION OF LICENSES; AND PRE-
SCRIBING PENALTIES FOR THE VIOLATION OF ITS PROVISIONS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ENGLEWOOD, COLORADO, as follows:
Section 1.
The 1969 E.M.C. is hereby amended by adding a new
chapter to Title IX, being Chapter 9, entitled "Wrecker and
Towing Services", which chapter reads as follows:
CHAPTER 9
WRECKER AND TOWING SERVICES
9-9-1: DEFINITIONS.
(a) Wrecker. A wrecker is a per on engaged
in the business of, or offering the services of, a
vehicle wrecker or towing service, whereby motor
vehicles are, or may be, towed or otherwise r moved
from one place o another by the use of a motor
vehicle, adapt d to, and d signed fo~ that purpos .

(d) Operator. Operator shall mean any
person operating a wrecker's towing vehicle.
{e) Towing Vehicle. Towing vehicle shall
mean any vehicle used by a wrecker for the towing
or transporting of other vehicles (or other property)
in the course of his business.
9-9-2: LICENSES.
, -
No wrecker shall have his name included on
the towinglist of the City of Englewood,and be requested
by the Police Department to respond to the scene of an
accident or emergency, for the purpose of towing a
v vehicle,without first having obtained a license from
the City Li cense Officer.
D (a) Aptlication for License. Any application
or a wrecker's1cense, other than a renewal thereof,
hall be accompanied by a non-refundable application
ee of Ten ($10.00) Dollars. All applications for
icenses, including renewal, shall be made upon
orms mad e vailabl by the City Llcense Officer.
{b) Annual License Fee. The annual license
a wrecker shall be F1fty ($50.00) Dollars per

receipt of a license application and application fee
from person seeking wrecker's license in the City
of Englewood, th City License Officer shall forward
said application to th Chief of Police, who shall

ii. That the applicant has received and
has currently in force a permit to operate as
a towing carrier from the Colorado Publ ic Utilities
Commission. The failure of a wrecker to maintain
a valid permit from the Public Utilities Commis-
sion shall be grounds for denial of a license,
or if a license shall be in effect at the time,
shall be grounds for revocation or suspension of
said license as hereinafter provided; and
iii. That the wrecker has adequate, safe
equipment,and an adequate record keeping system,
and can otherwise comply with the rules and reg-
ulations promulgated by the Chief of Police as
hereinafter provided; and
iv. That the wrecker has currently in
force public liability and property damage
insurance,or surety bond,providing coverage
sufficient to m et the requirements of the rules
and regulations of the Colorado Public Utilities
Commission governing owing carriers.
(d) Issuance. The Ch~ef of Police sh 11 w~th~n fifteen (iS) days return to the City License
Officer the application for~ together with h~s
recommendation for the granting or denial of the
license. Should the recommendation be for denial
of the license, th Chi f of Police shall state the
reasons for such recommend ion. Th City Licensing

RULES AND REGULATIONS GOVERNING WRECKERS .
The Chief of Police shall, within thirty (30)
days after final publication of this ordinance, set
forth in writing such rules and regulations governing
the conduct of wreckers as are deemed necessary to ensure
the inhabitants of, and other persons within this City,
safe, efficient and dependable wrecker and towing service.
These rules shall include, but not be limited to, the following:
(a) Equi pment. The Chief of Police shall
specify equipment at least the equivalen t of that
required by the rules and regulations of the Colorado
Publ ic Utilities Commission governing towing carriers,
and such other necessary equipment as determined by the said Chief of Police.
(b) Records. The Chief of Police shall
require the keep~f sufficient records to ensure ~omplilnce with the terms of this ordinance and said
rules and regulations as promulgated.
(c) Personnel. The rules shall sp ci fy
such steps as are necessary to determin e that the
operators and employees of the wrecker are of good characte~ and otherwise fit to participate in towing operations within the City.
(d) Rates. A schedule of r asonable rates,
for vehicles 10,000 pounds and und r, to be charged by
wreckers ~perating on the Ci ty's towing lis , shall
be establ~ahed by the City Manag r, or his design

in the Denver metropolitan area. The rate schedule,
as set forth in the rules and regulations, shall not
apply to towing services conducted by a wre cker when
his services are not requested by the Police Department.

9-9-4: SUSPENSION AND REVOCATION OF LICENSE.
(a) Upon a showing that a wrecker has
violated the provisions of this ordinance, or the
rules and regulations provided for herein, the
City License Officer may suspend for a period
of up to six (6) months, or revoke the license of
any wrecker. Except as provided in subsection (d)
of this Section 9-9-4, such suspension, or revocation,
shall not take effect for a period of ten (10) days
following service upon the wrecker of notice of
suspension or revocation, which notice shall specify
the reasons for whi ch the action is being taken.
{b) Service of said notice shall be by
personal service upon the wrecker, or his agent,
or by registered or certified mail, return receipt
requested, sent to the business address of said
wrecker as shown on his license.

(d) T~e City ~icense Officer may issue
a suspension order effective immediately upon
service of notice of said ~uspension upon a wrecker
when the City License Officer determines that the publ~c health, safety and welfare require such
immediate action, and in conjunction with the issuance
and service of a notice as provided for in subsections
(a) and (b) of this Section 9-9-4. Any such notice
shall state that the suspension shall be effective
immediately upon service of the notice, and shall
advise the wrecker of his right to a hearing under
the provisions of this subsection (d) and subsection
(c) of this Section 9-9-4.
9-9-5: TOWING AUTHORIZATION.
No wrecker licensed by the City of Englewood,
and no person engaged in the business of towing vehicles,
shall commence or originate the towing of a vehicle
within the City of Englewood without the written
consent of the registered owner, legal owner, person
in control, driver, or the authorized agent of any of
them, or other person having a legal r i ght to possession
of the vehicle, or from a police officer, save and
except under the following circumstances:
(a) A tow which is otherwis lawful m y

SUBJECT: Towing Contract
We have reviewed the enclosed request from the Pol ice Chief
concerning towing In the City of Englewood along with the
attached ordinances from Lakewood. I agree with his crit iq ue
of the current method of providing towing. As a result of
the procedure whereby the Oty receives its towing for nothing ,
the ci tizen Involved In a traffic accident can be given an
excessive charge by the towing company. We have had complaints
from citizens of exces sive tow charges from our cu rrent towing

The contract between the City of Englewood and Harvey Park Chevron for towin g
service expired November 30 , 1975. It is my understanding , however, that it
was mutually agreed that the contract would be extended 90 days to allow
su ffic ient time for a decision on a new contract .
It is my opinion that this contract leaves much to be desired from the city's
standpoint , and I sugg st a totally different approach be consider d.

1. The existing contractor has at least one tow truck painted green
and white, whi ch makes it appear as i f it Is a city owned veh ic le.
2 . The contractor, in the eyes of the pub I ic , is representing the
city to the degree that we contract with them and therefo re
recommend their service t o the exclusion of others .
3. The city has no control ove r the prices charged or the level of
service provided by the contractor.
4 . The city has no au t ho r ity to protect the contractor from other
companies wh o monitor the pol Ice radio and attempt to sol iclt
service from accident victims at the scene.
During the three months that I have been Chief o f Po l lee , I have received
several complaints from ci t izens who felt they had been "ripped off" by
the city tow contractor. Investigation Into the com pla ints has revealed
that the posslbi I lty existed, but there was no authority to correct the problem.
I have had corrplaints fro ~1r. I I Bush , he owner of Harvey Park, about
other wrecker companies atte~ting o ake busin ss ay from him by beating
his wrec ers to the cene and soliciting business. In turn, I ave received
complaints from t•o oth er En~l wood c anies r gardlng the conduct of Harvey
Park drivers at seen s tn~ir drl ers ha ha paned u on or actually witnessed.

2. Enact an ordinance to prevent and make unlawful the solicitation
of towing business by any person driving a wrecker at the scene
of a traffi c accident.
3 . Enact an ordinance governing wrecker and towing services In the
City of Englewood. This ordinance should j:rovide for the following:
A. That the pol ice department maintain a list of licensed Englewood
towing service companies in its communications division, and
that when towing services are requi red at the scene of ar, accident
or other mishap and the driver has no preference, a wrecker company
will be called from that list on a rotating basis .
B. The list wi II be available upon request for examination to assure
Impartial and equal uti lizatlon.
C. Wrecker services appearing on the rotation list must be licensed
to assure they have agreed to provide an acceptable level of
service within an acceptable price range.
D. Rules and regulations regarding equipment, safety, conduct of
operators, response time, and acceptable charges as established
by the City Manager or hi~ designee should be requ ired to obtain
and maintain a I lcense.
E. Violations of the rules and regulations as deter~ined by Investi-
gation should result in suspension or revocation of the I lc nse
end extrection from th~ service I ist during the period of suspension
or revocation.

Recently, this office received two telephone complaints
with reference to the proposed Sidewalk Improvement Dis-
trict #76:
1. Ms. Wilma Smith , 4327 S. Acoma -Her complair,t was
that the settled portion of the curbwalk was the
result of an installation made by the Denver Water
Board for a vent line from one of their large con-
duits. This settlement is actually on two properties,
4327 s. Acoma and 4343 S. Acoma. I have called the
Denver Water Board and they are going to look at
the problem, hopefully prior to the public hearing
on 1onday night.
2. Peter A. Konrad, 3163 w. Union Ave. claims that the
set led portion of the concrete was caused by Emerson
Construction Company during the installation of the
storm sewer line along H. Union Avenue. Attached is
a letter from Thomas A. Young of the firm of Sellards
& Grigg , Inc. written subsequent to the telephone
call, and a letter from Mr. Konrad as a response to
Mr. Young's letter. I did inspect the sidewalk per-
sonally, and although most of the cracks had been
previously marked with red paint, the crack that was
displaced the mos was no marked, or a least I

Dear Mr . Waggoner:
I met with Mr . Conrad of 3163 West Union on June 9, 1976, in
regard to the two broken concrete stones.
I observ d two adjacent stones near the center of the lot with
cracks. The cracks were large single cracks running across
the approximate center of each stone. The two cracks and the
joint between the stones all showed evidence of having been
painted with red paint some time ago.
Hr. Conrad said:
1 . He has lived in the house for 3.5 years.
2. He checked the property before buying and that all the
sidewalks were in good condition when he mov d in.
3. Th contractor (storm drain g ) was responsible for break-

vertical displace ment with respect to each other because of
the work of the storm drainage contractor.
From my observations the cracks existe d b e fore Bmerson Construc-
tion Company did the work. Also, it didn't a p pear to me that
Emerson had caused any significant vertical movement in any of
the pieces of the sidewalk during their work. There are a con-
siderable number of cracked sidewalk stones in this block and
to my knowledge, all the cracks except one are painted with red
paint.

Due to our erratic business hours, it may not be possible for us to
attend the meeting scheduled for June 28, 1976 in regard to the above
reference. However, we wish to inform the entire Council of our
opposition to the proposed improvement district.
This proposal, it seems to us, is being considered without due regard
to the extreme time limitation, without regard to further financial
burdens placed upon property owners and entirely without consideration
as to the minute amount of foot traffic present.
We have been considering the replacement of a large segment of concrete,
in excess of $2,100, but feel that ve are the ones to make these deci-
sions with regard to our ability to pay and in no way appreciate the
proposed action. We feel that council members are elected to represent
our interests and should limit themselves to this area rather than think-
ing of ways to spend our money for improvements that are not within their
abilities or concern unless they are, or happen to have an interest in,
concret or concrete contracting.
To put it bluntly, we are damn sick and tired of the big brother telling
us what to eat, not to eat, smoke, drink, or when and how often.
What abou the so-called safety of the pedes rian wh re there are no
walks at all?
We also feel that we are the only concerned parties who should select a
contractor who has sa.. minuscule regard for our landscaping, on which
w have ap.n ovu 6 years and iM--.rabla hours to aaintain as an u-
le for th entire c~un1ty.
If, after r ding the foregoing, you rs of the council feel that
w ar s at agitated, you are wrong --we are aad as hell .

A RESOLUTION DECLARING THE INTENT OF THE CITY COUNCIL OF THE
CITY OF ENGLEWOOD, COLORADO, TO CREATE AN IMPROVEMENT DISTRICT
IN SAID CITY, TO BE KNOWN AS SIDEWALK IMPROVEMENT DISTRICT
NO. 76; ADOPTING DETAILS AND SPECIFICATIONS THEREFOR;
ESTABLISHING A DATE AND PLACE FOR A PUBLIC HEARING UPON
THE CREATION OF SAID DISTRICT; AND ORDERING PUBLICATION
AND MAILING OF NOTICE THEREOF TO THE OWNERS OF PROPERTY TO BE ASSESSED WITHIN THE DISTRICT.
WHEREAS, Article X, Section 107, of the Charter of
the City of Englewood, and the provisions of Chapter 1,
Title XII, 1969 Englewood Municipal Code, authorize the City
Council of the City of Englewood on its own initiative and

i nstallation of those improvements to be made in the proposed
i mprovement district.

(b) The real property to be included within the
district shall consist of realty described here-
inabove.
(c) The probable total cost of the improvements
within said district is $76,889.15 and the amount
of funds of the City which is to be devoted to said
improvements is approximately $7,422.80. The
balance of the total probable cost (being approx-
imately $69,466.35) is to be paid by special
assessments to be levied upon each parcel of the
real property hereinabove described.
(d) All assessments levied against the afore-
said parcels of real property w~ll be due and
payable, without demand, within thirty (30) days

Due to our erratic business hours, it may not be possible for us to
attend the meeting scheduled for June 28, 1976 in regard to the above
reference. However, we wish to inform the entire Council of our
opposition to the proposed improvement d istrict.
This proposal, it seems to us, is being considered without due regard
to the extreme time limitation, without regard to further financial
burdens placed upon property owners and entirely without consideration
as to the minute amount of foot traffic present.
We have been considering the replac ment of a large segment of concrete,
in excess of $2,100, but feel that we are the ones to make these deci-
sions with regard to our ability to pay and in no way appreciate the
proposed action. W feel that council members are elected to represent
our interests and should limit th ms lves to this area rather than think-
ing of ways to spend our money for improv nts that are not within their
abilities or concern unless they are, or happen to have an interest in,
concrete or concrete contracting. •
To put it bluntly, we are damn sick and tired of the big brother telling
us what to eat, not to eat, smoke, drink, or when and how often.
